Family Intervention Officer Amendment 1 AGREEMENT#4554 AMENDED AND RESTATED PALM SPRINGS UNIFIED SCHOOL DISTRICT SCHOOL COMMUNITY POLICE PARTNERSHIP GRANT FOR THE FAMILY INTERVENTION OFFICER WHEREAS, the Palm Springs Unified School District ("District"), formed pursuant to the provisions of the California Education Code Section 12400, desires to continue to cooperate with the City of Palm Springs ("City"), and to continue its agreement with the City in order to insure the greater safety of students and to improve and strengthen law enforcement on or about the campuses of the schools of Palm Springs. WHEREAS, on October 15, 2003, the parties approved an agreement entitled "Palm Springs Unified School District School Community Police Partnership Grant Family Intervention Officer" ("Prior Agreement") to assign a full time uniformed police officer to the District during fiscal years 2003-04, 2004-05 and 2005-06. As a cost savings measure, the parties now agree to modify the Prior Agreement to modify the position from that of a sworn position to a civilian position. Accordingly, the parties now agree to rescind the Prior Agreement and to restate their agreement as set forth herein. NOW, THEREFORE, it is agreed by and between the parties as follows: 1. The City shall provide to the District during the 2004-05 and 2005-06 school years, a Police Department employee on a full-time basis with the equipment normally provided for use by the Police Department of the City for assignment to the District for the purpose of strengthening law enforcement, particularly at the schools within the city limits of Palm Springs and instilling in the young an affection, respect and understanding of the role of law enforcement in society. The title of this position shall be the Family Intervention Officer (FIO). 2. The FIO shall be a uniformed civilian officer shall work under the direction of the District's School Community Policing Partnership Operations Committee, and shall administer the partnership program entitled Project Rebound. Some assignments may require the officer to wear civilian business attire. The officer shall serve the District forty (40) hours per week. In the event the officer shall find it necessary to work overtime, advanced approval must be obtained from the police supervisor. Hours and site assignments shall be designed by joint agreement between the District and the Police Department. In instances where crimes occur, the civilian officer shall not be prohibited from taking appropriate measures to notify a sworn police officer. 3. The officer shall be expected to maintain radio contact with his or her direct supervisor at all times. In the event the officer shall find it necessary to leave the city limits of Palm Springs while on duty, the police -1- supervisor shall be notified, where feasible, in advance of the expected absence, and the Police Watch Commander shall be notified. 4. Pursuant to the terms of this agreement, for all of the services rendered by the FIO under this Agreement, the District shall pay to the City up to the sum of $60,000 for the annual salary and benefits of the FIO for fiscal year 2004-05, and up to the sum of $66,000 for the annual salary and benefits of the FIO for 2005-06, with payment to be made within 30 days upon quarterly billing by the City. In addition, the District shall pay the City for additional costs associated with this grant including, but not limited to, the cost of equipment, conferences and expenses related to training incurred under the provisions of the School Community Policing Partnership grant, not to exceed to $25,000, to be made within 30 days upon billing by the City. The total not to exceed contract amount during the two-year term of this agreement shall be $151,000. 5. Pursuant to Government Code § 895.4, each party hereby assumes the liability imposed on it, its officers and employees for injury caused by a negligent or wrongful act or omission occurring in the performance of that party's obligations under this agreement to the same extent that such liability would be imposed in the absence of Government Code § 895.2. Accordingly, each party shall defend, indemnify and hold harmless the other party for any claim, demand, cause of action, loss, liability, damage, cost or expense that may be imposed on such party solely by virtue of said Section 895.2. The term of this agreement will be from November 10, 2004 to June 30, 2006; however the agreement may be amended at any time by the mutual consent of the parties hereto, as memorialized in writing, and may be terminated by either party upon 30 days written notice to the other of its intention to do so. NOW, THEREFORE, it is agreed by and between the parties as follows: 1. The City shall provide to the District during the days school is in session one trained police officer on a full-time basis with the equipment normally provided for his use by the Police Department of the city for assignment to the School District for the purpose of improving and strengthening law enforcement, particularly at Palm Spring High School and the Ramon Academy and inculcating in the young an affection, respect and understanding of the role of law enforcement in society. 2. The police officer shall work under the direction of the Palm Springs High School principal unless called upon to service The Ramon Academy during which time the officer will work under the direction of that Principal for the purposes of enforcing school regulations and protecting school property and persons thereon. The officer shall be on campus eight hours per day, including his lunchtime, and will be subject to call, if necessary during lunch. His hours and site assignments shall be as designed by the High School principal. In instances where crimes occur, the police officer shall not be prohibited from taking appropriate legal measures in reference thereto. 3. The police officer shall be expected to maintain radio contact with the High school administration at all times. In the event the officer shall find it necessary to leave the campus, the Principal shall be notified in advance of the expected absence and the Police Watch Commander shall be notified. In such a circumstance, a patrol car shall be available for immediate response to a school emergency. 4. The District will pay to the City for all services rendered under this Agreement, the sum of$76,139.00 with payments to be made upon billing by the City, calculated at the total rate of $6,344.92 per month for 12 months, to be billed twice per year. Neither District nor any officer or employee of District shall be responsible for any damage or liability occurring by reason of any act or omission on the part of the City under or in connection with any work, authority, or jurisdiction delegated to City under this Agreement. It is further understood and agreed that pursuant to Government Code ¶895.4, the City shall fully indemnify, defend, and hold the District harmless for any liability imposed for injury (as defined by Government Code ¶810.8) occurring by reason of any act or omission on the part of City under or in connection with any work, authority, or jurisdiction delegated to City under this Agreement. 6. Neither the City nor any officer or employee of the City shall be responsible for any damage or liability occurring by reason of any act or omission on the part of the District under or in connection with any work, authority, or jurisdiction delegated to the District under this Agreement. It is further understood and agreed that pursuant to Government Code ¶ 895.4, the District shall fully indemnify, defend, and hold the City harmless from any liability imposed for injury (as defined by Government Code ¶810.8) occurring by reason of any act or omission on the part of the District under or in connection with any work, authority, or jurisdiction delegated to the District under this Agreement. The amended agreement is for $76,139 ($515 increase over last year) a year. For the past twenty-five years, the school district and the City have entered into an agreement whereby the school district pays to have the City provide the services of a full-time Palm Springs Police Officer on the high school campus. The amended agreement also stipulates that the officer will provide services to the Ramon Academy campus on an as needed basis. FISCAL IMPLICATIONS: A total of$76,139 with payments to be made monthly upon billing by the City, calculated at the total rate of$6,344.92 per month for 12 months, to be billed twice per year. This represents an annual increase of$515 per year. RECOMMENDATION: It is recommend that the Board approve the amendment to the agreement between the City of Palm Springs and Palm Springs Unified School District to provide a police officer on the Palm Springs High School and Ramon Academy campuses, as presented.
