HomeMy WebLinkAbout03926 - CVAG THERMAL IMAGING SYS CHP R 19217 �� , �� ^,� �� ,P/°V �J R �, I�� � �Jv � � f� �� v"���, _ _ _ . _-__ CVAG - Mou • Thermal Imaging System �woS;.,Jua; HP - Thermal Airport AGREEMENT #3926 Gu E�rdLMZ 7 R19217, 3-18-98 MEMORANDUM OF UNDERSTANDING This Memorandum of Understanding(the "MOU")made and entered into this 18th day of March, 1998, by and between the Coachella Valley Association of Governments (CVAG) and City of Palm Springs Police Department (the "Contributing Organization") is to confirm the contribution of$15,000 for the purpose of purchasing a Thermal Imaging System to be given to, maintained by and mounted on the California Highway Patrol Helicopter located at the Thermal Airport. 1. Purpose Funding contributed under this MOU will be combined with funding received from other contributing organizations for the purpose of purchasing a Thermal Imaging System to be given to the CHP and mounted on the California Highway Patrol helicopter located at Thermal Airport. 2. Role of CVAG The role of CVAG will be limited to assisting in the collection of funds from the contributing organizations and acting as a`Banker"for the disbursement of funds to a lead agency. 3. Lead Agency The California Highway Patrol("CHP")will be the lead agency for the technical portion of the procurement process and a lead city,for the purposes of procurement,will be designated by CVAG Safety Committee at a date prior to the collection of any funds related to this MOU. Ownership of the equipment and right to enforce any warranties shall be conveyed to CHP without charge and CHP shall have the obligation to operate and maintain said equipment without contribution from CVA G or the Contributing Organization. 4. Benefit It is so stated that the purchase of the above described equipment is of benefit to the Contributing Organization in providing necessary advanced technology law enforcement services. 5. Funding If funding contributions are not sufficient to purchase the stated equipment by June 30, 1999; contributed funds will be returned to the Contributing Organization within 60 days. If funding received is in excess of the required amount, excess funds will be .returned to the Contributing Organization on a pro-rata basis within 90 days of the equipment purchase and placing into service. Funds received under this MOU are designated as restricted and therefore may only be used for their intended purpose. Additionally, interest accrued as a result of holding specified funds for this purpose will be the property of CVAG for use to benefit the member jurisdictions consistent with the goals and objectives of CVAG. 6. Terms This MOU shall commence as of the day and year first above shown and shall remain in full force and effect unless terminated, (i)by automatic termination pursuant to Section 5 if there are not sufficient funds collected to purchase the stated equipment, (ii) completion of the services hereunder, or (iii) two (2) years from the date hereof, whichever shall first occur. 1Y1, lid 0,1.�:Li1,I C_S1J l 7.
