City Clerk 2003 GENERAL MUNICIPAL ELECTION RECOMMENDATION: That the Council: a) Call and give notice of the General Municipal Election to be held Tuesday, November 4, 2003, for the election of the Mayor and two Members of the City Council, all for a full term of four years; adopt regulations for candidates for elective office, pertaining to materials submitted to the electorate and the costs thereof; and request the Registrar of Voters to render specified services in connection with said election, including the canvass of said election. b) Consider options to resolving tie-votes for candidates in City election. BACKGROUND: The City Charter provides that elections for city offices shall be held in November of odd years and by Ordinance the election is consolidated with the November General election. The City Clerk retains direct control over the nomination process, campaign reporting, and coordination of all printing and publishing by the County on behalf of the City. Vote tabulation is conducted by the County. Regarding the candidate's statement, the County provides an estimate of the cost, per candidate, to cover the cost of candidate's statement, which is optional on the part of the candidate. The deposit required for each candidate desiring to submit such a statement will be $450. Each candidate will be billed for any cost in excess of the deposit, and will be refunded any unused portion of the deposit. The nomination period will be from July 14, 2003 until August 8, 2003 at 5 p.m. In the event any incumbent for the elective office fails to file by that deadline, the deadline will be extended for non-incumbent candidates to August 15, 2003 at 5 p.M. The cost for the election is funded in the 2003-04 Fiscal Year budget in Account 001-01 1 50-43860 at $80,000. 14 TIE-VOTES: In the event two or more persons receive an equal and the highest number of votes for an office to be voted for in a city election, the Council's current policy is that a tie-vote is resolved by a special run-off election. By Charter, the Council may determine whether a tie-vote is resolved by drawing lots, special election, or other means, provided that such action is taken not less than 30 days prior to the election. A special election could not occur less than 40 nor more than 125 days after the certification of the results of the election. A special run-off election would be a stand alone election, costing approximately $8,000 and occurring no later than March 2, 2004- Office holders would continue to serve until their successor was elected and qualified. No action is required if the Council desires to maintain the current policy, which has been in effect since 1994. Between 1987 and 1994, the policy was to resolve tie- votes by drawing lots. If the Council desires to change its policy, direction is needed in order to prepare the appropriate resolution. Resolutions (2) Ig RESOLUTION NO- OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, CALLING AND GIVING NOTICE OF HOLDING OF A REGULAR GENERAL MUNICIPAL ELECTION TO BE HELD ON NOVEMBER 4, 2003 FOR THE ELECTION OF CERTAIN OFFICERS OF SAID CITY AS REQUIRED BY THE PROVISION OF THE LAWS OF THE STATE OF CALIFORNIA RELATING TO GENERAL LAW CITIES. WHEREAS under the provisions of Article VIII of the Charter of the City of Palm Springs, and the laws relating to the conduct of municipal elections, a regular General Municipal Election shall be held on Tuesday, November 4, 2003, for the election of the Mayor (incumbent William G. Kleindienst); two (2) Members of the City Council (incumbents: Deyna Hodges and Jeanne Reller-Spurgin) of said City each for the full term of four years; NOW THEREFORE BE IT RESOLVED by the City Council of the City of Palm Springs, as follows: Section 1. The ballots to be used at said election shall be, both as to form and matter contained therein, such as may be required by law to be used thereat. Section 2. The City Clerk of said City is hereby authorized, instructed and directed to procure and furnish, through the Registrar of Voters for the County of Riverside or other resource as necessary, any and all official ballots, notices, printed material and all supplies, equipment and paraphernalia that may be necessary in order to properly and lawfully conduct said election. Section 3. The polls for said election shall be open at seven o'clock a.m. on the day of said election and shall remain open continuously from said time until eight o'clock p.m, of the same day when said polls shall be closed, except as provided in Section 14401 of the Elections Code of the State of California. Section 4. In all particulars not recited in this Resolution, said election shall be held and conducted as provided by law for holding municipal elections in said City. Section 5. Notice of time and place of holding said election is hereby given and the City Clerk is hereby authorized, instructed and directed to give such further or additional notice of said election, in time, form and manner as required by law. Section 6. That the City Clerk shall reimburse said County, or other resource, for services performed when the work is completed and upon presentation to the City of a properly approved bill. Section 7. Pursuant to Chapter 6, Division 15, of the Elections Code of the State of California, the canvass of the General Municipal Election to be held in said City is hereby ordered to be made by the City Clerk, and the Registrar of Voters of said County. WHEREAS Section 13307 of the Elections Code of the State of California provides that the governing body of the local agency adopt regulations pertaining to materials prepared by any candidate for a municipal election, including costs thereof, NOW THEREFORE BE IT RESOLVED by the City Council of the City of Palm Springs, as follows: Section 1. General Provisions: That pursuant to Section 13307 of the Elections Code of the State of California, each candidate for elective office to be voted for at the General Municipal Election to be held in the City of Palm Springs on Tuesday, November 4, 2003, may prepare a candidate's statement on an appropriate form provided by the City Clerk. Such statement may include the name, age and occupation of the candidate and a brief description of not more than 200 words of the candidates education and qualifications expressed by the candidate himself. Such statement shall not include party affiliation of the candidate, nor membership or activity in partisan political organizations. Such statement shall be filed in the office of the City Clerk at the time the candidate's nomination papers are filed. Such statement may be withdrawn, but not changed, during the period for filing nomination papers and until 5:00 p.m. of the next working day after the close of the nominating period. Section 2. Spanish Language. The City Clerk shall provide Spanish translations as required or requested. Section 3. Additional Materials. No candidate will be permitted to include additional materials in the sample ballot package. Section 4. Payment, The City Clerk shall estimate the total cost of printing, handling, translating, and mailing the candidate's statements filed pursuant to the Elections Code, and require each candidate filing a statement to pay in advance his or her pro rala share as a condition of having his or her statement included in the voter's pamphlet. The City Clerk shall bill each candidate for any cost in excess of the deposit and shall refund any unused portion of any deposit. Res. No. Page 2 Section 5.
