HomeMy WebLinkAbout10/2/2002 - STAFF REPORTS (4) DATE: October 2, 2002 TO: City Council FROM: Executive Director-Airports RATIFICATION OF EMERGENCY CONSTRUCTION CONTRACTS RECOMMENDATION: It is recommended that City Council ratify emergency construction contracts with James E. Simon Co. and Chris W. Foster, Inc.forwork atthe Airport terminal building related to the installation of Explosive Detection Systems. SUMMARY: This action would ratify emergency construction contracts authorized by the City Manager for the Airport to meet the November 1, 2002, expected arrival of Explosive Detection Equipment. BACKGROUND: The Aviation Transportation Security Act of 2001 mandates the installation of Explosive Detection Systems (EDS) at all airports by December 31, 2002. At Palm Springs, it is expected that EDS equipment will be arriving by November 1, 2002, for installation. In jointly developing a plan for the EDS at the Airport, it has been determined that three modifications to the building are necessary as follows: (also see attached sketch) 1. Temporary platform over stairs in new ticket wing 2. Pop-out of glass storefront in front of terminal 3. Demolition and remodel of old dress shop Section 7.04.040(3) Emergencies of the Municipal Code (The new Procurement Ordinance) states: Emergency Procurement for the Palm Springs International Airport. The City Manager or his/her representative may authorize the Director or the Director of Aviation, or his/her representative, to make emergency procurement of supplies, services or construction items regardless of the amount of the expenditure when there exists a threat to public health, welfare, security, or safety at the Palm Springs International Airport, as determined by the Director of Aviation or his/her representative and/or as defined by FAA Regulations or other appropriate safety or regulatory guidelines." Based on the above allowances and the mandates to protect public safety and security of ATSA, Airport staff has negotiated two construction contracts for the projects. October 2, 200 Ratification of Emergency Construction Contracts Page Two A contract has been negotiated with Chris Foster for the platform project at a cost not to exceed$20,000. A contract has been negotiated with James E. Simon, Co. for the other two projects at an amount not to exceed $80,000. A Resolution is attached which ratifies the City Manager's emergency contracting for these two projects. WHEREAS the Aviation Transportation Security Act of 2001 (ATSA) was enacted by the Federal Government and mandates the deployment of a Federal Security Force at airports; and WHEREAS ATSA mandated the installation of Explosive Detection Systems at all airports by December31, 2002, and at Palm Springs equipment is expected to begin arriving by early November; and WHEREAS the implementation of the Explosive Detection Plan at the Airport requires small remodels to the building, all which must be accomplished within the next month; and WHEREAS Section 7.04040(3) of the Procurement Ordinance allows for emergency contracting at the Airport to mitigate threats to public safety and security, and ATSA's deadlines were established to do just that; and WHEREAS staff has negotiated contracts with two local contracting firms to carry out this emergency work, which have been approved by the City Manager under emergency authority, NOW THEREFORE BE IT RESOLVED that the City Council does hereby ratify the emergency contracts for terminal building remodels as follows: Contractor Project Price Up To Chris W.
