SEWER AGREEMENT NO. 7J,THIS ,AGREEMENT made and entered into this V day of

19P), between the CITY OF PALM SPRINGS , CALIFORNIA, a municipal corporation ,
hereinafter called the CITY , and RADUL RADOVICH or DRAGICA RADOVICH , hereinafter
called the DEVELOPER.
WHEREAS, the DEVELOPER is , at the time of this agreement, the owner of LOTS
56 and 57, Assessors No. 504-223-001 and 504-223-018, delineated on the plat
"Sewer Construction Refund Agreement" attached hereto, marked Exhibit "A" , and
hereby made a part of this agreement.
WHEREAS, the CITY has established a policy for sewer refund agreements and con-
tributions for oversize sewer by City Council Resolution No. 13773 dated Apr. 15,
1984 which by reference is hereby made part of this agreement; and ---
WHEREAS , the DEVELOPER has submitted a financial statement of construction costs
for said sewers from: -
1. City of Palm Springs, dated November 5, 1979
2. Sing and Son Construction, dated May 22, 1979
3. John H. Hacker & Associates Civil Engineers , dated flay 15, 1979
4. R.B.C. Construction - Radul Radovich or Dragica Radovich, dated
November 6, 1979
copies of which are attached hereto , and made a part of this agreement; and
WHEREAS, the DEVELOPER, in accordance with the before mentioned Council
Resolution has requested that the CITY AND THE DEVELOPER enter into a Sewer
Refund Agreement to reimburse the DEVELOPER for the cost of off-side sewer which
benefits other properties ; and
WHEREAS, the CITY has determined that benefit from the construction of off-site
sewer will accrue to properties connecting to the off-site sewer; and
WHEREAS , the CITY has determined that said benefit will be in direct pro-
portion to the frontage of that portion of Parcel Nos . 56 and 57 Assessors Nos .
504-223-001 and 304-223-018
The total assessable frontage of lots which can connect to
the sanitary sewer by use of sewer laterals is 300. 00 feet;
NOW, THEREFORE, THIS AGREEMENT WITNESSTH that for and in
consideration of the mutual covenants indicated between
the CITY and the DEVELOPER, it is hereby agreed that developers ,
owners , or lessees of lots shown on Exhibit "A" abutting
said sewer shall pay to the CITY the amount shown herein, plus
sewer connection charges in effect at such time, prior to
a permit being issued for connection to said sewer. Upon receipt
of such payment CITY shall pay to DEVELOPER the amount shown
herein.

I, Radul Radovich, received Four Thousand dollars ($4,000)
from Mr. and Mrs. Blagoje Mojsilovich on September 6, 1979,
made payable jointly to Sing and Sons and R.B.C. Construction,
but as a loan to myself for a maximum period of six months,
but payable at an earlier date, if so desired by myself, and
at an interest rate of ten percent per anum. I agree to hold
Mr. and Mrs. Mojsilovich harmless from any expenses- incurred
in collecting said money if not payed within the given time
limit.
