RECOMMENDATION: That the City Council approve a time extension from October 18, 2002 to October 18, 2003 for Tentative Tract Map 28668 (TTM 28668), subject to the original conditions of approval. The subject property is located west of Rose Avenue and north of Stevens Road, R-1-A Zone, Section 10. SUMMARY: The Planning Commission recommends approval of the one year time extension for TTM 28668. This is the first such request for time extension of TTM 28668. The requested time extension is so the applicant can continue working toward resolving the conditions of approval for TTM 28668. The Planning Commission, at its June 12", 2002 meeting, by a 4-0-1-2 vote, recommended approval of the one year time extension for TTM 28668, subject to the original conditions of approval. BACKGROUND: The Planning Commission, at its September 13,2000 meeting, recommended that the City Council approve Case No. 5.0757 - TTM 28668. The City Council subsequently approved the project at its October 18, 2000 meeting. The Tentative Tract Map consists of a 6 lot single family residential subdivision with lots ranging in size from 0.567 to 0.9 acres. The time extension represents the first such request filed by the applicant. At this time, the applicant indicates that the extension is required to continue working toward resolving the conditions of approval for TTM 28668. The applicant is making good progress towards resolving the issues and will need more time to complete the process. ENVIRONMENTAL ANALYSIS AND NOTIFICATION Requests for time extension are categorically exempt from an environmental assessment per Section 15301 of the California Environmental Quality Act (CEQA) and local guidelines for implementation of CEQA. OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, APPROVING A TIME EXTENSION FROM OCTOBER 18, 2002 TO OCTOBER 18, 2003 FOR A TENTATIVE TRACT MAP TO SUBDIVIDE 4.48 ACRES OF LAND INTO A 6-LOT SINGLE FAMILY RESIDENTIAL SUBDIVISION, FOR THE PROPERTY LOCATED WEST OF ROSE AVENUE, NORTH OF STEVENS ROAD, R-1-A ZONE, SECTION 10. WHEREAS, Mainiero, Smith and Associates (agent for Edith Toor Armstrong) (the "Applicant') requests approval of a time extension for Tentative Tract Map 28668 (TTM 28668) for property located west of Rose Avenue and north of Stevens Road, R-1-A Zone, Section 10; and WHEREAS, the Applicant has requested additional time to October 18, 2003 to continue working towards resolving the conditions of approval for TTM 28668; and WHEREAS, on June 12, 2002, a public meeting on the request for a time extension from October 18, 2002 to October 18, 2003 for TTM 28668 was held bythe Planning Commission in accordance with applicable law; and WHEREAS,on June 12,2002,the Planning Commission voted 4-0-1-2 to approve a time extension from October 18, 2002 to October 18, 2003 for TTM 28668; and WHEREAS, on July 31, 2002, a public meeting on the request for time extension from October 18, 2002 to October 18, 2003 for TTM 28668 was held by the City Council in accordance with applicable law; and WHEREAS, the City Council has carefully reviewed and considered all of the evidence presented in connection with the project, including but not limited to the staff report, all written and oral testimony presented. NOW THEREFORE BE IT RESOLVED that the City Council of the City of Palm Springs, California, after considering the evidence provided at the meeting, does hereby approve the time extension for TTM 28668 from October 18, 2002 to October 18, 2003, subject to all previously adopted conditions of approval.
