PUBLIC HEARING ON A DISPOSITION AND DEVELOPMENT AGREEMENT WITH
BURNETT COMPANIES ON A 19.17 ACRE PARCEL AND A 22.21 ACRE PARCEL
NEAR THE CORNER OF SUNRISE WAY AND SAN RAFAEL ROAD
RECOMMENDATION:
It is recommended that the Agency hold over the approval of the Disposition and
Development Agreement with Burnett Companies on a 19.17 + acre parcel and a
22.21 acre parcel at the corner of Sunrise Way and San Rafael Road to facilitate
the development of a major single-family-home development
BACKGROUND:
In June, 2002 Burnett Companies requested that the DDA negotiated with the
Agency move forward for approval. The draft DDA was drafted in December, 2001
and awaited comments from the Developer. At the time, the Developer
contemplated that a Community Facilities District and City Development
Agreement be part of a package.
Staff moved forward with noticing the public hearing for this date; however, the
issue of the CFD and Development Agreement are prominently featured in the
DDA, which must now be revised to reflect the different timing of those efforts.
The CFD decision is at least several months off.
Since this was noticed in the newspaper, it needed to appear on the Agenda
rather than being pulled. However, staff is not recommending opening the public
hearing, but rather holding it over until the Planning Commission approvals are
complete and the issue of the CFD is ttled and the DDA is revised.
