The purpose of any such study and plan is to protect property and human health and safety, in accordance with FAA regulations, Part 139 . 337, from the hazard of aircraft strikes associated with wildlife located at Palm Springs Regional Airport . ARTICLE 2 Authority exists under the Animal Damage control act of 1931 (7USC 426- 426b and 426c, as amended) and the Rural Development, Agriculture, and Related Agencies Appropriations Act, 1988 (P.L. 100-202) for ADC to cooperate with States, individuals, public and private agencies, organizations, and institutions in the control of wild mammals and birds injurious to wildlife and human health and safety. ARTICLE 3 The Airport and ADC agree that : 1 . Access to secure areas within the Palm Springs Regional Airport will be provided by the Airport to ADC for purpose of the ecological study. The access procedure will be evaluated from time to time by the Director of Aviation or his/her designated representative . 2 . The ecological study will be conducted in accordance with mutually approved Scope of Work and Budget Plan. The Scope of Work and Budget Plan may be amended in writing, if agreed mutually by each parties . ARTICLE 4 Airport agrees : 1 . To pay for services rendered by ADC pursuant to this agreement not to exceed twenty thousand dollars ($20, 000) . Payments will be made by ' checsk payable to U. S•Department of Agriculture thin 30 days after receipt of the bill . 2 . To designate to ADC an authorized representative who will serve as a contact under this Agreement . 3 . To reimburse ADC for all unpaid obligations incurred as a result of this Agreement upon its termination or expiration. ARTICLE 5 ADC agrees : 1 . To provide personnel, equipment, supplies, and other support material necessary to perform ecological study activities, and assistance in the development of a wildlife hazard management plan, all in accordance with the Scope of Work. Scheduling, will be agreed upon by ADC and the Director of Aviation. 2 . To verbally update on a monthly basis, the authorized Director of Aviation or his/her designated representative regarding the progress of the ecological study, and any agreed upon assistance in the preparation of a wildlife hazard management plan. 3 . To submit a final report at the completion of the ecological study. 4 . To designate to the Director of Aviation an authorized representative who shall administer activities pursuant to this Agreement . ARTICLE 6 This Agreement is contingent upon the availability of funds appropriated by the Congress of the United States and the availability of funds from the Airport for purposes of this Agreement . ARTICLE 7 Nothing in this Agreement shall prevent the Airport from entering into separate agreements with any other organization or individual to perform an ecological study or to assist in the preparation of a wildlife hazard management plan.. ARTICLE S Pursuant to Section 22, Title 41, United State Code, no member of or delegate to Congress shall be admitted to any share or part of the Agreement or to any benefit to arise therefrom. ARTICLE 9 APHIS-ADC will hold the Airport harmless from any liability arising from the negligent act of omission of a government officer or employee acting within the scope of his or her employment to the extent compensation is available pursuant to the Federal Tort Claims Act (FTCA) , 22 US 2671 et . sag. , except to the extent that aforesaid liability arises from the negligent acts or omissions of the Airport, his employees, agents or subcontractor (s) . Such relief shall be provided pursuant to the procedures set forth in the FTCA and applicable regulations . ARTICLE 10 The Agreement shall become effective January 1, 1996 and shall continue until December 31, 1996 . This Agreement may be amended at any time by mutual agreement of the parties in writing. It may be terminated by either party upon ninety (90) days written notice to the other party. Further, in the event the Airport does not, for any reason, deposit necessary funds, APHIS-ADC is .relieved of there obligation to provided services under this agreement . The work concerns the undertaking of an ecological study at the Palm Springs Regional Airport (Airport) and delivery by the United States Department of Agriculture, Animal and Plant Health Inspection Service, Animal Damage Control (ADC) of reports concerning the study activities . 2 . The ecological study shall be developed to assess present or potential hazards to human life and aircraft at the Palm Springs Regional Airport and provide recommendations for wildlife hazard correction. 3 . The ecological study shall consist of three phases as follows : PHASE 1 : EVALUATION -Observation, monitoring and evaluation of conditions at Palm Springs Regional Airport that may enhance the possibility or contribute to hazards to human health and safety, aircraft and other property that may be caused by the flight or the presence of wildlife . PHASE 2 : REPORT PREPARATION AND SUBMISSION -Any immediate hazards wi:Ll be verbally reported at time of observation to Director of Aviation or his/her designated representative . To verbally update on a monthly basis, the Director of Aviation or his/her designated representative regarding the progress of the ecological study. -To submit a final report at the completion of the ecological study to the Director of Aviation. PHASE 3 : RECOMMENDATIONS -ADC will provide written recommendations for solutions to wildlife hazard problems, and provide assistance in the preparation of wildlife hazard management plan for the Airport . 4 . The ecological study will require ADC access to secure areas within Palm Springs Regional Airport . Access for the ecological study will be provided to ADC in a manner to be determined by the Director of Aviation. 5 . Palm Springs Regional Airport will provide an authorized vehicle and escort for all areas and facilities of the Airport . 6 . The Airport will provide maps and other data of the Airport and surrounding areas to ADC.
