ZONE, SECTION 25.
RECOMMENDATION:
The Planning Commission recommends that the City Council approve Tentative Parcel Map
30292 forthe development of a 104-unit apartment project on a vacant 4.97 net acre parcel
located at the southeast corner of East Palm Canyon Drive and Araby Drive, Section 25.
The applicant and owners are Friend Development - Palm Springs, LLC, and the officers
are Mr. Wyn Holmes and Mr. Randall Friend.
SUMMARY:
On April 10, 2002, the Planning Commission voted to recommend that the City Council
approve the project. At the public hearing testimony was provide regarding the proposed
density of the apartment project, traffic, pedestrian considerations, and the lack of
recreation facilities in the vicinity. A letter delivered to the Planning Commission at the
hearing has been attached for your review. The Planning Commission approved the
recommended conditions, with no additions, deletions or revisions.
BACKGROUND:
This case is related to Case No. 5.0843-CUP, a 104 unit apartment complex, which was
approved by the City Council on February 14, 2001. To satisfy a condition of approval of
Case No. 5.0843-CUP, the applicant has applied for approval of this map. The Tentative
Parcel Map would allow the consolidation of 43 lots into a single parcel, 4.97 acres in area.
The parcel measures approximately 200 feet wide by 1000 feet in length. The site parallels
the south side of East Palm Canyon Drive, east of Araby Drive. The site is currently divided
into 43 parcels, which range in size from approximately 0.05 to 1.9 acres in size. The
existing subdivision is consistent with an earlier subdivision for condominiums.

RECOMMENDATION:
That the Planning Commission recommend approval to the City Council of Tentative Parcel
Map 30292 for the development of a 104-unit apartment project on a vacant 4.97 net acre
parcel located at the southeast corner of East Palm Canyon Drive and Araby Drive, Section
25. The applicant and owners are Friend Development - Palm Springs, LLC, and the
officers are Mr. Wyn Holmes and Mr. Randall Friend.
BACKGROUND:
This case is related to Case No. 5.0843-CUP, a 104 unit apartment complex, which was
approved by the City Council on February 14, 2001. To satisfy a condition of approval for
the project, the applicant has applied for approval of this map. Friend Development-Palm
Springs, LLC has submitted a Tentative Parcel Map requesting consideration of the
consolidation of 43 lots into a single: parcel, approximately 4.97 acres in area. The parcel
measures approximately 200 feet wide by 1000 feet in length, and parallels the south side
of East Palm Canyon Drive, east of Araby Drive. The site is currently divided into 43
parcels, which range in size from approximately 0.05 to 1.9 acres in size. The parcels are
consistent with an earlier subdivision for condominiums.
Pursuant to Section 92.04.00 of the Zoning Ordinance,the proposed map complies with the
development standards established for the the R-3 Zone (Multiple Family Residential and
Hotel Zone), including minimum width (170 feet), depth (190 feet)and area (20,000 square
feet)
The parcel is located at the southeast corner of East Palm Canyon Drive and Araby Drive
and is bound by East Palm Canyon Drive on the north, Araby Drive on the west, Palapas
Nursery on the east, and single-story, multi-family residences on the south. The site is
relatively flat with native vegetation scattered across the property and no overhead utilities.
The strip of land between East Palm Canyon Drive and the 24-foot wide access road to
Palapas Nursery slopes down from north to south, with the street grade being
approximately seven feet higher than the proposed finished floor near the east end of the
property.

LAND USE AND ZONING:
Project site: Vacant - R-3 (Multiple-family Residential and Hotel Zone)
North: Multi-family residential (across East Palm Canyon) - R-3
South: Multi-family residential,(single story) - R-3
East: Palapas Nursery (single story) - R-3
West: Vacant (across Araby Drive) - R
GENERAL PLAN ANALYSIS:
The proposed map is located on a site which is designated H-43/R-21 (High Density
Residential) on the City of Palm Springs General Plan Land Use Map. The objective of the
H-43/R-21 General Plan Designation (providing for the development of a threshold of 15
and a maximum of 21 dwelling units per acre) is to allow for multi-family apartments and
similar permanent housing. The proposed map would allow for the development of 104
apartment units on a 4.97 net acre .site (20.92 units per acre) fits within the range of uses
allowed within the High Density Residential General Plan category. The proposed map is
consistent with General Plan Objective 3.8 and Policies 3.8.1 and 3.8.3.
ZONING ANALYSIS:
The project site is zoned R-3, Multiple-Family Residential and Hotel Zone. The R-3 zoning
designation is intended to provide for the development of high density apartments, hotels
and similar permanent and resort housing and certain limited commercial uses directly
related to the housing facilities. he proposed use fits within the range of uses allowed within
the R-3 zone. Pursuant to Zoning Code Section 92.25.00, multi-family dwellings are
permitted in the Resort Overlay Zone only by Conditional Use Permit, which was previously
approved by the Planning Commission, based upon the findings that the proposed use is
compatible with its surroundings and that the site in question was not appropriate for other
uses allowed by right within the underlying zone. The purpose of the Resort Overlay Zone
is to ensure adequate opportunities for tourism. The subject property is irregular in shape
and was not likely to be developed as a hotel or other similar use in the future.
CONDITIONS:
Three new Engineering Conditions are included,which include a bike way easement(#16),
a reciprocal assess agreement (# 17) and property conveyance to 1842 Araby Dr. (#18).
ENVIRONMENTAL ANALYSIS:
The proposed map is consistent with the applicable general plan and zoning designations,
the location is an in-fill development, the location is substantially surrounded by urban
development, the project is located on a site with no value for habitat for endangered, rare
of threatened species, the project is located on a site that can be adequately served by all
required utilities and public services and approval of the project will not result in any
significant effects relating to traffic, air quality or water quality. Therefore. the project is
Categorically Exempt from further environmental review under state law, CEQA Section
15332 (In-fill Project).

Note Resolution# 19992 & Conditional Use Permit # 5.0843 of Feb 14/01
I am a Homeowner located near this potential development, was not represented at last
years hearings resulting in Resolution 19992, but am now aware of this consolidation hearing.
I oppose the creation of a single parcel of 5.27 acres, from the 43 existing parcels, for the
following reasons:
1. I am told that:
a.) the developer of Park South owned the land upon which Park South was built,
and also the adjoining and contiguous land which is the subject matter of this
hearing;
b.) Park South was originally developed as Phase I and sold as a holiday
condominium with relatively low density; [The neighboring developments of
Villa Alegria, Co Co Cabana, Garden Villa East and Garden Villa West were
developed under the same concept and understandings.]
c.) the Park South developer created 30 parcels upon which the Park South Phase
I project was developed and sold; and
d.) Park South Units were sold and resold knowing that the adjoining contiguous
43 lots to the North that are today the subject matter of your hearing were
intended and described to be Phase II of this relatively low density project.
THUS the de facto zoning, as evidenced by the lots in existence and what could be built
upon them, at the time those lots were created and continuing up to this date, envisaged 43
homeowner owned units upon the land in question. [The current project is for 104 rental units.]
The fact that Phase II has not been built to this date, should not allow an automatic rejection of
that de facto zoning, and the reliance placed upon it by Park South and neighboring purchasers.

To treat this application as a mere "rubber stamping and run of the mill' consolidation
application, when the effect is to more than double density, is to ignore a long standing situation
beneficial to the neighborhood without proper consideration of their rights or desires.
In other words existing higher density zoning should not be available to the vendor of this
land, or to the new developer, because people to this date have relied upon lots already in place
that would mandate lower density, and effectively an ownership rather than a rental
development. If consolidation is to be effected, neighbors should have been made aware that this
was not a "mere technical' hearing as it appears to many to be, but a substantive hearing to
change pre approved land usage with all that might imply.
In addition, in these circumstances the following points should be given even more
weight than in normal circumstances.
2. The traffic study is critical to this proposed development. The intersection of Araby with
I I I is already potentially dangerous and has had a number of high speed accidents. The writer is
not sure why this should be, but the intersection does transept a high banked curve that appears
to create a number of problems for drivers.
Had Phase II of Park South been built one presumes entry would have been at the
existing Park South North entrance, well to the South of 111. [Indeed, may I ask why the original
plan is not still viable and the best possible option for this land? And if the answer is that the land
is worth more with this consolidation of these lots, then we know what we are really arguing
over, namely the benefit of the existing owner in the face of past implied or outright promises to
the City and neighbors?]
However with this new proposed development the existing low volume access road to the
existing nursery to the east of the existing property will in essence be used to serve an additional
104 housing units. This access already on occasion causes a problem. With two cars stacked to
turn left into this access, a car turning left off of 111 may well get caught in the I I I intersection
causing more dangerous events. This access is just to close to 111. It is also the wrong elevation
for a higher traffic access to 111.
3. The Araby intersection with 111 also causes problems with pedestrians, and particularly
children. The light is long and the temptation is to jaywalk. From the south side jaywalkers can
not properly assess the coming traffic. And even crossing 111 with the light, in the sole
crosswalk on the West side of Araby, requires some quickness and close attention. And for the
unsuspecting to try and cross on the green (without getting a walk light) is to ensure being
trapped on the highway. Of course life is not without risk, but in this instance why change the
socio-economic structure that currently exists on Araby (that is holiday condos and single family
residents "all' with cars) just for the sake of doing it and thus putting people and children at
greater risk? And of course you will have to create a crosswalk across Araby that currently does
not exist, further complicating the situation.
4. And of course there is no schooling South of Araby and thus children will be crossing to
the north.

5. And no recreation South of Araby so children will be crossing to the north.
6. This hearing should again consider Traffic Studies, Social Economic Studies, Educational
Needs Studies, Recreational Needs Studies, and other information before changing the structure
of the existing neighborhood and Lands effectively dedicated by the existing lots to ensure the
current quality of life in our neighborhood. This change can be avoided by refusing this
consolidation application.
7. One assumes that because this developer is attempting to infill no Environmental Study
was done. The writer is of the impression that the Wash to the East continues to fill up with sand
and it is possible the site of this application may becoming a potential "flood plane"? And of
smaller consequence, but still important, in a rain the South East corner of Araby and I I fills
with water in a rain.
8. Earlier documents in this matter show a site size of between 4.5, 5.12 and 5.27 acres. If
4.5 acres the development appears to be over density in any event. How this "growth" occurred
is not known to this applicant.
9. In summary this consolidation unjustly prejudices the neighbors, the community, The
City of Palm Springs, and future rental residents of the proposed project. And it unjustly benefits
the Vendor of the land and the Developer by allowing what was never intended for this site as
evidenced by its history and existing lot structure.

NOTICE IS HEREBY GIVEN that the Planning Commission of the City of Palm Springs, California,
will hold a public hearing at its meeting of April 10,2002.The Planning Commission meeting begins
at 1:30 p.m. (Public Hearings begin at 2:00 pm) in the City Council Chamber at City Hall, 3200 E.
Tahquitz Canyon Way, Palm Springs, California.
The purpose of the hearing is to consider an application for a tentative parcel map.

The proposed project is the creation of a single 5.27 acre parcel from 43 existing parcels, for use
as a 104 unit multi-family apartment complex.
The site is substantially surrounded by urban development and all utility services are available
adjacentto the site. Pursuantto Section 15332 of the California Environmental Quality Act(CEQA),
the project is categorized an "in-fill development", and is therefore Categorically Exempt from
further environmental review under state law (Section 32 In-Fill Development).
The proposed map, Initial Study and related documents are available for public review daily,
between 8 am and 5 pm at the City of Palm Springs in the Planning and Building Department,
located at 3200 Tahquitz Canyon Way.
If any individual or group challenges the action in court, issues raised may be limited to only those
issues raised at the public hearings described in this notice or in written correspondence at or prior
to the Commission meeting.
Notice of Public Hearing is being sent to all property owners within four hundred (400)feet of the
subject property.An opportunity will be given at said hearings for all interested persons to be heard.

The creation of a single 4.97 acre parcel from 43 existing parcels, for use as a 104
unit multi-family apartment complex, located on the southeast corner of the intersection
of East Palm Canyon Drive and Araby Drive, Zone: R-3, Section 25.
NOTICE IS HEREBY GIVEN that the City Council of the City of Palm Springs, California,will hold
a public hearing at its meeting of May 15, 2002. The City Council meeting begins at 7:00 p.m_ in
the City Council Chamber at City Hall, 3200 E. Tahquitz Canyon Way, Palm Springs, California.
The purpose of the hearing is to consider an application for a tentative parcel map. The proposed
project is the creation of a single 4.97 acre parcel from 43 existing parcels, for use as a 104 unit
multi-family apartment complex.
The site is substantially surrounded by urban development and all utility services are available
adjacent to the site. Pursuant to Section 15332 of the California Environmental Quality Act(CEQA),
the project is categorized an "in-fill development' and minor land division, and is therefore
Categorically Exempt from further environmental review under state law (Section 32 In-Fill
Development).
The proposed map and related documents are available for public review daily, between 8 am and
5 pm atthe City of Palm Springs in the Planning and Building Department, located at 3200 Tahquitz
Canyon Way.
If any individual or group challenges the action in court, issues raised may be limited to only those
issues raised at the public hearings described in this notice or in written correspondence at or prior
to the Council meeting.
Notice of Public Hearing is being sent to all property owners withing four hundred (400)feet of the
subject property. An opportunity will be given_ at said hearings for all interested persons to be

[RESOLUTION NO.
OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA,
APPROVING TENTATIVE PARCEL MAP 30292, AN APPLICATION BY
FRIEND DEVELOPMENT PALM SPRINGS LLC FOR A TENTATIVE
PARCEL MAP FOR THE CONSOLIDATION OF 43 PARCELS INTO ONE
VACANT 4.97 NET ACRE PARCEL, FOR FUTURE DEVELOPMENT OF
A 104-UNIT APARTMENT PROJECT, LOCATED AT THE SOUTHEAST
CORNER OF EAST PALM CANYON DRIVE AND ARABY DRIVE, R-3
ZONE, SECTION 25.
WHEREAS, Friend Development Palm Springs LLC (the "Applicant") has filed an
application with the City pursuant to Sections 9.60 of the Palm Springs Municipal Code for
a tentative parcel map to allow for the development of a two-story, 104-unit apartment
project on a 4.97 net acre parcel located at the southeast corner of East Palm Canyon
Drive and Araby Drive, R-3 Zone, Section 25; and
WHEREAS, the applicant has applied for approval of this map to satisfy a condition of
approval for a related case (Case 5.0843-CUP), which was approved, on appeal, by the
City Council on February 14, 2001; and
WHEREAS, a notice of a public hearing of the Planning Commission of the City of Palm
Springs to consider Applicant's application for Tentative Parcel Map 30292 was given in
accordance with applicable law; and
WHEREAS,the proposed Tentative Parcel Map is categorically exempt from the provisions
of the California Environmental Quality Act (CEQA) pursuant to Section 15332 (In-fill
Development Projects); and
WHEREAS, on April 10,2002,the Planning Commission reviewed and considered all of the
evidence presented in connection with the hearing on the project and the Planning
Commission has carefully reviewed and considered all of the evidence presented in
connection with the hearing on the project, including but not limited to the staff report and
all written and oral testimony presented;
WHEREAS, the Planning Commission voted to recommend that the City Council approve
said project;
WHEREAS, a notice of a public hearing of the City Council of the City of Palm Springs to
consider Applicant's application for Tentative Parcel Map 30292 was given in accordance
with applicable law; and
WHEREAS, on May 15, 2002, the City Council reviewed and considered all of the evidence
presented in connection with the hearing on the project and the Planning Commission has
carefully reviewed and considered all of the evidence presented in connection with the
hearing on the project, including but not limited to the staff report and all written and oral
testimony presented.

THE CITY COUNCIL HEREBY FINDS AS FOLLOWS:
Section 1: Pursuant to CEQA, the City Council finds-as follows:
This Conditional Use Permit is categorically exempt from environmental
assessment pursuant to Section 15332 of the California Environmental
Quality Act (CEQA) in that Section 15332 states that in-fill development
projects are exempt from CEQA; and
Section 2: Pursuant to Government Code Section 66473.5, the City Council finds that
the proposed subdivision and the provisions for its design and improvement
are compatible with the objectives, policies and general plan uses and
programs provided in the City's General Plan, including General Plan
Objective 8.8 and Policies 3.8.1 and 3.8.3; and
Section 3: Pursuant to Government Code Section 65567,the City Council finds that the
proposed subdivision and the provisions for its design and improvements
are compatible with the objectives, policies and general land use provided
in the City's local open space plan; and
Section 4: Pursuant to Government Code Section 65474, the City Council finds that,
with the incorporation of these conditions attached in Exhibit A:
a. The proposed map is consistent with the General Plan.
The subject property is designated as H-43/21 (High Density Residential) on the
City's General Plan Land Use Map and R-3 (Multiple-family Residential and Hotel
Zone) pursuant to the Zoning Map. The objective of the H-43/21 General Plan
Designation (providing for the development of a threshold of 15 and a maximum of
21 dwelling units per acre) is to allow for multi-family apartments and similar
permanent housing. The proposed subdivision for future development of 104
apartment units on a 4.97 net acre site (20.92 units per acre) fits within the range
of uses allowed within the High Density Residential General Plan category. The
proposed map for the future development of 104 apartment units is therefore in
harmony with the various elements and objectives of the City of Palm Springs
General Plan and is not detrimental to existing uses specifically permitted in the
zone in which the proposed use is to be located.
b. The design or improvements of the proposed subdivision is consistent with the
General Plan.
The subject site is zoned R-3 (Multiple-family Residential and Hotel Zone) and
designated H-43121 (High Density Residential) pursuant to the City's General Plan
Land Use Map. The proposed map is compatible with the General Plan and
existing land uses to the south, north (across East Palm Canyon Drive) and east,
as well as future uses of vacant land to the west (across Araby Drive), which could
be developed with a variety of high density residential uses pursuant to the City's
General Plan and Zoning Ordinance.

c. The site is physically suitable for the type of development contemplated by the
proposed subdivision.
The subdivision map and the associated conditions of approval will create an
appropriate improvement in compliance with the applicable criterial in the R-3 zone.
The project has been designed to comply with all performance and development
standards of the R-3 Zone of the Zoning Ordinance. The site is relatively flat with
native vegetation scattered across the property and no overhead utilities, and will
be accessed via Araby Drive. Thus, the project should be compatible with the
surrounding neighborhood.
d. The site is physically suitable for the type of development contemplated by the
proposed map.
The proposed subdivision is within an R-3 zoning classification and designated
H43/R21 by the Palm Springs General Plan The proposed subdivision will create
parcels similar in size to those in the area and zone. The proposed map has been
designed to comply with all performance and development standards of the R-3
Zone of the Zoning Ordinance. The site is relatively flat with native vegetation
scattered across the property and no overhead utilities, and will be accessed via
Araby Drive. Thus, the project should be compatible with the surrounding
neighborhood.
e. The design of the subdivision or improvements is not likely to cause substantial
environmental damage or substantially and unavoidably injure fish, or wildlife or
habitat.
A Categorical Exemption, pursuant to the standards of Section 15332 of the
California Environmental Quality Act (CEQA), is applicable to this project.
f.The design of the subdivision or improvements is not likely to cause serious public
health problems.
The proposed subdivision map and improvements have been designed to minimize
potential safety issues by positioning driveways and internal traffic flows perthe City
of Palm Springs traffic standards and Fire Department Standards. The subdivision
is consistent with lot size patterns in the area.
g. The design of the subdivision or the type of improvements will not conflict with
easements, acquired by the public at large, for access through or use of the
property within the proposed subdivision.
The proposed map will not conflict with the existing traffic flow adjacent to the
property or with access to utilities required to serve the subdivision and the
immediate area.
NOW, THEREFORE, BE IT RESOLVED that based upon the foregoing, the City Council
approves Tentative Parcel Map 30292, subject to the conditions set forth in Exhibit A on file
in the Department of Planning and Building, which are to be satisfied prior to issuance of
a Certificate of Occupancy unless otherwise specified.

CONDITIONS OF APPROVAL
Before final acceptance of the project, all conditions listed below shall be completed to the
satisfaction of the City Engineer, the Director of Planning, the Chief of Police, the Fire Chief
or their designee, depending on which department recommended the condition.
Any agreements, easements or covenants required to be entered into shall be in a form
approved by the City Attorney.
PLANNING:
1. The proposed development of the premises shall conform to all applicable regulations
of the Palm Springs Zoning Ordinance, Municipal Code, or any other City Codes,
ordinances and resolutions which supplement the zoning district regulations.
2. The owner shall defend, indemnify, and hold harmless the City of Palm Springs, its
agents,officers,and employees from any claim,action,or proceeding against the City
of Palm Springs or its agents,officers or employees to attach,set aside,void or annul,
an approval of the City of Palm Springs, its legislative body, advisory agencies, or
administrative officers concerning TPM 30292. The City of Palm Springs will promptly
notify the applicant of any such claim, action, or proceeding against the City of Palm
Springs and the applicant will either undertake defense of the matter and pay the
City's associated legal costs or will advance funds to pay for defense of the matter by
the City Attorney. If the City of Palm Springs fails to promptly notify the applicant of
any such claim, action or proceeding or fails to cooperate fully in the defense, the
applicant shall not,thereafter, be responsible to defend, indemnify, or hold harmless
the City of Palm Springs. Notwithstanding the foregoing, the City retains the right to
settle or abandon the matter without the applicant's consent but should it do so, the
City shall waive the indemnification herein, except, the City's decision to settle or
abandon a matterfollowing an adverse judgement orfailure to appeal,shall not cause
a waiver of the indemnification rights herein. The applicant shall apply for a Final
Parcel Map be within two(2)years from the effective date of approval. Extensions of
time may be granted bythe Planning Commission upon demonstration of good cause.
3. The conditions of approval for Case 5.0843-CUP are incorporated and shall apply to
this case.

4. Pursuant to Fish and Game Code Section 711.4 a filing fee of $78.00 is required.
This project has a de minimus impact on fish and wildlife, and a Certificate of Fee
Exemption shall be completed by the City and two copies filed with the County Clerk.
This application shall not be: final until such fee is paid and the Certificate of Fee
Exemption is filed. Fee shall in the form of a money order or cashier's check payable
to Riverside County.
5. Prior to issuance of a grading permit, a Fugitive Dust and Erosion Control Plan shall
be submitted and approved by the Building Official. Refer to Chapter 8.50 of the
Municipal Code for specific requirements.
6. The grading plan shall show the disposition of all cut and fill materials. Limits of site
disturbance shall be shown and all disturbed areas shall be fully restored or
landscaped.
7. This project shall be subject to Chapters 2.24 and 3.37 of the Municipal Code
regarding public art.The project shall either provide public art or payment of an in lieu
fee. In the case of the in-lieu fee,the fee shall be based upon the total building permit
valuation as calculated pursuant to the valuation table in the Uniform Building Code,
the fee being 1/2% for commercial projects or 1/4%for residential projects with first
$100,000 of total building permit valuation for individual single-family units exempt.
Should the public art be located on the project site, said location shall be reviewed and
approved by the Director of Planning and Building and the Public Arts Commission,
and the property owner shall enter into a recorded agreement to maintain the art work
and protect the public rights of access and viewing.
8. A bus shelter shall be constructed along the East Palm Canyon Drive frontage in
conjunction with the bus bay turnout on East Palm Canyon Drive. The design of the
shelter shall be integrated architecturally with the architecture of the buildings, to the
satisfaction of the Director of Planning and Building. Contact Sun Line Transit Agency
for details regarding bus stop furniture/shelter requirements and maintenance
requirements.
POLICE DEPARTMENT:
9. Developer shall comply with Section 11 of Chapter 8.04 of the Palm Springs Municipal
Code.
FIRE DEPARTMENT:
10. Construction shall be in accordance with the1998 California Fire Code, 1998
California Building Code,City of Palm Springs Ordinance 1570, Desert Water Agency
requirements, NFPA 13, 14,24,70,72 and 760 plus UL/CSFM listings and approvals.
11. Approved numbers or addresses shall be plainly visible and legible from the street or
road fronting the property per 1998 California Building Code, Chapter 5, Section 502.
12. Fire Department Access Roads shall be provided and maintained in accordance with
the 1998 California Fire Code, Article 9, Section 902 and local ordinances.

BUILDING DEPARTMENT:
13, Prior to any construction on-;site, all appropriate permits must be secured.
ENGINEERING DEPARTMENT:
The Engineering Department recommends that if this application is approved, such approval
is subject to the following conditions being completed in compliance with City standards and
ordinances:
Before final acceptance of the project, all conditions listed below shall be completed to the
satisfaction of the City Engineer.
GENERAL
14. Dedicate additional right-of-way as required to allow construction of a bus shelter at
the bus turnout near the northwest corner of the project.
15. A 5 foot wide pedestrian access easement from Araby Drive through the project to
East Palm Canyon Drive(at the southeast corner of the project)shall be dedicated to
the City on the parcel map in a manner acceptable to the City Engineer.
16, A bikeway easement across the 30 foot wide private access road shall be dedicated
to the City on the parcel map.
17. The property owner shall enter into a reciprocal access agreement with the owner(s),
master lease and all sub-leases (if any) of the property located at 3255 East Palm
Canyon Drive (Assessor's Parcel No. 510-030-010) providing unrestricted access to
the property.
18. The developer shall create a parcel to convey or grant to the owner(s)of the property
located at 1842 Araby Drive(Parcel 28 of Record of Survey 32/47,Assessor's Parcel
No. 510-070-028) historically used as a portion of that property to the satisfaction of
the Planning Director and City Engineer. The parcel shall be shown on the Parcel
Map, and shall be conveyed or granted priorto issuance of a certificate of occupancy
for any development occurring within the Tentative Parcel Map.
MAP
19. The Title Report prepared for subdivision guarantee for the subject property, the
traverse closures for the existing parcel and all lots created therefrom, and copies of
record documents shall be submitted with the Parcel Map to the Engineering
Department.
20. The Parcel Map shall be prepared by a licensed Land Surveyor or qualified Civil
Engineer and submitted to the Engineering Department for review. Submittal shall be
made prior to issuance of grading or building permits.
21. The following improvements shall be listed in an Improvement Certificate on the
Parcel Map clearly noting that the following improvements will be the minimum
development requirements for Tentative Parcel Map 30292, but not required to be
completed until, and prior 1,o, issuance of a certificate of occupancy for any
development occurring within the Tentative Parcel Map:

EAST PALM CANYON DRIVE
22. Construct an 8 inch curb and gutter, 38 feet south of the existing construction
centerline along the entire frontage, with a 35 foot radius curb return at the
intersection of Araby Drive per City of Palm Springs Standard Drawing No. 200.
23. Construct a curb ramp meeting current California State Accessibility standards at the
SOUTHEAST corner of the intersection with Araby Drive per City of Palm Springs Std.
Dwg. Nos. 212 and 212A.
24. Construct a 160-foot long by 10-foot wide bus turn out on the EAST PALM CANYON
DRIVE frontage beginning at the ECR of the southeast corner of the intersection of
Araby Drive. The configuration shall be approved by the City Engineer in conjunction
with SunLine Transit. Contact SunLine Transit for details regarding bus stop
furniture/shelter requirements. Developer shall construct shelter inclusive of furniture
and lighting.
25. Remove and replace existing pavement with a minimum pavement section of 5 inch
asphalt concrete pavement over 4 inch aggregate base with a minimum subgrade of
24 inches at 95% relative compaction, OR equal, from edge of proposed gutter to
clean sawcut edge of existing pavement along the entire frontage in accordance with
City of Palm Springs Standard Drawing No. 110 and 340. The pavement section shall
be designed, using"R"values, by a licensed Soils Engineer and submitted to the City
Engineer for approval.
ARABY DRIVE
26. Construct a 6 inch curb and gutter, 20 feet EAST of centerline along the entire
frontage of the subject property, with a 35 foot radius curb return at BOTH SIDES of
the intersection with the ACCESS ROAD and at the intersection with East Palm
Canyon Drive per City of Palrn Springs Standard Drawing No. 200.
27. Construct the BOTH SIDES of an 8 foot cross gutter and spandrel at the intersection
of ARABY DRIVE and ACCESS ROAD with a flow line parallel to the centerline of
ARABY DRIVE in accordance with City of Palm Springs Standard Drawing No. 200
and 206.
28. Construct a minimum 5 foot wide sidewalk behind the curb along the entire frontage
in accordance with City of Palm Springs Standard Drawing No. 210.
29. Construct a curb ramp meeting current California State Accessibility standards on
BOTH SIDES of the intersection with the ACCESS ROAD per City of Palm Springs
Std. Dwg. Nos. 212 and 212A.
30. Remove and replace existing pavement with a minimum pavement section of 3 inch
asphalt concrete pavement over 6 inch aggregate base with a minimum subgrade of
24 inches at 95% relative compaction, OR equal, from edge of proposed gutter to
centerline along the entire frontage in accordance with City of Palm Springs Standard
Drawing No. 110 and 315.The pavement section shall be designed, using"R"values,
by a licensed Soils Engineer and submitted to the City Engineer for approval.

31. The developer shall provide a minimum of 48 inches of sidewalk clearance around all
street furniture, fire hydrants and other above-ground facilities for handicap
accessibility.The developer shall provide same through dedication of additional right-
of-way and widening of the sidewalk or shall be responsible for the relocation of all
existing traffic signal/safety light poles, conduit, pull boxes and all appurtenances
located on the PALM CANYON DRIVE EAST, ARABY DRIVE and ACCESS ROAD
frontages of the subject property.
32. The developer shall be responsible for the relocation and modification of the existing
traffic signal poles, conduit, pull boxes and all appurtenances located on the
SOUTHEAST corner of PALM CANYON DRIVE EAST and ARABY DRIVE in
accordance with the requirements of the City of Palm Springs.
