LAND AND WATER CONSERVATION FUND PROGRAM
RECOMMENDATION:
That City Council adopt a resolution thatwill allow staff to submit an application to the State
of California, Department of Parks and Recreation, Office of Grant Services for funds
through the Land and Water Conservation Fund Program for the design and construction
of the skate park at Sunrise Piaza in the amount of$150,000.
SUMMARY:
Staff asks that City Council adopt a resolution that allows them to submit an application for
the design and construction of the skate park through the Land and Water Conservation
Fund Program in the amount of$160,000 as recommended by the Parks and Recreation
Commission.
BACKGROUND:
The Land and Water Conservation Fund Program provides funds to federal agencies and
the 50 states and six territories. The money allocated to the states may be used for
statewide planning and acquiring and developing outdoor recreation areas and facilities.
The program,which is administered nationally the by National Park Service(NPS), became
effective in January 1965 and was initially authorized for a 25-year period but has been
extended for another 25 year's to January 2015. Under the provisions of the California
Outdoor Recreation Resources Plan Act of 1967, the expenditure of funds allocated to
California is administered by the State Liaison Office(SLO),who is the Director of the State
Department of Parks and Recreation.
Funds for the program are derived from federal recreation fees, sale of federal surplus real
property,the federal motorboat fuels tax, and the Outer Continental Shelf mineral receipts.
If approved,the City will apply for a$150,000 grant through this program for the design and
construction of the skate park.This grant requires a dollar-for-dollar match,which the City
has allocated through Measure"Y."

RESOLUTION NO.
OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS,
CALIFORNIA, ALLOWING STAFF TO SUBMIT AN APPLICATION TO
THE LAND AND WATER CONSERVATION FUND PROGRAM FOR THE
DESIGN AND CONSTRUCTION OF THE SKATE PARK AT SUNRISE
PLAZA IN THE AMOUNT OF$150,000.
WHEREAS the Congress, under Public Law 88-578, has authorized the establishment of a Federal
Land and Water Conservation Fund Grant-In-Aid Program, providing matching funds to the State of
California and its political subdivisions for acquiring lands and developing facilities for public outdoor
recreation purposes; and
WHEREAS the State Department of Parks and Recreation is responsible for administration of the
program in the state, setting up necessary rules and procedures governing application by local
agencies under the program; and
WHEREAS said adopted procedures established by the State Department of Parks and Recreation
require the City to certify by resolution the approval of the application and the availability of local
matching funds prior to submission of said application to the state; and
WHEREAS the proposed skate park project is consistent with the Statewide Comprehensive
Recreation Resources Plan: California Outdoor Recreation Plan - 1994 and
WHEREAS the project must be compatible with the land use plans of those jurisdictions immediately
surrounding the project; and
WHEREAS City Council finds that the proposed skate park is located within an existing park facility
that is consistent with the General Plan,zoning regulations, affects a limited portion of the park(less
than five acres), has no habitat value, and will not cause any significant environmental impacts; and
WHEREAS City Council finds that the project is Categorically Exempt from the California
Environmental Quality Act.
NOW THEREFORE BE IT RESOLVED by the City Council of the City of Palm Springs:
SECTION 1. That approval is hereby given to file an application for Land and Water Conservation
Fund assistance; and
SECTION 2. That the City hereby certifies that it has matching funds from Measure"Y" and can
finance 100 percent of the project, half of which will be reimbursed; and
SECTION 3. That the City hereby certifies that the project is compatible with the land use plans
of those jurisdictions immediately surrounding the project; and
SECTION 4. That the City Manager is hereby appointed as agent of the City to conduct all
negotiations with the State Department of Parks and Recreation.
