HomeMy WebLinkAbout6/5/2002 - STAFF REPORTS (19) DATE: June 5, 2002 TO City Council FROM: Director of the Downtown Development Center and Director of Community and Economic Development APPROVE LEASE AMENDMENT NO. 3 FOR PALM CANYON THEATRE AT FRANCES STEVENS PARK RECOMMENDATION: That City Council approve a Minute Order to amend the Lease Agreement with Palm Canyon Theatre, Inc. at 538 North Palm Canyon Drive in order to extend the term of the existing amended lease to April 30, 2007 and to approve a lease amendment in a form acceptable to the City Attorney. SUMMARY: In 1997, City Council approved a five year lease with Palm Canyon Theatre at 538 North Palm Canyon Drive in Frances Stevens Park. This lease commenced on May 1, 1997 with termination on April 30, 2002, and included a provision for one (1) Extension Option for five (5) years. On January 18, 2002 Palm Canyon Theatre, Inc. formally submitted a "notice of intent to exercise option to extend lease" to the Director of Community and Economic Development. If approved by City Council, this would extend the term of this lease to April 30, 2007 at a rental rate of$1,400 per month with annual CPI rental rate adjustments and interest charges for any late rent payments. This amended lease is to be formally reviewed each year by staff, and performance reports submitted to City Council prior to continuing with the next year's program for Palm Canyon Theatre at this location. Also, this tenant is responsible for correcting outstanding code related improvements as identified by the City's Building Official. Where possible, Palm Canyon Theatre is encouraged to include other local theater groups within the scheduling of the City's facility. BACKGROUND: The City's current lease with Palm Canyon Theatre, Inc. is a "charitable lease", since the tenant is a non-profit corporation. Therefore, the lease rate is permitted to be at a below market rate value. Currently, per its amended lease, the tenant exclusively occupies 10,755 square feet of building floor area at the monthly rental rate of$1,290. Over the past five years, the tenant has made over $300,000 in tenant improvements to this property, including $18,450 in improvements to common area facilities which are supposed to be the responsibility of the City . On June 17, 1998, City Council approved Lease Amendment No. 2 which credited the tenant's rent in this amount. NA Palm Canyon Theatre Lease Page Two June 5, 2002 Also, a fire during the month of June, 2000 destroyed a portion of the leased premises, including a rehearsal room, public restrooms, tool room and costume shop. This fire damage, coupled with the extended period of time required by the City to make the necessary repairs, has significantly constrained the tenant's ability to operate successfully at this location. These repairs were just recently completed. Nick Singer, the City's staff person responsible for Revenue Recovery has worked diligently over the past several months to allow rent offsets in consideration of this problem, and yet as of April 12, 2002, the tenant remained $5,772.87 behind in rent payments. On this date, the tenant promised to pay the full amount due in order to correct this situation prior to requesting City Council to extend the term of the lease and this was in fact accomplished on this same date. Section 2.2 "Option Term" of the lease reads as follows: `If tenant is in default on the date of giving the option notice, the notice shall be totally ineffective, or if the tenant is in default on the date the extended term is to commence, the extended term shall not commence and this Lease shall expire at the end of the initial term or properly exercised extended term." The tenant was in default on January 18, 2002, the date that they issued the "notice of intent to exercise option to extend lease". They did become current on their rent on April 12, 2002. Since the Palm Canyon Theatre has worked very hard to become a valued component of the Palm Springs "arts and entertainment" community and has struggled in this endeavor, staff recommends that the term of their lease be extended by City Council for a term of five years, or until April 30, 2007, at the rental rate of$1,400 per month with annual CPI escalators and interest charges for past due rent. However, the intent of the original lease was to provide for a ten year amortization of the improvements made by the lessee; it was constructed as a five-and-five so that if, at the end of the first five years, the theater was unsuccessful, the lessee would not be burdened with an additional five years. At the time of the original lease, the theater did not exist in its current state: it was the gymnasium of the old Frances Stevens School. It was the investment of the lessee (at least $300,000) that created what is today a 231-seat theater with sound, lights, and a rotating stage. The argument that the City has a beautiful facility that shouldn't be wasted on the PCT is cast in a different light when the point is made that the PCT's investment actually created the theater facility, not the City's. Additionally, the original purpose of the lease, from the City's perspective, was to install a professional theater company in the building that could anchor the park and begin to create the Frances Stevens Arts Academy to match the festival center concept within the rest of the park. The regular cultural activities of the theater were seen as a way of moving the "arts & entertainment" concept that was beginning to take hold in the downtown area into the then- struggling Uptown area. That effort today can be seen as largely successful, notwithstanding the difficulties faced by the PCT over that term. The surrounding vacant land uses—the Spanish Inn, the Peppertree Inn, and the Palm Springs Hotel—are all now in various states of rehab, the latter as The Corridor project. The uses at the north end of downtown, too, are also stronger than they were in 1997. While the PCT cannot take all of the credit for the additional activity, the fact that the park has become a cultural focus for the entire community has increased the value of all of the property around it. Frequently Asked Questions about the PCT Lease Having read the other proposal and listened over the past few weeks to other interested parties debate the PCT lease, staff has prepared a summary of most of the assertions made along with some answers. Why are we not doing an RFP, given the other interest in the facility? The renewal of the lease was delayed by the arrival of a competing proposal and accompanying petition urging the rejection of the PCT lease renewal and the opening of a competitive process. The other proposal did in fact propose to pay a higher rent, as well as "open up" the theater to a broad coalition of other organizations. However, after reading the lease, staff determined that the original lease did contemplate a total of ten years: five years of lease with a relatively automatic five year extension. PCT did seek to exercise the option, but did so in January — about 18 days after the lease requires. Since they have now cured the default of the back rent, the City would need to use the 18-day-late notice as the legal basis of not renewing the lease. This type of technicality used to terminate the lease seems monumentally unfair, given the physical condition of the facilities over the past 24 months due to the fire, as well as the financial impacts to the theater from the fire and the construction of the fountain. Therefore, rather than listening to the argument that the lease extension is somehow an improper"done deal," it is important to understand that PCT was already in a lease that contemplated a problem-free extension. Is having an Artist's Equity theater important? Artist's Equity has certified via letter that PCT is the only regional Equity theater in the Coachella Valley, despite other assertions. It is likely to remain the only Equity house for the foreseeable future. In order to earn an Equity card — like a Screen Actors Guild card — an actor must earn credits through performances in Equity theaters, as well as work stints in costuming, set design, lighting, and box office. PCT runs an internship program to help young actors earn their Equity credits: these interns form the backbone of the PCT's support staff and dramatic company. Once in Equity, an actor must be paid the Equity minimum, and must never, ever be asked to work on Mondays, for example. The Equity house must be diligent about royalty payments and balance the Equity actors with non-Equity (i.e. free) actors, in order to keep ticket prices competitive. Running an Equity company is more expensive but worth it in the long run. Equity ensures the quality of the production, and the quality ensures the continued loyalty of the audience. It is arguable that the Equity quality is what preserved the majority of the audience for PCT during the two seasons that they had portable restrooms in the parking lot. A community theater, always a tenuous enterprise, would likely not have survived that test. If we didn't do the lease with the PCT, would there still be an Equity contract there? No. The PCT holds the Equity contract, not the building. It is unlikely that Equity would grant another contract to another Valley theater. What about the idea of opening the theater up to other users? The PCT has, over its history, rented space to other performers or groups during its "down"time. Sometimes this has worked well and sometimes it hasn't. The most frequent request of those renting space, however, is to be able to use the "building's" staff to run the lights, sound, etc. Some groups have asked for use of the box office facilities as well. Usually the amount of rent the group is willing to pay does not cover the additional cost to PCT to provide staff. (The "building" has no employees.) The building would also have to compete against other venues in the City, such as the Annenberg Theatre and the Palm Springs High School Auditorium, both of which are larger and superior facilities. Still, the idea has merit within those parameters and PCT has offered to look again at groups that may have had a presence there once and are no longer there. More successful has been the collaboration with performers on developing new events or entertainment, such as The Big Show on First Fridays. What kind of outreach and educational programs does the theater do? 1 s�A� PCT is a 501(c)3 non-profit with a cultural and educational mission. The lease reflects its non- profit status. While the cultural mission is evident, the biggest educational program the PCT runs is its Summer Camp, now in its sixth year. There students 8 to 18 learn all aspects of theater, including acting (of course), set design, props, costuming, lighting, and makeup. The PCT is also available for school field trips. A recent field trip was run like a mini-camp: the children rehearsed a play for several days, and then went to the theater to perform it. There they received lessons on movement and blocking, some costuming, and full makeup. What about the effects of the fire? How were those felt? The fire was obviously devastating to the PCT. It destroyed a rehearsal and set-building room on the south side of the building, and also destroyed most of the PCT's costumes in the costume shop. Fortunately, the fire came at the end of the regular season so, while the summer camp was immediately impacted, the PCT could sufficiently recover for the following season. Nevertheless, the lack of indoor restrooms for nearly two years had a gradual, but devastating, effect on season ticket sales and the box office. The loss of a set-building shop, too, created problems over the past few years; the Council is familiar with how precious set- construction and set-storage space is from dealing with the same issues at the Plaza Theater. Because of the nature of the ownership and the lease of the property, the rebuilding of the theater represented the worst combination of an insurance claim and a public works project, causing the design to stretch out and the construction to be performed in fits and starts over a long period. When the City's Public Works Department was finally asked to intercede in the project, it had already gone on over 15 months — and took another four months to finish. Is the theater actually paying the electric bill for the fountain? Yes. One of the unknown facts about the fountain is that the electricity to run it has come from the theater's service since the fountain was built. That issue was raised during the first lease negotiation session by the PCT representatives. None of the City staff at the meeting were aware of the fact and were sure it was not the case, but it turns out to be true. The original contractor installed a "demand" meter, rather than a regular Edison meter, on the fountain's service, without notifying the City that he was doing so. A demand meter is one that the City should have been reading in order to calculate the electricity usage, and then reimburse PCT. There is no separate billing from Edison on that meter. Obviously, the City would not have approved this arrangement had it been known at the time, but it reflects another shortcut on the part of the fountain contractor. A new Edison service is now being installed, and the calculation of what the City (specifically, Public Art) owes the PCT is being done. Ironically, it may turn out that the City owes the PCT an amount in excess of the prior delinquency on rent, which exacerbated an already lean year for the theater. Could the City manage the facility as a rental facility? Creating another City-owned "stage for hire"would cost the City money rather than make it money. The Plaza Theater, owned by the CRA, is successful because of the strong, single artistic vision of its tenant, the Fabulous Palm Springs Follies. Conversely, the Springs Theater at the Convention Center will be converted next year to group meeting space because the yield per square foot is significantly higher in a flat room. Any operator, including the City, that desired to rent the space out on a regular basis will need to be prepared to provide (and probably hire) staff ranging from electricians and janitors to ushers and box office personnel. /rd7 The cost to another organization to lease the facility, then, would be proportionately higher. Staff is comfortable that the PCT is positioned to succeed, now that is entering its sixth season and the major issues with the building have been addressed. New board leadership, too, should ensure continued improvement in compliance with all the terms of a new lease. Finally, the lease extension contains provisions that provide information necessary to the City and the lessee that will make the ongoing relationship positive and profitable for both sides. f GI THIRD AMENDMENT TO LEASE 538 North Palm Canyon Drive Palm Canyon Theater THIS THIRD AMENDMENT TO LEASE ("Third Amendment") is made this day of 2002 by and between the CITY OF PALM SPRINGS, a California municipal corporation ("City"), and THE PALM CANYON THEATRE, INC. a non-profit corporation ("Tenant"). R ECITALS A On July 9, 1997, Tenant entered into that certain Lease Agreement ("Lease") for a portion of real property described at Exhibit "A" attached and incorporated to the Lease ("Premises"). B. On October 1, 1997, City and Tenant entered into that certain Amendment to Lease, increasing Tenant's exclusive use of floor area at the Premises, increasing the monthly rental and prepaid rent amount, and allowing certain Tenant electrical improvements and repairs on the Premises, C. On June 17, 1998, City and Tenant entered into that certain Amendment and Addendum to adjust the rent to reflect the cost of public improvements made by Tenant, to clarify the responsibility for certain public improvements, and to change the accounting requirements of the Lease. D. On January 18, 2002, Tenant informed the City of its desire to exercise its option for an additional five years of lease. The parties hereto now desire to amend the Lease upon the terms and conditions contained herein. COVENANTS NOW, THEREFORE, for fair and valuable consideration, the receipt and adequacy of which is hereby acknowledged, the parties hereto now further amend the lease in the following particulars only: Section 1.3. Lease Commencement Date. May 1, 1997. Term: 10 years. Lease termination Date: April 30, 2007. Section 1.5. Monthly Rental. The lease shall be $1,400 per month, adjusted annually under the provisions of Section 3.2. Section 1.8. Use of Premises. Add "The tenant may allow other non-profit groups to use the facility, provided the use is consistent with this section and Section 9 of the Lease, "Assignment and Subletting." The Tenant is entitled to recover its cost incurred when another user leases the facility." /01 9 Section 3.7. Late Payment. Add at the end of the paragraph: "Sixty (60) days before the anniversary date each year (March 1) the City shall notify the Tenant of any outstanding delinquency, which must be cured prior to the anniversary date or the City may exercise its right of termination under Section 2.5 and terminate the lease. FULL FORCE AND EFFECT. Except as specifically provided in this Amendment, all terms and conditions in the lease shall remain unmodified and in full force and effect. I look forward each year to the stellar performances put forth by the dedicated group of actors, set designers, directors, and other individuals involved in each production. I have visited the theatre with my friends and family. My aunt and uncle, who rent a condo in Palm Springs each February and March, also attend the Palm Canyon Theatre when they are visiting from Chicago. They believe that the Palm Canyon Theatre provides as professional a level of entertainment as any theater in the Chicago area and at a much more reasonable price. Please renew the Palm Canyon Theatre's lease for as long as they make their payments. This would be a step in the right direction in the City of Palm Springs' continuing effort to bring culture and class to the Coachella Valley. Without this dedicated group of professional performers, the Valley will be sorely lacking for local upscale entertainment. The .Layne family and their hand-picked staff currently running the Palm Canyon Theatre provide a unique and irreplaceable service to the children of this community, one provided by no other organization in the Coachella Valley. If not, they should have. Nor do I recall if the Laynes were ever cited by the Fire ❑epart-ment for having illegally stacked stage sets under the eaves at the building, which resulted in the fire spreading more rapidly. The theater had been previously told about fire violations by your Fire Marshal just prior to that fire, but the proprietors refused to do anything about it. I also know that the theater, group has been way behind--off and on--in their rent over the years (in the $thousands) , and yet they were never evicted (as an apt. renter would be if they didn't pay their rent) - If someone within the City of Palm Springs has been "protecting" the Laynes by aliowing them to remain without paying L•imely rent--or not obeying fire regulations--this is an outrage- I think there "may" have been criminal behavior, and I think the Palm Springs Police Dept- should have done more on that investigation after the fire. In my 58 years of life, the Palm Canyon Theatre group stands as one ❑f the worst theater companies I've seen. Thor productions are dreadfully amateurish, and they are definitely NOT an asset to Palm Springs. They are a absolute disgrace to community theater. In adduion to our Main Stage productions(six to eight per year), the Theatre engages in a w1dc variety of educational and artistic activities We are always seeking ways to improve the program. For example, next season we plan to add comedy and stage combat to our already extensive offering of theatre classes. It is exciting to observe each year's activities and events build upon the experience of prior years. As is evident from our schedule,the Theatre's facilities are in nearly constant use,particularly during the peak season. Thus,there is very little realistic potential for increased sharing of 0tese facilities with other organizations. In past years the Theatre has arranged for the use of nearby (non-PCT)space in order to engage in cooperative arts efforts with other groups,normally in connection with summer educational activities. We hope that similar opportunities may also arise in the future. As you can see from the table in the Fact Sheet,our ticket sales increased significantly each year until the 2000-2001 season,when sales dropped precipitously. Clearly,the fire in June OF2000 and subsequent lack of bathroom facilities took its toll on revenues. With the completion of repairs and reopening of the bathrooms, Ticket sales have improved this year. We are excited about the forthcoming season and have been working on obtaining performance rights for plays that will be of interest to our audience. The Company feels that it's 501(c)(3) nonprofit community theater, under the classification of education, would be a significant addition to the City of Palm Springs. Desert Rose Theater Company was created with the purpose of establishing a year-round producing theater company in a permanent location in the Coachella Valley. Established in August 2000, the Company received its government exemptions in July, 2001. In the summer of 2001 we received a grant from the City of Rancho Mirage for a children's theater workshop, ages eight through eighteen, which culminated in a one and a half hour Christmas musical production. The Company has also produced and toured four productions throughout the Valley. We presented our touring shows to assisted living facilities at a reduced rate as part of our community outreach program. The Desert Rose Theater has eighty five (85) company members, including television, motion picture, and Broadway attars (Actor's Equity Association [AEA] and Screen Actor's Guild [SAG]; and directors, theater technicians, television and motion picture writers and non-performing individuals who believe in our mission. The Company began operation in 2001 with an account of nine dollars ($9.00) and in a matter of months had brought in fourteen thousand dollars ($14,000.00), all without having a theater facility. We know we will be very successful once we obtain a permanent location. During the development of the Company the Board of Directors has been in contact with the following local performing arts organizations which are interested in using our facility or working with us when we acquire a theater location: Playwrights Circle, Grove's Lag Cabin, 'West Coast Opera Company, Derrik Lewis' Musical Chairs, Metropolitan Community Church, and Children's Playtime Productions. There are also several other performing arts organizations which we could approach, including the Layne family's performing arts group and the Palm Springs Ballet Company. The Company's year-round schedule would include educational workshops for children and adults taught by skilled personnel in the various phases of performing arts with scholarships available; a winter season of six to seven full-length productions from mid- September through the end of May, each being presented for four weeks; a children's theater program; a Reader's Theater; Young People's Showcases; opera, dance, and ballet presentations; Theater Sports; and guest artists. In addition, a program will be developed with local schools for the bussing of children to the theater's presentations. The opening night of each seasonal production will be offered as a benefit performance with a percentage of the house going to various local charities. The Board of Directors also has 2 an innovative idea regarding how to work in conjunction with the annual Renaissance Faire which is presented in Frances Stevens Park,adjacent to the theater. Regarding Actor's Equity Association, it is the Company's intention to use Equity actors under Guest Artist/Special Agreement contracts once we feel the theater's receipts are sufficient to afford the union's required salaries and benefits. The Desert Rose Theater pursues an ongoing grant solicitation program to government agencies, corporations, and foundations, as well as donations from private individuals. BUSINESS DESCRIPTION Desert Rose Theater Company (DRTC) is a nonprofit 501(c)(3) Public Benefit Corporation, EIN 33--0932651, with principal offices located 640 S. Calle Petunia, Palm Springs, CA 92262. DRTC's date of incorporation was August 17, 2000, under Charter number 2257825, in the State of California. PURPOSE OF BUSINESS The purpose of this corporation is to establish a year--round producing live theater company in a permanent location in the Coachella Valley. MISSION STATEMENT It is our mission to provide community theater experiences for the inter- generational population of the Coachella Valley. Opportunities include theater appreciation, education, performance, technical and directorial development, thus promoting enthusiasm for the performing arts and the cultural enrichment of the community. 2 DESERT ROSE THEATER COMPANY BUSINESS PROPOSAL Continued DESCRIPTION OF THE BUSINESS Since its incorporation DRTC has been presenting melodramas, plays, and touring shows at hotels, resorts, senior centers, assisted living facilities, and libraries in the Coachella Valley. It is the Corporation's intent to present productions including, but not limited to, musicals, comedies, revues, mysteries, and dramas; theater workshops and classes in all phases of the performing arts; to create a children's theater; to organize touring shows for schools, senior centers, assisted living facilities, conventions, country clubs, and charity fund raising activities;and to present readings of new plays, i.e.: working with Playwright's Circle. DESIRED IMAGES Specifically, the corporation's desire is to offer quality, inoffensive entertainment for the enjoyment and edification of the community. In other words: "Going beyond the ordinary to achieve the extraordinary by setting the stage for good things to happen." DRTC wishes to be recognized as an integral part of the community by giving scholarships for the corporation's workshops; by using local talent in our productions; by working with schools to establish a program of busing children to the theater; by doing benefit shows for local charities; to offer reasonable admission prices to all of our presentations and various activities; and to work with other performing arts organizations. INVENTORY The Corporation's present inventory, purchased by DRTC or donated by Penni Thompson and Jimmie Warner, is approximately twenty five thousand dollars ($25,000.00) which is comprised of materials and equipment. There is also twenty five hundred dollars ($2,500.00) in sound equipment on loan to the Corporation by the President. 3 DESERT ROSE THEATER COMPANY BUSINESS PROPOSAL Continued LICENSES AND PERMITS DRTC is a recognized and certified nonprofit corporation in the State of California and has received its tax exemption from the Franchise Tax Board and its 501(c)(3) tax exemption for the Internal Revenue Service, EIN 33- 0932651. All licenses,permits, etc. will be obtained as required. EXISTING CONTRACTS We negotiate contracts as we book our shows at various venues. Some of our venues have been Miracle Springs Resort and Spa, Wellington Place, Palm Desert Library, Borders Book Store, Melvin's Restaurant and Lounge, Ranch Mirage Art Fair, Desert Business Association Expo, Joslyn Senior Center and Oasis Resort. MARKETING The corporation's market base is the general public, including residents, visitors, vacationers, out of town bus tours, and conventioneers. Advertising and promotion will include, but is not limited to, print advertising, telephone directory, public relation articles, news releases, radio and television spots, Public Service Announcements and talk shows; flyers, posters, mailing lists, e-mail, a web site on the Internet; organization newsletters; convention bureaus; service club personal appearances; performances for theatrical agents; concierges; provide theater tickets for charity raffles; and word--of-mouth. Public relations are being handled by a professional public relations person. COMPETITIVE ANALYSIS At the present time there is no permanent legitimate community theater operating in the Coachella Valley, which has a current population in excess ; of two hundred, ninety one thousand (291,000) permanent residents. The number swells to approximately four hundred, twelve thousand (412,000) ; 4 DESERT ROSE THEATER COMPANY BUSINESS PROPOSAL Continued each year during the winter Season, The growth rate of the Coachella Valley since 1999 has been 3.3% annually and from 1980 to the present the population has increased by 138%. DRTC will seek a permanent theater plant in a central Valley location, making the experience of going to the theater accessible to the greatest number of people, The permanent residents, which includes a large retirement community, and the seasonal visitors to the Coachella Valley, look for, enjoy, and appreciate quality and affordable theater entertainment, the type of entertainment DRTC will provide, In addition to the fact there is a very large audience for theater in the Valley, there are a great number of talented people of all ages who are looking for a venue where they may participate in and gain experience from all phases of the performing arts. She has owned two businesses, was responsible for : the set up of box office operations for two theaters, and co-founded and designed the very successful Desert Rose Theater in Cathedral City. Under her leadership the Desert Rose Theater received fourteen Desert Theater League nominations for its first three productions. Thompson is also a twice nominated and one time winner of a Desert Theater League award. 5 DESERT ROSE THEATER COMPANY BUSINESS PROPOSAL Continued JIIVIMIE R. WARNER, Secretary, holds a Master's Degree in Theater from Occidental College in Los Angeles and has twenty five years experience in children's, community, and professional theater in Los Angeles, Chicago, and New York. Warner directed the first national touring company of the Off--Broadway musical hit THE FANTASTICKS and directed it again in St. Thomas in the US Virgin Islands. He created and organized THE T IREE CROWNS THEATER in St. Thomas for which he served as producer, director, and business manager for four years. During that time he also served on the Board of Directors of the Ballet Theater of the Virgin Islands and directed its annual productions. As an employee of Walt Disney Studios he created and served as Chairman of the Board of the Disney Players, a community theater group for studio employees. JUNE C. PEEVER, Treasurer, is a long-time Valley resident with a diverse business background and is very much involved with both the community and the theater. She has six years experience in banking, ten years in merchandising, and has managed a cafeteria unit, in charge of ordering supplies and bookkeeping. She was a newspaper reporter and columnist for ten years. June volunteers as a Citizen on Patrol and was named Volunteer of the Year by the Joslyn Senior Center. She is active with the Joslyn Singers, Joslyn Players, and has 16 years of participation in local theatrical venues, with a Desert Theater League Award nomination. Charles H. Hayden, Jr., member of the Board, has resided in the Valley for over thirty years. He is a graduate of Loyola University with a Bachelor's Degree in Business Administration. He owned Hayden's Family Restaurant in Desert Hot Springs for twenty nine years. In 1983 he was elected to the ; Board of Trustees of the College of the Desert and still serves the College in that capacity. In 1999 he was elected to the Board of Directors of the California Community College League and has held that position to the present. The basic requirements are few, for example: amount of space for seating, sufficient parking,adequate restrooms, high ceilings and, most significant, no support columns located in the center of the building, but it is difficult to find them all contained in the same location. Once a possible venue comes close to having the basics,the cost per square foot comes into the equation. Needless to say,our members will be the first to know when the just-right facility rears its lovely head. DUES DUE JUNE 30 Dues for 2002-2003 are due by June 30. Member dues are of great importance because they are one of the factors upon which our nonprofit status is based. Last year membership dues paid for liability insurance, volunteer insurance, and volunteer automobile insurance; 3 storage units for all of our theater equipment; the production of 3 touring shows; government fees, credit card service for ticket sales; office supplies; printing; postage; etc., the necessities involved in running a community theater which are not as obvious as a big stage production. IF YA AIN'T GOT A THEATER....TOURI The Company's "VMODUNIT" mystery comedy has been presented at many venues,as has our latest touring show"YJNGU" which is a staged comedy reading presented in costumes of the 1920s. The latter has been presented at the Palm Desert Library and Border's Bookstore at The River and has been well received. In fact,a member of the Border's audience wrote to Letters of The Desert Sun (April 12) praising our show,part of which we quote here: "TOP PERF,ORMANCES...They are: The Desert Bose Theatre Company's "Zingu" (sic)which is clever,polished nonsense, held at Borders, by donation;..." "XI NGU"will be presented next at the Joslyn Senior Center on Sunday May 19 at 1 p.m. The third show, a comedy revue with music called "BITS `N PIECES," will premiere at Oasis Resort on May 1. Spaghetti dinner at 6 p.m. and show at 7 p.m. with your discount is $17.50, or tickets for the show only are$13.00. Make required reservations by calling 328-2324 or 416-1496 by 5 p.m. on Tuesday. The show, above all else, is a COMEDY. Nonetheless, a crime has been committed and everyone in the room needs to help solve it and point the finger at the guilty one. Four actors (two couples) enter and sit at different tables. They nonchalantly interact with the guests, at first, pretending they have also come for dinner and the show. However, as things develop they become suspects and the guilty one is arrested at the end of the show for the dastardly deed that has been committed. The detective, played by myself, gets everyone laughing during the investigation and even gets the audience to participate in two sing-a-longs. Upon arrival the audience is provided with a "WHODUNIT" answer sheet and a pencil, so they can take notes as clues are reveled. Toward the end of the show the detective will tell everyone what questions need to be answered in order to solve the crime. At the end of the presentation the answers are collected and the detective then wraps up the case,with the awarding of two prizes. One prize is the"booby" prize and is awarded to the guest who gets everything absolutely wrong. The winner is then announced and ; awarded with the other prize, a bird hand puppet, which squeaks. It is called THE MALTESE COO- COO BIRD. i The show runs about one hour and ten minutes, but can be lengthened or shortened to fit any particular occasion, whether a dessert, hors d'oeuvre, or potluck event. The facility presenting the show provides the dinner and our company provides the show. We require a minimum of thirty(30) guests, but there is no maximum. Eight (8) dinners are required for the actors. Four (4) dine with the guests and four (4) eat after the show. Our company charges fifteen dollars ($15.00) per person and any additional charge you make above that amount goes to your organization or facility. We hope to hear from you soon. Upon arrival the audience is provided with a "WHODUNIT" answer sheet and a pencil, so they can take notes as clues are reveled. Toward the end of the show the detective will tell everyone what questions need to be answered in order to solve the crime.
