employed in the County of Riverside, over the age of eighteen years, and not a party to the within
action or proceeding; that my business address is 3200 E. Tahquitz Canyon Drive, Palm Springs,
California; that on the 21th$' day of November, 2001, 1 served the within (NOTICE OF PUBLIC
HEARING) on PLANNING COMMISSION CASE NO. 5.0891 and 5.0893 to consider application
for a General plan Amendment so as to redesignate property from M-15: Medium Density
Residential to Resort Commercial, and a Zoning Map Amendment to rezone property from
WR2:Watercourse and Limited Multi-Family Residential Zone to WC1:Watercourse and Retail
Business Zone. The property is located at 4601 Matthew Drive, Section 30, on persons
contained in Exhibit"A"attached hereto in said action or proceeding by depositing a true copythereof,
enclosed in a sealed envelope with postage thereon fully prepaid, in a mailbox, sub-post office,
substation or mail chute, or other like facility, regularly maintained by the Government of the United
States in the City of Palm Springs, California, addressed to the list of persons or firms indicated on
the report received and certified from the City's Planning Technician dated September 26, 2001 and
attached hereto as Exhibit"A".
Notices (10) (along with stamped envelopes) were mailed to the Bureau of Indian Affairs, Palm
Springs Field Office, P.O. Box 2245, Palm Springs, CA 92263, which they will in turn send

NOTICE IS HEREBY GIVEN that the Planning Commission ofthe City ofPalm Springs,California,will
hold a public hearing at its meeting ofDecember 12,200 1. The Planning Commission meeting begins at
1:30 p.m,with the public hearing beginning at 2:00 p.m.,in the Council Chambers at City Hall,3200 E.
Taliquitz Canyon Way, Palm Springs.
The purpose ofthe hearing is to consider arequest for a General Plan Amendment so as to redesignate
property from M-15:Mediurn Density Residential to Resort Commercial,and a request for a Zonirtg Map
Amendment to rezone property fxom WR2:Watercourse and Limited Multiple-Family Residential Zone
to WC I: Watercourse and Retail Business Zone. The property is located at 4601 Matthew Drive
In accordance with Section 15063 of the California Environmental Quality Act,an initial study was
prepared for this project and a Negative Declaration has been prepared.
If any individual or group challenges the action in court,issues raised maybe limited to only those issues
raised at the public hearing described in this notice or in written correspondence at or prior to the Planting
Commission heating. An opportunity will be given at said hearing for all interested persons to be heard.

THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA DOES ORDAIN AS
FOLLOWS:
SECTION 1.Pursuant to Section 9407.00.13 of the Palm Springs Zoning Ordinance, the official
zoning map of the City of Palm Springs, referred to herein, is hereby amended as follows:
Change of Zone from W-R-2 to W-C-1
The parcel of property legally shown on Exhibit A is approved for a change of zone from W-R-2 to
W-C-1 specifically on Matthew Drive, east of Cherokee Way on file in the Planning & Zoning
Department, Case 5.0891.
SECTION 2.EFFECTIVE DATE. This Ordinance shall be in full force and effectthirty(30)days after
passage.
