DATE: July 17, 2002 TO: City Council FROM: Public Works Director/City Engineer ANNUAL MAINTENANCE DISTRICTS - PUBLIC HEARINGS FOR FISCAL YEAR 2002/03 RECOMMENDATION: It is recommended that City Council hold annual Public Hearings for 2 Lighting Maintenance Districts and 6 Parkways Maintenance Districts and approve 8 Resolutions adopting maintenance costs for: Lighting District No. 1-Belardo Area; Lighting District No.2- McManus Drive; Lighting District No. 3-Crossley Tract; Lighting District No. 4- Eagle Way area; Parkways District Nos. 6A, 6B and 6C -various locations; Parkways District No. 7-Sunrise Norte ; Parkways District No. 8 - Vintage Palms and Parkways District No. 9 - Flora Vista Tract, and approving the Fixed Charges Reports for the above 10 Maintenance Districts for Fiscal Year 2002/03. BACKGROUND: At the June 19 , 2002 Council Meeting, 10 Engineer's Reports and 6 Resolutions of Intention*were approved by City Council, setting the Public Hearing date for July 17, 2002 for 8 of the 10 maintenance districts in Palm Springs: 1. Street Lighting Maintenance District No. 1 (Belardo Area-166 Lots)** 2. Street Lighting Maintenance District No. 2 (McManus Drive-25 Lots)** 3. Street Lighting Maintenance District No. 3 (Crossley Tract- 75 Lots) *Res. #20363 4. Street Lighting Maintenance District No. 4 (Eagle Way Area-43 Lots) *Res. #20364 5. Parkways Maintenance District No. 6A (Chia Rd. Area- 24 Lots) *Res. #20365 6. Parkways Maintenance District No. 66 ("Parkside Estates" Tract- 93 Lots) *Res.#20365 7. Parkways Maintenance District No. 6C ("Park Sonora" Tract- 30 Lots) *Res. #20365 8. Parkways Maintenance District No. 7 ("Sunrise Norte' Tract- 53 Lots) *Res. #20366 9. Parkways Maintenance District No. 8 ("Vintage Palms" Tract- 63 Lots) *Res. #20367 10. Parkways Maintenance District No. 9 ("The Springs" Tract- 77 Lots) * Res. #20368 Eight (8) of the districts listed above are under the "Landscaping and Lighting Act of 1972" which requires Public Hearings every year. **Lighting Districts No. 1 &2 were created under the "Street Lighting Act of 1,931,"which require public hearings every 5 years. Since the last hearing for these districts was held in July 2001, a public hearing will not be required this year. As a result, the City Council only need to approve the annual maintenance costs for all 649 properties within the 10 districts and conduct a Public Hearing for Lighting Districts 3 and 4 and the 6 Parkways Districts. Attached is the Fixed Charges Report Summary for the 10 Maintenance Districts for FY02/03. Individual assessments are listed by assessor's parcel number and County Fund Number in the Fixed Charges Reports. Upon approval by City Council,the annual assessments will be forwarded to the Riverside County Tax Collector to be listed on the 2002/03 tax rolls. Under laws governing maintenance districts,any increases in annual assessments,over previously set maximums,would require a Public Meeting,then a Public Hearing following mailing of individual ballots to all affected property owners (Proposition 218-Article XIIID, Section 4 of the California Constitution, approved by California voters on November 5, 1996). Prop. 218 requires a 45-day Notice and Ballot(majority vote)for new formations or increases that exceed previously set maximums . Note: There are no cost increases over and above previous public hearing and Council approved maximum limits for any assessments for the maintenance districts in 2002/03. Assessments for all ten maintenance districts are detailed in the Engineer's Reports approved by City Council on June 19, 2002 and summarized as follows: SLMD No.1 (Belardo): Assess $8,581 ($51.69 average cost each for 166 lots)- $7,280 in 01/02 SLMD No.2 (McManus): Assess $4,250 ($170 each for 25 lots)- same as 01/02 SLMD No.3 (Crossley): Assess $2,484 ($33.12 each for 75 lots)- $1,985 in 01/02 SLMD NoA(Eagle Way): Assess $1,129 ($26.26 each for 43 lots)- same as 01/02 PMD No.6A (Fairport): Assess $4,181 (20 Lots:20 @ $149.32; 4 @ $298.64)- $1,296 in 01/02 PMD No.6B (Parkside): Assess $1,818 ($19.55 each for 93 lots)- same as 01/02 PMD No. 6C (Park Sonora): Assess $8,262 ($275.40 each for 30 lots)- same as 01/02 PMD No.7 (Sunrise Norte Tract): Assess $23,747 ($448.06 each for 53 lots)- $18,084 in 01/02 PMD No.8 (Vintage Palms): Assess $11,657 (62 @ $110.94; 2 @ $2,389.50)- $8,394 in 01/02 PMD No.9(Flora Vista Tract):Assess$0 ($0 because$17,762 surplus exceeds$17,196 estimate) Assessments are based on comparison of actual costs incurred in prior years vs. assessments in prior years to obtain annual adjustments to compensate for debits and credits on an annual basis. Also attached is a background memorandum which indicates the formation dates, locations and reasons for formation for the annual maintenance districts. The resolutions overule protests, confirm the spread of assessments as indicated on the Engineer's Reports and order the City Clerk to file a certified copy of the spread of assessments and map with the County of Riverside to place the assessments on the Riverside County Tax Roll for Fiscal Year 2002/03. Parkways District 9 77 1997 "Flora Vista" Tract (Flora Vista Tract) landscape buffer strip was Sunrise Way- Via developer installed on Escuela to Rac.Club Sunrise Way at Via Escuela, petioned by the property owners(1972 Act) TOTAL PROPERTIES 649 Additional Information: Lighting Maintenance Districts The Neighborhood Street Lights are maintained by the City Crews and Southern California Edison Co.(SCE)-(facilities maintenance crews, managed by local SCE office). Most of the annual costs (about 80% or more) are the basic SCE monthly electrical charges. In many cases the street lights were requested by property owners as a crime deterrent. Most of the general public, however, seem to prefer the dark desert sky atmosphere and do not wish neighborhood street lighting promoted by the City. The lighting districts were established in areas where more than 60% of the given area residents had petitioned the City to have the street lights installed. There are 309 properties in Palm Springs within the 4 lighting district boundaries. Parkways Maintenance Districts The parkways districts are primarily developer oriented projects that installed off-site landscaping along the public right-of-way perimeters of subdivisions as a condition-of-approval requirement of the Planning Commission. The landscaping is an enhancement to the project and neighborhood. These are typically single-family property ownerships that are not within a condominium type situation to handle the costs by association dues. Their chosen option is to form the maintenance district to spread the costs annually on the tax rolls since there is no other practical method to collect and pay for the annual maintenance costs . There are 340 properties in the 6 parkway maintenance districts City-wide, (see attached location map). Effective July 1, 2001 PAC WEST LAND CARE, INC. took over the annual Parkways Maintenance contract (replacing "The Groundskeeper" from prior year). PAC WEST's contract is for 3 years, with an option for 2 +2 additional years of extensions. Scott Mikesell, Director of Parks, Recreation and Facilities, administers and oversees the annual maintenance contracts. With the exception of Lighting Districts Nos. 1 and 2,most of the maintenance districts were formed under the California "Landscaping and Lighting Act of 1972". The exceptions are Lighting District No. 1 (Belardo area) and Lighting District No. 2 (McManus), which were formed under the California "Street Lighting Act of 1931". The 1931 Act only requires a public hearing once every five years, whereas the 1972 Act requires public hearings every year. The annual assessments (Fixed Charges Reporting Forms)must be submitted to the County Tax Collector by the 3rd. week of August annually. We therefore schedule to approve the Engineers Reports and adopt the Resolutions of Intentions amorally in June and hold the Public Hearings amorally in July in order to make the County Clerk's annual August deadline. According to the City Clerk, there have been no protests to date for any of the districts listed above, including the earliest district dating back to 1967.
