HomeMy WebLinkAbout12/19/2001 - STAFF REPORTS (13) J DATE: December 19, 2001 TO: City Council FROM: Assistant City Manager- Special Projects DEMOLITION PROJECT-AIRPORT RECOMMENDATION: It is recommended that City Council award a demolition contract to Vision's West in the amount of$19,300 forthe demolition of two houses north of the Airport, subject to FAA approval. SUMMARY: This action would result in the demolition of the two homes north of the Airport which were previously acquired by the Airport as part of its noise compatibility/runway extension project. BACKGROUND: The Airport has acquired two homes north of the Airport: 1841 N. Farrell Drive and 1750 Sharon Road. A bid document has been circulated for the demolition of these two homes and bids were received on December 6, 2001 at 2:00 p.m. as follows: CONTRACTOR AMOUNT DBE % 1. Vision's West $19,300 18% 2. Warren Duncan Contracting $51,300 0% The low responsive bidder is Vision's West at $19,300 The low bidder,Vision's West,was accidently left off the bidders list and,therefor, did not receive Addendum #1 and, therefore, did not acknowledge its receipt. The addendum provided Disadvantaged Business commitment forms. Vision's West provided its own commitment form. To correct the City's error, the forms have been faxed to Vision's West so that they may properly fill them out. The intent of the addendum was met and, therefore, it is recommended thatthe minor irregularity be waived. The company is from Quail Valley, California, experienced in demolition work and is properly licenced. 1704 December 19, 2001 Page Two The funds for this work are available in a 90% grant from the Federal Aviation Administration, account # 415-6600-56018 and a Resolution is attached recommending approval of the contract. (b) Federal - The general prevailing rate of wages, as determined by the Secretary of Labor are included hereinafter as part of the Contract documents, provided, that if there is any difference between the State of federal wage rate for any given craft or mechanic needed to execute the work, it shall be mandatory upon the Contractor and any subcontractor to pay the higher of the two rates . All labor on the project shall be paid no less than the minimum wage rates established by the U.S . secretary of Labor. N-8 TRADE RESTRICTIONS: All solicitations, contracts and subcontracts resulting from projects funded under AIP must contain the foreign trade restriction required by 49 CFR Part 30, Denial of Public Works Contracts to Suppliers of Goods and Services of Countries that Deny Procurement Market Access to U.S . Contractors . The Aviation Safety and Capacity Expansion Act of 1990 provides that preference be given to steel and manufactured products produced in the United States when funds are expended pursuant to a grant issued under the Airport Improvement Program. N-9 EQUAL EMPLOYMENT OPPORTUNITY AND AFFIRMATIVE ACTION REQUIREMENTS: Each bidder must complete, sign and furnish, prior to award of the contract, the "Bidders Statement on Previous Contracts Subject to EEO Clause, " a "Certification of Non- segregated Facilities, " and the "Assurance of Disadvantaged Business Enterprise Participation" as contained in the Bid Proposal . These items must be submitted with his or her bid. The EEO requirements, labor provisions, and wage rates are included in the specifications and bid documents and are available for inspection at the Department of Building and Safety, City Hall, Palm Springs, California. To be eligible for award, each bidder must comply with the affirmative action requirements which are contained in the specifications . Disadvantaged Business Enterprises (DEB' s) as defined in 49 CFR Part 23 shall have the maximum opportunity to participate in the performance of contracts under this agreement . Consequently, the DBE requirements of 49 CFR Part 23 apply to this agreement. Women will be afforded equal opportunity in all areas of employment . However, the employment of women shall not diminish the standards of requirement for the employment of minorities . OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, AWARDING DEMOLITION CONTRACT CP 00-19, AIP 3- 06-0181-23, TO VISION'S WEST, SUBJECT TO FEDERAL AVIATION ADMINISTRATION APPROVAL, IN THE AMOUNT OF $19,300. WHEREAS Palm Springs International Airport has acquired homes north of the Airport and has circulated a Demolition Contract for bid and has received four(4) bids; and WHEREAS the low responsive bidder is Vision's West with a bid of$19,300; and WHEREAS the minor irregularity occurred in that Vision's West was accidently left off the bidder's list and, therefore, did not receive Addendum#1 to the bid. However, they did meet the intent of the Addendum by submitted Disadvantaged Business Goals and have since received and acknowledged the Addendum with no change in price. NOW THEREFORE BE IT RESOLVED as follows: Section 1. That the minor irregularity of not acknowledging the Addendum is hereby waived as the error was a City error and there is no change in price; and Section 21 Thatthe Demolition Contract CP 00-19,AIP 3-06-0181-23, is hereby awarded to Vision's West in the amount of$19,300 subject to FAA approval.
