Opening Statement by Dolliah
"Where is the justice in Palm Springs, California?" This drama
started in October of 2000. While expressing my displeasure and in-
justice of a few situations here in the city, I called attention to them
on a small audio system and with signs to explain. further.
Unfortunately every weekend I was confronted with 3 to 7 police
cars, police bicyclists and plain clothes officers. I was told I don't
have the right to stand on Indian Canyon and Tahquitz to voice my
opinion, I have to keep moving! In November 2001 on the 4th Gay
Pride weekend, I made a wedding dress that I intended to wear cele-
brating MY PRIDE. The crowd loved my presentation and I felt
wonderfirl and all of the work I put in my costume seemed worth it
all. Until the Palm Springs Police Officer on a motorcycle STOPPED
ME. He told me I don't have a right to walk down. Palm Canyon
Blvd., and if I don't get off the street he will get 2 other officers and
they will escort me off the street. THAT'S HOW IT STARTED!
My wedding dress wound up in the mud in the gutter and the plot
thickens...

I am expressing my appreciation for the letter I received .from your office on 1-18-02.
You sent me a claim form and I need to give you a breakdown of what I am asking
for:

Each trip is 3 hours which is 1 1/2 hours each way. The rates for my services are
$12.00 to $20.00 per hour and up.

Each trip after February 6, 2002 will be an additional $36.00 each week I visit until I
receive the word the bill has been approved or until a judge makes a ruling on this case hi
Small Claims Court, and all of the money I spend in preparation of this case will be an addi-
tional cost to the City of Palm Springs City Council.
Please allow me to give you an update to my situation:
1. I am an entertainer and a fashion designer.
2. 1 made a wedding dress that I wanted to wear on Sunday November 4, 2001 for Gay
Pride Weekend.
3. I was walking down Palm Canyon with the audience pleased at my appearance. It was a
major presentation.
4. UNTIL a Palm Springs Police Officer on a motorcycle stopped me. The officer said: 1f
you don't have a parade permit you can't walk down Palm Canyon.
My reply: Oh, no, no, I'm not in the parade, I'm just walking down the street before
the parade starts.
Officer said: You can't walk down Palm Canyon.
I said: You mean I can't walls down Palm Canyon Blvd.
Officer said: NO! And if you don't get off the street I will get 2 other officers and we
will escort you off the street.
NOTE: During this dialogue the crowd was screaming and booing because I was be-
ing harassed by the Police. I was the ONLY person stopped by the Police and a lot of peo-
ple were walking back and forth up and down Palm Canyon.
The officer said: Do you need some help
i said: NO. I've got it.
NOTE: 1 folded up my dress and my train, picked it up and ran down a block until I
found a fire hydrant in front of the California Pizza Kitchen. As I sat there, because of the
length of my dress and train it laid in the gutter in mud and oil and dirt.
I informed the City CounciI on Wednesday November 7, 2001 of the situation.
1 got NO response!

I got NO response!
The Council cancelled a couple of meetings without my knowledge. But I still got
dressed and made the journey, unfortunately my time was wasted.
I have gotten to the point of running out of patience.
On Wednesday January 16, 2002 the City Council changed the meeting time from 7
pm to 6 pm.
I was just livid! I had to sit (hrough the meeting before I could speak daring the last
Public Comments. Now instead of 3 minutes, I only got 2 minutes!
On Wednesday January 16, 2002 1 created a sign which I used during my 2 minutes
to inform the Mayor and the members of the City Council because they have been reluctant
to resolve this situation early. I am adding my travel time and money I spend to acquire evi-
dence pertaining to my case.
Gentlemen, this matter could have been resolved months ago but unfortunately it has
gotten worse.
I appreciate your patience and your time to address this situation.

P.S. My next objective is to address the Palm Springs Police Department.
I was a victim of a hate crime on several situations but the incident I am referring to
will be of November 11, 2001, Veterans Day.
I was invited by Mr. Randy Schecker, the President of the Gay Veteran's Associa-
tion, to march with this organization in the Veteran's bay Parade in Palm Springs, Califor-
nia. Just before the parade started some of the men were uncomfortable marching with a
Drag Queen. I explained to them I've got a right to march.
1 gave 6 years of my life to the United States Marine Corps. Some members threatened to lay
down their flags and refused to starch. I was asked not to march with the Gay Veteran's As-
sociation! So 1 walked the entire parade route alone, with Rrt" ide.
After the parade I was invited by a gentleman to accompany him for a drink. He rec-
ommended the Tool Shed. I was fine about that. While we were there, Randy and other
members of the Gay Veteran's Association were there drinking also. Randy got up from the
bar and walked over to me, fussing and complaining because of what had happened earlier
that day.
Randy told me: "I busted my ass for 6 years to get this organization off the ground."
I said: "That's good, but your men need a little more education and a lot more toler-
ance. They want to be accepted for who they are and their li festyle, then they better learn
how to accept someone else 1'0r their lifestyle."
Then Randy fussed at me and bit me in my chest and irmuediately left the bar. I told
Tony (the bartender) to call the police. That's a hate crime.
The police never arrived! I went to the police station to file a complaint. After a long
period of time the case was refused and dropped.
NOTE: I'm not going to drop it because if somebody hit your momma in the chest
you would consider it a hate crime also.

Dear Dolliah:
It is my understanding that on January 9, 2002 during public comments, you asked how a
claim could be filed for the cleaning of your three-piece wedding dress. The City
Manager forwarded to my attention a copy of the cleaning bill for$150.00 from Valet
Dry Cleaning and a picture of you standing on the curb.
Enclosed is a two-sided claim form that you need to complete and forward to the City
Clerk's office. Once you have submitted the claim to the City Clerk, our office will
review the details and will get back to you within several weeks.

Dear Council Members,
Two weeks ago I appeared before you and made what I consider serious allegations
regarding specific actions taken by the building department. At that time I also
provided you with documentation supporting those allegations. To date, I have
received no response from anyone in City Government—no letter, no e-mail, no phone
call, nothing!
In addition to being a marathon meeting, the last City Council meeting included a
seemingly endless discussion regarding moral and ethical responsibility. In spite of
pontification ad naseum on the subject, I do not see it being uniformly practiced by
members of the City Council or the Departments for which they are responsible.
I would like to know where I have to go to buy tickets in order to get some of this
moral and ethical treatment. I would also like to know how much the tickets cost.
We have been in our home for almost a year, and it has been over 14 months since we
complained to the building department regarding code violations. We still, however,
have inadequate attic ventilation, missing insulation in exterior walls, no
weather-stripping on attic access panels (all of which are violations of national and/or
state building codes) and we can still see the magnificent Palm Springs sunrises through
our front door. Unfortunately, those sunrises are visible through cracks in the door with
the door still closed. When the builder was confronted with these issues, his response
was: "What do you expect for a half-million dollars?"
With that kind of response from the builder, there is very little question in my mind as
to where Bergheer California, Inc. stands regarding morals and ethics. What I do not
understand is where the building department stands. Why does it not enforce the law
and why does it continue to promote Bergheer?
Let me give you an example. In presenting Bergheer's latest project to the planning
commission, Doug ) vans waxed eloquent about the quality of the `hand-troweled'
stucco finish to be used on the proposed project. This is the same finish which was

I used on 34 of the 35 homes in The Colony of E1 Mirador. I believe, however, that his
comments should have been preceeded by the phrase: "The following is a paid political
announcement."
I will assume that the `paid' part does not apply, but in my opinion the `political' part
is right on target. His comments are certainly NOT based on fact. The .facts are:
• The stucco was not applied according to what I understand are generally accepted
industry standards, i.e. The scratch coat and the brown coat were not properly cured
before the color coat was applied,
• In many areas it appears that the required 7/8 inch minimum thickness was not
met.
• A logical result: Many homes have serious cracks in the exterior finish.
• One homeowner told me that he is going to have his entire home re-stuccoed
because the stucco job is so bad.
I am flabbergasted that Mr. Evans would take what is one of the biggest complaints by
the homeowners of The Colony of El Mirador and tout it as a quality advantage in
promoting Bergheer California, Inc. I simply cannot understand his apparent
infatuation with the Bergheer organization.
Again, I ask: What is going on?
