RECOMMENDATION
That the City Council approve Tentative Parcel Map 30703 subject to the conditions of approval
in the attached resolution.
SUMMARY
The purpose of the hearing is to consider a Tentative Parcel Map application by John L. Sanborn
for Melvyn Haber Revocable Trust to divide one(1)parcel into two(2)parcels. There is an existing
single family residence on the parcel but there are no plans for a structure on the proposed parcel
at the present time.
The Planning Commission at its August 141h, 2002 meeting, by a 6-0-1 vote, recommended
approval, subject to the conditions in the attached resolution of TPM 30703.
BACKGROUND
The property, which is located at 700 W. Stevens Road, is 1.76 acres (76795 square feet) and
includes an existing single family residence. The property is zoned R-1-A (Single Family
Residential)with a General Plan designation of L2 (Low Density Residential 2-4 units/acre). The
proposed parcel map will create two new parcels. Parcel 1 would be 38,281 square feet and Parcel
2 would be 19,257 square feet. Parcel 1 has an existing single family residence. An Administrative
Minor Modification was approved for the substandard size of Parcel 2. The substandard lot is due
to the 10 foot side setback requirement for single family residences in the R-1-A zone. Any future
development on Parcel 2 will comply with all R-1-A property development standards, including
setbacks.
Both parcels will be consistent with the goals and policies of the Zoning Ordinance and General
Plan.

The Public Works and Engineering Department has recommended conditions of approval which

include provisions for construction of General Plan street improvements on Stevens Road,
construction of sanitary sewer improvements, as well as the undergrounding of existing overhead
utilities. Stevens Road is identified as a Collector Street on the General Plan, requiring a 40 feet
wide travel way. Originally, Stevens Road was constructed in 1953 as a local street with a 24 feet
wide travel way. The property was previously subject to conditions similar to those currently
proposed as part of the approval of the existing single family residence located on Parcel 1,
approved as Case No. 3.566 in 1983. Concurrently with the development of the single family
residence, the property was also resubdivided from three individual lots into two parcels, via Parcel
Map 19257. This parcel map closely resembles the proposed Tentative Parcel Map 30703,
however, after recordation of Parcel Map 19257 and pursuant to the request of the property owner,
Lot Line Adjustment 89-16 was submitted, approved and recorded in 1989 merging Parcels 1 and
2 of Parcel Map 19257.
The construction of ultimate street improvements and undergrounding of overhead utilities were
deferred to a covenant for the single family residence, as was allowed under the Municipal Code.
These covenants are recorded and are on file with the City. The Engineering Department
recommends that the street improvements adjacent to Parcel 1 be deferred to a new covenant, to
be recorded against Parcel 1, to reflect the change in legal description of the property from the
underlying Lots 21 and 22 of Palm Vista Estates to Parcel 1 of Parcel Map 30703. However, in
accordance with Subdivision Map Act regulations and current Municipal Code, the recommended
street improvements adjacent to Parcel 2(the vacant parcel) must be reflected on the Parcel Map
as an Improvement Certificate. When a building permit application for a single family residence
is received for the vacant parcel, the street improvements may be deferred to a covenant at that
time.
In regards to the utility undergrounding covenant, the existing covenant was allowed through the
Municipal Code exemption for single family residence construction, and relates only to the
underlying Lots 21 and 22 of Palm Vista Estates, and not the entire property. However, the
Municipal Code requires utility undergrounding for subdivisions, and an exemption is not allowed
for cases where the linear feet exceeds 300 feet. The subject property, including the portion of the
property affected by the existing covenant, is 375.99 feet. The Engineering Department
recommends that the existing overhead utility lines across the entire rear property line of the
subject property be installed underground, in conformance with the Municipal Code.
In regards to required sanitary sewer line construction; the property was subject to construction of
an 8 inch sewer main and connection thereto, as part of Assessment District 143. This portion of
the sanitary sewer system along Stevens Road was never constructed, and the property owner
deferred this obligation to a covenant. The covenant relates only to the underlying Lots 21 and 22
of Palm Vista Estates, and not the entire property. Furthermore,the covenant specifically deferred
the sanitary sewer obligation for the property until such time "...that the central sewage treatment
facilities are capable of serving the area...". The City's wastewater treatment plant has
subsequently been improved to adequately serve the entire City, and the condition of the sewer
covenant has been satisfied whereby construction of the sewer line extension is required.
The length of the sewer line extension is approximately 250 feet and would extend from Via Monte
Vista to Parcels 1 and 2. The property owner is not eligible for an exemption per Municipal Code
Chapter 15.14.010 which allows for exemptions. This chapter states that exemptions may be
granted by the city manager, or city council and include, "...single family dwelling on a lot of record
and the distance from the lot line to the public sewer is greater than five hundred feet," and,
"...unusual topographical or other terrain conditions exists which make the connection to the public

sewer impractical, unreasonable, unfeasible or impose extreme economic hardship upon the
property owner if he is required to connect such building to the public sewer system." Previously
granted exemptions have been related to servicing existing homes when the City went through its
city-wide sewer program in the 1980s and for new homes on existing lots. However, it is not clear
that the exemptions would apply for new subdivisions.
The property owner, with this proposed Tentative Parcel Map, is requesting subdivision of the
property into a similar configuration as the two parcels of Parcel Map 19257. However, to
resubdivide the property, the property owner is subject to the Municipal Code and Zoning
Ordinances currently in effect that govern approval of tentative maps. The Engineering Department
recommends deferral of street improvements to covenant as they relate to Parcel 1 and deferral
via an Improvement Certificate on the Parcel Map as they relate to Parcel 2; and recommends
undergrounding of overhead utilities and construction of sewer line extension consistent with
Municipal Code regulations.
ENVIRONMENTAL ANALYSIS AND NOTIFICATION
This action is categorically exempt from the provisions of the California Environmental Quality Act
(CEQA) per section 15332, whereas the proposed Tentative Parcel Map meets the conditions
outlined for In-Fill Development Projects.
All property owners within a 400 foot radius of the subject property have been notified. As of the
writing of this report, staff has received two phone calls from surrounding property owners inquiring
about the nature of the project, but there was no objection to the creation of a new parcel.

two parcels for the property located at 700 W. Stevens Road, Zone R-1-A, Section 10.
Commissioner Marantz abstained due to a conflict of interest.
Jing Yeo,Assistant Planner, reported that there is an existing single family residence on the parcel
and no plans at this time to construct a structure on the proposed parcel. She reported that both
parcels are would be consistent with the goals and policies of the Zoning Ordinance and the
General Plan and reviewed the exhibits for the Planning Commission.
Chairman Klatchko opened the Public Hearing.
Mr. Alan Sanborn, Sanborn A&E, addressed the Planning Commission to state that he has
concerns with some Conditions of Approval and submitted photographs of the existing condition
of the curb line at the vacant parcel location. Specifically, he stated that Engineering Condition
Nos. 3-6 regarding Stevens Road West would necessitate the removal of all landscaping and the
addition of a retaining wall 6-8 feet in height. He explained that there are no sidewalks in the
adjacent neighborhood and that the Planning Commission had recently approved a subdivision with
no sidewalks required. He stated that the developer of the property would be willing to participate
in an assessment district for sewer connection at the time that all property owners agree to
participate.
There being no further appearances, the Public Hearing was closed.
Commissioner Caffery suggested that a sidewalks are a possible Planning Commission Study
Session review item for the near future. Director clarified that the General Plan addresses the
issue and allows covenants for sidewalks and other street improvements.
Chairman Klatchko suggested that the roadway designation of Stevens Road west of Camino
Monte Vista be reviewed for possible reclassification.
Marcus Fuller, Civil Engineer, stated that in 1984 or 1985, there was an existing residence which
covered two lots and required a parcel map and that, in 1988, a lot line adjustment was approved
to merge the lots. He stated that the applicable conditions to re-subdivide those lots include the
original covenants for the existing home which is covered in Engineering Condition No. 07. He
reported that the City does not require improvements for vacant parcels—that the Map Act governs
those requirements and that the ability to defer by covenant at the time of building permit is an
option and that nothing is required of the applicant at this time. He clarified that when the City
determines and forms an assessment district to fully improve the streets is the time the covenants
will be called. He stated that the Municipal Code requires sewer connections for homes at the time
of construction; however, at the time of the existing home's construction, there was no sewer plant
capacity, and, because the map application has been brought forth, it is appropriate to impose this
condition to be consistent with Municipal Code goals. He reported that the burden for the applicant
is that costs for the approximate 250 feet of sewer line must be paid up front; however, at the end

of the year, the City will enter into an agreement with developer for cost recovery which would be
collected by the City from by neighboring property owners at the time of new home construction
or if existing septic systems fail and then reimbursed to the applicant.

CONDITIONS OF APPROVAL
Before final acceptance of the project, all conditions listed below shall be completed to the
satisfaction of the City Engineer, the Director of Planning, the Chief of Police, the Fire Chief or their
designee, depending on which department recommended the condition.
Any agreements, easements or covenants required to be entered into shall be in a form approved by
the City Attorney.
1. The proposed development of the premises shall conform to all applicable regulations of the
Palm Springs Zoning Ordinance, Municipal Code, or any other City Codes, ordinances and
resolutions which supplement the zoning district regulations.
2. The owner shall defend, indemnify, and hold harmless the City of Palm Springs, its agents,
officers, and employees from any claim, action, or proceeding against the City of Palm
Springs or its agents, officers or employees to attach, set aside, void or annul, an approval
of the City of Palm Springs, its legislative body, advisory agencies, or administrative officers
concerning Tentative Parcel Map 30703. The City of Palm Springs will promptly notify the
applicant of any such claim, action, or proceeding against the City of Palm Springs and the
applicant will either undertake defense of the matter and pay the City's associated legal costs
or will advance funds to pay for defense of the matter by the City Attorney. If the City of
Palm Springs fails to promptly notify the applicant of any such claim, action or proceeding or
fails to cooperate fully in the defense, the applicant shall not, thereafter, be responsible to
defend, indemnify, or hold harmless the City of Palm Springs. Notwithstanding the
foregoing, the City retains the right to settle or abandon the matter without the applicant's
consent but should it do so,the City shall waive the indemnification herein, except, the City's
decision to settle or abandon a matter following an adverse judgement or failure to appeal,
shall not cause a waiver of the indemnification rights herein.
3. That the property owner(s) and successors and assignees in interest shall maintain and
repairthe improvements including and without limitation sidewalks, bikeways, parking areas,
landscape, irrigation, lighting, signs, walls, and fences between the curb and property line,
including sidewalk or bikeway easement areas that extend onto private property, in a first
class condition, free from waste and debris, and in accordance with all applicable law, rules,
ordinances and regulations of all federal, state, and local bodies and agencies having
jurisdiction at the property owner's sole expense. This condition shall be included in the
recorded covenant agreement for the property if required by the City.

4. Prior to issuance of a grading permit, a Fugitive Dust and Erosion Control Plan shall be
submitted and approved by the Building Official. Refer to Chapter 8.50 of the Municipal
Code for specific requirements.
5. The grading plan shall show the disposition of all cut and fill materials. Limits of site
disturbance shall be shown and all disturbed areas shall be fully restored or landscaped.
6. Drainage swales shall be provided adjacent to all curbs and sidewalks-3'wide and 6"deep.
The irrigation system shall be field tested prior to final approval of the project. Section
14.24.020 of the Municipal Code prohibits nuisance water from entering the public streets,
roadways or gutters.
7. An Administrative Minor Modification shall be required priorto issuance of building permits so
as to allow the creation of a substandard lot 19,257 square feet in size.
ENGINEERING:
Before final acceptance of the project, all conditions listed below shall be completed to the
satisfaction of the City Engineer.
STREETS
1. Any improvements within the street right-of-way require a City of Palm Springs
Encroachment Permit. Work shall be allowed according to Resolution 17950 - Restricting
Street Work on Major and Secondary Thoroughfares.
2. Submit street improvement plans prepared bya Registered Civil Engineerto the Engineering
Department. The plan(s) shall be approved by the City Engineer prior to issuance of any
grading or building permits.
Minimum submittal shall include the following, IF applicable:
A. Copy of signed Conditions of Approval from Planning Department.
B. All agreements and improvement plans approved by City Engineer, IF applicable.
C. Proof of processing dedications of right-of-way, easements, encroachment
agreements/licenses, covenants, reimbursement agreements, etc. required by these
conditions.
STEVENS ROAD WEST
3. Remove the existing roll curb located 12 feet north of centerline and construct a 6 inch curb
and gutter, 20 feet NORTH of centerline along the entire frontage per City of Palm Springs
Standard Drawing No. 200 and 206.
4. Construct minimum 10 wide driveway approaches at approved points of access, in
accordance with City of Palm Springs Standard Drawing No. 201.
5. Construct a minimum 5 foot wide sidewalk behind the curb along the entire frontage in
accordance with City of Palm Springs Standard Drawing No. 210.

6. Construct ac pavement with a minimum pavement section of 3 inch asphalt concrete
pavement over 6 inch aggregate base with a minimum subgrade of 24 inches at 95% relative
compaction, OR equal, from edge of proposed gutter to centerline along the entire frontage
in accordance with City of Palm Springs Standard Drawing No. 110 and 315. The pavement
section shall be designed, using "R" values, by a licensed Soils Engineer and submitted to
the City Engineer for approval.
7. The developer shall enter into a covenant agreeing to construct all mentioned street
improvements along the Parcel 1 frontage, to supercede the existing covenant recorded as
Document No. 185717, September 12, 1983, against Lots 21 and 22 of Palm Vista Estates,
Unit No. 1, Map Book 26, Page 9.
SANITARY SEWER
8. Connect all sanitary facilities to the City sewer system. Lateral shall not be connected at
manhole.
9. Developer shall construct an 8 inch sewer main from the existing cleanout east of the
property to Manhole No. 7 as shown on the approved Sewer Improvement Plan, File No. 2A-
1-90, Drawing No. 2780-3, on file with the Engineering Department. The developer shall
have a California licensed civil engineer modify the approved drawing to extend the 8 inch
sewer main to service the existing structure located on Parcel 1, if possible, or shall
otherwise construct required sewer mains as necessary to provide sewer service to Parcel
1 as shown on the approved Sewer Improvement Plan, File No. 2A-1-89, Drawing No. 2780-
2.
10. All sewer mains constructed by the developer and to become part of the City sewer system
shall be televised by the developer prior to acceptance of said lines.
11. The developer may enter into a reimbursement agreement with the City of Palm Springs for
reimbursement of the construction costs for the sewer main extension as properties connect
to the extended sewer main in the future. If a reimbursement agreement is requested, the
developer shall contact the City Engineer for details relating to a sewer reimbursement
agreement. The reimbursement agreement shall be completed prior to approval of the
Parcel Map.
GRADING
12. Drainage swales shall be provided adjacent to all curbs and sidewalks-3'wide and 6"deep-
to keep nuisance water from entering the public streets, roadways, or gutters.
GENERAL
13. Any utility cuts in the existing off-site pavement made by this development shall receive
trench replacement pavement to match existing pavement plus one additional inch. See City
of Palm Springs Standard Drawing No. 115. Pavement shall be restored to a smooth
rideable surface.

14. All existing utility lines that are less than 35 kV on/or adjacent to this project shall be
undergrounded. The location and size of the existing overhead facilities shall be provided to
the Engineering Department along with written confirmation from the involved utility
company(s) that the required deposit to underground the facility(s) has been paid, prior to
issuance of a grading permit.
All undergrounding of utilities shall be completed prior to issuance of a Certificate of
Occupancy.
MAP
15. The Title Report prepared for subdivision guarantee for the subject property, the traverse
closures for the existing parcel and all lots created therefrom, and copies of record
documents shall be submitted with the Parcel Map or Final Map to the Engineering
Department.
16. The Parcel Map shall be prepared by a licensed Land Surveyor or qualified Civil Engineer
and submitted to the Engineering Department for review. The map shall be approved by the
City Council prior to issuance of grading or building permits.
17. All required street improvements adjacent to Parcel 2 included in these Engineering
Conditions of Approval shall be listed in an Improvement Certificate on the Parcel Map and
clearly noted that those improvements adjacent to Parcel 2 are the minimum development
requirements for Parcel 2 of Parcel Map No. 30703, and need not be completed until
issuance of a certificate of occupancy for Parcel 2.
TRAFFIC
18. The developer shall provide a minimum of 48 inches of sidewalk clearance around all street
furniture, fire hydrants and other above-ground facilities for handicap accessibility. The
developer shall provide same through dedication of additional right-of-way and widening of
the sidewalk or shall be responsible for the relocation of all existing traffic signal/safety light
poles, conduit, pull boxes and all appurtenances located on the STEVENS ROAD WEST
frontage of the subject property.

NOTICE IS HEREBY GIVEN that the City Council of the City of Palm Springs, California, will hold
a public hearing at its meeting of September 18, 2002. The meeting begins at 7:00 p.m. in the
Council Chambers at City Hall, 3200 East Tahquitz Canyon Way, Palm Springs, California.
The purpose of the hearing is to consider a Tentative Parcel Map application by John L. Sanborn
for Melvyn Haber Revocable Trust to divide one parcel into two parcels for the property located at
700 W. Stevens Road,Zone R-1-A, Section 10. The resulting parcels would be 38,281 square feet
and 19,257 square feet. No new development is proposed as part of this application.

NOTICE IS HEREBY GIVEN that the Planning Commission of the City of Palm Springs, California,
will hold a public hearing at its meeting of August 14, 2002. The meeting begins at 1:30 p.m.
(public hearings begin at 2:00 p.m.), and will be held at the Council Chamber of the City Council
of the City of Palm Springs, 3200 East Tahquitz Canyon Way, Palm Springs, California 92262.
The purpose of the hearing is to consider a Tentative Parcel Map application by John L. Sanborn

OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS,
CALIFORNIA APPROVING TENTATIVE PARCEL MAP 30703
SUBJECT TO THE CONDITIONS STATED, TO DIVIDE A 1.32
ACRE PARCEL INTO TWO PARCELS. FOR THE PROPERTY
LOCATED AT 700 W. STEVENS ROAD, ZONE R-1-A, SECTION
10.
WHEREAS, John L. Sanborn for Melvyn Haber Revocable Trust (the "Applicant"), has filed an
application with the City pursuant to Section 94.02.00 of the Zoning Code and the Palm Springs
Municipal Code Section 9.60 for a Tentative Parcel Map to divide a 1.32 acre parcel into two
parcels for the property located at 700 W. Stevens Road, Zone R-1-A, Section 10; and
WHEREAS, the Applicant has filed Tentative Parcel Map 30703 with the City and has paid the
required filing fees; and
WHEREAS, said Tentative Parcel Map was submitted to appropriate agencies as required by the
subdivision requirements of the Palm Springs Municipal Code, with the request for their review,
comments and requirements; and
WHEREAS, notice of a public hearing of the Planning Commission of the City of Palm Springs to
consider Applicant's application for Tentative Parcel Map 30703 was given in accordance with
applicable law; and
WHEREAS, on August 14, 2002, a public hearing on the application for Tentative Parcel Map
30703 was held by the Planning Commission in accordance with applicable law; and
WHEREAS, notice of a public hearing of the City Council of the City of Palm Springs to consider
Applicant's application for Tentative Parcel Map 30703 was given in accordance with applicable
law; and
WHEREAS, on September 18, 2002, a public hearing on the application for Tentative Parcel Map
30703 was held by the City Council in accordance with applicable law; and
WHEREAS, pursuant to Government Code Section 66412.3, the City Council has considered the
effect of the proposed Subdivision, Tentative Parcel Map 30703 and the approval of the proposed
Subdivision represents the balance of these respective needs in a mannerwhich is most consistent
with the City's obligation pursuant to its police powers to protect the public health, safety, and
welfare; and
WHEREAS, the proposed Subdivision, Tentative Tract Map 30703, is considered a "project"
pursuant to the terms of the California Environmental Quality Act ("CEQA"), and is categorically
exempt from the provisions of CEQA per Section 15332, for In-Fill Development Projects; and
WHEREAS, the City Council has carefully reviewed and considered all of the evidence presented
in connection with the hearing on the Project, including but not limited to the staff report, and all
written and oral testimony presented.

THE CITY COUNCIL HEREBY FINDS AS FOLLOWS:
Section 1: Pursuant to Section 9.63.070 of the Zoning Ordinance, the City Council finds that
with the incorporation of those conditions attached in Exhibit A:
a. Tentative Parcel Map 30703 is categorically exempt from environmental assessment per
Section 15332, In-fill development projects, of the California Environmental Quality Act
(CEQA).
b. The proposed map is consistent with the applicable General Plan.
C. The design or improvements of the proposed subdivision are consistent with the General
Plan.
d. The site is physically suitable for the type of development contemplated by the proposed
subdivision.
e. The site is physically suitable forthe proposed density of development contemplated bythe
proposed subdivision.
f. The design of the subdivision or improvements is not likely to cause substantial
environmental damage or substantially and unavoidably injure fish orwildlife or their habitat.
NOW, THEREFORE, BE IT RESOLVED that, based upon the foregoing, the City Council hereby
approves Tentative Parcel Map 30703, subject to those conditions set forth in Exhibit A, attached.
