CVAG MULTI-AGENCY TRAFFIC SIGNAL COOPERATIVE AGREEMENT
RECOMMENDATION:
It is recommended that the City Council approve the First Amendment to Agreement No.
4231, with Coachella Valley Association of Governments (CVAG), for the CVAG Multi-
Agency Traffic Signal Cooperative Agreement, City Project 95-06, increasing the
agreement by $42,355.67 for a new total of$564,555.67.
SUMMARY:
The CVAG Multi-Agency Traffic Signal Cooperative Agreement between CVAG and the
City of Palm Springs provides for reimbursement to CVAG for City construction costs
associated with the Indian Canyon Drive traffic signal interconnect project, City Project 95-
06. The original agreement had an estimated budget amount, which requires amendment
to reflect actual construction costs now that the project is complete.
BACKGROUND:
On June 7, 2000, the City Council approved Agreement No. 4231 with CVAG for the
CVAG Multi-Agency Traffic Signal Cooperative Agreement. This agreement provided for
reimbursement to CVAG for costs associated with the construction of the City's portion of
the CVAG Valley-Wide traffic signal interconnect project. That portion, the Indian Canyon
Drive corridor, from Camino Parocela to Racquet Club Road, was constructed under a
single contract between CVAG and Steiny Construction for the CVAG Valley-Wide Traffic
Signal Interconnect Project
The plans and specifications were prepared by CVAG's and the City's consultant, DKS
Associates, and the consultant's preliminary estimate for the City's portion of the project
was $522,200. This amount was indicated in the original CVAG agreement, and was
established as the reimbursement amount due from the City to CVAG. The CVAG
agreement was finalized and approved by the City and CVAG prior to solicitation for bids
by CVAG.
Following solicitation of bids, CVAG awarded a construction contract to Steiny
Construction, and the actual contract award amountforthe City' s portion, based on Steiny
Construction's lowest, responsible bid was $546,325. Now that construction is complete,
extra work and unforeseen changes in the project required change orders in the amount
of $18,230.67 (or slightly more than 3% of the contract amount) to date. Therefore, the
City's liability to CVAG for its portion of the CVAG Valley-Wide Traffic Signal Interconnect
Project is$564,555.67, or an increase of$42,355.67 overthe original amount of$522,200
indicated in the CVAG Agreement.

All costs associated with the Indian Canyon Drive traffic signal interconnect project are
covered by a $664,000 Federal STP grant. Payments madeto CVAG in accordance with
this Agreement will be reimbursed by Caltrans through the STP grant. In fact, staff has
already submitted reimbursement requests to and received payment from Caltrans for
$429,906.93 of costs associated with this project and reimbursable through the STP grant.
Staff has prepared an amendment to the CVAG agreement that will increase the original
amount to reflect the final construction amount. All costs associated with the increase to the
CVAG agreement are reimbursable through the STP grant. Sufficient funds are available
in account 26 1-4491-501 59 (Tahquitz Canyon/Indian).

The following provisions of Agreement No. 4231 are hereby amended to read as follows:
SECTION 1 (a) is amended as follows:
Revise the second sentence to read:
Both parties agree thatthe budgeted amountforthe construction within CPS is$564,555.67.
Except as specifically amended by this Amendment No. 1, all terms and provisions of
Agreement No. 4231 remain in full force and effect.
