HomeMy WebLinkAbout7/17/2002 - STAFF REPORTS (18) DATE: July 17, 2002 TO: City Council FROM: Director of Planning & Building CONDITIONAL USE PERMIT 5.0895 - APPLICATION BY SPRINT PCS FOR A CONDITIONAL USE PERMIT FOR THE INSTALLATION OF A COMMERCIAL COMMUNICATIONS ANTENNA ON A 55-FOOT TALL MONOPOLE AND FIVE SMALL EQUIPMENT CABINETS WITHIN A 432 SQUARE FOOT LEASE AREA LOCATED AT PALM SPRINGS FIRE STATION 3 AT 590 EAST RACQUET CLUB ROAD, ZONE O, SECTION 2. RECOMMENDATION: That the City Council approve Conditional Use Permit No. 5.0895 for the installation of a commercial communications antenna on a 55-foot tall slim monopole and five small equipment cabinets within a 432 square foot leased area located at City of Palm Springs Fire Station No. 3, located at 590 E. Racquet Club Road, Zone O, Section 2. Sprint PCS's representative is Steve Kaali. The Palm Springs Fire Department is the sublessor of the property to Sprint PCS. SUMMARY Planning Commission at its May 22, 2002 meeting, by a 4-0-1 vote recommended approval of Conditional Use Permit No.5.0895. The mono-pole as recommend by Planning Commission would be a 55' tall column without a flag. The existing flag pole would remain, and the proposed monopole would be located near the equipment area. Sprint PCS's representative spoke as the applicant and no other public comments have been received. BACKGROUND Sprint PCS has submitted an application for a Type II Conditional Use Permit to install a commercial communications antenna on a 55-foot tall monopole structure designed to look like a flag pole and five equipment cabinets within a 432 square foot leased area located at 590 E. Racquet Club Road. Sprint PCS is currently in the process of expanding their wireless telecommunication services to cover the immediate area as well as the entire Coachella Valley. The communication antenna is proposed to be an internal design locating the antennas within the proposed flag pole structure near the top of the pole. As a condition of approval, a final landscape plan would be required to be reviewed and approved by the Director of Planning and Building prior to issuance of building permits. The associated radio equipment will be housed in five equipment cabinets. The proposed equipment cabinets will be surrounded by a proposed six-foot high perimeter block wall which will be stuccoed and painted to match the existing building. A six-foot tall 30 feet wide automated sliding entry gate is being proposed to secure the parking lot. ANALYSIS Airport staff, was consulted about the site and indicated that the proposed commercial communications antenna structure is not an obstruction (i.e., the structure does not penetrate air 13A space around the airport), nor would the proposed antenna have any direct or indirect impacts on operations at Palm Springs International Airport. Helicopter tours fly in that area during the season, as well as some private helicopters,and whenever necessary,emergency/rescue aircraft. As such, Planning Commission has included a condition of approval which indicates that the City reserves the right to require, at any time in the future, one obstruction light on the tallest point of the structure extending 12" - 24" above the highest point of pole/fronds if deemed necessary by the Director of Planning and Building. Airport Operations would advise the Director of Planning and Building in the event the Airport receives complaints from pilots, the Tower Manager or the FAA. As an additional condition of approval, the applicant would be required to obtain all necessary approvals from the Federal Aviation Administration prior to issuance of building permits. The applicant has submitted photographs of the existing site as well as photo simulations of the proposed flag mono-pole and how it would appear in the current visual environment surrounding the site. These photo simulations depict the existing building which measures 15' at the maximum height, the proposed flag mono-pole at 55', five equipment cabinets within the leased area, and proposed 6' tall automated sliding gate pursuant to the proposed conditions of approval set forth in Exhibit A of the attached Resolution, and the proposed six-foot high perimeter wall around the lease hold area. The site is surrounded primarily by residential uses and open space. The Planning Commission, upon recommendation of the Design Review Committee, recommends relocating the monopole, deleting the proposed flag and keeping the existing flag pole(s) in their current location. The Planning Commission found that the existing flag poles are in scale with the building and that a single antenna pole without the proposed flag would reduce visual impact and result in the least view obstruction. Due to the site and surrounding uses, the Planning Commission found that a stealth antenna design(i.e. palm tree orflag pole)would create a greater view obstruction than a monopole. As recommended, there will be no visible antennas because they are located inside the pole. As a condition of approval, a final landscape plan and parking lot plan would be required to be reviewed and approved by the Director of Planning and Building prior to issuance of building permits. Planning Commission has also included conditions of approval pertaining to the removal of the antenna and/or monopole and equipment cabinets in the event the equipment becomes obsolete, are abandoned or the Conditional Use Permit expires. ENVIRONMENTAL ANALYSIS AND NOTIFICATION This Conditional Use Permit is categorically exempt from environmental assessment pursuant to Section 15303 of the California Environmental Quality Act (CEQA). Section 15303 states that installation of small new equipment is exempt from CEQA. All property owners within 400 feet of the project site have been notified of the public hearing. Todd Mierau, Assistant Planner, reported that the proposed antenna will include associated radio equipment housed in five cabinets, surrounded by a proposed six-foot high perimeter block wall, stuccoed and painted to match the exiting building. He reported that a six-foot tall, 30 foot wide automated sliding entry gate is also being proposed in order to secure the parking lot. He reported that Design Review recommended that the antenna not be disguised as a flagpole. Directorstated that an exiting flag pole at the site is approximately 25 feet in height and that a 55 foot flag pole would not be appropriate. He stated that FAA regulations will dictate lighting of the antenna. Chairman Klatchko opened the Public Hearing. Mr. Steve Kaali, Sprint PCS, addressed the Planning Commission to state that he is available for questions. There being no further appearances, the Public Hearing was closed. M/S/C (Shoe nberger/Jurasky 7-0) to approve per Conditions of Approval in Staff Report and relocate pole near the equipment; delete flag from antenna, and maintain the original flag pole as is. Commissioner Jurasky suggested that future antenna applications be reviewed initially at a Study Session prior to Planning Commission consideration. Case 3.1950—Application by John Wessman for a Architectural Approval to allow for the paving of a roadway and construction of two driveways on Camino Monte Roadway, a hillside property. Commissioner Matthews and Commissioner Raya abstained due to conflicts of interest. Director reported that the key issue is the developability of the lots—whether they are legal or not. He stated that staff has worked with the City Engineer and City Attorney and determined that the lots have been legally recorded (some lot line adjustments, some land trades with the City in an effort to bring future development downhill as far as possible which is best for flora and fauna). He clarified that, normally, grading plans alone are not considered — usually entire proposed development plans are considered. He reported that the applicant proposes relocating an existing trail and dedicating an easement for construction of anew pedestrian/equestrian trail. He clarified that the trail use is virtually year-round. He reported that the City will assume liability for the trail easement. He reported that a portion of the site is identified by Fish and Wildlife Service as Critical Area for Peninsular Bighorn Sheep and that the applicant and the City will coordinate with Fish and Wildlife Service to determine any modifications necessary to avoid negatively impacting the Peninsular Bighorn Sheep habitat. He reported that, if access and paving are approved today, the next likely step will be demolition of the existing water tower and the building of homes. OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA APPROVING CONDITIONAL USE PERMIT NO. 5.0895, SUBJECT TO THE CONDITIONS STATED, FOR SPRINT PCS TO INSTALL A COMMERCIAL COMMUNICATIONS ANTENNA ON A 55-FOOT TALL MONOPOLE AND FIVE EQUIPMENT CABINETS WITHIN A432 SQUARE FOOT LEASED AREA, LOCATED AT 590 EAST RACQUET CLUB ROAD,ZONE O, SECTION 2, AND MAKING FINDINGS IN SUPPORT THEREOF. WHEREAS, Sprint PCS ("Applicant") has filed an application with the City pursuant to Section 94.02.00 of the Zoning Ordinance for the installation of a Commercial Communications Antenna on a 55-foot tall monopole and five equipment cabinets within a 432 square foot leased area located at 590 East Racquet Club Road, Zone O, Section 2; and WHEREAS, notice of public hearing of the Planning Commission of the City of Palm Springs to consider Applicant's application for Conditional Use Permit No.5.0902was given in accordance with applicable law; and WHEREAS, on May 22, 2002, a public hearing on the application for Conditional Use Permit No. 5.0895 was held by the Planning Commission in accordance with applicable law; and WHEREAS, on July 17, 2002, a public hearing on the application for Conditional Use Permit No. 5.0895 was held by the City Council in accordance with applicable law, and WHEREAS, the proposed Conditional Use Permit(Case No. 5,0895)is categorically exempt from the provisions of the California Environmental Quality Act(CEQA)pursuant to Section 15303(New Construction or Conversion of Small Structures); and WHEREAS, the City Council has carefully reviewed and considered all of the evidence presented in connection with the hearing on the project, including, but not limited to, the staff report, and all written and oral testimony presented. THE CITY COUNCIL HEREBY FINDS AS FOLLOWS: Section 1: Pursuant to CEQA, the Planning Commission finds as follows: This Conditional Use Permit is categorically exempt from environmental assessment per Section 15303 of the California Environmental Quality Act (CEQA) in that Section 15303 states that installation of small new equipment is exempt from CEQA. 13C,' Section 2: Pursuant to Zoning Ordinance Section 94.02.00, the Planning Commission finds that: a. The use applied for at the location set forth in the application is properly one for which a conditional use permit is authorized by the City Zoning Ordinance. Pursuant to the Zoning Ordinance, a commercial communications antenna is authorized in the O (Open Space) Zone pursuant to approval of a Type If Conditional Use Permit. b. The use applied for is necessary or desirable for the development of the community, is in harmony with the various elements or objectives of the General Plan, and is not detrimental to existing uses or to future uses specifically permitted in the zone in which the proposed use is to be located. The proposed communications antenna is in harmony with the various elements and objectives of the City of Palm Springs General Plan and is not detrimental to existing uses specifically permitted in the zone in which the proposed use is to be located. The proposed communications antenna will not have a significant visual impact on the environment surrounding the site. C. The site for the intended use is adequate in size and shape to accommodate said use, including yards, setbacks, walls or fences, landscaping and other features required in order to adjust said use to those existing or permitted future uses of the land in the neighborhood. The site for the communications antennae, on a 432 square foot leased area located at 590 East Racquet Club Road, is adequate in shape and size to accommodate said use, including all features required in order to adjust said use to those existing or permitted future uses of the land in the neighborhood. d. The site for the proposed use related to streets and highways is properly designed and improved to carry the type and quantity of traffic to be generated by the proposed use. The site for the proposed communications antennae will not have a direct or indirect impact on streets and highways and is properly designed in the subject area. e. The conditions to be imposed and shown on the approved site plan are deemed necessary to protect the public health, safety and general welfare, including any minor modifications of the zone's property development standards. All proposed conditions of approval are necessary to ensure public health and safety. 13C-4)11--�-, NOW, THEREFORE, BE IT RESOLVED that, based upon the foregoing, the City Council hereby approves Conditional Use Permit No. 5.0895, subject to those conditions set forth in Exhibit A, on file in the Department of Planning and Building, which are to be satisfied prior to the issuance of a Certificate of Occupancy unless otherwise specified.
