APPROVE AMENDMENT NO. 3 (FINAL) TO CVAG REIMBURSEMENT AGREEMENT FOR
COMPLETED MID-VALLEY PARKWAY PHASE-1 PROJECT
RECOMMENDATION:
That City Council approve Amendment No. 3 (Final) to joint City/CVAG/Cathedral City
Reimbursement Agreement No. A3562 with the Coachella Valley Association of Governments
(CVAG) for the Mid-Valley Parkway Phase-1 construction project, reducing final project costs by
$256,238, from $15,747,000 to $15,490,762, due to final fund balance; City Project No. 94-19
SUMMARY:
On May 8, 1996 a master reimbursement agreement was executed with CVAG, Palm Springs and
Cathedral City forthe construction of Phase-1 of the Mid-Valley Parkway(MVP)project within Palm
Springs and Cathedral City.Amendment No.2 to thatjoint-agreement authorized up to$15,747,000
for project costs (Ref. Minute Order No. 5821, City Agreement No.A3562). The CVAG Executive
Committee approved Amendment No. 3 (Final) to the joint MVP agreement on June 3, 2002.
BACKGROUND:
On May 15, 1998 the west end (Phase-1) of the Mid-Valley Parkway project was opened to traffic
along Mesquite Avenue and Dinah Shore Drive, including the new 4-lane Dinah Shore Bridge
across the Whitewater River channel.The project was constructed with Regional Measure A funds
and Palm Springs was the lead agency representing also CVAG and Cathedral City in the joint
construction effort. CVAG wishes to close out the final project costs for the Phase-1 of the MVP in
order to apply the $256,238 project fund balance to the final MVP phase along Dinah Shore Drive
in Cathedral City, On June 3, 2002 the Executive Committee of CVAG approved Amendment No.
3 (final) to the MVP Phase 1 agreement, thereby transferring the $256,238 fund balance to the
Cathedral City segment of the Mid-Valley Parkway. The Cathedral City segment of Dinah Shore,
(Date Palm Dr. to Plumley Rd.) as well as easterly segments of the MVP in Rancho Mirage and
Riverside County are being widened to 4-lanes to match the 4-lane configuration to the west,greatly
improving traffic flows on the Mid-Valley Parkway which now carries about 20,000 cars daily.

AMENDMENT NUMBER THREE/CONSTRUCTION AND PROJECT COMPLETION
THIS AMENDMENT NUMBER THREE is made and entered into this day of
12002,by and between the City of Palm Springs("Lead Agency"),the City of Cathedral
City ("Agency"), and the Coachella Valley Association of Governments, a California joint powers agency,
("CVAG").
This amendment reduces the cost ofthe project by$25 6,23 8 from$15,747,000 to$15,490,762. All other provisions in
the existing Reimbursement Agreement are considered in force.

11.4 Consider Award of Contract to Assess Benefit of Improvements to the Jefferson Street Interchange
The City of Indio has requested that another benefit assessment analysis be conducted to determine
the level of responsibility each of the jurisdictions served by the planned improvements to the
Jefferson Street interchange on Interstate 10 should bear.
CVAG is,presently involved with the improvement of five interchanges on Interstate 10 through the
Coachella Valley, in order to equitably assign responsibility for the local costs of these improvements,
CVAG requested that a benefit assessment evaluation be conducted for each of the Interchanges
such that the jurisdictions which would derive the greatest benefit from the improved interchanges
would be responsible for the highest proportionate costs.
After it was completed. the City of Indio raised some issues about the validity of the assessment
spread for the Jefferson Street interchange. In order to give fair consideration of those Issues,CVAG
staff was authorized to retain yet another consultant to conduct a benefit assessment analysis of this
Interchange only.
Proposals for conducting the Jefferson Street/ 1-10 benefit assessment were reviewed by a
committee of representatives from the cities of Indio, La Ouinta, Rancho Mirage, Indian Wells and
from Riverside County. The committee unanimously selected a consultant to complete this project,

STAFF RECOMMENDED MOTION: That the Executive Committee approve the recommendation to
award a contract to HDR Transportatioq to conduct a Benefit Assessment Analysis for the Jefferson
Street Interchange on Interstate 10 for an amount not to exceed $27,000.

12.2 Consider Amendments to Agreements for Mid Volley Parkway Project
The men ments to contracts for lvyo different phases of the Mid Valley
Parkway Project.
Amendment Number Four for the Mid Valley Parkway,contract for the "Dinah Shore Drive from Date
Palm Drive to Plumley Road" phase provides the following:

1) acknovyledges CVAG's agreed share of the project cost as 75% of eligible expanses;
2) Increases this phase of the project cost by $266,238, from $785,000 to $1,041,238; and
3) deletes the future repayment schedule, since the City of Cathedral City is currently paying their
25% share of project costs.
This is also a request to approve Amendment Number Three to the contract for the"Mesquite3Avenuefrom Gene Autry Trail to Dinah Shore Drive,including the Dinah Shore Drive Bridge"phase ofValley Parkway Project; reducing the cost by 4256,238 to accommodate the above increa

2) Amendment Number Three for the City of Palm Springs - City of Cathedral City - CVAG
Agreement for the Mid-Valley Parkway 'Mesquite Avenue from Gene Autry Trail to Dinah
Shore Drive, Including the Dinah Shore Drive Bridge" Phase.
12.3 Ramon Road frpm Date Palm Drive to Da Vail Drive
The CVAG Executive Committee, on April 30, 2001 approved a list of projects to receive 75%
estimated costs from the $8,7 Million of STIP Funds available to CVAG, and approved the attached
City of Cathedral City - CVAG agreement for the "Ramon Road from Date Palm Drive to Da Vill
Drive" as one of those projects on that list. The City of Cathedral City requested changing the
construction date of this project to FY 200612006, as the construction funds will not be available
until the California Transportation.Commissipn (CTC) approve these funds for actual ekpenditure in
FY 2006/06.

STAFF RECOMMENDED MOTION:That the Executive Committee Approve the City of Cathedral City-
CVAG reimbursement agreement for the Ramon Road from Date Palm Drive to Da Vall Drive with the
only change that this project shall be under construction by FY 2005/2006, when federal
construction funds are available. -

I HEREBY CERTIFY that this Minute Order approving Amendment No. 3 (Final) to joint
City/CVAG/Cathedral Agreement No.A3562 with the Coachella Valley Association of Governments
(CVAG), for the Mid-Valley Parkway Phase-1 construction project, reducing final project costs by
$256,238, from $15,747,000 to $15,490,762 due to final fund balance; City Project No. 94-19, was
adopted by the City Council of the City of Palm Springs, California, in a meeting thereof held on the
31 day of July, 2002.
