AIRPORT ADVERTISING SERVICES AGREEMENT NO. A4043 AMENDMENT NO. 1 AND
AIRPORT PUBLIC ART PLACEMENT
RECOMMENDATION:
It is recommended that the City Council approve Amendment No. 1 to Contract Service
Agreement No. A4043 with Airport Displays, Ltd. for airport advertising services and
airport public art placement.
SUMMARY:
This action would allow the flexibility in the existing agreement with Airport Displays, Ltd.
to have various artwork of the"highest professional standards"displayed for public view
along the mid-valley parkway ,airport extension road.
BACKGROUND:
Airport staff has evaluated opportunities to display public art in various locations on
airport property other than just the Airport Terminal Building. We have also coordinated
with the Planning Commission and Public Arts Commission regarding this issue.
Recently, Airport Displays, Ltd. in cooperation with Buschlenmowatt Galleries of Palm
Desert, presented a proposal to place three (3) corton steel sculptures created by Jean
Claude Farhi along the mid-valley parkway airport extension road. The sculptor, J.C.
Farhi, is in major collections throughout Europe and America. One of two of his largest
works is at the entry to the Nice Airport on the Cote D'Azur in the south of France, with
the second being a 50 foot private commission for Bill Gates of Microsoft. Attached are
photos and dimensions of the proposed sculptures for your review.
The recommended placement of the art work within the medians off the Ramon Road
entrance is ideal in keeping with the international focus of the Airport, but also the
landscape masterplan designed by Michael Buccino & Associates. To confirm this,
Michael Buccino offered his professional assistance on deciding the proper placement
locations for the sculptures and showed great enthusiasm regarding their installation.
While these sculptures are considered public art they are also for sale and are subject
to the provisions of the agreement regarding procurement of artwork. Each sculpture
has a estimated value of about $100,000. There will be no signage indicating the
artwork is for sale, but this information will be given to the public through other
advertising efforts and through the airport administration offices. If sold, the airport will
receive compensation as indicated in Exhibit"C" of the agreement(i.e. Contractor shall
pay to City a base line fee in an amount equal to fifty percent (50%) of Contractor's net
receipts actually received by Contractor from the sale of advertising space in the"Airport
Terminal"). The estimated amount for compensation to Airport Displays is between three
(3) and ten (10) percent.

If approved,the sculptures will be on display between May 16,2002 and March 16,2003
with possible extension periods. Airport Displays, Ltd.and Buschlenmowatt galleries will
maintain full insurance coverage on the artwork while on site relieving the Airport from
the responsibility in this regard. The artwork will be installed and removed at the sole
cost of Airport Displays and Buschlenmowatt galleries.
In keeping with the concept of the "Palm Springs Experience", the Airport will continue
to explore other possibilities for bringing quality artwork to the Palm Springs International
Airport. Not only is this an enhancement to an already beautiful entryway, it is also a
revenue producing opportunity for the Department of Aviation.
The Public Arts Commission reviewed the proposed artwork at its May 9, 2002 and
recommends City Council approval for the placement of the art sculptures along the mid-
valley parkway airport extension road. The Planning Commission reviewed the proposed
layout of the sculptures at its May 8, 2002 meeting, and also recommended City Council
approval.
The Airport Commission recommended City Council approval of Amendment No. 1 to
Agreement No. A4043 and placement of public art as defined in the attached plot plan
at its May 1, 2002 meeting.

ADVERTISING IN AIRPORT TERMINAL AND PUBLIC ART PLACEMENT
ON THE MID-VALLEY PARKWAY AIRPORT EXTENSION ROAD
WHEREAS,the City of Palm Springs,California,hereinafter called"CITY"or"LESSOR,"
and "AIRPORT DISPLAYS, LTD," hereinafter called "LESSEE" or "AIRPORT DISPLAYS,"
entered into Lease Agreement No. A4043, effective December 2, 1998; and
WHEREAS, Lessor and Lessee mutually desire to extend airport advertising services and
airport public art placement along the mid-valley parkway airport extension road;
NOW, THEREFORE, the parties hereto mutually agree as follows:
EXHIBIT "A" SCOPE OF SERVICES, the first sentence is hereby amended to read as
follows:

1. CONCESSION:
1.1: Grant and Acceptance of Concession. City grants to Contractor the sole and
exclusive right, subject to reservations herein, to use certain space and
facilities in and about the passenger terminal building and the mid-valley
parkway airport extension road at the Palm Springs International Airport
Terminal ("Airport Terminal"), more particularly defined in Section 2.2
below,for the installation,maintenance,and removal of advertising displays
and public art placement.
Except as expressly herein modified,the terms,covenants and conditions of Agreement No.
4043, and subsequent Amendment No. 1 are hereby ratified, and shall continue in full force and
effect.

I HEREBY CERTIFY that this Minute Order, approving Amendment No. 1 to
contract service agreement No. A4043 with Airport Displays, Ltd. for airport
advertising services and public art placement, was adopted by the City Council
of the City of Palm Springs, California, in a meeting thereof held on the 15"'day
of May, 2002.
