RECOMMENDATION: That the City Council approve Tentative Tract Map 30313 for the subdivision of 2 acres into 24 condominium units and approve the associated Architectural Approval application, located at 705 East Arenas Road. The applicant is Palm Springs Modern Homes, L.L.C.. SUMMARY: The applicant is seeking a Tentative Tract Map to subdivide 2 acres of land into 24 condominium units. The proposed project is very similarto that approved in 2001 forthe lot directly to the west, where 24 condominium units are currently under construction. The related architectural approval application, Case 3.2163, was approved by the Planning Commission at its February 27, 2002 meeting.At that meeting, the Planning Commission, by a vote of 5-0, also recommended approval of the tentative tract map BACKGROUND: Palm Springs Modern Homes, LLC is proposing the subdivision of an existing two-acre lot into 24 condominium properties. The proposed site, located at 705 E. Arenas Road, is located near the southeast corner of Arenas Road and Calle El Segundo. The site itself is approximately 165 feet wide and 328 feet long, with no significant slope in any direction. In conjunction with the Tentative Tract Map application, the applicant is proposing the construction of a 24 unit gated condominium complex. These units, ranging in size from 1,556 squarefeetto 1,690 squarefeet,are arranged intothree buildings ofeightunits each. The units themselves are designed as two-story townhouses with individual exterior entries, each consisting of two bedrooms. Each building, designed in a U shape, surrounds the parking area for the residents of that building, creating a parking "court". These areas consistof 14 covered parking spaces each,fora total of 42 spaces designated forresidents of the complex. In addition to these spaces, there are four guest parking spaces located within the gates of the property, and two guest parking spaces outside the gates for a total of 48 spaces. The required number of parking spaces for this project is 42. The proposed structures and parking comply with all applicable zoning codes. ADJACENT ZONING / LAND USE: North: R-4-VP (Vehicle Parking, Large-Scale Hotel and Multiple Family and Limited Retail Commercial Zone) Current Land Use: Parking Structure �1017 South: R-4 (Hotel and Multiple Family Zone) Current Land Use: Apartment Complex East: R-4 (Hotel and Multiple Family Zone) Current Land Use: Vacant West: R-4 (Hotel and Multiple Family Zone) Current Land Use: Condominium Complex Under Construction ANALYSIS: The subject property is zoned R-4,which has a density ratio of one dwelling unit per 1,500 square feet of lot area. By right of zone, the applicant could propose up to 58 units on this site. Instead, they are proposing less than half of that amount in exchange for a larger amount of usable open space.The project complies with all requirements of the R-4 zone. The proposed project is substantially consistentwith the draft Section 14 Master Plan.The landscaping at the front of the project, consisting primarily of California fan palms (Washingtonia filiifera) and citrus species, is consistent with the plan's planting matrix for Arenas Road. The proposed streetscape includes an eight-foot sidewalk behind the curb. The draft Section 14 Master Plan, however, calls for a four-foot wide sidewalk on Arenas Road, with a four-foot landscaped parkway between the sidewalk and curb.As a four-foot wide sidewalk does not meetthe city's design standards,northeAmericans with Disabilities Act access requirements, staff is not recommending alterations to the proposed sidewalk design. ENVIRONMENTAL ANALYSIS AND NOTIFICATION: Pursuant to CEQA, an initial study has been prepared and it has been determined that the project will not have a significant impact on the environment, if mitigation measures are incorporated. The only mitigation measure required is the continuous on-site presence of a certified archaeologist during the entire grading and construction process. The subject site is located on the valley floor and is underlain by deposits of alluvium. Because the site is generally level, there are no unique geological features. There are no known geological hazards present on the site other than groundshaking potential associated with earthquakes. There are no known unstable earth conditions associated with the project site based on the review of the Seismic Safety Element of the City of Palm Springs General Plan. Therefore,there will be no geologic impacts on the project as a result of the project, nor will the project create geologic impacts. Based upon a review of the Federal Emergency Management Agency, Preliminary Flood Insurance Rates Maps,the hydrology study for this project, and the knowledge of the Department of Planning & Building and the City Engineer,there is no flood hazard on-site during the 100 year flood event. The development of the 24 proposed units will result in some additional storm water run- off, but this should be very minimal. On-site retention basins are proposed which will be designed to retain storm water on-site. There are no additional issues relating to drainage and groundwater concerns. Casitas Arenas Condominiums are located directly downwind of the proposed project site. This exposes the residents to dust during construction. To minimize construction activity emissions,the project applicant will be required to comply with the City's Fugitive Dust and Erosion Control Ordinance. Compliance with this Ordinance will make the impacts less than significant. 5.c,d)NO IMPACT. With the adoption of the General Plan,the City Council adopted a Statement of Overriding Considerations regarding air quality. This statement acknowledged that it is not feasible to reduce city-wide impacts to air quality to a level of insignificance at this time. Implementation of the General Plan mitigation recommended by the South Coast Air Quality Management District will reduce the magnitude of the impacts as much as feasible. The addition of 24 condominium units will not cause a significant impact. 6. TRANSPORTATION/CIRCULATION Would the proposal result in: a) Estimated Average Daily Trips generated by the project? The proposed 24 condominium units will generate more traffic in the area then currently exists. However, due to the remaining vacant lots in the area,the increased traffic should not be elevated to a level above that seen by other neighborhoods throughout the City of Palm Springs. The applicant is required to dedicate additional right-of-way along Arenas Road to accommodate the future widening of the street, This will effectively mitigate any increase in traffic generated by the construction of this project. 6,c-h)NO IMPACT. The project site is located in an urbanized area of the City. Circulation within the vicinity of the project site will be adequate based upon the judgment of the Department of Planning&Building and the Engineering Division. The applicant will be required to construct sidewalks adjacent to the project on Arenas Road, The project will not affect rail, waterborne, or air traffic. Therefore, there is no potential for a significant impact to these traffic related issues as a result of the project. 7. Since the project only entails a 24 lot residential subdivision,the project will not conflict or interfere with an energy conservation plan. The project site does not contain any mineral resources being located in an urbanized area of the City. Therefore, there should be no impacts to energy and mineral resources as a result of the project. 9. HAZARDS Would the proposal: a) Be a risk of accidental explosion or release substances(including,but not limited to: oil, pesticides,chemicals,or radiation? ❑ ❑ ❑ b) Create possible interference with an emergency response plan or emergency evacuation plan? ❑ ❑ ❑ c) Create any health hazard or potential health hazard? ❑ ❑ ❑ d) Create exposure of people to existing sources of potential health hazards? ❑ ❑ ❑ e) Increase the risk of fire hazard in areas with flammable brush,grass or trees? ❑ ❑ ❑ 9.a-e)NO IMPACT. In the judgment of the Department of Planning&Building,there are no aspects of the proposed project or of project construction which would involve explosives, pesticides, radiation, chemicals, or other hazardous substances. In addition, the project site is not located within a fire hazard area. The proposed improvements will not block roadways or routes used by the Fire Department and the Police Department. Therefore, there would be no risk of a release of or exposure to hazardous materials which would result in a potential for a significant impact on the environment. 9 Potentially Significant Potentially Unless Less Than No Significant Mitigation Significant Impact Impact Incorporated Impact 10. NOISE Would the proposal result in: a) Increases in existing noise levels? ❑ ❑ ❑ b) Exposure of people to severe noise levels? ❑ ❑ ❑ c) Will the project be compatible with the noise compatibility planning criteria according to Table 6-F of the Palm Springs Municipal Airport F.A.R. Part 150 Noise Compatibility study? ®YES ONO 10, a, b) NO IMPACT. The proposed residential subdivision is expected to generate noise levels that would be typical for residential development. The site is located in an urbanized area adjacent to existing residential uses. In the evaluation of the Department of Planning & Building, noise levels will not exceed the noise levels stated within the Palm Springs Municipal Code, Chapter 11.74. Compliance with the Palm Springs Municipal Code, Chapter 8.04,will limit the hours during which construction activities may occur.The project site is not located within the Airport F.A.R. Part 150 Noise Compatibility study. Therefore,no potentially significant impacts to the environment would result from noise. 11. PUBLIC SERVICES Would the proposal have an effect upon or result in a need for new or altered government services in any of the following areas: a) Fire protection? ❑ ❑ ❑ Distance to nearest fire station(114 mile) b) Police protection? ❑ ❑ ❑ c) Schools? ❑ ❑ ❑ d) Maintenance of public facilities, including roads? ❑ ❑ ❑ e) Other governmental services? ❑ ❑ ❑ 11.a-e)NO IMPACT. The application only entails subdividing 2 acres into 24 residential lots. Thus,the project should not impact existing fire and police services. The applicant will be required to pay the Palm Springs Unified School District to mitigate potential impacts to the school district. The project is located within an urbanized area of the City. All utilities and services are currently provided to the subject area. The project is not large enough to require modifications to the existing services other than street improvements adjacent to the subject property. There are existing Southern California Edison easements that run through the subject property. Therefore,there should be no impacts to utilities and service systems as a result of the project. 13. AESTHETICS Would the proposal: a) Affect a scenic vista or scenic highway? ❑ ❑ ❑ b) Have a demonstrable negative aesthetic effect? ❑ ❑ ❑ c) Create light or glare? ❑ ❑ ❑ 13.a-c)NO IMPACT. The project site is not located near a scenic thoroughfare as defined in the General Plan. Since the project entails development of multi-family residences which will be compatible with existing development, there should not be a negative aesthetic impact. Development within the project site will create additional light;however,this will be typical for multi-family residential development which should not be an impact. Therefore,there should be no impacts to aesthetics as a result of the project. 14. The subject site is located in an urbanized area of the City. Records of the Department of Planning&Building were examined to determine if any paleontological resources have been recorded for the site and none were identified. Therefore, there should be no impacts to paleontological resources as a result of this project. 14,b-e)POTENTIALLY SIGNIFICANT UNLESS MITIGATION INCORPORATED.The subject site is located within Section 14 of the Chy of Palm Springs. Historically,this section has been the home of several generations of members of the Agua Caliente Band of Cahuilla Indians. Specifically, a cultural resource, the Round House, was located approximately 150 feet to the east of the subject property. According to the submitted Archeological Report, there is the potential for artifacts to be discovered during construction. The report suggests that an Archeologist be present at all limes to mitigate the impact of construction on cultural and archeological resources. Mitigation:On-site monitoring during construction by a qualified archaeologist in close consultation with the Agua Caliente Band of Cahuilla Indians. 15. RECREATION Would the proposal: a) Increase the demand for neighborhood or regional parks or other recreational facilities? ❑ ❑ ❑ b) Affect existing recreational opportunities? ❑ ❑ ❑ 15.a-b)NO IMPACT. Since the project only entails construction of 24 multi-family residences,there should not be an impact on existing recreational facilities. Therefore,there should not be an impact to recreation as a result of this project, 16. NO IMPACT. The project only entails the subdivision of 2 acres into 24 residential lots. The project will meet both the General Plan designation and the Zoning Ordinance upon approval of the Tentative Tract Map. RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, APPROVING TENTATIVE TRACT MAP 30313 TO ALLOW FOR THE SUBDIVISION OF 2 ACRES INTO 24 CONDOMINIUM PROPERTIES LOCATED AT 705 EASTARENAS ROAD, R-4 ZONE, SECTION 14. WHEREAS, the City Council has received a request by Palm Springs Modern Homes, LLC for a Tentative Tract Map to allowfora24 lot subdivision for condominium development(the project);and WHEREAS, the proposed development will provide 24 condominiums; and WHEREAS, notice of a public hearing of the City Council of the City of Palm Springs to considerthe application for Tentative Tract Map 30313 and Case 3.2013 was given in accordance with applicable law; and WHEREAS, on February 27,2002, a public hearing on the application for the Tentative Tract Map was held by the Planning Commission in accordance with applicable law; and WHEREAS, on February 27, 2002, the Planning Commission voted to recommend that the City Council approve the proposed project; and WHEREAS, on April 24, 2002, a public hearing on the application for the Tentative Tract Map was held by the City Council in accordance with applicable law; and WHEREAS, the City Council has carefully reviewed and considered all of the evidence presented in connection with the hearing on the project, including but not limited to the staff report, and all written and oral testimony presented. THE CITY COUNCIL HEREBY FINDS AS FOLLOWS: Section 1: Pursuant to CEQA, the City Council finds as follows: Pursuant to CEQA, an initial study(dated February 1, 2002) has been prepared, it has been determined that the project will not have a significant impact on the environment, and a Negative Declaration has been filed. Section 2: Pursuant to Government Code Section 66473.5, the City Council finds that the proposed subdivision and the provisions for its design and improvement are compatible with the objectives, policies, and general land uses and programs provided in the City's General Plan and any applicable specific plan; and Section 3: Pursuant to Government Code Section 65567, the City Council finds that the proposed subdivision and the provisions for its design and improvements are compatible with the objectives, policies, and general land use provided in the City's local open space plan; and & � Page 2 of 3 Resolution TTM 30313 April 24, 2002 Section 4: Pursuant to Government Code Section 66474, the City Council finds that with the incorporation of those conditions attached in Exhibit A: a. The proposed map is consistent with the applicable general and specific plans. The subject property is designated as H43/30 (High Density) allowing 43 hotel or 30 residential units per acre and is zoned R-4. The application entails subdividing 2 acres into 24 condominium lots. The project complies with the General Plan and will be a beneficial improvement within the neighborhood. b. The design orimprovements of the proposed subdivision are consistentwith the General Plan. The improvements associated with the proposed subdivision include 24 condominiums, sidewalks,and landscaping. The proposed condominium project provides off-street parking, sufficient amenities, and have been designed to be compatible with surrounding developments. All of the proposed improvements are consistent with the General Plan. c. The site is physically suitable forthe type of development contemplated by the proposed subdivision. The project will comply with all R-4 property development standards. The surrounding neighborhood consists of existing multiple-family residential and commercial uses, as well as a church. Thus, the project is compatible with the surrounding neighborhood. d. The site is physically suitable for the proposed density of development contemplated by the proposed subdivision. The project will be compatible with existing land use designations in the surrounding neighborhood based on the density. The proposed 24 unit development is consistent with the General Plan designation of 30 residential units per acre. In this case, the units would consist of two-story buildings that have been designed to respect the existing buildings in the neighborhood. The neighborhood also consists of some existing two-story buildings to the south of the subject property and a new two-story development located immediately west of the subject property. Thus, the project should be compatible with the surrounding neighborhood. e. The site for the proposed use relates to streets and highways properly designed and improved to carry the type and quantity of traffic to be generated by the proposed use. Conditions of this projectwill require dedication of right-of-way along Arenas Road that the streetcan be developed to its ultimate right-of-way as required by the General Plan such that the roadway will not be negatively impacted by trips generated from this project. f. The conditions to be imposed and shown on the approved site plan are deemed Page 3 of 3 Resolution TTM 30313 April 24, 2002 necessary to protect the public; health, safety, and general welfare, including any minor modifications of the zone's property development standards. All proposed conditions of approval are necessary to ensure public health and safety including, but not limited to, the requirements for curb, gutter, and sidewalks. Additionally, the project design features abundant landscaping, large common areas, covered parking, and provide adequate off-street parking. g. A nexus and rough proportionality have been established for requirement of dedication of the additional right-of-way to the City and the off-site improvements as related to the tentative tract map. The off-site improvements,which are required by the Zoning Ordinance, are related to the project since the property owners must use Arenas Road to access the site. Currently,the subject property is vacant and therefore little or no usage of the roads, sidewalks, and utilities is due to the subject property at this time. However, the future property owners will benefit from any improvements made to Arenas Road such as dedication of easements, sidewalks,and future widening. The required dedication of right-of-way and improvements will provide safety benefits to the property owners and will aesthetically enhance the neighborhood. NOW, THEREFORE, BE IT RESOLVED that, based on the foregoing, the City Council hereby orders the filing of a Negative Declaration,and approves Tentative Tract Map 30313 subject to those conditions set forth in the attached Exhibit A. Arenas Road April 3, 2002 TTM 30313 CONDITIONS OF APPROVAL Before final acceptance of the project, all conditions listed below shall be completed to the satisfaction of the City Engineer,the Director of Planning,the Chief of Police, the Fire Chief ortheir designee, depending on which department recommended the condition. Any agreements, easements or covenants required to be entered into shall be in a form approved by the City Attorney. 1. The proposed development of the premises shall conform to all applicable regulations of the Palm Springs Zoning Ordinance, Municipal Code, or any other City Codes, ordinances and resolutions which supplement the zoning district regulations. 2. The ownershall defend, indemnify, and hold harmless the City of Palm Springs, its agents, officers, and employees from any claim, action, or proceeding against the City of Palm Springs or its agents, officers or employees to attach, set aside,void or annul, an approval of the City of Palm Springs, its legislative body,advisory agencies,or administrative officers concerning Case 3.2163 and Tentative Tract Map 30313. The City of Palm Springs will promptly notify the applicant of any such claim, action, or proceeding against the City of Palm Springs and the applicant will either undertake defense of the matter and pay the City's associated legal costs or will advance funds to pay for defense of the matter by the City Attorney. If the City of Palm Springs fails to promptly notify the applicant of any such claim, action or proceeding or fails to cooperate fully in the defense,the applicant shall not, thereafter, be responsible to defend, indemnify, or hold harmless the City of Palm Springs. Notwithstanding the foregoing, the City retains the right to settle or abandon the matter without the applicant's consent but should it do so, the City shall waive the indemnification herein, except, the City's decision to settle or abandon a matter following an adverse judgement orfailure to appeal, shall not cause awaiverofthe indemnification rights herein. 3. The mitigation measures of the environmental assessment shall apply. The applicant shall submit a signed agreement that the mitigation measures outlined as part of the negative declaration will be included in the plans priorto Planning Commission consideration of the environmental assessment. 4. Architectural approval shall be valid for a period of two (2) years. The appeal period for an Architectural Approval and Tentative Tract Map application is 15 calendar days from the date of project approval. Permits will not be issued until the appeal period has concluded. 6. Final landscaping, irrigation, exterior lighting, and fencing plans shall be submitted for approval by the Department of Planning and Building prior to issuance of a building permit. Landscape plans shall be approved by the Riverside County Agricultural Commissioner's Office prior to submittal. 7. Prior to issuance of a grading permit, a Fugitive Dust and Erosion Control Plan shall be submitted and approved by the Building Official. Refer to Chapter 8.50 of the Municipal Code for specific requirements. 8. The grading plan shall show the disposition of all cut and fill materials. Limits of site disturbance shall be shown and all disturbed areas shall be fully restored or landscaped. 9. Drainage swales shall be provided adjacent to all curbs and sidewalks - 3' wide and 6" deep. The irrigation system shall be field tested prior to final approval of the project. Section 14.24.020 of the Municipal Code prohibits nuisance waterfrom entering the public streets, roadways or gutters. 10. All proposed trees within the public right-of-way and within 10 feet of the public sidewalk and/or curb shall have City approved deep root barriers installed per City of Palm Springs Engineering specifications. 11. The applicant prior to issuance of building permits shall submit a draft declaration of covenants, conditions and restrictions ("CC&R's")to the Director of Planning and Building for approval in a form to be approved by the City Attorney, to be recorded prior to issuance of occupancy permits. The CC&R's shall be enforceable by the City,shall not be amended without City approval, shall require maintenance of all property in a good condition and in accordance with all ordinances. The applicant shall submit to the City of Palm Springs a deposit in the amount of$2,000,for the review of the CC&R's by the City Attorney and pay the City administrative fee of$265. 12. Separate architectural approval and permits shall be required for all signs. A detailed sign program shall be submitted for review and approval by the Planning Commission prior to issuance of building permits. 13. All roof mounted mechanical equipment shall be screened from all possible vantage points both existing and future perSection 9303.00 of the Zoning Ordinance. The screening shall be considered as an element of the overall design and must blend with the architectural design of the building(s). The exterior elevations and roof plans of the buildings shall indicate any fixtures or equipment to be located on the roof of the building, the equipment heights, and type of screening. Parapets shall be at least 6"above the equipment for the purpose of screening. 15. No exterior downspouts shall be permitted on anyfacade on the proposed building(s)which are visible from adjacent streets or residential and commercial areas. 16. The design, height,texture and color of building(s), fences and walls shall be submitted for review and approval prior to issuance of building permits. 17. The street address numbering/lettering shall not exceed eight inches in height. 18. An exterior lighting plan in accordance with the lighting ordinance in effect at the time shall be submitted for review and approval by the Director of Planning & Building prior to the issuance of building permits. A photometric study and manufacturer's cut sheets of all exterior lighting on the building, in the landscaping, and in the parking lot shall be submitted for approval prior to issuance of a building permit. If lights are proposed to be mounted on buildings, down-lights shall be utilized. 19. Parking lot light fixtures shall align with stall striping and shall be located two to three feet from curb face. 20. Submit plans meeting City standard for approval on the proposed trash and recyclable materials enclosure prior to issuance of a building permit. 21. This project shall be subject to Chapters 2.24 and 3.37 of the Municipal Code regarding public art.The project shall either provide public art or payment of an in lieu fee. In the case of the in-lieu fee, the fee shall be based upon the total building permit valuation as calculated pursuant to the valuation table in the Uniform Building Code, the Peeing being 1/2% for commercial projects or 1/4% for residential projects with first $100,000 of total building permit valuation for individual single-family units exempt. Should the public art be located on the project site, said location shall be reviewed and approved by the Director of Planning and Building and the Public Arts Commission, and the property owner shall enter into a recorded agreement to maintain the art work and protect the public rights of access and viewing. 22. Prior to the issuance of building permits, locations of all telephone and electrical boxes must be indicated on the building plans and must be completely screened and located in the interior of the building. Electrical transformers must be located toward the interior of the project maintaining a sufficient distance from the frontage(s) of the project. Said transformer(s) must be adequately and decoratively screened. 24. Islands of not less than 9 feet in width with a minimum of 6 feet of planter shall be provided every 10 parking spaces. Additional islands may be necessary to comply with shading requirements in # 43 below. 25. Shading requirements for parking lot areas as set forth in Section 9306.00 of the Zoning Ordinance shall be met. Details to be provided with final landscape plan. 26. Parking stalls shall be delineated with a 4 to 6 inch double stripe-hairpin or elongated "U" design. Individual wheel stops shall be prohibited;a continuous 6"barrier curb shall provide wheel stops. 27. Concrete walks with a minimum width of two (2) feet shall be installed adjacent to end parking spaces or end spaces shall be increased to eleven (11) feet wide. 28. Tree wells shall be provided within the parking lot and shall have a planting area of six feet in diameter/width. 29. Standard parking spaces shall be 17 feet deep by 9 feet wide; compact sized spaces shall be 15 feet deep by 8 feet wide. Handicap parking spaces shall be 18 feet deep by 9 feet wide plus a 5 foot walkway at the right side of the parking space; two(2) handicap spaces can share a common walkway. One in every eight(8)handicap accessible spaces, but not less than one (1), shall be served by an 8 foot walkway on the right side and shall be designated as "van accessible". 30. Handicapped accessibility shall be indicated on the site plan to include the location of handicapped parking spaces, the main entrance to the proposed structure and the path of travel to the main entrance. Consideration shall be given to potential difficulties with the handicapped accessibility to the building due to the future grading plans for the property. 31. Automatic Fire Sprinklers: An approved, automatic Fire Sprinkler System is required. Plans forthe fire sprinkler system shall be submitted at the time of application fora building permit. Submitted plans shall be 'wet stamped' by a C-16 fire sprinkler contractor. 2. Fire Flow Determination: Provide information on building size and type of construction. This information is necessary to calculate the fire flow requirement. 3. Residential Smoke Detector Installation: Provide Residential Smoke Detectors. Detectors shall receive their primary power from the building wiring, and shall be equipped with a battery backup. (310.9.1.3 CBC) 4. Site Fire Protection: Provide a garden hose or hoses on construction site equipped with an adjustable spray nozzle capable of reaching all combustible construction. 5. Premises Identification: Approved numbers or addresses shall be provided for all new and existing buildings in such a position as to be plainly visible and legible from the street or road fronting the property. 6. Building or Complex Gate Locking Devices: Gate(s) shall be equipped with a KNOX key switch device or Key box. Contact the fire department for a KNOX application form as soon as possible. 7. Fire Hydrant Requirements: A commercial fire hydrant is required on the street fronting the property. The commercial hydrant required for the Phase 1 project immediately west of this proposed project is accepted as meeting this requirement. A residential fire hydrant will be required on the access road on the east side of the project. This hydrant must be installed in conformance with Desert Water Agency standard drawings W111 and W112. No landscape planting,walls, or fencing are permitted within 3 feet of fire hydrants, except groundcover plantings. 8. Site Plan: Provide the fire departmentwith two copies of an approved site plan. Approved locations for fire hydrants will be marked on this site plan, with one copy being returned to the applicant. The second copy will be retained by the fire department. 9. Fire hydrant systems: Following fire department selection of hydrant locations, plans and specifications for fire hydrant systems shall be submitted to the fire department for review and approval prior to construction. Combustible Debris: Combustible debris shall not be accumulated within buildings. Combustible debris, rubbish and waste material shall be removed from buildings as often as practical. (8704.5 CFC) 13. Motor Equipment. Internal combustion powered construction equipment shall be used in accordance with the following: 1. Equipment shall be located so that exhausts do not discharge against combustible material; 2. When possible, exhausts shall be piped to the outside of the building; 3. Flame Producing Equipment: The use of torches or flame -producing devices for the sweating of pipe joints shall be in accordance with Article 49. (8704.10 CFC) 18. Flammable Liquids. The storage, use and handling of flammable liquids shall be in accordance with Article 79. Ventilation shall be provided for operations utilizing the application of materials containing flammable solvents. (8704.11 CFC) Open flame devices and other sources of ignition shall not be located in areas where flammable materials are being used. (8704.12 CFC) 19. Asphalt and Tar Kettles: Asphalt and tar kettles shall be located and operated in accordance with Section 1105 CFC. (8704.13 CFC) 20. Temporary Electrical Wiring: Temporary electrical wiring shall be in accordance with Section 8503 CFC. (8704.14 CFC) 21. Building Access for Firefighting: Construction material shall not block access to buildings, hydrants or fire appliances. Fire/Police/Ambulance access gates shall be at least 14' in width and equipped with a frangible chain and padlock. 23. Site Plan: Provide the fire department with a legible 81/2"X 11"site plan. This plan will be used for fire dept. complex map books. 24. Fire Extinguisher Requirements: Provide one 2-A:10-B:C portable fire extinguisher for every 75' of floor or grade travel distance for normal hazards. Final location will be determined, as conditions warrant, by the field inspector. 25. Trash Container Protection: If trash container space is within 5 feet of a combustible building wall then the enclosure must be protected by an approved automatic fire sprinkler system. (1103.2.2 CFC) 26. Connections, Valves and Devices: Fire department connections shall be visible, accessible,have NSTfemale inlets,have KNOX locking protective caps, have an approved check valve located in the main line (As close to the FDC as possible) and have a UL and CSFM listing. If fire sprinkler system is over 100 heads an approved anti-tamper device with 24 hour monitoring must be installed on the OS&Y valves at the Backflow Preventer/Double Check Valve assembly. 27. Plan Submittal: Fire sprinkler plans shall be approved prior to the installation of any pipe. Contractor shall submit plans directly to the fire department as soon as possible. (One set will be retained by the fire department.). Submittal to include manufacturers cut sheets and UUCSFM listings with expiration dates on all material and equipment used.Submittal shall also include hydraulic calculations.A set of approved plans shall be maintained at all times on the job site 28. Fire Alarm System: Fire Alarm System required. Installation shall comply with the requirements of NFPA 72. Plans for the fire alarm system shall be submitted at the time of application for a building permit. (310.10 CBC). 29. Fencing Required: Construction site fencing with 14'wide access gates is required for all combustible construction over 5,000 SF in accordance with City of Palm Springs Ordinance 1570 or as determined by the Fire Marshal as the Authority Having Jurisdiction. Fencing shall remain intact until buildings are stuccoed or covered and secured with lockable doors and windows. ENGINEERING: The Engineering Department recommends that if this application is approved, such approval is subject to the following conditions being completed in compliance with City standards and ordinances: Page 8 of 12 Conditions of Approval (TTM 30313) April 3, 2002 Before final acceptance of the project, all conditions listed below shall be completed to the satisfaction of the City Engineer. STREETS 1. Any improvements within the street right-of-way require a City of Palm Springs Encroachment Permit. Work shall be allowed according to Resolution 17950 - Restricting Street Work on Major and Secondary Thoroughfares. 2. Submit street improvement plans prepared by a Registered Civil Engineer to the Engineering Department. The plan(s)shall be approved by the City Engineer prior to issuance of any grading or building permits. Minimum submittal shall include the following, IF applicable: A. Copy of signed Conditions of Approval from Planning Department. B. All agreements and improvement plans approved by City Engineer, IF applicable. C. Proof of processing dedications of right-of-way, easements,encroachment agreements/licenses,covenants,reimbursement agreements,etc.required by these conditions. ARENAS ROAD EAST 3. Dedicate an additional right-of-way of 15 feetto provide the ultimate half streetwidth of 40 feet along the entire frontage of the subject property. 4. Construct a 6 inch curb and gutter, 32 feet SOUTH of centerline along the entire frontage of the subject property per City of Palm Springs Standard Drawing No. 200. 5. The west driveway approach shall be constructed in accordance with City of Palm Springs Standard Drawing No. 201 and have minimum width of 24 feet. The east (Main Entry) driveway approach shall be constructed in accordance with City of Palm Springs Standard Drawing No. 201 and have the width necessary for emergency vehicles to make the turning movement and line up with the gate for entry. 6. Construct a minimum 8 footwide sidewalk behind the curb along the entire frontage in accordance with City of Palm Springs Standard Drawing No. 210. Remove and replace existing pavementwith a minimum pavement section of 3 inch asphalt concrete pavement over 6 inch aggregate base with a minimum subgrade of 24 inches at 95% relative compaction, OR equal, from edge of proposed gutter to centerline along the entire frontage in accordance with City of Palm Springs Standard Drawing No. 110 AND 325. The pavement section shall be designed, using "R"values, by a licensed Soils Engineer and submitted to the City Engineer for approval. SANITARY SEWER 8. Connect all sanitary facilities to the City sewer system. Lateral shall not be connected at manhole. GRADING 9. A copy of a Title Report prepared/updated within the past 3 months and copies of record documents shall be submitted to the City Engineerwith the first submittal of the Grading Plan. 10. Submit a Grading Plan prepared by a Registered Professional to the Engineering Department for plan check. Grading plan shall be submitted to the Planning Department for comments prior to submittal to the Engineering Department. A PM 10 (dust control) Plan shall be submitted to and approved by the Building Division prior to approval of the grading plan.The Precise/Engineered Grading Plan shall be approved by the City Engineer prior to issuance of any grading or building permits. Minimum submittal includes the following: A. Copy of Planning Department comments regarding the grading plan. B. Copy of signed Conditions of Approval from Planning Department. C. Copy of Site Plan stamped approved and signed by the Planning Department. D. Copy of Title Report prepared/updated within past 3 months. E. Copy of Soils Report, IF required by these conditions. F. Copy of Hydrology Study/Report, IF required by these conditions. 11. Drainage swales shall be provided adjacent to all curbs and sidewalks-3'wide and 6" deep - to keep nuisance water from entering the public streets, roadways, or gutters. In accordance with City of Palm Springs Municipal Code, Section 8.50.00, the developer shall post with the City a cash bond of two thousand dollars ($2,000.00) per acre for mitigation measures of erosion/blowsand relating to his property and development. 13. A soils report prepared by a licensed Soils Engineer shall be required for and incorporated as an integral part of the grading plan forthe proposed site.A copy of the soils report shall be submitted to the Building Department and to the Engineering Department along with plans, calculations and other information subject to approval by the City Engineer prior to the issuance of the grading permit. 14. Contactthe Building Departmentto get information regarding the preparation of the PM10 (dust control) Plan requirements. 15. In cooperation with the Riverside County Agricultural Commissioner and the California Department of Food and Agriculture Red Imported Fire Ant Project, applicants for grading permits involving an engineered grading plan and the export of native soil from the site will be required to present a clearance document from a Department of Food and Agriculture representative in the form of an approved "Notification of Intent To Move Soil From or Within Quarantined Areas of Orange, Riverside, and Los Angeles Counties" (RIFA Form CA-1) or a verbal release from that office prior to the issuance of the City grading permit. The developer shall accept all flows impinging upon his land and conduct these flows to an approved drainage structure. On-site retention/detention or other measures approved by the City Engineer shall be required if off-site facilities are determined to be unable to handle the increased flows generated by the development of the site. Provide a hydrology study to determine if the developed stormwater runoff exceeds the capacity of the approved drainage carriers. 17. The project is subject to flood control and drainage implementation fees. The acreage drainage fee at the present time is $9,212.00 per acre per Resolution No. 15189. Fees shall be paid prior to issuance of a building permit. ON-SITE 18. The minimum pavement section for all on-site streets/parking areas shall be 2-1/2 inch asphalt concrete pavement over 4-inch aggregate base with a minimum subgrade of 24 inches at 95% relative compaction, OR equal. The pavement section shall be designed, using "R" values, determined by a licensed Soils IL �. f�3 Page 11 of 12 Conditions of Approval (TTM 30313) April 3, 2002 Engineer and submitted with the Fine Grading Plan to the City Engineer for approval. 19. The following requirements for a gated entry shall be met to provide adequate setbacks and turning movements for vehicles entering the primary parking facilities of this project: A. Provide a minimum curb cut as set forth in Item # 5, 2"1 paragraph. B. Provide a minimum 50 foot setback to the access gate control mechanism C. Provide a turnaround after the mechanism for vehicles unable to enter the project D. Security gates shall be a minimum of 14 feet clear width in each direction. 20. The on-site parking lot shall be constructed in accordance with City of Palm Springs Zoning Ordinance, Section 9306.00. GENERAL 21. Any utility cuts in the existing off-site pavement made by this development shall receive trench replacement pavement to match existing pavement plus one additional inch. See City of Palm Springs Standard Drawing No. 115. Pavement shall be restored to a smooth rideable surface. 22. All proposed utility lines on/or adjacent to this project shall be undergrounded prior to issuance of a Certificate of Occupancy. 23. All existing utilities shall be shown on the grading/street plans. The existing and proposed service laterals shall be shown from the main line to the property line.The approved original grading/street plans shall be as-built and returned to the City of Palm Springs Engineering Department prior to issuance of the certificate of occupancy. 24. The developeris advised to contact all utility purveyors for detailed requirements for this project at the earliest possible date. 25. Nothing shall be constructed or planted in the corner cut-off area of any driveway which does or will exceed the height required to maintain an appropriate sight distance per City of Palm Springs Zoning Code 93.02.00 D. 26. All proposed trees within the public right-of-way and within 10 feet of the public sidewalk and/or curb shall have City approved deep root barriers installed per City of Palm Springs Engineering specifications. /� et l y Page 12 of 12 Conditions of Approval (TTM 30313) April 3, 2002 MAP 27. The Title Report prepared for subdivision guarantee for the subject property, the traverse closures for the existing parcel and all lots created therefrom, and copies of record documents shall be submitted with the Final Map to the Engineering Department. 28. The Title Report prepared for subdivision guarantee forthe subject property and the traverse closures for the existing parcel and all areas of right-of-way or easement dedication shall be submitted to the City Engineer for review and approval with the Grant Deed. 29. The Final Map shall be prepared by a licensed Land Surveyor or qualified Civil Engineer and submitted to the Engineering Department for review. Submittal shall be made prior to issuance of grading or building permits. TRAFFIC 30. The developer shall provide a minimum of 48 inches of sidewalk clearance around all street furniture, fire hydrants and other above-ground facilities for handicap accessibility. The developer shall provide same through dedication of additional right-of-way and widening of the sidewalk or shall be responsible for the relocation of all existing traffic signal/safety light poles, conduit, pull boxes and all appurtenances located on the ARENAS ROAD EAST frontage of the subject property. 31. Striping plans are to be prepared and submitted along with street improvement plans for review and approval by the City Engineer. 32. Construction signing,lighting and barricading shall be provided foron all projects as required by City Standards or as directed by the City Engineer. As a minimum, all construction signing, lighting and barricading shall be in accordance with State of California, Department of Transportation, "MANUAL OF TRAFFIC CONTROLS FOR CONSTRUCTION AND MAINTENANCE WORK ZONES' dated 1996, or subsequent additions in force at the time of construction. 33. This property is subject to the Transportation Uniform Mitigation Fee based on the RESIDENTIAL MULTI-FAMILY ITE Code B land use.
