MESA DRIVE AND CAMINO CARMELITA RIGHT-OF-WAY VACATION
RECOMMENDATION:
It is recommended that the City Council adopt a resolution of intention to vacate a
portion of the right-of-way dedicated for the public streets named Mesa Drive and
Camino Carmelita in Section 27, Township 4 South, Range 4 East; File R-01-019.
SUMMARY:
The Streets & Highways Code of the State of California dictates the process that a
City must follow to vacate public rights-of-way. This step initiates the process the
Council must follow in considering the proposed public right-of-way vacation.
BACKGROUND:
The City has been petitioned by the owner of land adjacent to Mesa Drive
and Camino Carmelita to vacate excess portions of right-of-way adjacent to his
property. These streets were originally dedicated to(but not accepted by) Riverside
County as Lots E and F of Palm Canyon Mesa Tract, Unit No. 2, recorded in Map
Book 16, Pages 41 to 42. Additionally, a portion of Mesa Drive was dedicated to and
accepted by the City of Palm Springs as Lot E of Lilliana Gardens, recorded in Map
Book 23, Page 8, recorded August 6, 1948. Subsequently, the City of Palm Springs
accepted the rights-of-way dedications of Palm Canyon Mesa Tract, Unit No. 2,
through Resolution 9133, adopted January 8, 1968,and recorded January 11, 1968.
Mesa Drive and Camino Carmelita are designated as local streets on the City's
Circulation Element of the General Plan. As such,these streets require a total right-
of-way width of 50 feet. Currently, Mesa Drive has a total width of 60 feet, while
Camino Carmelita has a total width of 63.1 feet. Therefore, there exists excess
right-of-way not necessary for public use adjacent to the petitioner's property.
The proposed right-of-way vacation was determined to be consistent with the
General Plan and was approved by the Planning Commission at its November 14,
2001, meeting. If the City Council desires to consider the proposed right-of-way
vacation, adoption of the attached Resolution of Intention will schedule a Public
Hearing for February 20, 2002.

NOW THEREFORE BE IT RESOLVED by the City Council of the City of Palm Springs, as

vacate that portion of the public streets named Mesa Drive and
Camino Carmelita, as described in Exhibit"A" and shown on Exhibit
"B" attached hereto and made a part hereof.
Section 2. That the City Engineer is to hereby conspicuously post notices of this
street vacation along the line of that portion of Mesa Drive and
Camino Carmelita proposed to be vacated at not more than 300 foot
intervals, but not less than 3 in all on said portions of streets. Such
notices shall state the passage of this Resolution of Intention, and
the time and place of hearing all persons interested in, or objecting
to, this proposed vacation.
Section 3 That the 20" day of February, 2002, at the hour of 7:00 P.M., in City
Council Chambers located at 3200 E. Tahquitz Canyon Way, Palm
Springs, California, is hereby fixed as the time and place of hearing
any and all persons interested in or objecting to the proposed street
vacation, said time being not less than 15 days from the date of
adoption of this Resolution.
