HomeMy WebLinkAbout4/24/2002 - STAFF REPORTS (21) DATE: April 24, 2002 l TO: City Council FROM: Executive Director-Airports SUBJECT: PARKING STRUCTURE CONSTRUCTION - ORDINANCE SUSPENSION RECOMMENDATION: It is recommended that the City Council take action to temporarily suspend, for the term of the Parking Structure construction, noise and construction hours regulatory ordinances. SUMMARY: This action would result in suspension of the noise and construction hours regulatory ordinances to allow expedited construction of the Parking Structure. BACKGROUND: The City Council has expressed a desire to fast-track the construction of the Downtown Parking Structure so as to not adversely affect downtown businesses later than Thanksgiving of 2002. To accomplish this compressed construction schedule, as well as to accommodate the required continuous pours and proper concrete curing, construction will occur at all hours of the day and night. Precautions will be taken on the site to mitigate as many effects on the surrounding neighborhoods as possible. Attached is a proposed Ordinance which would temporarily suspend the Noise Ordinance and the Construction Hours Ordinance from the effective date through January 31, 2003 for work emanating from the Downtown Parking Structure site. 444: - Allen F. AN ORDINANCE OF THE CITY OF PALM SPRINGS, CALIFORNIA, PERTAINING ONLY TO THE DOWNTOWN PARKING STRUCTURE CONSTRUCTION ACTIVITY, TEMPORARILY SUSPENDING THE NOISE ORDINANCE AND CONSTRUCTION HOURS ORDINANCE FOR THE DURATION OF THE DOWNTOWN PARKING STRUCTURE CONSTRUCTION. THE CITY COUNCIL OF THE CITY OF PALM SPRINGS,CALIFORNIA,DOES ORDAIN AS FOLLOWS: SECTION 1. FINDINGS A. The City Council finds that the benefit derived fxom the construction o f a parking structure in the Downtown, as approved by the voters in November of 2001, is significant to the ongoing efforts to enhance the marketable image of the City of Palm Springs. B. The City Comicil finds that certain regulatory ordinances generally desirable and necessary may, nonetheless, impede the timely completion of the Downtown Parking Structure; and that the operation of such regulatory ordinances should be suspended during the construction period of the parking stricture in that designated location to facilitate the parking structure construction- C. The City Council .[finds that the public interest in expediting the construction of the Downtown? Parking Structure and the benefits to be derived therefrom outweigh the temporary public inconvenience entailed in the suspension of such regulatory ordinances, and that the public welfare and interest will be served by such suspensions. SECTION 2. SUSPENSION OF REGULATORY ORDINANCES The City Council does hereby temporarily suspend Section 8.04.220 Limitation of fours of Construction and Section 11.74.042 Construction(Noise Prohibition). The temporary suspension of these Palm Springs Municipal Code sections specifically relate to the construction activity at the Downtown Parking Structure site (Indian Avenue on the east, Palrn Canyon Drive on the west, Baristo Road on the south,and Arenas Road on the north),and do not apply to other locations within the City,and are only effective froze the effective date of this Ordinance through January 31,2003. SECTION 3.
