HomeMy WebLinkAbout00044C - RIVERSIDE COUNTY BOARD OF SUPERVISORS ASSESSOR TAX COLLECTION Riverside Co Board of Supery Assessor Tax:Collection AGREEMENT #44 R214, 6-30-39 A GREEMENT THIS AGREEMENT. made and entered into this 6th day of July, 1939, by and between the CITY COUNCIL OIa' THE CITY Or PALM SPRINGS, a municipal corporation i.n the County of River- side, duly organized and existing wader and by virtue of the laws of the State of California, First party, and the BOARD OF SUPERVISORS OF THE COUNTY OF RIVERSIDE, in the State of California, second party, IN I T N E S S E T H WHEREAS, the City Council of the said City of. Palm Springs has by Ordinance No. e.1, elected that the duties of .ass,ossing property and collecting taxes provided by law to be performed by the Assessor and the Taa: Collector of said City shall be performed by the County Assessor and the County Tax Collector of the County of Riverside,, and WHEREAS, the said parties hereto desire to fix by agreement the compensation to be charged by and paid to said County of Riverside for the performance of the services of assessment and collection of such tares. NOIIT THEREFORE.. in consideration of the pre'-nises, axed of the mutaual covenants hereinafter contained, it is hereby agreed by and between the parties hereto, that the said City of Palm Springs shall pay to the County of Riverside for the assess- ment and collection of the taxes of said. City, as in said ordi- nance provided, compensation in a sure equal to one per cent (1%) of the first Twenty-five Thousand ({>25,000.00) Dollars of taxes collected by the County of Riverside, its officers or. employees, :for and in behalf of said City and/compensation in a. sum equal to one-fourth of one per cent (1/4%) for all sums -1- _ over Twenty-five Thousand (,jT25,000.00) Dollars so collected. AND IT IS FURTHER AGREED, that said compensation shall be paid to the County of Riverside by deduction of the sank from taxes collected by the officials of the County of River- side as herein provided, and that the net amount thereof, after such deduction, shall be paid to the Treasurer of said City, in accordance with the provisions of an Act of the legislature of the State of California, approved March 27th, 1895, (Statutes 1395, page 219) , and amendments thereto. IN WITNESS 117REREOF the parties hereto have hereunto set their hands, the day and year first above written, the first party causing this agreement to be executed by the Mayor of the City of PaLm Springs, and attested by the City Clerk, and the second party causing the scarce to be executed by the Chairman of its Board of Supervisors, and attested by the Clerk of said Board, all by virtue of respective resolutions of the parties hereto, duly passed. G.Wnite, Deputy RESOLUTIOiV NO. 216 WHEREAS, by Ordinance No. 44, the City of Palm Springs elected that the duties of assessing property and collecting tares provided by laird to be performed b-: the Assessor and Tax Collector of the City, shall be performed by the County Assessor and the County Tax 8ollector of Riverside County vrherein. the City of Palm Springs is situated, pursuant to an Act of the Legislature of the State of California, approved IViarch 27, 1895, (Statutes 1895, page 219) and amendments thereto, and WHEREAS, said Act provides that the amount of compensation to be charged by and paid to the County for the services of assessment and collection of taxes as provided in said Act, for an on behalf of the City shall be fixed by agreement between the Board of Supervisors of Riverside County and the City Council of the City of Palm Sprir'gs, and that not more than one per cent shall be charged for collecting . the first twenty five thousand dollars so collected and not more than one fourth of one per cent for all sums over that amount, and WHEREAS$ the Board of Supervisors of riverside County are agree- able to execution of an agreement in form as per the copy hereto at- tached as-Exhibit A and--by-reference made a part -hereof, same being the usual form of agreement used by said Board of Supervisors for that purpose, and same is satisfactory to this Council. NO117 THEREFORE BE IT RESOLVED that the Mayor and the City Clerk of -the City of Palm Springs, and of the City Council thereof, be and they are hereby authorized and directed, for and on behalf of this City Council, and in its name and under the seal of the City of Palm Springs, to forthwith execute and deliver the said agreement in form as per the attached copy. I hereby certify that the foregoing is a true copy of a resol- ution duly moved, seconded and adopted by the City Council of the City of Palm Springs, at a meeting thereof held on the 30th day of June, 1939.
