HomeMy WebLinkAbout2/19/2003 - STAFF REPORTS (11) DATE: February 19, 2003 TO: City Council FROM: Director of Planning and Zoning CASE NOS. 5.0916, 5.0938, AND 5.0941 -APPLICATIONS TO AMEND THE GENERAL PLAN LAND USE AND CIRCULATION ELEMENTS SO AS TO: (A) REDESIGNATE 5.11 ACRES OF LAND FROM M15 (MEDIUM DENSITY RESIDENTIAL 12-15 UNITS/ACRE)TO GC (GENERAL COMMERCIAL) AND C (CONSERVATION) FOR THE PROPERTY LOCATED AT 4155 EAST MATTHEW DRIVE, ZONE R-2 AND R-1-AH, SECTION 30; (B) REDESIGNATE 3.27 ACRES OF LAND FROM M15 (MEDIUM DENSITY RESIDENTIAL 12-15 UNITS/ACRE) TO H30 (MEDIUM- HIGH DENSITY RESIDENTIAL 21-30 UNITS/ACRE) FOR THE PROPERTY LOCATED AT THE NORTHEAST CORNER OF MURRAY CANYON DRIVE AND SIERRA MADRE, ZONE R-2 AND O, SECTION 35; (C) DELETE AN UNIMPROVED PORTION OF ARENAS ROAD BETWEEN SUNRISE WAY AND HERMOSA DRIVE FROM THE CIRCULATION PLAN. RECOMMENDATION The Planning Commission recommends that the City Council order filing of a Mitigated Negative Declaration and a resolution to approve (a) an application by Matthew Dragicevich Charitable Remainder Trust for an amendment to the General Plan Map so as to redesignate 5.11 acres of land located at 4155 E. Matthew Drive from M15 (Medium Density Residential) to GC (General Commercial)and C(Conservation), (b)an application by Laguna Pacific, LP for Canyon Vista, LP to amend the General Plan Map from M15 (Medium Density: 12-15 units/acre) to H30 (Medium- High Density: 21-30 units/acre)for the property located at the northeast corner of Murray Canyon Drive and Sierra Madre, and (c) an application by Palm Springs Modern Homes ll, LLC for an amendment to the General Plan Circulation Plan to remove an unimproved portion of Arenas Road between Sunrise Way and Hermosa Drive. SUMMARY All three proposed General Plan Amendments were initiated by property owners/applicants and are associated with these items tonight's City Council Agenda. If approved, the City's General Plan will be amended. The Planning Commission held joint public hearings on each proposal and associated application. The Planning Commission recommends approval of all three General Plan Amendments. BACKGROUND Matthew Dragicevich Charitable Remainder Trust, Laguna Pacific, LP for Canyon Vista, LP, and Palm Springs Modern Homes II, LLC have filed independent applications for amendments to the General Plan Land Use and Circulation Elements. Each request to amend the General Plan is being brought forward in conjunction with other development projects. The justification for the General Plan Amendments and the associated projects is discussed below. GENERAL PLAN MAP AMENDMENT TO REDESIGNATE 5.11 ACRES AT 4155 EAST MATTHEW DRIVE - MATTHEW DRAGICEVICH CHARITABLE REMAINDER TRUST The General Plan identifies how the City would like land utilized in the future. The General Plan also contains policies that further address the City's expectations with respect to the physical development of land. The General Plan Map Amendment is being requested in conjunction with a change of zone from R-2 and R-1-AH to C-M and 0 in order to facilitate the existing commercial uses of the property. The General Plan designation for the subject property is proposed to be changed from Medium Density Residential 12-15 units/acre (M15) to General Commercial (GC)and Conservation (C) in order for the zoning to be in conformance with the General Plan. The C designation for the subject propertywould include hillside lands where developmentwill be limited due to the precipitous slope. If any limited development occurs, it will be subject to the City's hillside regulations. The GC designation allows for commercial uses needing a large amount of space and are not dependent on pedestrian traffic. The proposed use of the auto body shop and land use consistent with C-M zoning would be consistent with General Plan Policy 3.28.5 which states, "Develop a specific plan, when feasible, for the Cherokee Way district to provide for a transition which would move the commercial uses to the East Palm Canyon Drive corridor and residential uses to the cove area." The use would also be consistent with General Plan Policy 3.28.7 which states, "Encourage the elimination of non-conforming uses/structures and the establishment of desired uses." The issue for consideration is a determination as to where the boundaryfor residential uses should be located in the cove area. The General Plan update accomplished in 1993 showed the cove area south of the intersection of Matthew Drive and Linden Drive designated M15, East Palm Canyon Drive designated Resort Commercial(RC), and the property along Cherokee Way designated GC. There was debate at the time of the update as to the appropriate location of the General Plan/Zoning boundary for the MI5/R-2 designation. The proposal is to establish an east to west transition between multi-family residential zoned property and commercially zoned property. In addition, the property owner to the east supports moving the line eastward for the limits of commercially zoned property, closer to the existing single family residential property. The proposed General Plan Amendment would be consistent with existing uses and would allow the non-conforming use of the auto body shop to continue. Attached to related Case 5.0916, request for change of zone, is a written commitment from the property owner with regards to site improvements and the closure of the boat repair facility. The proposed Change of Zone from R-2 to C-M and R-1-AH to 0-20 is not in conformance with the current General Plan designation of M15. The present land use is commercial with outdoor storage and there are commercial uses to the west and northwest, and residential uses to the east and north. The zone change will be such that the existing businesses and related open storage areas will be re-zoned to C-M with the remainder of the vacant land and hillside area re-zoned to 0-20. The Commission finds the Change of Zone and General Plan Amendment are appropriate due to the designations of adjacent properties. The property to the west is zoned C-M and is designated GC while the property to the northwest is zoned W-C-2 and is designated GC. The designation of the subject property as GC would be an extension of the Cherokee Way commercial corridor onto Matthew Drive. p A C), GENERAL PLAN MAP AMENDMENT TO REDESIGNATE 3.27 ACRES AT THE NORTHEAST CORNER OF MURRAY CANYON DRIVE AND SIERRA MADRE - LAGUNA PACIFIC, LP FOR CANYON VISTA, LP The proposed General Plan Map Amendment refers to redesignating the 3.27 acre project site from Medium Density Residential 12-15 units/acre (M15) to Medium-High Density Residential 21-30 units/acre(H30). The General Plan Map Amendment is being requested in conjunction with Case 5.0938-PD-282 TTM 31006, a request for Planned Development District 282 in-lieu of a change of zone and Tentative Tract Map 31006 for the construction of 66 timeshare units located at the northeast corner of Murray Canyon Drive and Sierra Madre.The property to the west is designated H43/21 (High Density 30-43 units/acre) and zoned R-3 (Multi-Family and Hotel Zone). The proposed General Plan Map Amendment is a logical extension of the General Plan designation to the west. Without the amendment, the maximum allowable density for the subject property would be 49 units.The applicant's lease requires them to construct at least 50 timeshare units on the site. The proposed General Plan Map amendment is consistent with the surrounding neighbourhood because of the multi-family designations and nature of development surrounding the site. To the north of the subject property is single family residential zoned property, also owned by the applicant. The single story buildings on the north end of the project site will also facilitate the transition from the two-story buildings to the one-story single family residential community further to the north. Therefore, the General Plan amendment is appropriate and will not be detrimental to the neighbourhood. GENERAL PLAN CIRCULATION PLAN AMENDMENT TO DELETE PORTION OF ARENAS ROAD BETWEEN SUNRISE WAY AND HERMOSA DRIVE-PALM SPRINGS MODERN HOMES ll, LLC The development is proposing to remove a portion of Arenas between Hermosa Drive and Sunrise Way from the General Plan Circulation Element. The amendment to the General Plan Circulation Element is being requested in conjunction with TTM 30941 for the construction of 48 condominium units for the property located at 1460 and 1550 East Baristo Road. The Engineering and Planning and Zoning Departments required a traffic study be completed to evaluate the traffic impacts relating to the deletion of the Arenas. The study found that the impacts would be less than significant due to the low density of the project and adequate alternate access for properties to the north and west. The deletion of Arenas will extend from the proposed cul-de-sac on Arenas Road to Hermosa Drive and will be consistent with the Draft Section 14 Master Plan (see Attachment 4). The portion of Arenas proposed to the removed form the Circulation Element is also currently unimproved. ENVIRONMENTAL ASSESSMENT AND NOTIFICATION Environmental Assessments were prepared for each proposed amendment. Upon completion of the EA, staff found that although the proposed project could have a significant impact on the environment, there will not be a significant effect in this case because of the mitigation measures described in the Mitigated Negative Declaration. The EA for each General Plan Amendment was prepared in conjunction with the related actions which are on tonight's City Council agenda. Those Environmental Assessments are hereby incorporated by reference into this staff report and are available for public review at the offices of the Department of Planning and Zoning. ) M3 All property owners within four hundred (400)feet of the subject properties have been notified. In addition, the EAs were sent to local utilities and interested parties. As of the writing of this report, staff received comment from the Desert Water Agency, Palm Springs Unified School District, Southern California Gas Company, and Agua Caliente Band of Cahuilla Indians. The correspondence is attached to the report for the cases related to each proposed General Plan Amendment. No sing-nificant environmental issues were raised. The City Council meeting begins at 7:00 p.m. in the Council Chamber at City Hall, 3200 E. Tahquitz Canyon Way, Palm Springs. The purpose of the hearing is to consider amendments to the General Plan with regards to the Land Use and Circulation elements. The General Plan Map Amendment will facilitate the development of a 66- unit timeshare project. The third request is for Case 5.0941, an application by Palm Springs Modern Homes 11, LLC for an amendment to the General Plan Circulation Plan to delete Arenas Road between Hermosa Avenue and Sunrise Way. Currently, Arenas Road is designated as a secondary thoroughfare on the General Plan, but is unimproved in the portion described above. The deletion of Arenas Road between Hermosa Avenue and Sunrise Way is consistent with existing conditions and the Draft Section 14 Master Plan. An Environmental Assessment has been prepared and will be reviewed by the City Council at the meeting. A draft Mitigated Negative Declaration of Environmental Impact has been prepared for the subject proposals. WHEREAS, Matthew Dragicevich Charitable Remainder Trust (the "applicant') has filed Case 5.0916 with the City for a General Plan Map Amendment to redesignate 5.11 acres of land from Medium Density Residential 12-15 units/acre(M15)to General Commercial(GC)and Conservation (C)for the property located at 4155 East Matthew Drive, Zone R-2 and R-1-AH, Section 30; and WHEREAS, Laguna Pacific, LP for Canyon Vista, LP (the "applicant') has filed Case 5.0938 with the City for a General Plan Map Amendment to redesignate 3.27 acres of land from Medium Density Residential 12-15 units/acre (M15)to Medium-High Density Residential 21-30 units%acre (H30)for the property located at the northeast corner of Murray Canyon Drive and Sierra Madre, Zone R-2 and O, Section 35; and WHEREAS, Palm Springs Modern Homes II, LLC(the"applicant') has filed Case 5.0941 with the City for an amendment to the General Plan Circulation Plan to delete an unimproved portion of Arenas Road between Sunrise Way and Hermosa Drive in conjunction with the project located at 1460 and 1550 East Baristo Road; and WHEREAS, notice of a public hearing of the Planning Commission of the City of Palm Springs to consider Case Nos. 5.0916, 5.0938, and 5.0941, requests to amend the General Plan Land Use and Circulation Elements was given in accordance with applicable law; and WHEREAS, on January 22, 2003 a public hearing to consider Case Nos. 5.0916, 5.0938, and 5.0941, requests to amend the General Plan Land Use and Circulation Elements, was held by the Planning Commission in accordance with applicable law; and WHEREAS, notice of a public hearing of the City Council of the City of Palm Springs to consider Case Nos. 5.0916, 5.0938, and 5.0941, requests to amend the General Plan Land Use and Circulation Elements was given in accordance with applicable law; and )ate WHEREAS, on February 19, 2003 a public hearing to consider Case Nos. 5.0916, 5.0938, and 5.0941, requests to amend the General Plan Land Use and Circulation Elements, was held by the City Council in accordance with applicable law; and WHEREAS, in accordance with Section 15063 of the California Environmental Quality Act, an Environmental Assessment was prepared and staff found that with the incorporation of proposed mitigation measures, the proposed project could not have a significant effect on the environment; and WHEREAS, the City Council has carefully reviewed and considered all of the evidence presented in connection with the hearing on the project, including but not limited to the staff report, all written and oral testimony presented. THE CITY COUNCIL HEREBY FINDS AS FOLLOWS: Section 1: Pursuant to CEQA, the City Council finds that the current environmental assessment for Case Nos. 5.0916, 5.0938, and 5.0941 adequately addresses the general environmental setting of the proposed Project, its significant environmental impacts, and the mitigation measures related to each significant environmental effect for the proposed project. The City Council further finds that with the incorporation of proposed mitigation measures,potentially significant environmental impacts resulting from this project will be reduced to a level of insignificance and therefore recommends adoption of a Mitigated Negative Declaration for the project. Section 2: Given the use and location of the site located at 4155 East Matthew Drive, the existing commercial uses of the site more closely associates with the commercial uses to the west and northwest than the apartments to the north and residential use and vacant land to the east. The property located at 4155 East Matthew Drive is suitable for the uses intended in the General Plan designation and the uses permitted in the proposed zone, in terms of access, size of parcel, relationship to similar or related uses, and other considerations deemed relevant by the Commission. Section 3: The property at the northeast corner of Murray Canyon Drive and Sierra Madre is currently vacant, but was formerly developed as a tennis club. The re-designation of the property located at the northeast corner of Murray Canyon Drive and Sierra Madre to H30 is appropriate due to surrounding multiple family land use designations. The project site is suitable for the use of land on a timeshare basis due to the density and resort character of the development in the surrounding vicinity. The project will be accessed from Murray Canyon Drive, a secondary thoroughfare, and Sierra Madre, a collector street. Both Murray Canyon Drive and Sierra Madre have already been improved to secondary and collector street standards, respectively.The project site abuts the Canyon Country Club golf course and is sensitive to single family residential development to the north. The building height for the project decreases to fifteen feet and one-story 200 feet from the R-1 C zoning to the north.The 200 foot setback is required by Section 92.04.03.D.2,which limits building heights to 15 feet or one-story when R-3 zoned property abuts R-1 zoned property. /47)0"c Section 4: The deletion of a portion of Arenas Road between Sunrise Way and Hermosa Drive is consistent with the Draft Section 14 Master Plan's Land Use and Circulation Plan and will allow the General Plan to remain internally consistent. The portion of Arenas proposed to be removed is currently unimproved with no plans for future improvements. The proposed amendment to the General Plan Circulation Element is necessary and proper at this time, and is not likely to be detrimental to the adjacent property or residents. Section 5: The proposed amendments to the General Plan are necessary and proper at this time, and are not likely to be detrimental to the adjacent property or residents.
