PARKING STRUCTURE RELOCATION SERVICES FOR THE WEST SIDE OF
THE 200 SOUTH INDIAN CANYON DRIVE BLOCK IN DOWNTOWN
RECOMMENDATION:
That City Council award a contract to Overland Resources of Palm Desert,
California in the amount of$10,500 for professional relocation services in
regard to the anticipated construction of a parking structure along the west
side of the 200 South Indian Canyon Drive block between Arenas Road
and Baristo Road, contract to be in a form approved by the City Attorney.
SUMMARY:
Based upon a presentation on behalf of the "Downtown Parking Think
Tank" and subsequent direction from City Council, staff proposes that
business and residential relocation services related to the construction of
a proposed parking structure at the referenced location proceed at this
time in order to expedite the design and construction process.
BACKGROUND:
In order for this proposed parking structure to begin construction on or
about June 1, 2002 and be completed by the end of November, 2002, and
thus minimize construction impacts to adjacent businesses and not lose
another season before implementation of the needed parking downtown,
professional relocation technical assistance services for one business
(The Saloon) and two small related adjacent apartment units should
begin at this time. Property acquisition negotiations are in process with
private land owners at this site, and no substantial obstacles to the
assembly of the site under City ownership are anticipated at this time.
Staff recommends that the required relocation technical services be
provided by Overland Resources of Palm Desert. The reasons for
recommending this firm for this time sensitive assignment are as follows:
1) in 1998, after a competitive proposal and selection process, the firm
was selected by the City of Palm Springs to perform similar services at the
Palm Springs International Airport; 2) they were the only Coachella Valley
firm to respond to this previous selection process; and 3) they have done
an outstanding job for the City at the airport for a very similar assignment,
and are thus highly recommended by staff.

Two other Southern California relocation consulting firms (not located in
the Coachella Valley) were contacted by staff in regard to their potential
interest in this specific assignment, and they declined to respond due to
current work loads and travel distance for this small contract. Also, local
presence is highly desirable in this type of services contract, since direct
contact with businesses and residents in need of these services is very
important.
This team will continue this relocation consulting services work during the
site and building design process for the parking structure, with completion
of their work anticipated prior to start of construction at this site. The total
cost for this work is $10,500. The funding for this task will come
from the Parking Fund (132-4463-43200) and is anticipated to be
reimbursed from the eventual proceeds of a bond issue.

CONTRACT SERVICES AGREEMENT FOR
DOWNTOWN PARKING RELOCATION SERVICES
THIS CONTRACT SERVICES AGREEMENT (herein "Agreement") is made and
entered into this _ day of , 2002, by and between the CITY OF PALM SPRINGS,
a municipal corporation (herein "City") and Overland Resources. (herein "Contractor").
(The term Contractor includes professionals performing in a consulting capacity).
NOW, THEREFORE, the parties hereto agree as follows:
1.0 SERVICES OF CONTRACTOR
1.1 Scope of Services. In compliance with all of the terms and
conditions of this Agreement, the Contractor shall perform the work or services set forth
in the "Scope of Services" attached hereto as Exhibit "A" and incorporated herein by
reference. Contractor warrants that all work and services set forth in the Scope of
Services will be performed in a competent, professional and satisfactory manner.
1.2 Compliance With Law. All work and services rendered hereunder
shall be provided in accordance with all ordinances, resolutions, statutes, rules, and
regulations of the City and any Federal, State or local governmental agency of competent
jurisdiction.
1.3 Licenses, Permits, Fees and Assessments. Contractor shall obtain
at its sole cost and expense such licenses, permits and approvals as may be required by
law for the performance of the services required by this Agreement.
2.0 COMPENSATION
2.1 Contract Sum. For the services rendered pursuant to this
Agreement, Contractor shall be compensated in accordance with the "Schedule of
Compensation"attached hereto as Exhibit"B"and incorporated herein by this reference,
but not exceeding the maximum contract amount of$10,500.00 ("Contract Sum").
2.2 Method of Payment. Provided that Contractor is not in default
under the terms of this Agreement, Contractor shall be paid as outlined in Exhibit "B",
Schedule of Compensation.
3.0 COORDINATION OF WORK
3.1 Representative of Contractor. Kathy Woolley is hereby designated
as being the principal and representative of Contractor authorized to act in its behalf with
respect to the work and services specified herein and make all decisions in connection
therewith.

EXHIBIT "A"
SCOPE OF SERVICES
Proiect Understandinq: The City is planning to construct a parking facility that will displace
two(2) residential tenants and one(1) business on South Indian Canyon. The acquisition
activities will be conducted by City staff who will provide Overland's relocation staff with
contact information and appraisal details as needed for the relocation process. The
Relocation Plan services and Residential Relocation Assistance services for the
displacements will be performed contemporaneously.
Scope of Work: Relocation activities include the preparation of the Relocation Plan which
will comply with state guidelines and law, preparation and delivery of informational
materials, brochures and required notices; interviews with relocatees to ascertain
relocation requirements and benefits; research to identify suitable and sufficient relocation
sites, within the requirements of state law, and referrals to same; claims preparation;
Decent, Safe & Sanitary inspections; and advice throughout the relocation process.
Contractor shall make every reasonable effort to determine relocatees relocation needs
and find a suitable site so that relocatees will be able to timely relocate, so that the project
can proceed.
Time for Performance: Work to commence on January 15, 2002 and be completed by
May 15, 2002.

SCHEDULE OF COMPENSATION
Proiect Fees: Contractor's compensation is to be on a fixed fee basis nd will be billed monthy
based on the percentage of the work effort completed. The individual components of the
fixed fee are as follows:
Model Relocation Plan (under 15 households) $ 2,000
Residential Relocation Services (2 households @ $2,500 each) $ 5,000
Non-Residential Relocation Services (1 business @ $3,500 each) $ 3,500

WHEREAS the "Downtown Parking Think Tank" has issued its parking
recommendations, including a proposed parking structure located along the west
side of Indian Canyon Drive between Arenas Road on the north and Baristo road on
the south; and
WHEREAS City Council requires business and residential relocation services in
order to facilitate the timely design and construction of this project;
NOW THEREFORE BE IT RESOLVED that City Council approves a contract with
Overland Resources of Palm Desert, California in the amount of $10,500 for parking
structure site business and residential relocation consulting services for the west side
of the 200 South Indian Canyon Drive block in downtown Palm Springs.
