PARKING STRUCTURE -APPROVAL OF PLANS
RECOMMENDATION:
It is recommended that City Council approve the plans, specifications and working
details forthe Downtown Parking Structure City Project#01-27 and authorize bidding
for all trade contracts.
SUMMARY:
This action will be the final step to undertaking the construction of the Downtown
Parking Structure.
BACKGROUND:
The City has hired Walker Parking Consultants to design the Downtown Parking
Structure. The work has been completed and is now ready for bidding. This project
will be broken into trade contracts and individually bid over the next few weeks.
Copies of the plans and specifications are on file in the City Clerk's office.
A Minute Order is attached for City Council consideration.

Subject: New Parking Structure Elevators
Dear Jerry,
This letter pertains to the subject of the third elevator in the new parking Structure to be built behind The
Palm Springs Chop House/Deck. It has come to my attention through several conversations with you that it
is The City of Palm Springs desire to construct the parking structure without inclusion of the third elevator.
The City through you has requested that I concede the obligation to have the City include this elevator. I
am opposed to the elimination of the third elevator and request formally and expect that the third elevator
be included in this project as discussed, approved and agreed by all parties involved for the following
reasons:
1. The mutual agreement of my landlord, Mr. Zachary Franks, and The Chop House/Deck as long-term
lessee of the premises commonly known as the Chop House at 262 South Palm Canyon Drive was
prefaced by and contingent upon the City of Palm Springs'promise at our joint(Mr. Franks and Chop
House) request to include the third elevator. The City did not offer this elevator--Mr. Franks and myself
requested it. Through the entire dialog, think tank meetings, discussions and negotiations the third
elevator has been included as an integral component of this Structure. The drawings included in the
executed Real Estate Acquisition Agreements reflect the inclusion of the third elevator. My
agreement/understanding with the City of Palm Springs and our subsequent(Chop House)
endorsement and support of the parking structure was expressly contingent upon the inclusion of the
third elevator.Additionally, my landlord Zachary Franks requested the inclusion of the third elevator to
project as well in exchange for his contribution of his real estate to and for this endeavor. The City has
accepted and agreed to this inclusion. Neither Mr. Franks nor myself are willing to concede this
elevator, especially since it has been included since Mr. Franks and I commenced our discussions and
negotiations with the City and is so included in the plans and the final agreements (the plans attached
to the executed Acquisition Agreements). We have no desire to renegotiate this point.

2. The two other elevators are accessed at remote locations relative to our building.The first is at the
corner of Palm Canyon Drive & Baristo, with the second being accessed on Indian Canyon by the Fish
Market. Both elevator locations are remote with respect to providing access to our building.This is
most certainly contrary to the best interests of The Chop House/Deck. I have invested significant
dollars, energies and emotions into Downtown Palm Springs and have requested little in return.This
elevator is a necessary component of the parking structure to provide access to our business interests
and to help deposit people directly into the center of Palm Canyon Drive.

Dear Jerry,
As you know, my agreement to transfer my property to the City of Palm Springs
was premised on the only design which has been shown or suggested to me.which
includes an elevator at the rear-center of the structure. I have yet to be informed
c5rectly of a ahenge of design; this is to reiterate that the elevator in the configuration
and location portrayed remains c condition of my conveyance.

ADVERTISEMENT FOR TRADE Trade Contractor PRE-QUALIFICATION
DOWNTOWN PARKING STRUCTURE
CITY PROJECT#01-27
NOTICE IS HEREBY GIVEN that the City of Palm Springs has determined that bidders for
below designated trade contracts must be pre-qualified prior to submitting a bid on the Downtown
Parking Structure:
Bid Package 97 - Concrete &Reinforcing
Bid Package #9 -Masonry
Bid Package#10 - Miscellaneous Metals
Bid Package#13 -Metal Stud Framing and Plaster
Bid Package 917 =Plumbing
Bid Package#19 -Fire Protection
Bid Package #20 - Electrical
Bid Package#22 - Site Concrete
It is mandatory that all Trade Contractors who intend to submit a bid for any of the above listed bid
packages fully complete the pre-qualification questionnaire,provide all materials requested herein,
and be approved by the City of Palm Springs to be on the final qualified Bidders lists. No bid will
be accepted from a Trade Contractor that has failed to comply with these requirements for the
referenced bid packages. If two or more business entities submit a bid as part of a Joint Venture, or
expect to submit a bid as part of a Joint Venture, each entity within the Joint Venture must be
separately qualified to bid. The last date to submit a(ally completed questionnaire is June 4,2002.
Trade Contractors are encouraged to submit pre-qualification packages as soon as possible,
so that they may be notified of omissions of information to be remedied or of their pre-qualification
status well in advance of the bid closing dates.
Answers to questions contained in the pre-qualification questionnaire, information about current
bonding capacity,notarized statement from surety,and the most recent reviewed or audited financial
statements,with accompanying notes and supplemental information are required. The City will use
these documents as the basis of rating Trade Contractors in respect to the size and scope of contracts
upon which each Trade Contractor is qualified to bid. The City reserves the right to check other
sources available. The City's decision will be based on objective evaluation criteria.
The City reserves the right to adjust, increase, limit, suspend or rescind the pre-qualification rating
based on subsequently learned information. Trade Contractors whose rating changes sufficient to
disqualify them will be notified, and given an opportunity for a hearing consistent with the hearing
procedures described below for appealing a pre-qualification rating.
While it is the intent of the pre-qualification questionnaire and documents required therewith to
assist the City in determining bidder responsibility prior to bid and to aid the City in selecting the
lowest responsible bidder,neither the fact of pre-qualification,nor any pre-qualification rating,will
preclude the City from a post-bid consideration and determination of whether a bidder has the
quality, fitness, capacity and experience to satisfactorily perform the proposed work, and has
demonstrated the requisite trustworthiness.

The Palm Springs Downtown Parking Structure will be owed and operated by the City of Palm
Springs. The City has contracted with Turner Construction Company to serve as Construction
Manager for the project. hidividual trade contracts will be bid,awarded and held by the City of Palm
Springs. The project is contained within approximately 50,000 square feet of land. The stricture
will be a multi-level 375 space reinforced concrete municipal parking structure. It is anticipated that
individual trade contracts will be developed for construction of the project. The anticipated
completion/occupancy date is mid-November 2002.
The pre-qualification packages should be submitted under seal and marked "CONFIDENTIAL"
to Harold E. Good, CPPO, Director of Procurement & Contracting, City of Palm Springs, 3200 E.
Tahquitz Canyon Way, Palm Springs, California 92263-2743.
The pre-qualification packages(questionnaire answers and financial statements)submitted by Trade
Contractors are not public records and are not open to public inspection. All information provided
will be kept confidential to the extent permitted by law. However,the contents may be disclosed to
third parties for purpose of verification, or investigation of substantial allegations, or in the appeal
hearing. State law requires that the names of Trade Contractors applying for pre-qualification status
shall be public records subject to disclosure, and the first page of the questionnaire will be used for
that purpose.
Each questionnaire must be signed under penalty of perjury in the manner designated at the end of
the form,by an individual who has the legal authority to bind the Trade Contractor on whose behalf
that person is signing. If any information provided by a Trade Contractor becomes inaccurate, the
Trade Contractor must immediately notify the City and provide updated accurate information in
writing, under penalty of perjury.
The City reserves the right to waive minor irregularities and omissions in the information contained
in the pre-qualification application submitted,to make all final determinations, and to determine at
any time that the pre-qualification procedures will not be applied to a specific future public works
project.
Trade Contractors may submit pre-qualification packages during regular working hours on any day
that the offices of the City of Palm Springs are open. Trade Contractors who submit a complete pre-
qualification package will be notified of their qualification status no later than two business days
after submission of the information.
The City of Palm Springs may refuse to grant pre-qualification where the requested information and
materials are not provided, or not provided by Jrme 4, 2002. There is no appeal from a refusal for
an incomplete or late application,but re-application for a later project is permitted. The closing time
for bids will not be changed in order to accommodate supplementation of incomplete submissions,
or late submissions. Pre-qualification is trade specific and will be evaluated separately for each bid
package.
Where a timely and completed application results in a rating below that necessary to pre-qualify, an
appeal can be made. An appeal is begun by the Trade Contractor delivering notice to the City of
its appeal of the decision with respect to its pre-qualification rating,no later than two business days
prior to the closing time for the receipt of bids for this project. Without a timely appeal, the Trade
Contractor waives any and all rights to challenge the decision of the City,whether by administrative
process,judicial process or any other legal process or proceeding.
Note:A Trade Contractor may be found not pre-qualified for bidding on a specific
trade contract to be let by the City of Palm Springs,to be let by the City of
Palm Springs until the Trade Contractor meets the City's requirements. In addition,
a Trade Contractor may be found not pre-qualified for either:
(I) Omission of requested information or
(2) Falsification of information
