On March 10, 1983, Ronald L. Dunphy, on behalf of DUNPHY INDUSTRIES, a California partnership, executed a certain document entitled "Agreement and Covenant Running with the Land" (hereinafter referred to as "COVENANT") , in favor of the CITY OF PALM SPRINGS, a municipal corporation, affecting certain real property described therein, consisting of 113 residential lots as shown on Riverside County Tract Map No. 14920. Said COVENANT is shown in the records of the City Clerk of the CITY OF PALM SPRINGS as Agreement No. 1914, and was recorded on March 18, 1983 , at Vol . 1983 , Page 51335 of the Official Records of Riverside County. 2. Said COVENANT was intended to and did provide for payment on behalf of each lot or parcel in said Tract No. 14920 of the proportionate share of the cost of construction of the Bogert Trail Bridge, which provides access to said Tract No. 14920 and to each of said lots. Said payment, in the sum of $3 , 184. 10 together with interest at the rate of 10.5% from January 4, 1983 to the date of payment, is required by said COVENANT to be made prior to issuance of building permit for each such lot in said Tract No. 14920. 3. Payment of the sum required for satisfaction of said COVENANT as to the within-described lot has been made by or on behalf of the owner or lessee of said lot. 4. The CITY OF PALM SPRINGS now desires to release the within described lot from the effect of COVENANT, and to acknowledge full satisfaction of the obligation of said COVENANT as to the real property which is the subject of this partial release. 5. It is intended that COVENANT continue in full force and effect as to all real property within said Tract No. 14920, excepting only the real property which is the subject of this Partial Release or of any similar Partial Release duly executed and recorded on behalf of the CITY OF PALM SPRINGS. DUNPHY is the sole Lessee under a long-term Indian Lease affecting that certain real property located in River- side County, California, consisting of 113 residential lots as set forth on Riverside County Tract Map No . 14920 , and is the only sig- natory necessary to encumber said leasehold interest by this Covenant Running With the Land; and B. DUNPHY intends to sublease said lots to members of the public (Sublessees) who will eventually construct residen- tial dwelling units upon said 113 lots ; and C . The CITY shall maintain the Bogert Trail bridge in good order and repair and in the event of damage to or destruction of said bridge, the CITY will comply with any legal obligation to provide or restore access to said Tract 14920 within a reasonable time after said damage or destruction. 3 . This agreement is intended to run with the land, to encumber the leasehold interest in the land, and obligate each lot to pay the sum of $3 , 184 . 10 together with interest , as aforesaid, until such sum has been paid. As each lot pays the sum of $3 , 184 . 10 and said interest , the CITY shall record or cause to be recorded a release setting forth the legal description of said lot and stat- ing that said lot is no longer encumbered by the effects of this agreement . 4 . Should any legal action be brought for the purpose of protecting or enforcing any rights under this agreement , the prevailing party shall recover , in addition to all other relief, such reasonable attorneys ' fees and Court costs as the Court may determine.
