RESULTS OF 2002 SPECIAL MUNICIPAL ELECTION
RECOMMENDATION:
That the Council declare the results of the 2002 Special Municipal Election.
BACKGROUND:
On August 7, 2002 Council called a Special Election to be consolidated with the
statewide election to be held November 5, 2002. The purpose of the call was to
place four citizens' initiatives and two Council Measures on the ballot. The Citizen
initiatives were regarding the Utility User Tax, Transient Occupancy Tax, Term
Limits and Parking and all were rejected. The Council Measures were Board and
Commission Appointments and Council Vacancies and both were approved.
The results of the election have been certified and are attached as Exhibit A of the
proposed Re lution.

RESOLUTION NO.
OF THE CITY COUNCIL OF THE CITY OF PALM
SPRINGS, CALIFORNIA, RECITING THE FACTS OF THE
SPECIAL MUNICIPAL ELECTION HELD IN SAID CITY ON
THE 5th OF NOVEMBER, 2002, DECLARING THE
RESULT THEREOF AND SUCH OTHER MATTERS AS
ARE PROVIDED BY LAW.
WHEREAS a special municipal election was held and conducted in the City of Palm
Springs, California, on November 5, 2002, as required by law; and
WHEREAS notice of said election was duly and regularly given in time, form and
manner as provided by law; that voting precincts were properly established; that
election officers were appointed and that in all respects said election was held and
conducted and the votes cast thereat, received and canvassed and the returns made
and declared in time, form and manner as required by the provisions of the Elections
Code of the State of California for the holding of elections in cities; and
WHEREAS on August 7, 2002, the City Council called a Special Municipal election to
be consolidated with the November 5, 2002 statewide election, for the purpose of
placing Citizen and Council Initiated Measures concerning the Utility User Tax,
Transient Occupancy Tax, Term Limits, Parking, Board and Commission appointments
and Council Vacancies; and
WHEREAS pursuant to Resolution 20437 adopted August 7, 2002, the City Clerk of
said City has caused the canvass of the returns of said election and has certified the
results to this City Council, said results are received, attached and made a part hereof
as Exhibit A,
NOW THEREFORE BE IT RESOLVED by the City Council of the City of Palm Springs,
as follows:
Section 1. That there were 27 voting precincts established for the purpose of
holding said election consisting of consolidations of the regular elections
precincts in said City as established for the holding of state and county
elections.
Section 2. That said special general municipal election was held for the purpose of
submitting the following measures to the electors of said City; to-wit:
MEASURE [ U j Shall the City Municipal Code be amended to repeal
the City's 5% utility tax on users of telephone, electricity and gas
services?
MEASURE [V ] Shall the City Municipal Code be amended concerning
the tax currently collected on persons occupying hotel rooms so that the
tax rate will vary from 10% to 12.5% based on the number of rooms in
the hotel with monies raised by the tax to be spent solely to encourage
local tourism and not for other City services?

MEASURE [ W 1 Shall the City Charter be amended to establish term
limits prohibiting any person elected to the office of the Mayor or City
Council or appointed to any City board or commission from serving
more than two terms or a total of ten years in that office or on that board
or commission?
MEASURE [ X ] Shall the City Charter and Municipal Code be
amended to prohibit the City (other than at the airport) from (a)
metering, charging for or taxing any public parking space, (b)
reserving public parking spaces for any user (except handicap
parking), and (c) placing any time restrictions for public parking spaces
less than 24 hours?
MEASURE [ Y ] Shall the City Charter be amended to provide that
persons serving on city boards and commission be nominated and
appointed by the City Council rather than nominated by the Mayor and
appointed by the City Council?
MEASURE [ Z ] Shall the City Charter be amended so that after a City
Council election is called by the Council or within 90 days after the City
Council election if a vacancy occurs on the City Council the City Council
must appoint the next highest vote getter to that open seat?
Section 3. That the number of votes given at each precinct and the number of
votes given in the City to each of the Measures, are as listed in Exhibit A
attached.
Section 4. That as a result of said election, a majority of the qualified voters voting
on Measure U, relating to the Utility User Tax did vote against thereof,
and that same measure was rejected.
Section 5. That as a result of said election, a majority of the qualified voters voting
on Measure V, relating to the Transient Occupancy Tax did vote against
thereof, and that same measure was rejected.
Section 6. That as a result of said election, a majority of the qualified voters voting
on Measure W, relating to the Term Limits did vote against thereof, and
that same measure was rejected.
Section 7. That as a result of said election, a majority of the qualified voters voting
on Measure X, relating to the Parking did vote against thereof, and that
same measure was rejected.
Section 8. That as a result of said election, a majority of the qualified voters voting
on Measure Y, relating to the Board and Commission appointments did
vote in favor thereof, and that same measure was approved.
Section 9. That as a result of said election, a majority of the qualified voters voting
on Measure Z, relating to the Council Vacancies did vote in favor
thereof, and that same measure was approved.

Section 10. The City Clerk shall enter on the records of the City Council of said City,
a statement of the results of said election, showing:
(1) The measures voted upon;
(2) The number of votes given at each precinct for and against each
measure;
(3) The total number of votes given in the City for and against each
measure.
(4) The whole number of votes cast in the City.
