RECOMMENDATION: That the City Council approve Tentative Tract Map 30574 and Case 5.0908.-PD-276 for the subdivision of 35,554 square feet of land into 5 lots for a multi-family residential complex, located at 772 Prescott Drive. The applicant is Architectural Properties owned by Allen Miller. SUMMARY: The applicant is seeking a Tentative Tract Map to subdivide 35,554 square feet of land into 4 lots and 1 common area lot and approval of a Planned Development District to allow the development of four residential units and associated improvements. The proposed map is consistent with the design criteria of the Planned Development District. Planning Commission recommended approval of the proposal as submitted, leaving City Council to decide whether the applicant will have to underground all existing overhead utilities. The current conditions of approval requires all proposed utility lines and adjacent utility lines to be undergrounded. Based upon Planning Commission direction staff has evaluated the existing conditions and has determined that compliance with Engineering Condition #21 may make the project technically and economically infeasible. Staff suggests that the City Council require undergrounding of the north property line overhead utility and that the requirement along the east property line be waived since it may be technically and economically infeasible. BACKGROUND: The project site currently consists of one (1) lot and is designated as R-2 (Limited Multiple- Family Residential Zone) in the General Plan. The proposed units are 2,270 square feet each. Surrounding zones consist of R-1 zone to the west. R-2 to the north, R-1 to the south, and C-1 (Central business zone) to the east. Surrounding uses include single family residential to the west, and south, a commercial lot to the east, and a church to the north. The proposed homes will be one (1) story with a maximum height of fifteen (15)feet and 2,270 square feet each. The applicant is proposing eight (8) covered parking spaces and two (2) open parking spaces totaling 10 for the project. Each unit is proposed with a 485 square foot two (2) car garage and a decorative drive. All units will include a pool and spa. An existing six (6)foot high block wall which will be stuccoed to match the proposal borders the property. Total building area for the site is 11,020 square feet comprising of 31% of the total lot area. Paving, including streets and drive is proposed at 4,204 square feet and equals 12% of the total lot area. Landscaping and open space are proposed at 20,330 square feet or 57% of the total proposed development lot area. An access agreement with the adjacent property owner(Church)to the north, for the City of A;)� Palm Springs Fire Department to access the site will be required. The Public Works Department is recommending that full street improvements along the Prescott Drive frontage be installed, including the installation of improvements such as curbs, gutters, and sidewalks. The current conditions of approval requires all proposed utility lines and adjacent utility lines to be undergrounded. At the public hearing the applicant testified that undergrounding all of the adjacent overhead utilities would be technically and economically infeasible for a four unit project. Existing overhead utilities exist on the north and east property lines. At the Planning Commission direction staff met with the applicant, evaluated existing conditions, and determined that undergrounding the east property line utilities would be technically infeasible without financial and other assistance form adjacent property owners. These overhead utilities have multiple over head service connections and undergrounding would require new underground service connections and meters to serve several existing buildings. The cost of such undergrounding would likely be $300 to $500 per linear foot or up to $263,000. The north property line overhead line can be undergrounded without hardship and the developer has agreed to so do. Staff suggests that City Council revise Engineering Condition Number 21 to require undergrounding of the north property line utility line only. This action would be consistent with past City Council actions for similar multifamily residential projects. The Planned Development is proposing modification of the R-2 property development standards for required building separation between units. Fifteen feet is the required separation between units. The applicant is proposing six (6)foot eight (8) inches separation between each unit, and three (3)feet four (4) inches to side property line. This separation proposal between structures and proposed property line meets the Uniform Building Code. Planning Commission supports this proposed modification due to the project location, parcel size, and parcel configuration. The proposed project creates an appropriate transition between R-1 and commercial zones and has a scale that fits in the neighborhood. ENVIRONMENTAL ANALYSIS AND NOTIFICATION: This action is categorically exempt from the provisions of the California Environmental Quality Act (CEQA) per section 15332, whereas the proposed Tentative Tract Map meets the conditions outlined for In-Fill Development Projects. Case 5.0908 — Application by Architectural Properties for a Tentative Tract Map and Planned Development District for the subdivision of 35,554 square feet of land into five lots with modified side setbacks and lot size requirements located at 772 Prescott Drive, R-2 Zone, Section 10. Commissioners Jurasky and Grence abstained due to conflicts of interest. Director reviewed plans and exhibits for Planning Commission and stated that the applicant will do single-story villas with pools, garages with decorative drives, and property line walls — a crisp modern design with a formal landscape plan consistent with architecture. Chairman Klatchko opened the Public Hearing. Mr.Allen Miller,Architectural Properties, addressed the Planning Commission to state that he and the other principal, Mr. Andrew Karpiak, have reviewed the.Conditions of Approval and would like to request relief from Planning Condition No. 27. He stated that Engineering Condition No. 20 requiring the undergrounding of utilities would have a severe financial impact upon the project to 7Onb4 Page 3 of 8 May 22, 2002 Planning Commission Minutes the point that the project would be cancelled. He stated that, since the power poles serve property across the street from the subject site, he understood that they could remain in use. Mr. Chris Selene, WWCOT Architectural Planning, project architect, addressed the Planning Commission to ask that Engineering Condition No. 7 be clarified so that the 19' measurement begins at the back of the sidewalk in order to align parking stalls with architecture of buildings. He stated that, regarding Engineering Condition No. 9, the project engineer reports that the existing paving is only 18 months old so it should not have to be removed and replaced. Regarding Planning Condition No.27, he stated that there is a 3'6"landscape easement between the adjacent property and the property line and requested that an additional 3'4" area be sufficient to satisfy intention of the condition. He submitted a new site plan exhibit for Planning Commission review. There being no further appearances, the Public Hearing was closed. Commissioner Raya called Mr. Selene to the podium to ask if it would be possible to add 1-2 parking spaces. Mr. Selene reported that he discussed this with staff and was encouraged not to in order to keep setbacks, water retention areas, and landscaping in place. He confirmed that the trash is within an enclosure. Dave Barakian, City Engineer, reported that, regarding Engineering Condition No. 9, the requirement does not apply in this instance where the existing curb and gutter is so new. He stated that City Ordinance requires the undergrounding of utilities in this case. He stated that, in the past, if adjacent development was served by overhead utilities and those overhead utilities also served the subject development property, then staff could recommend that Planning Commission agree to covenant; however, this has not been done in a Tract Map situation in the past. Commissioner Raya called Mr. Sanborn to the podium. Mr. Sanborn reviewed water retention areas for the Planning Commission. City Engineer stated that, for reducing water retention areas, the Planning Commission has established a policy that, unless developer can prove that retention capacity exists downstream,all water must be retained onsite. Mr.Sanborn stated that a hydrology report has been submitted and that the prior development probably had runoff into the street. City Engineer stated that, after checking the code and location of poles, he feels the City could defer the undergrounding by covenant and, further,through CC&Rs for future property owners. He stated that calling a covenant on a Tentative Tract Map would be difficult to enforce. Commissioner Matthews stated that the community wants power lines undeirgrounded. M/S(Matthews/Caffery)to approve per Conditions of Approval in Staff Report; and delete Planning Condition No. 27. Commissioner Raya stated that he felt requiring the undergrounding of utilities is a tremendous burden to developers and should be addressed as a City-wide program. Fie asked the motion maker to reconsider the requirement. Commissioner Raya asked that the City Council be informed that there is a feeling of concern for the viability of the development if undergrounding of utilities is required. He called the applicant to the podium. Mr. Chris Selene stated that deferment to CC&Rs is acceptable and that the cost of the land is significant different than the cost of the number of poles in the ground which would need to be removed. He stated that future home sites would face the mountains and away from the poles. He stated that the pole at the northeast corner is most problematic. Call for vote: 5-0, 2 abstentions (to approve per Conditions of Approval in Staff Report; and delete Planning Condition No. 27.) The project design and improvements will be a beneficial improvement for the neighborhood and will be compatible with the General Plan and with the existing land uses within the vicinity. e. The site is physically suitable for the type of development contemplated by the proposed Planned Development. The required dedication of right-of-way and improvements will provide safety benefits to the property owners and will aesthetically enhance the neighborhood. h. STREETS 1. Any improvements within the street right-of-way require a City of Palm Springs Encroachment Permit. 2.
