Date: May 15, 2002 To: City Council From: Director of Planning & Building APPEAL OF PLANNING COMMISSION APPROVAL OF CASE NO.6.458-AN APPLICATION BY TRAVIS ENGINEERING (AGENT FOR VONS) FOR A VARIANCE TO ALLOW A 298 SQUARE FOOT KIOSK WITHIN A SELF-SERVICE FUELING CENTER AND A MINIMUM DISTANCE OF 100 FEET FROM THE SITE TO AN ABUTTING A RESIDENTIAL ZONE, LOCATED AT 4733 E. PALM CANYON DRIVE, C-D-N ZONE, SECTION 30. APPEAL An appeal by a City Councilmember of the Planning Commission approval of Variance 6.458 for a 298 square foot kiosk within a fueling center, 452 square feet less than that required by the zoning ordinance, and a setback abutting a residential zone of 100 feet, 75 feet less than that required by the zoning ordinance, located at 4733 E. Palm Canyon Drive. The applicant is Kyle Collinsworth, representing Vons, and Karl Huy, representing Travis Engineering. The City Council may uphold, override or modify the decision of the Planning Commission. At the conclusion of the public hearing the City Council should provide staff direction, in the form of a motion, so that a resolution can be prepared for consideration at the next City Council meeting. SUMMARY The Planning Commission, at the February 271h, 2002 meeting approved, by a 3-2 vote, Conditional Use Permit 5.0876 for a fueling center at 4733 E. Palm Canyon Drive and related Variance 6.458 for a reduction in the size of the kiosk and a reduction in the setback abutting a residential zone. During the public hearing, 1 person spoke in strong opposition noting traffic and safety concerns from the increased volume of vehicles that will cluster at the intersection of E. Palm Canyon Drive and Gene Autry Trail. The applicants spoke in favor. The Planning Commission decision was subject to conditions that included a photometric study to compare the footcandle readings of the canopy lighting to the existing parking lot lighting and assurance in the form of a covenant recorded against the land that the owner of the gas station and the market shall be one entity. The decision was appealed by a City Councilmember on March 12, 2002 on the grounds that the variance may grant a special privilege contrary to limitations placed upon other properties in the vicinity and zone of the project. BACKGROUND Travis Engineering, agent for Vons, submitted an application for a Conditional Use Permit to develop a self-service fueling center within an existing shopping center and a Variance request to develop a 298 square foot kiosk within the fueling center and a reduction of the west setback abutting an R-3 zone from 175 feet to 100 feet. The property owner is Vons, and the project is located at 4733 E. Palm Canyon Drive, at the southeast corner of E. Palm Canyon Drive (Highway 111) and Gene Autry Trail / Matthew Drive. The 0.79 acre project site is bound by East Palm Canyon Drive to the north, Gene Autry Trail to /47A the west, and the existing Vons shopping center complex to the east and south. The site is currently vacant and is generally level. When the center was built, the pad was designed to serve as a future development pad. It was graded and landscaped with sod, trees, and shrubs around the perimeter. The applicant proposes a self-service fueling center to consist of a 3,724 square foot(86'-8"x 43') fuel island canopy structure, ten fueling positions at five product dispensers, a 298 square foot service attendant kiosk with restroom, site landscaping and irrigation improvements, and signage. ADJACENT ZONING / LAND USE North: R-3 (Multiple Family Residential & Hotel Zone); Condominiums (across East Palm Canyon Drive/Highway 111) South: 0-20 (Open Land Zone); Vacant/Mountains East: C-D-N (Designed Neighborhood Shopping Center Zone); existing shopping center West: R-3 (Multiple Family Residential & Hotel Zone); Vacant (across Gene Autry Trail) VARIANCE According to Section 94.02.00.H.2.k. of the Palm Springs Zoning Ordinance, automobile service station buildings shall have a minimum gross floor area of 750 square feet. The applicant has proposed a 298 square foot building with a single restroom facility. The site is located at the southwest corner of Gene Autry Trail and East Palm Canyon Drive and is within 175 feet of a residentially zoned (Section 94.02.00.H.2.a.iii.) R-3 properties to the west and north. The setback on the west is 100 feet and the setback to the north is 202 feet. The proposed project will be owned and operated by Vons, the owner and operator of the Vons Market. ANALYSIS Vons has submitted information to support the variance in the attached variance application. Reasons supporting the variance include ownership and operation of a supermarket on adjacent property, reduction in the scope of development, and location of the site relative to the adjacent R-3 zoned property. The site is separated from R-3 property by Gene Autry Trail / Matthew Drive to the west and by East Palm Canyon Drive to the north. The subject property has a setback of 100 feet on the west, including a 20 foot landscaped parkway on site. The property to the west has a Resort Commercial General Plan designation. Staff has discussed a possible change of zone for this site since it has a commercial General Plan designation and fronts on a major thoroughfare. The R-3 property to the north is 202 feet away from the subject property and is separated by East Palm Canyon Drive which is State Highway 111. The nearest automobile service stations are located at Smoke Tree Shopping Center, two miles to the west and at Gene Autry Trail and Ramon Road, one mile to the north. The area is under served and a fueling station would be an added convenience to the neighborhood. Planning Commission required limited hours of 6am-11 pm coupled with no retail sales to reduce operational impacts to existing residential properties. The Planning Commission found that accessory retail sales will be available at Vons Market therefore eliminating the need for on site retail and a structure 750 square feet in size. The project does not include any service bays, automotive repair, convenience mart, or the sale of beer and wine. Dear Council, The reason for my appeal is one of fairness to all prior and potential fueling centers (gas stations) that have previously sought this specific use or may in the future. If this specific type and size of facility is indeed what Palm Springs desires, then the ordinance should be amended to allow it throughout the City. Singling out the one site and stretching a variance condition to meet it is not "leveling the playing field" for other similar properties. If we are to be "business friendly" then I suggest we accomplish that by using the proper vehicle, a zoning text amendment. If the council does agree with the requested specific use and its characteristics, I suggest that the council, then deny this appeal and instruct staff to modify the zoning text. Through the consideration and granting of this variance request to reduce the scope of development the Planning Commission is assured that the adjustments authorized by said variance will not constitute a special privilege contrary with limitations placed upon other properties in the vicinity and zone of the subject property.According to the City's planning staff, limitations are placed on developments to protect against increases or enlargements of the scope of development in excess of City codes. Dear Ms. Sanders: I am requesting a "notice of review" in regard to the above referenced variance as set forth in the Zoning Ordinance, section 94.10.00. It is my feeling that the variance may grant a special privilege contrary to limitations placed upon other properties in the vicinity and zone of the project. Granting of the variance may have the potential to encourage a specific type of fueling center (gas station) which, by ordinance and past planning commission direction, has heretofore been discouraged. In my mind the proper and equitable procedure to Accomplish the applicant's goal should be a zoning text amendment which would then indicate the desire of the council to change the way gas stations look and operate within our city. Dear Council, The reason for my appeal is one of fairness to all prior and potential fueling centers (gas stations) that have previously sought this specific use or may in the future. If this specific type and size of facility is indeed what Palm Springs desires, then the ordinance should be amended to allow it throughout the City. Singling out the one site and stretching a variance condition to meet it is not "leveling the playing field" for other similar properties. If we are to be "business friendly" then I suggest we accomplish that by using the proper vehicle, a zoning text amendment. If the council does agree with the requested specific use and its characteristics, I suggest that the council, then deny this appeal and instruct staff to modify the zoning text. BACKGROUND: Travis Engineering, agent for Vons, has submitted an application for a Conditional Use Permit to develop a self-service fueling center within an existing shopping center and a Variance request to develop a kiosk within the fueling center and a reduction of the west setback abutting an R-3 zone from 175 feet to 100 feet. The property owner is Vons, and the project is located at 4733 E. Palm Canyon Drive, at the southeast corner of E. Palm Canyon Drive (Highway 111) and Gene Autry Trail. The 0.79 acre project site is bound by East Palm Canyon Drive to the north, Gene Autry Trail to the west, and the existing Vons shopping center complex to the east and south. The site is currently vacant and is generally level. When the center was built, the pad was designed to serve as a future development pad. It was graded and landscaped with sod, trees, and shrubs around the perimeter. The applicant proposes a self-service fueling centerto consist of a 3,724 square foot(86'-8"x 43') fuel island canopy structure, ten fueling positions at five product dispensers, a 298 square foot service attendant kiosk with restroom, site landscaping and irrigation improvements, and signage. ADJACENT ZONING / LAND USE: North: R-3 (Multiple Family Residential &Hotel Zone); Condominiums (across East Palm Canyon Drive/Highway 111) South: R-G-A (Garden Apartment & Cluster Residential Zone); Vacant/Mountains East: C-D-N (Designed Neighborhood Shopping Center Zone); existing shopping center 1704 1 West: R-3 (Multiple Family Residential & Hotel Zone); Vacant (across Gene Autry Trail) VARIANCE: According to Section 94.02.00.H.2.k. of the Palm Springs Zoning Ordinance, automobile service station buildings shall have a minimum gross floor area of 750 square feet. The applicant has proposed a 298 square foot building with a single restroom facility. The site is located at the southwest corner of Gene Autry Trail and East Palm Canyon Drive and is within 175 feet of a residentially zoned (Section 94.02.00.H.2.a.iii.)R-3 properties to the west and north. The setback on the west is 100 feet and the setback to the north is 202 feet. The proposed project will be owned and operated by Vons, the owner and operator of the Vons Market. ANALYSIS: The proposed fueling center station is a conditionally permitted use within the C-D-N zone. As noted, the project proposes a self-service fueling center to consist of a 3,724 square foot (86'-8" x 43') illuminated fuel island canopy structure, ten fueling positions at five product dispensers, underground fuel tanks, a 298 square foot service attendant kiosk, site landscaping and irrigation improvements, and signage. in accordance with zoning code Section 92.10.01, convenience commercial uses established in a C-D-N complex shall direct their activities to serving the specific neighborhood in which they are located. The proposed fuel station will be located on a vacant pad within an existing developed shopping center. It will provide a service to residents in nearby neighborhoods, and is thus considered an appropriate use for this location and zone. The proposed fueling station will operate with an attendant present from 6 am to 11 pm daily. Vons has agreed that there will be no unmanned operations. Five self-service gas pumps and a canopy structure will accommodate gasoline sales. Lighting is proposed to be recessed under the canopy. The proposed kiosk will be for the use of the attendant only. All multiple product (fuel) dispensers will be ADA compliant. The site is a vacant pad within an existing shopping center. The project area is landscaped with turf and some mature trees at the perimeter. The proposed project adds additional landscaping to the site. A slope bank and flood control channel exists to the north of the site, between the project area and the sidewalk along East Palm Canyon Drive. Gene Autry Trail is to the west of the site, and parking for the existing Vons shopping center exists to the south and east sides of the site. Vons has submitted information to support the variance in the attached variance application. Reasons supporting the variance include ownership and operation of a supermarket on adjacent property, reduction in the scope of development, and location of the site relative to the adjacent R-3 zoned property. The site is separated from R-3 property by Gene Autry Trail to the west and by East Palm Canyon Drive to the north. The subject property has a 100 foot setback on the west including a 20 foot landscaped parkway on site. The property to the west has a Resort Commercial General Plan designation. Staff has discussed possible change of zone for this site since it has a commercial General Plan designation and fronts on a major thoroughfare. The R-3 property to the north is 202 foot away from the subject property and is separated by East Palm Canyon Drive which is State Highway 111. The nearest automobile service stations are located at Smoke Tree Shopping Center, two miles to the west and at Gene Autry Trail and Ramon Road, one mile to the north. The area is under served and a fueling /#7#4 �� station would be an added convenience to the neighborhood. Staff recommends limited hours of 6am-11 pm coupled with no retail sales to reduce operational impacts to existing residential properties. Accessory retail sales will be available at Vons Market therefore eliminating the need for on site retail. Staff has conditioned the project to include no retail sales within the kiosk unit negating the need for a structure 1,000 square feet in size. The project does not include any service bays, automotive repair, convenience mart, or the sale of beer and wine. The variance request shall not constitute a grant of special privilege contrary with limitations placed upon other properties in the vicinity and zone of the project. The request to reduce the scope of development by reducing the size of the kiosk building eliminates any special privileges. The proposed project complies with all requirements of the C-D-N zoning and staff has determined that there will be no detrimental effects to public health, safety, convenience or welfare or injurious to property or improvements in the same vicinity and zone. The variance request is specifically being submitted to reduce the size of the kiosk unit below the City's required minimum of 750 square feet and to reduce the 175 foot minimum setback to residentially zoned property. The proposed project, complies with all requirements of the C-D-N zoning. Therefore, the City's General Flan will not be adversely affected by the granting of the variance. The proposed site plan depicts vehicular access at the south side of the project area, near the shopping center entry drive off of Gene Autry Trail, and on the east side of the project site adjacent to the center parking lot. Approximately 30' of clear area has been provided between each fueling dispenser(and the kiosk, as applicable), which provides adequate room for parking of vehicles at the dispensers and vehicular maneuvering. Forty-five feet of stacking distance from the site entrance to the dispensers has been provided to ensure that the entry to the site does not become congested. Lastly, the applicant has also provided a site plan demonstrating that the site design provides sufficient area for fuel truck maneuvering. Therefore, on-site circulation needs appear to have been adequately addressed within the proposed site plan. No existing shopping center parking will be eliminated by the proposed project. Staff has evaluated the existing shopping center parking and has determined that the center currently meets parking requirements according to zoning ordinance requirements. Architectural modifications recommended by the staff including the utilization of matching materials between the kiosk and canopy structures and matching of the canopy column colors with the columns in the existing shopping center. These have been included in the proposed conditions of approval in Exhibit A, attached. The project incorporates landscaping along the perimeter of the site to soften the project. A block wall will screen vehicles from view from the public right of way. ENVIRONMENTAL ANALYSIS AND NOTIFICATION: This project is categorically exempt frorn the California Environmental Quality Act pursuant to Section 15332 (Infill Development Projects). All property owners within four hundred (400) feet of the subject site have been notified. As of the writing of this report, staff has not received any correspondence from adjacent property owners. Any agreements, easements or covenants required to be entered into shall be in a form approved by the City Attorney. PLANNING: 1. The proposed development of the premises shall conform to all applicable regulations of the Palm Springs Zoning Ordinance, Municipal Code, or any other City Codes, ordinances and resolutions which supplement the zoning district regulations. 2. The owner shall defend, indemnify, and hold harmless the City of Palm Springs, its agents, officers, and employees from any claim, action, or proceeding against the City of Palm Springs or its agents, officers or employees to attach, set aside, void or annul, an approval of the City of Palm Springs, its legislative body, advisory agencies, or administrative officers concerning Case 5.0876 and the related General Plan Amendments. The City of Palm Springs will promptly notify the applicant of any such claim, action, or proceeding against the City of Palm Springs and the applicant will either undertake defense of the matter and pay the City's associated legal costs or will advance funds to pay for defense of the matter by the City Attorney. If the City of Palm Springs fails to promptly notify the applicant of any such claim, action or proceeding or fails to cooperate fully in the defense, the applicant shall not, thereafter, be responsible to defend, indemnify, or hold harmless the City of Palm Springs. The Conditional Use Permit, Variance, and Architectural approval shall be valid for a period of two (2) years. The use and all improvements must be fully operational within two (2) years from date of approval. Extensions of time may be granted by the Planning Commission upon demonstration of good cause. 4. The appeal period for a Conditional Use Permit application is 15 calendar days from the date of project approval. Permits will not be issued until the appeal period has concluded. 5. Final landscaping, irrigation, exterior lighting, and fencing plans shall be submitted for /�1* S approval by the Department of Planning and Building prior to issuance of a building permit. Landscape plans shall be approved by the Riverside County Agricultural Commissioner's Office prior to submittal. Additional screening shall be provided to buffer the fuel center use from residentially zoned lands to the north and west. 6. The project is subject to the City of Palm Springs Water Efficient Landscape Ordinance. The applicant shall submit an application for Final Landscape Document Package to the Director of Planning and Building for review and approval prior to the issuance of a building permit. Refer to Chapter 8.60 of the Municipal Code for specific requirements. 7. The grading plan shall show the disposition of all cut and fill materials. Limits of site disturbance shall be shown and all disturbed areas shall be fully restored or landscaped. 8. Drainage swales shall be provided adjacent to all curbs and sidewalks - 3' wide and 6" deep. The irrigation system shall be field tested prior to final approval of the project. Section 14.24.020 of the Municipal Code prohibits nuisance water from entering the public streets, roadways or gutters. 9. All proposed trees within the public right-of-way and within 10 feet of the public sidewalk and/or curb shall have City approved deep root barriers installed per City of Palm Springs Engineering specifications. 10. Prior to issuance of a building permit, the applicant must provide a standard avigation easement and non-suit covenant in a form prescribed and approved by the City Attorney, with reference to present and future owners of the parcel. 11. Separate architectural approval and permits shall be required for all signs. A detailed sign program shall be submitted for review and approval by the Planning Commission prior to issuance of building permits. 12. Canopy mounted mechanical equipment shall be prohibited. 13. No exterior downspouts shall be permitted on any facade on the proposed building(s) which are visible from adjacent streets or residential and commercial areas. 14. Perimeter walls shall be designed, installed and maintained in compliance with the corner cutback requirements as required in Section 9302.00.D. 15. The design, height, texture and color of building(s), fences and walls shall be submitted for,review and approval prior to issuance of building permits. 16. The street address numbering/lettering shall not exceed twelve inches in height. 17. An exterior lighting plan in accordance with the lighting ordinance in effect at the time shall be submitted for review and approval by the Director of Planning & Building prior to the issuance of building permits. A photometric study and manufacturer's cut sheets of all exterior lighting on the building, in the landscaping, and in the parking lot shall be submitted for approval prior to issuance of a building permit. If lights are proposed to be mounted on buildings, down-lights shall be utilized. All lights shall be fully shielded or recessed into the canopy whereby light sources are not visible from off-site. Between the hours of 11 pm and 6am, fueling station lighting shall be reduced to the minimum necessary for on-site security. The applicant shall provide an existing parking area lighting photometric analysis. Said survey shall extend a minimum of 100' of coverage adjacent to the subject property or to include sufficient area to fully evaluate existing parking lot lighting conditions. 18. Submit plans meeting City standard for approval of the proposed trash and recyclable materials enclosures prior to issuance of a building permit. 19. The exterior ladder depicted at the kiosk building shall be moved inside the building or eliminated. 20. Utilize matching materials between the kiosk and canopy structures and matching of the canopy column colors to the columns in the existing shopping center. 21. The on-site restroom, or an on-site restroom, must be made available to the public. 22. Compressed water and air must be provided on site. 23. The hours of operation shall be from 6am to 11 pm, seven days per week. An on-site attendant shall be required during all times when fuel is offered for sale. 24. The project shall comply the City's Noise Ordinance, Chapter 11.75 of the Palm Springs Municipal Code. No music or other recorded audio communication shall be allowed due to proximity to residentially zoned land. 25. The fueling station shall be wholly owned and operated by Vons or successor and shall not be sold or leased. This ownership requirement shall be recorded as a covenant against the lands, the Vons Supermarket parcel, and the fueling station parcel. Said covenant shall be in a form approved by the Director of Planning and Building and the City Attorney. Said covenant shall be recorded prior to issuance of a grading permit. City Attorney costs for review of said covenant shall be paid by the applicant. 26. If the Vons Gas facility is for any reason not owned and operated per condition of approval No. 25, the Gas facility shall be removed including all tanks and other underground facilities. The site shall be fully restored, including full site landscape and irrigation, and shall be maintained in first class condition. 27. The planting island in the southeast corner of the site shall be re-configured to provide a taper transition which aligns with the first parking island located to the east. BUILDING DEPARTMENT: 1. Prior to any construction on-site, all appropriate permits must be secured. ENGINEERING: STREETS 1. Any improvements within the street right-of-way require a City of Palm Springs 74 3D Encroachment Permit. Work shall be allowed according to Resolution 17950 - Restricting Street Work on Major and Secondary Thoroughfares. PALM CANYON DRIVE EAST (HWY 111) 2. All broken or off grade CURB, GUTTER, AC PAVEMENT AND SIDEWALK shall be repaired or replaced. MATTHEW DRIVE 3. All broken or off grade CURB, GUTTER, AC PAVEMENT AND SIDEWALK shall be repaired or replaced. SANITARY SEWER 4. Connect all sanitary facilities to the City sewer system. Lateral shall not be connected at manhole. GRADING 5. A copy of a Title Report prepared/updated within the past 3 months and copies of record documents shall be submitted to the City Engineer with the first submittal of the Grading Plan. 6. Submit a Grading Plan prepared by a Registered Professional to the Engineering Department for plan check. Grading plan shall be submitted to the Planning Department for comments prior to submittal to the Engineering Department. The PM 10 (dust control) Plan shall be submitted to and approved by the Building Division prior to approval of the grading plan. The Grading Plan shall be approved by the City Engineer prior to issuance of any grading or building permits. Minimum submittal includes the following: A. Copy of Planning Department comments regarding the grading plan. B. Copy of signed Conditions of Approval from Planning Department. C. Copy of Site Plan stamped approval and signed by the Planning Department. D. Copy of Title Report prepared/updated within past 3 months. E. Copy of Soils Report, IF required by these conditions. 7. A soils report prepared by a licensed Soils Engineer shall be required for and incorporated as an integral part of the grading plan for the proposed site. A copy of the soils report shall be submitted to the Building Department and to the Engineering Department along with plans, calculations and other information subject to approval by the City Engineer prior to the issuance of the grading permit. 10. Contact the Building Department to get information and guidelines regarding the preparation of the PM10 (dust control) Plan requirements. 11. In cooperation with the Riverside County Agricultural Commissioner and the California Department of Food and Agriculture Red Imported Fire Ant Project, applicants for grading permits involving an engineered grading plan and the export of native soil from the site will be required to present a clearance document from a Department of Food and Agriculture representative in the form of an approved "Notification of Intent To Move Soil From or Within Quarantined Areas of Orange, Riverside, and Los Angeles Counties" (RIFA Form CA-1) or a verbal release from that office prior to the issuance of the City grading permit. The California Department of Food and Agriculture office is located at 73-710 Fred Waring Drive, Palm Desert. (Phone: 760-776-8208). DRAINAGE 12. The developer shall accept all flows impinging upon his land and conduct these flows to an approved drainage structure. On-site retention/detention or other measures approved by the City Engineer shall be required if off-site facilities are determined to be unable to handle the increased flows generated by the development of the site. Provide calculations to determine if the developed Q exceeds the capacity of the approved drainage carriers. 13. The developer shall coordinated with Riverside County Flood Control & Water Conservation District (RCFC) relative to the design and construction of Line 41 and any effects this project has on said Line 41. The comments from RCFC shall be given to the City Engineer and shall be incorporated, as necessary, into the final development plans. ON-SITE 14. The minimum pavement section for all on-site streets/parking areas shall be 2-1/2 inch asphalt concrete pavement over 4-inch aggregate base with a minimum subgrade of 24 inches at 95% relative compaction, OR equal. The pavement section shall be designed, using "R" values, determined by a licensed Soils Engineer and submitted with the Fine Grading Plan to the City Engineer for approval. 15. The on-site parking lot shall be constructed in accordance with City of Palm Springs Zoning Ordinance, Section 9306.00. 16. A reciprocal access agreement shall be entered into an/or a copy of the existing agreement shall be provided to the City Engineer prior to issuance of a grading permit. GENERAL 17. All proposed utility lines on/or adjacent to this project shall be undergrounded prior to 7* ;7L issuance of a Certificate of Occupancy. 18. In the nearly quarter century we have enjoyed the Canyon Sands area we have done just fine without another gas station to further blight the beautiful desert scenery. And there are gas stations for our needs within a mile or so east of this already croweded intersection. Even with the recent street improvements the traffic still tends to jam up along the southern perimeter of Canyon Sands and the gass station would just add to that congestion. Page 8 of 14 Planning Commission Minutes • February 27, 2002 Director outlined the application and reviewed subject area on maps. He reviewed the application's zoning clarification requests and stated that the owners of Smoke Tree Ranch would like the opportunity to consider other uses for the property than hotel. He stated that staff has received comments from the public opposing the building height limit of 60 feet. He explained the entitlement issues regarding Palm Springs Mall and the property to the east and the shopping center at Sunrise Way and Vista Chino; noting that, if those shopping centers would like to apply for the same uses, they would have the right to apply through a Public Hearing process. He explained that Community Shopping Center zoning allows for larger development (from approximately 15 to 60 acres) with larger lot sizes and a broader range of use as opposed to a Neighborhood Shopping Centerwhich has a maximum size of approximately 15 acres. He clarified that Section 92.11.04 Performance Standards of the Zoning Ordinance text would be amended to include electric vehicles as well as more traditional transportation systems and that Section 94.02.00 Conditional Use Permit 6.Shopping Centers would be clarified and also allow City Council to require posting of performance bonds. He explained that, under the current Ordinance, the applicant is required to build half of the project before the zoning amendment can be applied for which makes financing issues difficult. He explained that, underthe current Ordinance, a hotel 60 feet in height could be proposed and that the subject application is for clarification purposes. He also stated that, under the current Ordinance,the Palm Springs Mall or the Stater Bros. Mall could not make that application. Commissioner Caffery asked staff to determine whether or not he has a conflict of interest. Staff . determined there is no conflict of interest for Commissioner Caffery. Director reported that the City has held one meeting with primary leasehold interests and have incorporated comments from that meeting into the proposed General Plan text in order to create the opportunity for mixed use development(Le. not purely shopping)in orderto augment the village feel of the existing center. He confirmed that the application includes the restriction that only one supermarket is allowed and noted that the subject site is in the same General Plan area as projects such as Palm Hills and El Mirador. Chairman Klatchko explained that the Planning Commission will take no action today and opened the Public Hearing. Mr. Walter Vogel addressed the Planning Commission to state that Mr. Graham Barbey recently told him that there would be no supermarket on the eastern parcel of the development and he asked that it be required that the existing supermarket is the only supermarket allowed at the center. Mr.Scott Cale, representing the Garden Villa Condominiums,addressed the Planning Commission to state that he represents 40 homeowners who oppose this application. He stated that there are questions as to the specific site under consideration, the possibility of Murray Road being developed through to Barona Road, and whether or not a Traffic Study has been done. He stated that he was alarmed by the No Impact statement from the Environmental Assessment as he felt that any new project would have an impact on the neighborhood. He stated that a building 60 feet in height would definitely impact the views of many neighbors and that noise would be an issue as well. He stated that this is ofie of the last open fields in Palm Springs and that developing it would • be environmentally significant. Page 9 of 14 Planning Commission Minutes . February 27, 2002 Mr. Paul Depalatis,Smoke Tree Ranch Planning Consultant, addressed the Planning Commission to state that Smoke Tree Ranch owners have worked with the City to craft proposed language which would be in the City's interest by creating an asset of this property and giving it ambiance. He clarified that, under the current General Plan, many uses are allowed at the subject site and the proposal is basically just for a different combination of uses. He stated that under the current zoning, a hotel use could propose a building of 60 feet in height. He reported that Smoke Tree Ranch is willing to work with the City on this height limit if the Planning Commission requests. Mr. Michael James Landry, President of the Diplomat Homeowners' Association, addressed the Planning Commission to state that residents of the 48 units at the Diplomat received no Public Hearing Notice. He stated that residents are opposed to a 60 foot tall hotel and its impact on the environment. There being no further appearances, the Public Hearing was continued to the meeting of March 27, 2002. Director reported that the extension of Murray Road is on the City's General Plan but that Smoke Tree Ranch is strongly opposed to the road going through their property. Commissioner Matthews commented that it is frequent for the Planning Commission to hear from neighborhood groups who have concerns regarding applications which are entitled by-right-of-zone. He stated that it is possible that the neighborhood groups do not have enough information at this time and that Smoke Tree Ranch has a good history of being a fine neighbor and place of business.
