AT 2555 VIA MIRALESTE, ZONE O, SECTION 2.
RECOMMENDATION:
The Planning Commission recommends that the City Council conduct a public hearing on
the request and, if the City Council so desires, adopt the attached resolution, amending the
Zoning Map. The applicant is Mr. Udo Kierspe and the property owner is the City of Palm
Springs.
SUMMARY:
On June 12, 2002, the Planning Commission voted 4-0, with 1 abstention, to recommend
that the City Council amend the Zoning Map.
Approval of the proposed Zoning Map Amendment will result in a residential land use
designation for the subject property. The applicant intends to convert the former Crocker
Library building into a single family residence.
BACKGROUND:
The subject property is a 0.99 acre parcel located on the west side of Via Miraleste, north
of Racquet Club Drive and south of Francis Drive. The property is zoned O:Open Space,
and designated on the General Plan map as L-4: (Low Density Residential). The parcel is
fairly flat, with an existing building and parking lot on the southern third of the site.
The site is presently owned by the City of Palm Springs and was formerly utilized as a
public library. The library has been closed for some time and has more recently been
leased to a private party for use as a child care facility. The City of Palm Springs has
determined the property to be surplus and has entered into negotiations with the applicant,
Mr. Udo Keirspe, for the sale of the property. Approval of a change of zone to a single
family residential use is one of the conditions of the sale.
Uses, zoning, and general plan designations abutting the site are as follows:
Use Zone General Plan
North Single Family Res. R-1-C L-4: Low Density Residential
South Fire Station O L-4: Low Density Residential
East Park/School O PR: Parks and Recreation
West Single Family Res. R-1-C L-4: Low Density Residential 150P
Detailed plans have not been submitted as part of this application. If the Zoning Map is
amended, building plans depicting the modifications necessary to convert the library into
a residential structure would be required. The applicant has noted that he does not intend
to modify the exterior of the building, rather he would add a kitchen and complete restroom
facilities, while also updating the landscaping on site. A garage or carport would also be
required before the building could be utilized as a single family residence. The plans would
be consistent with the L-4 Residential Low Density General Plan designation and the R-1-C
zoning district.
The parcel is of sufficient size that, if the applicant so desires, the parcel could be
subdivided for additional single family residential lots in the future. A maximum of four lots,
including one for the existing building could be created, however, given the location of the
farmer library building on the parcel, a subdivision into three parcels is more likely.
GENERAL PLAN:
The proposed change of zone is consistent with the General Plan.
AMENDMENT TO THE ZONING MAP
The zoning map is one of many tools utilized to implement of goals and objectives of the
General Plan. The zoning map should only be amended if such amendment in consistent
with the General Plan and furthers the goals and objectives outlined in the General Plan.
An amendment to the Zoning Map to Residential Single Family (R-1-C) would be
appropriate as this zone is intended for single family residential uses, which currently exist
to the north and west of the project site.Additional single family residential uses are located
south of Racquet Club Road and east of the Victoria Park/Vista Del Monte school complex.
CEQA AND NOTIFICATION
The site is substantially surrounded by urban development and all utility services are
available adjacent to the site. Pursuant to Section 15332 of the California Environmental
Quality Act (CEQA), the project is categorized an "in-fill development", and is therefore
Categorically Exempt from further environmental review under state law (Section 32 In-Fill
Development).
All owners of property within 400 feet of the subject property have been notified of the
public hearing. As of the preparation of this report, staff has not received any comments
from the public.

will hold a public hearing at its meeting of June 12, 2002. The Planning Commission meeting
begins at 1:30 pm (Public Hearings begin at 2:00 p.m.) in the City Council Chamber at City Hall,
3200 E. Tahquitz Canyon Way, Palm Springs, California.
The purpose of the hearing is to consider an application for a change of zone. The building was
formerly used as a public library. The applicant intends to convert the facility to a single family
residence. The proposed change of zone would be consistent with the General Plan.
The site is substantially surrounded by urban development and all utility services are available
adjacenttothe site. Pursuantto Section 15332 of the California Environmental Quality Act(CEQA),
the project is categorized an "in-fill development', and is therefore Categorically Exempt from
further environmental review under state law (Section 32 In-Fill Development).
The application and related documents are available for public review daily, between 8 am and 5

to the Commission meeting.

THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA DOES ORDAIN
AS FOLLOWS:
SECTION 1.Pursuant to Section 94.07.0013-6 of the Palm Springs Zoning Ordinance, the
official zoning map of the City of Palm Springs, referred to herein, is hereby amended as
follows:
Change of Zone from O to R-1-C
The parcel of property legally shown on Exhibit A is approved for a change of zone from O
to R-1-C, specifically on the property located on Assessor Parcel Number 501-590-007,
which is situated west of Via Miraleste, south of Francis Drive and north of Racquet Club
Road on file in the Planning and Zoning Department, Case 5.0912.
SECTION 2.EFFECTIVE DATE. This Ordinance shall be in full force and effect thirty (30)
days after passage.
SECTION 3. PUBLICATION. The City Clerk is hereby ordered to and directed to certify
to the passage of this Ordinance, and to cause the same or summary thereof or a display
advertisement, duly prepared according to law, to be published in accordance with law.
