Set forth service to be rendered, amount to be paid, manner of payment, time for performance or completion, determination of satisfactory performance and cause for termination, other terms and conditions, and attach plans, specifications, and addenda, if any.) WITNESSETH WHEREAS, CONTRACTOR has a need for gunshot residue analysis, AND; WHEREAS, the COUNTY has the necessary facilities, personnel, and tools to perform these services for the CONTRACTOR through the San Bernardino County Sheriff's Department (hereinafter referred to as SHERIFF); NOW, THEREFORE, in consideration of mutual covenants and conditions, the parties hereto agree to the following: I. RESPONSIBILITIES AND DUTIES OF THE CONTRACTOR 1. CONTRACTOR shall collect the evidence to be analyzed in accordance with the standard policies and procedures; of the SHERIFF. 2. CONTRACTOR shall provide the evidence to the SHERIFF only in gun shot residue kits approved by SHERIFF. 3. Evidence collection kits shall lie returned to CONTRACTOR after the completion of analysis by SHERIFF, and it shall be the sole responsibility of CONTRACTOR to maintain the evidence kits in accordance with standard evidence holding procedures. 02-12311 000 aov 111e1 Page 1 of 3 II. RESPONSIBILITIES AND DUTIES OF THE COUNTY 4. COUNTY shall perform an atomic absorption analysis of the evidence provided by CONTRACTOR, to include an analysis for the presence of antimony and/or barium. 5. COUNTY shall provide a written report to CONTRACTOR detailing the findings of the Analyst performing the residue analysis. 6. COUNTY shall provide personnel for required court appearances related the the analysis performed by SHERIFF. III. COMPENSATION 7. In consideration for the services performed hereunder by SHERIFF, CONTRACTOR agrees to pay the sum of $150 for each gun shot residue analysis. In the event that a court appearance is necessary by SHERIFF personnel, CONTRACTOR shall pay the sum of $80.00 per hour from the time the individual leaves the San Bernardino County Scientific Investigations Division until their return to same location. 8. Contractor shall be billed on a quarterly basis for all services performed during each quarter. IV. TERM AND TERMINATION 9. The term of this contract shall be for a period of time commencing upon its execution by the San Bernardino County Board of Supervisors, and terminating only as hereinafter provided. This contract may be terminated at any time, with or without cause, by CONTRACTOR or by COUNTY upon written notice given to the other party at least 30 days prior to the date specified for such termination. In the event of such termination, each party shall fully pay and discharge all obligations in favor of the other accruing prior to the date of such termination, and each party shall be released from all obligations or performance which would otherwise accrue subsequent to the date of termination. Neither party shall incur any liability to the other by reason of termination. 10. The SHERIFF of San Bernardino shall have the authority to exercise the COUNTY'S rights under this contract, including the right to give notice of termination at his sole discretion. V. INDEMNIFICATION 11. The CONTRACTOR agrees to indemnify, defend, and hold harmless the COUNTY and its authorized agents, officers, volunteers, and employees against any and all claims or actions arising from CONTRACTOR'S acts, errors, or omissions and for any costs or expenses incurred by the COUNTY on account of any claim therefor. 12. The COUNTY agrees to indemnify and hold harmless the CONTRACTOR and its authorized agents, officers, volunteers, and employees against any and all claims or actions arising from COUNTY'S negligent acts or omissions on account of any claim therefor. WILLIAMS, SHERIFF SUBJECT: CONTRACT WITH THE CITY OF PALM SPRINGS FOR THE SHERIFF'S DEPARTMENT To PROVIDE GUNSHOT RESIDUE ANALYSIS SERVICES RECOMMENDATION: Approve contract with the City of Palm Springs for the Sheriff's Department to provide gunshot residue analysis to the Palm Springs Police Department. REASON FOR RECOMMENDATION: This contract provides for the Sheriff's Department Scientific Investigations Division to perform analysis of gunshot residue kits which are collected from criminal suspects. The analysis can provide crucial evidence in the determination of whether or not a specific suspect has fired a weapon. In previous years most local law enforcement agencies have relied on the State of California for these services. Due to budget constraints placed on the State, they will no longer be providing this service. Additionally, the smaller size of most local law enforcement agencies preclude them from establishing laboratories for the analysis of various crime related items. This contract will help promote regional law enforcement goals, through a shared use of resources. REVIEW BY OTHER DEPARTMENTS: This contract has been reviewed and approved as to form by County Risk Management and Deputy County Counsel Ronald D. Reitz. FINANCIAL IMPACT: Contract revenues will fully offset the cost of providing this service.
