APPEALS: The project developer, Herb Lundin, is appealing the Planning Commission's May 14, 2003, denial of the placement of a"Sav-on"sign on two monument signs at the Sunrise Way and Ramon Road center, which the developer seeks identify as the "Ralph's Sav-on Center". The Planning Commission approved two monument signs, one per street frontage, identifying the center as the "Ralph's Center" and omitting the "Sav-on" text from these signs. Frank Tysen is appealing the Planning Commission's approval of face and halo illumination of the main Ralph's and Sav-on building signs. The City Council may uphold, override or modify the decision of the Planning Commission. At the conclusion of the public hearing, the City Council needs to direct staff to prepare a resolution for consideration at the City Council's next meeting. SUMMARY At its meeting on May 14, 2003,the Planning Commission voted to approve a sign program at 425 Sunrise Way South. The applicant had submitted a number of variations of the proposed signs for consideration by the Planning Commission. The developer is only appealing the Planning Commission's decision to prohibit placing a"Sav-on"sign on each monument sign. The developer believes that for marketing purposes, major tenants should be identified on the monument signs. Two monument signs were approved,each a approximately 57.5 square feet in area.The proposed signs measure 5'-9" tall by 10'-0" wide. Pursuant to Section 93.20.05 of the Zoning Ordinance (Permitted Signs), to list the names of anchor stores on monument signs a shopping center site must be a minimum of 15 acres in area. For shopping enters less than 15 acres, monument signs are allowed to list the name of the center only. The proposed center is slightly less than ten acres in area. A"anchor store" is defined by the sign ordinance as a tenant occupying more than 20,000 square feet. Sav-on will occupy approximately 16,000 square feet. Based on these facts, the Planning Commission determined that the shopping center should be called the Ralph's Center. The developer asks the City Council to re-name the center the "Ralph's Sav-on Center." / � A The second appeal addresses the type of lighting for the main building signs. These signs include one "Ralph's" sign and two "Sav-on" signs. The Ralph's sign is designed with Ralph's trademark oval in a face and halo illuminated channel with red acrylic face and ret trimcap retainer, which would be installed 2"off the building. Within the oval, the Ralph's trademark script is designed with similar face and halo illuminated channel letters, with red acrylic face and ret trimcap retainer, which would similarly be installed 2" off the building. The Sav-Ons signs are designed with illuminated channel wall letters,with white aluminum returns, red plex letter faces, with white trim cap edges. These letters would be internally illuminated with LED illumination. At the meeting, Mr. Tysen suggested that, in order to provide for a softer and more indirect lighting that the Planning Commission should allow halo illumination only. A representative of the sign company stated that to ensure visibility both types of illumination were required. The Planning Commission voted to allow both types of illumination. Grounds for the appeal is the need for SavOn's inclusion on the monument signs because it is their only store in Palm Springs, and it needs to be readily identified for the public. This.is because SavOn is very well known in Southern California and many visitors to Palm Springs who may not-be regular customers to the new center would appreciate knowing SavOn is located therein. Without this identification, it is expected that many will miss the opportunity to be served by SavOn while traveling in the vicinity. This is based on statistics that show seasonal residents of approximately 30,000 in addition to permanent residents of 44,000. As there was no quorum for review and approval of the minutes of the April 30, 2003 meeting,they will be considered again at the May 28, 2003 meeting. l �All Page 2 of 9 Planning Commission Minutes May 14, 2003 ARCHITECTURAL APPROVAL: Case 5.0827 —Application by Lundin Development for a Sign Program for a 10 acre shopping center at 425 Sunrise Way South, Zone C1, Section 14. Director reported that the Design Review Committee reviewed the most recent signage plans at its May 13, 2003 meeting and had several suggestions which are included in staffs written report. He reviewed the site plans and exhibits for the Planning Commission and stated that the proposed Sign Program is very creative and allows for center uniformity while providing flexibility for individual tenants through the use of LED displays both back-lit and face-lit. Page 3 of 9 Planning Commission Minutes May 14, 2003 Staff confirmed that there are two separate pharmacies (Ralph's in-store pharmacy and Sav-On). Chairman Klatchko invited the applicant to address the Planning Commission. Mr. Lloyd Francis stated that he is the sign contractorfor Ralph's and that the letters forthe Ralph's sign will be individual, face- and back-lit, channel letters. Mr. Greg Bever, Lundin Development Co., expressed his appreciation to staff and the Design Review Committee for their review of the proposed Sign Program. He stated that it is important for the center to have two monument signs (one for Sunrise Way and one for Ramon Road) for many reasons including traffic safety as the anchor tenants(Ralph's and Sav-On) of the center are setback a significant distance from the street frontages. He stated that visitors to the City may miss the center or, without readily visible signage, try to identify the stores by their on-building signs which could be a traffic hazard as they will not be easily visible from the street for moving traffic. He stated that naming and signing the center the Ralph's/Sav-On Center is consistent with many other shopping centers in the City such as the Albertson's/Sav-On Center on Vista Chino, the Stater Bros./DQ Center on Vista Chino, the Jenson's Center, and the Smoke Tree Ranch Ralph's/Long's Drug Center. He stated that there is a precedent of identifying major tenants on monument signs. Mr. Jim Cioffi, project architect, stated that the proposed Sign Program is very complicated as a result of the scale of the buildings and site layout (i.e. that the anchor tenants are setback from Sunrise Way by 410 feet) but that the overall philosophy has been to weave a thread of continuity into the program while allowing enough individuality for tenants to have identification and that the back-lit LED Plexiglass lettering will provide that through variations in colorwhile maintaining center uniformity. He stated that the proposed monument signs meet the intent of the Design Review Committee suggestions and confirmed that the precision block will be clad with slate. He stated that, if asked, neither Ralph's nor Sav-On would likely agree to designing the signs with identical (non-corporate) fonts. Mr. Frank Tyson stated that he likes the proposal and stated that the preponderance of red in the sign colors would look better if the letters read black at night. Ms. Laura Paix, Ralph's, requested that the Planning Commission approve the proposed Sign Program today in order for the store to open by the targeted date of July 30, 2003. Mr. Mike Reed, Sav-On, requested Planning Commission approval of the proposed Sign Program and stated that the subject store would be the first free-standing store that Sav-On has in the City. Commissioner Conrad stated that she understands the desires of the tenants in this very commercial center to have the requested signage and suggested that elimination of the word "Center" may unclutter the monument signs. She stated that an entirely different name (i.e. one more elegant) than "Ralph's/Sav-On Center" for the center would have been preferable. Chairman Klatchko stated that he does not believe it will be difficult to see the Sav-On store from Ramon Road and that, as the neighborhood shopping center is significantly smaller than the 15- acre minimum size for a Commercial Shopping Center designation as required by the sign ordinance, it does not seem necessary or consistent to allow tenant(Sav-On) identification on the ` � � �� Page 4 of 9 Planning Commission Minutes May 14 2003 monument as the wall sign will be easily seen from the street. He reiterated that the monument signs are not intended to be tenant identification signs but, rather, center identification signs. Commissioner Marantz commented that the elimination of the word "Center" on the monument signs would make them acceptable to her. Commissioner Caffery cautioned that sign lighting must not be too intense, especially from the southwest side, in order to protect the night sky. He stated that he believes "Ralph's Center" is sufficient for monument signage. M/S/C (Caffery/Conrad 4-1, 2 absent, Marantz dissenting) to approve as submitted and find that the Sign Program,due to the physical characteristics of the property and the orientation and design of the structures on the property, strict application of the regulations of the sign ordinance will not give adequate visibility to the signage;that the approved program will be compatible with the design of the property and will represent the least departure from the standards of the sign ordinance necessary for the effectiveness of the program; and that the approved program is compatible with the surrounding property and not contrary to the purpose of the sign ordinance; and subject to the following conditions: • Ralph's Market accessory signs (Bank & Pharmacy) shall be placed on top of the beams; • Tenant signs be approved subject to approval of 6 to 8 standard LED light colors and that signs be mounted on the face of beams where proposed (signs shall not be on top of beams); • Sav-On sign lighting shall be at a reasonable and low level; • Sav-on drive-thru sign shall be designed and installed as a tenant sign (perforated metal) and hang under the fascia; • Monument sign shall identify Ralph's Center only and the sign shall have the shape of the Ralph's main sign with 'Center' placed below it. The light shall be deleted from the urn; • Letters on Starbuck's sign shall be 12" in height; • Drive-thru shall be installed under drive-thru canopy (tenant sign design); • The north elevation sign shall have the Starbuck's logo only; • The east elevation sign may be either a letter or logo sign (no drive-thru); • A ground-mounted drive-thru customer convenience sign is permitted at the drive-thru entry; • Carl's, Jr.shall have east elevation sign lowered to center on stucco joints and a movement sign is not approved; • Customer convenience and traffic signs shall have a base instead of pole design; • A revised sign program shall be submitted for staff review and approval prior to issuance of any sign permits. Director reported that the project architect, Mr. Jim Cioffi will be receiving an American Institute of Architects award for his work on the Downtown Parking Structure and thanked him for his contribution to that project.
