HomeMy WebLinkAbout03091 - SUNLINE AIRPORT GROUND ACCESS TAXICAB RULES MO4987 Sunline - Airport Ground Access - Rules & Regulations AGREEMENT #3091 M04987, 4-1-92 AGREEMENT THIS AGREEMENT is made and entered into by and between the City of Palm Springs ("City") , a municipal corporation and SunLine Transit Agency ("SunLine") , a California Joint Powers Agency, this J C� day of �'-�---� 1992 , and is made with reference to the t� following facts: R E C I T A L S City, pursuant to its police power, has enacted an ordinance regulating ground transportation services including taxicab transportation services at the Palm Springs Regional Airport. SunLine has been authorized by joint powers agreement to regulate taxicab transportation services throughout the Coachella Valley in all areas except within the boundaries of the Palm Springs Regional Airport. SunLine has adopted an ordinance regulating taxicab transportation services in the Coachella Valley. The parties wish to grant SunLine the authority to enforce regulations adopted by City as they concern taxicab transportation services at the Palm Springs Regional Airport and to provide that such enforcement be pursued through the administrative hearing procedures contained in SunLine' s taxicab ordinance and regulations. The parties wish to share in any monetary penalties collected as a result of SunLine' s enforcement of taxicab regulations as they pertain to the Palm Springs :Regional Airport. 1 NOW, THEREFORE, in consideration of the mutual promises and covenants contained herein, the parties hereto agree as follows: 1. City will amend its regulations as they pertain to taxicab transportation services within the boundaries of the Palm Springs Regional Airport ("Airport Regulations") , from time to time as deemed appropriate by the City. 2 . SunLine will incorporate the Airport Regulations into SunLine ordinance 91-1 as amended and will, upon such incorporation, have joint authority with City to enforce the Airport Regulations as they pertain to the taxicab transportation services. 3 . SunLine, at the city' s request, will pursue enforcement of the Airport Regulations through the administrative hearing procedures contained in SunLine' s taxicab ordinance and regulations. In providing such enforcement, SunLine shall have the authority to assess monetary penalties not to exceed the limitations prescribed by the Palm Springs Municipal Code for violations of the Airport Regulations. 4 . Monetary penalties collected by SunLine for violations of the Airport Regulations shall be shared between the City and SunLine sixty percent (60%) to the City and forty percent (400) to SunLine. SunLine will pay the City' s share of collected monetary penalties to the City on a quarterly basis within fifteen (15) days of the end of each quarter. 5. Either party may terminate this agreement with or without cause upon thirty (30) days written notice to the other 6112\03PSAIR.AG -2- 0 party.
