HomeMy WebLinkAbout3/26/2003 - STAFF REPORTS Ji DATE: March 26, 2003 TO: City Council FROM: Director of Planning and Zoning RE: 2003 WHITE PARTY RECOMMENDATION That the City Council consider adopting a resolution suspending certain regulatory ordinances to allow the 2003 White Party at certain locations on April 18-20, 2003. SUMMARY The White Party has been held in Palm Springs for the past 13 years. The event utilizes a wide range of venues including Knott's Soak City, Palm Springs Convention Center, Wyndham Hotel, Arenas Road vacant lot, and the Hilton Hotel. The event is scheduled for April 18-20, 2003. Over the past several years, the success of the event has resulted in increased attendance, expanded activities, and use of additional sites. As the event has grown, the City has received noise-related complaints for three locations including Wyndham Hotel, Arenas Road vacant lot, and the Convention Center. Noise complaints are a result of loud music. If the City Council wishes to facilitate the 2003 event, certain regulatory ordinances that would normally impede such an activity will need to be temporarily suspended. Ordinances include Noise Ordinance, Noise Nuisance, Dance Permits, and Sign Ordinance. BACKGROUND This year,the White Party is scheduled for April 18-20. Enterprises, Hilton Palm Springs, Wyndham Palm Springs, and Knott's Soak City Water Park. As noted above, each venue will be utilized for specific times and events. The event venues (with the exception of one) are existing facilities which are capable of handling the event without any special measures. The Arenas Road vacant lot will require the temporary installation of a stage, tents, restrooms, and a Ferris Wheel (see attached site plan). This site is fenced and has previously been managed by the Marquis Hotel. This year, the Hilton Hotel will work in conjunction with the promoter to manage and operate Dance Party at this site. A pyrotechnic show is planned near the Marquis Villas on April 20' from 9:00 p.m. to 9:10 p.m. Permits and inspections for the pyrotechnic show are handled through the Fire Department. The primary ordinance which needs to be suspended to facilitate the event as planned is the Noise Ordinance. Last year, noise complaints were received by the Police Department for the pool party at the Wyndham Hotel and the dance party at the Arenas Road vacant lot. In prior years, there have been complaints about the dance party at the Convention Center. Suspension of the Noise Ordinance (Chapter 11.74.00) and Noise Nuisance (11.08.040) are needed since the promoter intends to use professional, concert-grade sound systems at the Wyndham Hotel,Arenas Road site, and Convention Center. During last years' events, the Police Department received complaints regarding noise levels and was placed in an awkward situation. If the Noise Ordinances are not suspended, certain events may violate the City Ordinances and the Police Department may need to take enforcement action. Enforcement action could range from turning music noise levels down, citations, or canceling the music portion of an event. The Knott's Soak City activity will not require suspension of the subject ordinance. Knott's Soak City management requires all activities to comply with the Noise Ordinance. Other ordinances which need to be suspended include Chapter 5.12 Dances (permit required and prohibition between 2:00 a.m. and 9:00 a.m.), and the Sign Ordinance (temporary signs). Additionally, the City Council, by adopting the resolution, would be approving a carnival at the Arenas Road site (Ferris Wheel and dancing show). The promoter is not asking the City for any financial support. The event is a for-profit activity which also raises funds for AIDS Assistance Program ($2,000), ALPA ($20,000), DADE Human Rights Foundation($5,000), and contributes to outreach programs organized by Desert Aids Project ($10,000) and Riverside County Department of Health Services ($600). The total funds raised for these services is estimated to be$37,600. The promoter estimates an increase in TOT of $72,476 for the three-day event and $1.8 million in increased spending in the local economy. The event also contracts for security, medical aid, and other services. At this time, contracts for Police, Fire, and California Highway Patrol are in place. Staff recommends that the promoter also be required to post a $1,500 deposit for the trash removal after the event. Special Events Planning Team will meet Tuesday and any other issues will be reported at the City Council meeting. Ma Page 3 of 3 March 26, 2003 City Council Staff Report 2003 White Party ANALYSIS If the City Council wishes to facilitate this event as proposed, certain regulatory ordinances that could impede the conduct of such an event will need to be temporarily suspended. The promoter will need to apply for Land Use Permits for the Wyndham Pool Party and Dance and the Arenas Road Dance. As has been the case in previous years, the promoter has agreed to work with the City in reducing noise and other safety concerns though the implementation of crowd control measures,on-site security,traffic control, medical aid, and contracted Police and Fire services. In terms of Police and Fire services, last year's events resulted in approximately$9,790 in combined overtime paid by the promoter(Police$7,150 and Fire $2,640). The promoter is not requesting that the City pay for any event production or operational costs. The City will invoice the promoter for any costs immediately following the event. With all this in mind, I would like to request that the city of Palm Springs officially sanction the event, and that you cast your vote to suspend the Noise Ordinance for the weekend of the event (April 18 - 20) when the issue comes before council next week. This function has been handled by the Palm Springs Marquis in years past and this year will be handled by the Mton Palm Springs. addition to the Mton staff, 25 security officers have been contracted for this event A-L0 yard dumpster and skip loader have been ordered and the entire area will be cleaned up. This year we have again contracted fire works from Pyro Spectacular, a most reputable company, and they, us and Deputy Fire Marshall, Robert Morgan havI reviewed all the necessary requirements. There will be no aerial shells this year so the sound reports will be less than in previous years. We will however send a letter to all the surrgunding neighbors advising them of the fireworks taking place, We will also add to tT.s letter that the function will be taking place in their neighborhood along with the hours T. the evem. As this function takes place at the same time as the Arenas Block Party, a expect a great deal of pedestrian traffic at the comer of Arenas and Calle Encilia. We hfivo contracted the California Hghway Patrol to have two officers direct the flow of trafTi from 3:00pm to 10:00pm A First-Aid tent is being set up, 40 portable toilets, 50 trash cans and a 20 yard dumpster for trash collection. All necessary permits and proper insurance coverag for the event will be arranged. The CHP reports that they received many 911 calls by accidental jostl• of cell phones on the dance floor, We agree to put up signage this year asking guest to p#ease turn off their cell phones while attending the event. Sunday, April 20, 2003 - 9:00pm - 5:00am - Wyndham Closing Patty - This parry is planned to be held in the Wyndham Ballroom and the adjoining pool deck. We received some complaints last year regarding this event and a lot of it was due o the poor set up. The speakers were facing outwards from the area rather than in. This year we will be meticulous in the set up of the sound system insuring that the majontylof the sound stays within the Wyndham's walls..In addition, we agree to close the pool deck portion of the event at 12:00am rather than have it go all night. After 10:00pm we 1 start ratcheting the sound down on the pool deck. 7 6.
