HomeMy WebLinkAbout2/20/2002 - STAFF REPORTS (15) DATE: FEBRUARY 20, 2002 TO: CITY COUNCIL FROM: DIRECTOR OF PLANNING AND BUILDING REQUEST BY WATSON COMMERCIAL DEVELOPMENT SERVICES FOR THE ADOPTION OF A RESOLUTION OF CONVENIENCE AND NECESSITY IN ORDER TO SELL ALCOHOL FOR OFF-SITE CONSUMPTION AT A NEW SAV-ON DRUGSTORE TO BE LOCATED AT THE NORTHWEST CORNER OF SUNRISE WAY AND RAMON ROAD, C-1 ZONE, SECTION 14. RECOMMENDATION: That the City Council consider the adoption of a Resolution of Convenience and Necessity in order to sell alcohol for off-site consumption at a proposed drugstore to be located at the northwest corner of Sunrise Way and Ramon Road. The applicant is Albertsons, Inc.; the president is Dave Simonson. SUMMARY The applicant has proposed to operate a large drug store at this recently approved shopping center. The applicant desires to sell alcoholic beverages as a part of this business. The site is in a census tract with an over-concentration of alcoholic beverage licenses, and therefore the state Department of Alcoholic Beverage Control will not issue a license unless the City Council provides a letter indicating that the premises will provide for the public convenience and necessity. BACKGROUND The subject property will be within a large approved shopping center. Staff anticipated that other tenants, including Ralphs, will make similar requests in the future. There is an apartment building to the north of the shopping center and a vacant lot to the west. There are commercial centers to the south and east, across Ramon Road and Sunrise Way, respectively. In accordance with Section 23958.4 of the Business and Professions Code which took effect on January 1, 1995, the state Department of Alcoholic Beverage Control will not issue a license for the sale of beer and wine at this location if the City Council does not issue a letter indicating that issuing such a license for the premises will provide for the public convenience and necessity. 13A A finding of"Public Convenience and Necessity" means that the applicant premises will provide for the convenient patronage of the public whereby the convenience does not already exist in the immediate area; necessity implies that the premises is needed by the community. WHEREAS, Albertsons, Inc. ("applicant') has requested the adoption of a Resolution of Convenience and Necessity in order to sell alcohol at an new retail store at the northwest corner of Sunrise Way and Ramon Road, C-1 Zone, Section 14; and WHEREAS, the City Council is being asked to adopt a Resolution of Convenience and Necessity pursuant to the requirements of the Alcoholic Beverage Control Board; and WHEREAS, the City Council has carefully reviewed and considered all of the evidence presented in connection with the project, including but not limited to the staff report; and NOW,THEREFORE, BE IT RESOLVED that, based upon the foregoing, the City Council hereby adopts a Resolution of Convenience and Necessity.
