DEVELOPMENT AT SOUTH PALM CANYON DRIVE BETWEEN SUNNY DUNES ROAD TO THE
NORTH, MESQUITE AVENUE TO THE SOUTH, RANDOM ROAD TO THE EAST, AND SOUTH
BELARDO ROAD TOT HE WEST, W-C-1 AND W-R-3 ZONES, SECTIONS 22 AND 23.
RECOMMENDATION:
The Planning Commission recommends that the City Council approve a time extension from May
17, 2002 to May 17, 2003 for the Star Canyon Palm Springs Planned Development District 260
(PD-260) and Tentative Tract Map 29691 (TTM 29691), subject to the original conditions of
approval. The subject property is located at South Palm Canyon Drive between Sunny Dunes
Road to the north, Mesquite Avenue to the south, Random Road to the east, and South Belardo
Road to the west, W-C-1 and W-R-3 Zones, Sections 22 and 23.
SUMMARY
The Planning Commission recommends approval of the one year time extension for PD-260 and
TTM 29691. This is the first such request for time extension of PD-260 and TTM 29691. The
requested time extension is due to the project being set back by the slow market in the hotel
industry. However, the applicant has experienced a surge of activity since the beginning of 2002
and is currently in negotiations with several large public companies regarding the financing and
construction of both the hotel and timeshare components of the project.
The Planning Commission, at its April 24"', 2002 meeting, by a 5-0-2 vote, recommended approval
of the one year time extension for PD-260 and TTM 29691, subject to the original conditions of
approval.
BACKGROUND:
The Planning Commission, at its April 26, 2000 meeting, recommended that the City Council adopt
a Mitigated Negative Declaration and approve Case No. 5.0830 - TTM 29691 and PD-260. The
City Council subsequently approved the project at its May 17, 2000 meeting.
The Planned Development District consists of a proposed mixed-use facility which includes an 198-
room hotel, 176 vacation ownership units, banquet and meeting facilities, restaurant and lounge
facilities, pool, spa, and other associated amenities on an existing 11.41 acre site. The Tentative
Tract Map includes the subdivision of and existing 11.41 acre parcel into nine lots ranging in size
from .35 acres to 3.23 acres for timeshare condominium purposes and to facilitate the development
of the mixed use facility.

At this time, the applicant indicates that: the extension if required to continue active negotiations
with several large public companies relating to the financing and construction of both the hotel and
timeshare components of the project. The applicant has indicated that an announcement can be
made within forty-five days.
ENVIRONMENTAL ANALYSIS AND NOTIFICATION
Request for time extension are categorically exempt from an environmental assessment per
Section 15301 of the California Environmental Quality Act (CEQA) and local guidelines for
implementation of CEQA.

Our Star Canyon project has been set back due to the slow market in the hotel industry
last year and the devastating effect of 9/11. But, things are changing. We have
experienced a surge of activity since the beginning of the year and are presently
negotiating with several large public companies relating to the financing and construction
of both the Hotel and Timeshare components of the project. We hope that an
announcement can be made within the next forty-five days.
Please extend the Planned Development District# 260 and Tentative Tract Map # 29691
for a time period of one year.

An amendment to Planned Development District#260, and the related Tentative Tract Map 29691,
to change the land uses from hotel and timeshare to all timeshare, with 198 hotel rooms becoming
79 time share units, and other miscellaneous amendments, at the Star Canyon Resort, located at
South Palm Canyon Drive between the Tahquitz Canyon Wash to the north, Mesquite Avenue to
the south, South Palm Canyon Drive to the east, and South Belardo Road to the west, W-C-1 and
W-R-3 Zones, Sections 22 and 23.

NOTICE IS HEREBY GIVEN that the Planning Commission of the City of Palm Springs, California,
will hold a public hearing at its meeting of July 10, 2002. The Planning Commission meeting begins
at 1:30 p.m., with public hearing at 2:00 pm, in the Council Chamber at City Hall, 3200 E. Tahquitz
Canyon Way, Palm Springs, California.
The applicant requests permission to amend Planned Development District#260, and the related
Tentative Tract Map 29691, to change land uses from hotel and timeshare to all timeshare, with
198 hotel rooms becoming 79 time share units, in addition to the approved 176 timeshare units.
Other miscellaneous amendments are proposed. The site plan, building design and heights are to
remain similar to those earlier approved. The proposed project is located at South Palm Canyon
Drive between Sunny Dunes Road to the north, Mesquite Avenue to the south, Random Road to
the east, and South Belardo Road to the west.
Pursuant to the California Environmental Quality Act(CEQA), a Mitigated Negative Declaration has
previously been adopted for this project.
The application, site plan, approved map, Initial Study and related documents are available for
public review daily, between 8 am and 5 pm at the City of Palm Springs in the Planning and
Building Department, located at 3200 Tahquitz Canyon Way.
If any individual or group challenges the action in court, issues raised may be limited to only those
issues raised at the public hearings described in this notice or in written correspondence at or prior
to the Commission meeting.
Notice of Public Hearing is being sent to all property owners within four hundred (400) feet of the
subject property.An opportunity will be given at said hearings for all interested persons to be heard.

TO THE NORTH, MESQUITE AVENUE TO THE SOUTH, RANDOM
ROAD TO THE EAST, AND SOUTH BELARDO ROAD TO THE
WEST, W-C-1 AND W-R-3 ZONES, SECTIONS 22 AND 23.
WHEREAS, Palm Springs New Millennium(Star Canyon Villas),(the"Applicant')requests approval
of a time extension for Planned Development District 260(PD-260)and Tentative Tract Map 29691
(TTM 29691)for property located at South Palm Canyon Drive between Sunny Dunes Road to the
north, Mesquite Avenue to the south, Random Road to the east, and South Belardo Road to the
west, W-C-1 and W-R-3 Zones, Sections 22 and 23; and
WHEREAS, the Applicant has requested additional time to May 17, 2004 to continue negotiations
with interested parties regarding financing and construction of the hotel and timeshare portions of
the project; and
WHEREAS, on April 24, 2002, a public meeting on the request for a time extension from May 17,
2002 to May 17, 2003 for PD-260 and TTM 29691 was held by the Planning Commission in
accordance with applicable law; and
WHEREAS, on April 24, 2002, after holding a public meeting and considering all of the evidence
presented in connection with the project, including but not limited to the staff report, all written and
oral testimony presented, the Planning Commission recommended approval to City Council of the
time extension, subject to the original conditions of approval; and
WHEREAS, on May 15, 2002 a public meeting on the application for Case No. 5.0830-TTM 29691
- PD-260 was held by the City Council in accordance with applicable law; and
WHEREAS, the City Council has carefully reviewed and considered all of the evidence presented
in connection with the project, including but not limited to the staff report, all written and oral
testimony presented.

NOW THEREFORE BE IT RESOLVED that the City Council of the City of Palm Springs, California,
after considering the evidence provided at the meeting, does hereby approve the time extension
for PD-260 and TTM 29691 from May 17, 2002 to May 17, 2003.
