HomeMy WebLinkAbout1/16/2002 - STAFF REPORTS (7) DATE: January 16, 2002 TO: City Council FROM: Director of Public Works/City Engineer SAN JOAQUIN DRIVE RIGHT-OF-WAY VACATION RECOMMENDATION: It is recommended that the City Council adopt a resolution of intention to vacate a portion of the right-of-way dedicated for the public street named San Joaquin Drive in Section 18, Township 4 South, Range 5 East; File R-01-035. SUMMARY: The Streets & Highways Code of the State of California dictates the process that a City must follow to vacate public rights-of-way. This step initiates the process the Council must follow in considering the proposed public right-of-way vacation. BACKGROUND: The City has been petitioned by the owner of land adjacent to San Joaquin Drive to vacate an excess portion of right-of-way adjacent to his property. The centerline of San Joaquin Drive is the mutual boundary between the cities of Palm Springs and Cathedral City, with the westerly 40 feetof the street reserved as a public right-of- way from deeds recorded April 29, 1977, as Document No. 74689, and recorded August 23, 1979, as Document No.'s 177941 and 177942. The current property owner has received City Council approval of the development of the property, through Tentative Parcel Map 29631, approved October 18, 2000. That approval required that the property owner apply forthe vacation of the west 15 feet of the 40 feet wide right-of-way. The purpose in this action is to reserve sufficient right-of-way width to construct full street improvements for San Joaquin Drive, but with access from Tentative Parcel Map 29631 being taken from within the map and not from San Joaquin Drive. As such, the proposed right-of-way vacation was determined to be consistent with the General Plan through consideration of Tentative Parcel Map 29631 by the Planning Commission at its September 13, 2000, meeting. If the City Council desires to consider the proposed right-of-way vacation, adoption of the attached Resolution of Intention will schedule a Public Hearing for February 20, 2002. DAVID J. That the City Council does hereby signify and declare its intention to vacate that portion of the public street named San Joaquin Drive, as described in Exhibit "A" and shown on Exhibit "B" attached hereto and made a part hereof. Section 2. That the City Engineer is to hereby conspicuously post notices of this street vacation along the line of that portion of San Joaquin Drive proposed to be vacated at not more than 300 foot intervals, but not less than 3 in all on said portion of street. Such notices shall state the passage of this Resolution of Intention, and the time and place of hearing all persons interested in, or objecting to, this proposed vacation. Section 3. That the 2011 day of February, 2002, at the hour of 7:00 P.M., in City Council Chambers located at 3200 E. Tahquitz Canyon Way, Palm Springs, California, is hereby fixed as the time and place of hearing any and all persons interested in or objecting to the proposed street vacation, said time being not less than 15 days from the date of adoption of this Resolution.
