INDIAN CANYON DRIVE TRAFFIC SIGNAL INTERCONNECT
RECOMMENDATION:
It is recommended that the City Council terminate Agreement No.4221 with Rancho
California Consultants, for Indian Canyon Drive Traffic Signal Interconnect, City
Project 95-06.
SUMMARY:
City Project 95-06 facilitated the construction of new and modification of existing
traffic signals along Indian Canyon Drive to allow for traffic signal interconnect
improvements made possible through a State Transportation Program federal grant
awarded to the City. Agreement No. 4221 with Rancho California Consultants
provided the City with construction management services for this project. During
construction of the project, Rancho California Consultants grossly underperformed
in conformance with the requirements of the Agreement, is unresponsive, and has
failed to complete the required construction management services. It is necessary
to terminate the Agreement in light of the Consultant's failure to perform as required.
BACKGROUND:
On May 17, 2000, Council approved Agreement No. 4221 with Rancho California
Consultants to provide staff with construction management services related to the
Indian Canyon Drive Traffic Signal Interconnect, City Project 95-06. This project is
federally funded, and has been combined with Coachella Valley Association of
Government's (CVAG)'s Valley-wide traffic signal interconnect project. CVAG had
also entered into contract with Rancho California Consultants to provide them with
required construction management services for their portion of the project.
At this time, construction related to both the City's and CVAG's projects is nearly
complete. During construction, Rancho California Consultants was expected to
perform services related to coordinating work performed by the contractor,materials
and construction inspections and miscellaneous project administration, as well as
prepare and file various federal forms required as part of the federally funded
project. This coordination was to come through the City of Palm Springs Director of
Public Works/City Engineer, who is acting as the Resident Engineer for both the
City's and CVAG's project.
Throughout this project, City and CVAG staff have had little or no performance by
Rancho California Consultants,despite repeated efforts to obtain the information and
services from them required to bring this project to completion. This failure to
perform gave the CVAG Executive Committee grounds to terminate its contract with
Rancho California Consultants at its January 28, 2002, meeting.

Staff recommends that Council follow CVAG's lead, and terminate its contract with
Rancho California Consultants in accordance with Section 5.2 of Agreement No.
4221, clearing the way for a new consultant to be hired by both CVAG and the City
to provide the construction management services required to complete this project.
