AN ORDINANCE OF THE CITY OF PALM SPRINGS,
CALIFORNIA, ADOPTING AND AMENDING THE 2001
EDITIONS OF THE CALIFORNIA BUILDING CODE WITH
APPENDICES CHAPTER 3, DIVISION IV,4 DIVISION 11, 12,
DIVISION IIA,15, 18, 31 DIVISIONS 11 AND III, 33 AND 34,
DIVISION III.THE CALIFORNIA MECHANICAL CODE,THE
CALIFORNIA PLUMBING CODE, THE CALIFORNIA
ELECTRICAL CODE, AND THE 1997 EDITIONS OF THE
UNIFORM HOUSING CODE, UNIFORM CODE FOR THE
ABATEMENT OF DANGEROUS BUILDINGS, UNIFORM
SOLAR ENERGY CODE, UNIFORM SWIMMING POOL,
SPA AND HOT TUB CODE AND THE UNIFORM
ADMINISTRATIVE CODE.
THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, DOES ORDAIN
AS FOLLOWS:
SECTION 1: Section 8,04.005 of the Palm Springs Municipal Code is hereby amended to
read as follows:
8.04.005 Citation of Building Code This chapter, the California Building Code,2001
edition;the California Mechanical Code,2001 edition;the California Plumbing Code,
2001 edition; the California Electrical Code, 2001 edition; the Uniform Housing
Code, 1997 edition; the Uniform Code for the Abatement of Dangerous Buildings,
1997 edition; the Uniform Solar Energy Code, 1997 edition; the Uniform Swimming
Pool, Spa and Hot Tub Code, 1997 edition; the Uniform Administrative Code, 1997
edition; the California Seismic Safety Commission Model Ordinance; may be
collectively referred to and cited as the "Palm Springs Building Code".
SECTION 2. Section 8.04.010 of the Palm Springs Municipal Code is hereby amended to
read as follows:
8 04 010 California Building Code --Adopted These certain documents, a copy of
each of which are on file in the office of the City Clerk, being marked and
designated as "California Building Code, 2001 edition," and appendices Chapters
3 Division IV, 4 Division 11, 12, DIVISION IIA,15, 18, 31 Divisions II and 111, 33 AND
34, DIVISION Ill including tables and indices thereto, except as hereinafter
modified, are hereby adopted as the Building Code of the City by reference,
pursuant to the provisions of Section 50022.1 et. seq. of California Government
Code.
SECTION 3. Section 8.04.015 of the Palm Springs Municipal Code is hereby amended to
read as follows:
8.04.015 California Building Code -- Additions Amendments and Deletions The
California Building Code adopted herein by reference is hereby amended by the
following additions, deletions and amendments:
1. Subsection 106.2, Work Exempt From Permit, items 1 through 11 are
deleted.

2. Subsection 904.2.2, All occupancies except Group R, Division 3 and Group
U occupancies, is amended to read as follows: An approved automatic fire
sprinkler system shall be installed in every building except detached single
family residences where the gross floor area exceeds 3,000 square feet, or
any building regardless of size which is built beyond a five minute Fire
Department emergency response time as defined from time to time by
resolution of the City Council.
Notes: 1. For purposes of this code section regarding business size,
fire resistive walls shall not be considered for purposes of
reducing the gross floor area of the building.
2. In all Group R occupancies, the locally modified standard for
installation of sprinkler systems in residential occupancies
shall be used.
Exception: Group R-3 occupancies in Tracts 2082, 2928, 3600 and
8137 are exempt from the five minute response time fire
sprinkler requirement.
3. Subsection 904.2.3.1, Drinking Establishments, is amended to read as
follows: An approved automatic fire sprinkler system shall be installed in
every Group A occupancy including those that result from a change of use
in an existing building or portion thereof.
4. The following is added to Section 1503, Roofing Requirements: All wood
shakes or shingles, as defined in Section 1502, shall be pressure treated
fire retardant with a minimum Class B rating.
5. Subsection 2506A.4, Weather-resistive Barriers, is amended to read as
follows: Weather-restrictive barriers shall be installed as required in
Subsection 1402.1.
6. The following exception is added at the end of Subsection 2506A.5,
Application of Metal Plaster Bases:
Exception: Weep screeds may be eliminated where the exterior plaster
is carried all the way to grade on wall systems where the
foundation plate is affixed flush to the edge of an on grade
concrete floor slab and the lath and paper extends at least
two inches below the plate line.
7. Appendix Chapter 12, Division IIA, Subsection 1208A.1.1 Purpose and
Scope, is amended to read as follows: The purpose of this section is to
establish uniform minimum noise insulation performance standards to
protect persons within hotels, motels, dormitories, apartment houses,
attached dwellings and those detached single-family dwellings located within
the airport 'N' zone overlay from the effects of excessive noise, including,
but not limited to, hearing loss or impairment and interference with speech
and sleep.

8. Appendix Chapter 15, Section 1515, Inspection and Written Approval, is
amended by the addition of the following paragraph: All roof top equipment,
unless exempted by the Building Official, shall be provided with an approved
six (6) inch high platform equipped with a sheetmetal cover. Design of the
platform shall be as per City detail or approved equal.
9. Items numbered 1, 8 and 9 are deleted from Appendix Chapter 33,
Subsection 3306.2, Exempted Work.
10. Appendix Chapter 33,Subsection 3309.3, Grading Designation, is amended
to read as follows: Grading in excess of 2,000 cubic yards shall be
performed in accordance with the approved grading plan prepared by a civil
engineer, and shall be designated as "engineered grading". Grading
involving less than 2,000 cubic yards shall be designated as 'regular
grading" unless the permittee chooses to have the grading performed as
engineered grading, or the Building Official determines that special
conditions or unusual hazards exist, in which case, grading shall conform to
the requirements for engineered grading.
Exception: Grading in excess of 2,000 cubic yards which is primarily of
a landscaping and "fine grading" nature, where no flood
hazard is present, may be termed 'regular grading" at the
discretion of the Building Official.
11. The following subparagraph 8 is added to Appendix Chapter 33, Subsection
3309.4, Engineered Grading Requirements,concerning information on plans
and specifications: An effective means of dust control which shall include
provisions for adequate watering during the grading process and provision
for continuance of dust control after grading, until such time that the graded
surface presents sufficient protective cover against wind orwater erosion so
that special dust control measures are no longer necessary.
SECTION 4. Section 8.04.020 of the Palm Springs Municipal Code is hereby amended to
read as follows:
8.04.020 California Mechanical Code--Adopted That certain document, a copy of
which is on file in the office of the City Clerk, being marked and designated as
"California Mechanical Code, 2001 edition", and all appendices, tables and indices
thereto, except as hereinafter modified, is hereby adopted as the Mechanical Code
for the City of Palm Springs, by reference pursuant to the provisions of Section
50022.1 et. seq. of the California Government Code.
SECTION 6. Section 8.04.030 of the Palm Springs Municipal Code is hereby amended to
read as follows:
8.04.030 California Plumbing Code --Adopted That certain document, a copy of
which is on file in the office of the City Clerk, being marked and designated as
"California Plumbing Code, 2001 edition", and appendices A, B, C, D, H, I, K,
including tables and indices thereto, except as hereinafter modified, is hereby
adopted as the Plumbing Code of the City by reference, pursuant to the provisions
of Section 50022.1 et seq. of the California Government Code.

SECTION 7. Section 8.04.032 of the Palm Springs Municipal Code is hereby amended to
read as follows:
8.04.032 California Plumbing Code --Additions and Amendments The California
Plumbing Code adopted herein by reference is amended by the following additions
and amendments.
1. IAPMO Installation Standard IS 1-91, PVC Sewer Pipe, Subsection
301.1.1 is amended to read as follows: PVC sewer pipe and piping
conveying storm water shall be schedule 40 or approved equal. PSP
and PSM sewer piping is not interchangeable in sizes eight inches
and larger.
SECTION 8. Section 8.04.035 of the Palm Springs Municipal Code is hereby amended to
read as follows:
8.04.035 Uniform Housing Code--Adopted.That certain document, a copy ofwhich
is on file in the office of the City Clerk, being marked and designated as "Uniform
Housing Code, 1997 edition" and all appendices, tables and indices thereto, is
hereby adopted as the Uniform Housing Code of the City by references, pursuant
to the provisions of Section 50022.1 et. seq. of the California Government Code.
SECTION 9. Section 8.04.040 of the Palm Springs Municipal Code is hereby amended to
read as follows:
8 04 040 Uniform Code forthe Abatement of Dangerous Buildings--Adopted That
certain document, a copy of which is on file in the office of the City Clerk, being
marked and designated as "Uniform Code for the Abatement of Dangerous
Buildings, 1997 edition" and all appendices, tables and indices thereto, is hereby
adopted as the Uniform Code for the Abatement of Dangerous Buildings in the City
by reference, pursuant to the provisions of Section 50022.1 et. seq. of the California
Government Code.
SECTION 10. Section 8.04.045 of the Palm Springs Municipal Code is hereby amended
to read as follows:
8.04,045 Uniform Solar Energy Code--Adopted. That certain document, a copy of
which is on file in the office of the City Clerk, being marked and designated as
"Uniform Solar Energy Code, 1997 edition", and all appendices, tables and indices
thereto, is hereby adopted as the Uniform Solar Energy Code of the City by
reference, pursuant to the provisions of Section 50022.1 et. seq. of the California
Government Code.
SECTION 11. Section 8.04.050 of the Palm Springs Municipal Code is hereby amended
to read as follows:
8.04.050 Uniform Swimming Pool Spa and Hot Tub Code--Adopted That certain
document, a copy of which is on file in the office of the City Clerk, being marked and
designated as"Uniform Swimming Pool, Spa and Hot Tub Code, 1997 edition", and
all appendices, tables and indices thereto, is hereby adopted as the Uniform
Swimming Pool, Spa and Hot Tub Code of the City by reference, pursuant to the
provisions of Section 50022.1 et. seq. of the California Government Code.

SECTION 12. Section 8.04.055 of the Palm Springs Municipal Code is hereby amended
to read as follows:
8.04.055 California Electrical Code -- Adopted. That certain document, a copy of
which is on file in the office of the City Clerk of the City, being marked and
designated as"California Electrical Code, 2001 Edition", and all appendices, tables
and indices thereto except as amended herein, is hereby adopted as the Electrical
Code of the City by reference, pursuant to the provisions of Section 50022.1 et. seq.
of the California Government Code, and all of its provisions (except as hereinafter
modified) shall regulate the installation, arrangement, alternative, repair, use, and
generation of electricwiring,connections,fixture, apparatus, machinery, appliances,
and other electric devices on premises within the City.
SECTION 13. Section 8.04.060 of the Palm Springs Municipal Code is hereby amended
to read as follows:
8.04.060 California Electrical Code -- Additions and Amendments. The California
Electrical Code adopted herein by referenced is hereby amended by the following
additions and amendments.
1. Add the following to the end of Subsection 90-8(a):
SERVICE LOAD.The main switch and/or distribution panel of a singlefamily
dwelling or condominium occupancy shall have an adequate capacity and
space to carry the calculated load, plus an 8 KW future with four (4) spare
spaces at the time of final inspection. The 8 KW load is not to be reduced
by any demand factor.
2. Add the following to the end of Subsection 310-2(b):
ALUMINUM CONDUCTOR LIMITATIONS. No aluminum wiring shall be
used.
EXCEPTION:Aluminum wiring in sizes 1/0 and larger may be used for main
feed to sub-panels only and shall be enclosed in a raceway.
SECTION 14. Section 8.04.065 of the Palm Springs Municipal Code is hereby amended
to read as follows:
8.04.065 Uniform Administrative Code --Adopted. That certain document, a copy
of which is on file in the office of the City Clerk, being marked and designated as
"Uniform Administrative Code, 1997 edition", and all appendices,tables and indices
thereto, is hereby adopted as the Uniform Administrative Code of the City by
reference, pursuant to the provisions of Section 50022.1 et seq. of the California
Government Code.
SECTION 16. OPERATIVE DATE. The provisions of this Ordinance shall become
operative on November 1, 2002 which is the effective date of the 2001 edition of the
California Building Standards Code, published by the State of California.
SECTION 17. EFFECTIVE DATE.This Ordinance shall be in full force and effect thirty(30)
days after passage.

SECTION 18, PUBLICATION. The City Clerk is hereby ordered and directed to certify to
the passage of this Ordinance, and to cause the same or a summary thereof or a display
advertisement, duly prepared according to law, to be published in accordance with law.

ADOPTING BY REFERENCE THE "2001
CALIFORNIA FIRE CODE" INCORPORATING
AND AMENDING THE 2000 UNIFORM FIRE
CODE VOLUMES 1 AND 2, INCLUDING ALL
SUPPLEMENTS AND APPENDICES THERETO,
WITH CERTAIN AMENDMENTS, ADDITIONS,
DELETIONS AND EXCEPTIONS.

THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, DOES
ORDAIN AS FOLLOWS:
SECTION 1. Section 11.01.010 of the Palm Springs Municipal code, referred
to herein, is hereby amended to read as follows:
11.01.010 California Fire Code Adopted That certain document, a copy of
which is on file in the office of the City Clerk, entitled, "California Fire Code,
2001 Edition" and all appendices, tables and indices thereto, except as
hereinafter modified, are hereby adopted as the Fire Code of the City of
Palm Springs by reference, pursuant to the provisions of Government Code
Section 50022.1 et. seq.
SECTION 2. Section 11.02.020 of the Palm Springs Municipal Code, referred
to herein, is hereby amended to read as follows:
11.02.020 Additions, deletions and amendments The California Fire Code
adopted herein by reference is amended by the following additions, deletions
and amendments:
(1) Add subsection 6 to Section 1003.2.2 to read as follows:
6. An approved automatic fire sprinkler system shall be
installed in every building where the gross floor area
exceeds 3,000 square feet.
Exception: Detached single-family residences.

For purposes of this code subsection regarding building
size, fire resistive construction shall not be considered
for purposes of reducing the gross floor area of the
building. In all Group R occupancies, the locally
modified standard for installation of fire sprinkler
systems shall be used.
(2) Add subsection 7 to Section 1003.2.2 to read as follows:
7. An approved automatic fire sprinkler system shall be
installed in any building, regardless of size, which is
built beyond a five-minute fire department emergency
response time as defined from time to time by
resolution of the City Council.
Exception: Group R-3 occupancies in Tracts 2082, 2928, 3600 and 8137
are exempt from the five-minute response time fire sprinkler requiremert.
(3) Amend Subsection 1003.2.3.1 Drinking Establishments
1. An approved automatic fire sprinkler system shall be installed in every
Group A occupancy including those that result from a change of use
in an existing building or portion thereof.
(4) Add Subsection 1007.2.9.3. Upon sale of any single family dwelling, the
seller shall have installed therein, permanently wired or battery powered
approved detectors of products of combustion other than heat only,
commonly known as smoke detectors. The smoke detectorsare required
to be State Fire Marshall approved and listed. The seller must obtain
certification from the Fire Department of the installation and proper
operation prior to close of sale of property.
(5) Add Section 2501.19 Detailed Requirements for Installaion of Permanent
Tiki and/or Luau torches using Liquid Fuel or Natural Gas.
1. Installer shall obtain permit from the Building division of the
Department of Planning and Building after review and approval of the
application for said permit by the fire Prevention Division of the Fire
Department.
2. Maximum length of flame shall not exceed twenty-four (24) inches.
3. Flame shall be a minimum of eight feet (8') from ground level and
entire torch shall be entirely on private property.
4. Minimum size of pipe support shall be one and one half inches (1
1/2") in diameter. EXCEPTION: If mounted on a structure and
braced to the satisfaction of the inspection authority, minimum size
could be one inch (1").
A radius of five feet(5') between torch burner and combustibles shall
be maintained.
5. Torches mounted on ground shall be embedded at least twelve
inches (12") in an eighteen-inch (18") cube of concrete or more if
necessary to ensure stability and shall be mounted perpendicular at
right angle to the ground.
6. When exposed to probable vehicular damage due to proximity to
alleys, driveways or parking areas, torches shall be suitably
protected.
7. Where natural gas is used, an approved shut-off valve shall be
located at or near the base of the torch and a labeled secondary
shut-off shall be located at a readily accessible remote location.
Secondary valves may operate one or more torches.
(6) Amend Section 5201.6.3 to read as follows Unsupervised Dispensing:
Unsupervised dispensing shall not be allowed at motor vehicle fuel-
dispensing stations accessible by the general public. Unsupervised
dispensing at locations not utilized by the general public is allowed when
the owner or operator provides, and is accountable for, daily site visits,
regular equipment inspection and maintenance, conspicuously posted
instructions for the safe operation of dispensing equipment, and posted
telephone numbers for the owner or operators. A sign, in addition to the
signs required by Section 5201.8 shall be posted in a conspicuous
location reading:
IN CASE OF FIRE, SPILL OR RELEASE
1. Use emergency pump shutoff!
2. Report the accident!

During hours of operation, stations having unsupervised dispensing shall
be provided with a fire alarm transmitting device. A telephone not
requiring a coin to operate is acceptable.
(7) Amend Section 7802.3 Fireworks. The manufacture, storage, sale, offer
for sale, use or handling of fireworks is prohibited. The provisions of this
section do not apply to fireworks displays conducted in accordance with
the provisions of any permit issued pursuant to this chapter.
(8) Add Section 8203.4 New Installation of Liquefied Petroleum Gas. All
new installation of liquefied petroleum gas with an aggregate capacity of
2,000 gallons or more shall be protected by an approved automatic fixed
water spray system. The system shall protect the entire surface area of
the tank and the cargo tanker transfer area. The system shall be
calculated to provide a minimum density of .25 gallons per minute per
square foot with a one-hour duration water supply.
SECTION 3. THE PRIOR "California Fire Code, 1998 Edition, Volumes I and II"
are each and all hereby repealed. Also, any other ordinances or parts of
ordinances in conflict with the herein ordinance are hereby repealed with the
exception of Chapter 8.04 of the Palm Springs Municipal Code.
SECTION 4. VALIDITY. If any section, subsection, clause or phrase of this
ordinance is for any reason held by a court of competent jurisdiction to be invalid,
such a decision shall not affect the validity of the remaining portions of this
ordinance. The City Council of the City of Palm Springs, hereby declares that it
would have passed this ordinance and each section of subsection, sentence,
clause and phrase thereof, irrespective of the clauses or phrases being declared
invalid.
SECTION 5. VIOLATION A MISDEMEANOR/INFRACTION. A violation of
specific provisions of this Ordinance adopted hereby is a misdemeanor, punishable
by imprisonment in the County jail not exceeding six months, or by a fine not
exceeding one thousand dollars ($1,000), or by both. All otherviolations of the
remaining provisions of the ordinance adopted hereby are infractions, punishable
by a maximum fine of one hundred dollars ($100.00) for the first offense and a
maximum fine of five hundred dollars ($500.00) for each additional violation
committed within the same year.
SECTION 6. VIOLATION A PUBLIC NUISANCE. The City hereby declares a
violation of any provision of this Ordinance or of any code adopted hereby to be a
public nuisance.
SECTION 7. FULL FORCE AND EFFECT. Except as expressly modified herein,
Palm Springs Municipal Code Section 11.02 shall remain unmodified and in full
force and effect.
SECTION 8. OPERATIVE DATE. The provisions of this Ordinance shall become
operative on November 1, 2002, which is the effective date of the 2001 edition of
the California Fire Code, published by the State of California.
SECTION 9. EFFECTIVE DATE. This ordinance shall be in full force and
effective thirty (30) days after passage.
SECTION 10. PUBLICATION. The City Clerk is hereby ordered and directed to
certify to the passage of this Ordinance, and to cause the same or a summary
thereof of a display advertisement, duly prepared according to law, to be published
in accordance with law.

CITY OF PALM SPRINGS
NOTICE IS HEREBY GIVEN that the City Council of the City of Palm Springs, California, will
hold a public hearing in the Council Chamber, 3200 E Tahquitz Canyon Way; on Wednesday,
October 2, 2002, at 7:00 p.m.
The purpose of the hearing is to consider adoption of ordinances introduced September 4, 2002,
adopting by reference with amendments the 2001 California Fire Code, adopting and amending the
2001 California Building Code with appendices Chapter 3,Division IV,4 Division 11, 12,Division
I IA, 15, 18, 31 Divisions 11 and III, 33 and 34, Division III,the 2001 California Mechanical Code,
the 2001 California Plumbing Code, the 2001 California Electrical Code, and the 1997 editions of
the Uniform Housing Code, Uniform Code for the Abatement of Dangerous Buildings, Uniform
Solar Energy Code, Uniform Swimming Pool, Spa and Hot Tub Code and the Uniform
Administration Code.
