APPROVE AMENDMENTS TO VILLAGEFEST RULES AND REGULATIONS
RECOMMENDATION:
That City Council approve various amendments to the "VillageFest Rules
and Regulations" as proposed by the VillageFest Board and staff and as
drafted by the office of the City Attorney.
SUMMARY:
The VillageFest Board has been working with Fred Galante of the City
Attorney's office to draft revisions and refinements to the "VillageFest
Rules and Regulations" in order to improve the quality of the event. These
changes are summarized in this report and fully addressed in the
attached "VillageFest Rules and Regulations" document, which highlights
all proposed additions, deletions and changes in language.
BACKGROUND:
Most of the proposed additions, deletions and refinements proposed are
minor in nature and are for clarification purposes. However, changes of
substance include:
1) deletion of barbeque vendors from the event due to
complaints about smoke;
2) addition of a requirement for Food Vendors to own a local
restaurant or operate out of an approved commissary;
3) addition of a provison allowing nonprofit organizations that
service the community of Palm Springs, benefit the City of Palm
Springs, and which are non-political and non-religious, to sell
items without having to meet the restrictions placed on Arts, Crafts
and Jewelry vendors with the "Rules and Regulations"; and
4) establishment of a vendor category distribution profile for for
VillageFest in order to maintain a balanced yet diversified event
(Farmers/ Food @ 20%, Arts/Crafts @ 50%, Jewelry @ 15% and
Miscellaneous @ 15% of the total number of vendors).

I. PURPOSE
The purpose of Palm Springs VillageFest is to create a community event for residents and
tourists of the Coachella Valley. It is the goal of the City to schedule activities at VillageFest that
promote a wholesome, family atmosphere. The event is organized and administered by the City of
Pahn Springs. The City sponsors the event in order to:
Id provide a forum for community activities
is create a positive image of downtown Pahn Springs
'd maintain the downtown as the center of social, civic, and retail activities
Id expose community members and visitors to retail stores and services available in the
downtown area
Id enhance the community as a whole
All VillageFest activities must be consistent with these goals.
VillageFest takes place in downtown Palm Springs on Palm Canyon Drive every Thursday
night. The perimeter of the event consists of Indian Canyon Drive or east thereof and Belardo Road
or west thereof. (When the term"perimeter of the event"is used,it refers to this area.For example,
when these rules require parking outside of the perimeter of the event, it means parking outside of
this area.)
VillageFest is under the auspices of the Palm Springs VillageFest Board and is administered
by the VillageFest Manager and the VillageFest Coordinator. The VillageFest Board is comprised of
Palm Springs area business people trained or knowledgeable in arts, crafts, or with other relevant
backgrounds. The VillageFest Board is appointed by the City Council. The VillageFest Board
reviews all applications to determine whether the proposed activity fits within VillageFest's purpose,
goals, and structure. All VillageFest Board meetings are posted meetings, open to the public, and
interested parties are encouraged to attend.
II. PARTICIPATION
Each VillageFest participant must fall into one of the following categories, governed by the
following specific rules:
A. ARTS, CRAFTS, AND JEWELRY
1. Art, crafts,jewelry, or wearable accessories vendors may not sell items that are
commercially available or have been purchased wholesale, or have not received approval from the
VillageFest Board.In its decision to approve or disapprove an article the VillageFest Board may also
consider the factors described at subsection Ill. D. below .

2. Seventy-five percent of any craft,jewelry,or wearable accessory item offered for
sale (except aromatics)must be handcrafted work of the artist selling the wares at the booth. Items
that are merely hand-assembled of commercially-available manufactured parts will not be considered
handcrafted for the purposes of this event.The artist may be represented at the VillageFest event by
an immediate family member during any day in which the artist is absent,provided the artist is not
absent for more than 3 consecutive events.
B. FOOD SERVICE VENDORS
1. All food service vendors must stay in their specified booths during each
VillageFest event,which spaces shall exclude curbs or pavers.
2. VillageFest food operators (except produce or 100%pre-packaged non-potentially
hazardous food vendors) shall own a restaurant or get approval from Riverside County
Environmental Health Department to operate out of an approved local food establishment (a
commissary). If a food vendor operates out of an approved commissary, all food and related
products are to be stored at the commissary. At no time shall food, or related products, be stored
at home or other unapproved location. Participating restaurants will be subject to the same
application and review process as all other food service vendors.
3. All food service vendors must have adequate trash containers for refuse as
indicated by the VillageFest Coordinator, which shall include at least two (2) trash cans, and shall
clean and remove any trash or debris from their booth area and surrounding areas before leaving the
VillageFest event.
4. Hand-washing facilities approved by the Riverside County Health Department
must be provided within the temporary food facilities.
5. Food service equipment shall be equipped with tight-fitting closures to prevent the
entrance of insects.
6. Facilities for the sanitary disposal of all liquid waste are required and are subject
to the approval of the Riverside County Health Department.
7. All condiments are to be individually wrapped or dispensed from sanitary pour-,
pump-, or squeeze-type devices.
8. All food service vendors must comply with requirements imposed by the
Riverside County Health Department, including securing and continuously maintaining a yearly
Riverside County Health Department food permit.
9. Vendor vehicles must be moved out of the event perimeter prior to
commencement of the event.
10. All areas must be kept neat and clean at all times.

11. No food preparation may take place outdoors, except the cooking of foods on
burners which do not produce smoke.
C. FARMERS MARKET
1. The Farmers Market operates under the State Department of Food and Agriculture
regulations. Certain guidelines have been established by the Fanners Market and the City with
respect to specific needs of the event.Permits must be up-to-date and displayed at point of sale at all
times.
2. All people wishing to sell their crops directly to the public must contact the
VillageFest Coordinator. Permits and assignments will be made after the application review is
completed.
3. Vendors may not display or advertise items that they are not permitted to sell. Gift
packs containing produce not grown by the vendor are prohibited.
4. Vendors must clean up their assigned spaces before leaving and must provide
their own refuse containers. City trash containers are not to be used for vendor debris.
D. POLITICAL, RELIGIOUS,AND NONPROFIT ORGANIZATIONS
1. A limited number of spaces are available for political, religious, and nonprofit
organizations. Applicants will be given space at the event on a first-come, first-served basis and
rotating four(4)week cycle;participation will not be based on the background or qualifications of a
group or individual or the content of the message involved.
2. Organizations wishing to raise funds during the event must have a current
nonprofit status.Verification must be provided at the time of application.Upon review and approval,
a VillageFest Permit will be issued free of charge.
3. All monies generated by sales or solicitations, excluding direct material costs,
must go to the nonprofit group.A full accounting of the nonprofit group's activities shall be provided
on a yearly basis by June 30, to the VillageFest Coordinator.
4. Giving away merchandise or food items comparable to those that have been
approved for sale by another participant at VillageFest will not be allowed.
5. No loudspeaker or public address system maybe used by the participants during
the event. Participants may not harass, follow, or intimidate downtown visitors. Activities that are
conducted in such a manner as to interfere with the goals or purposes of the event may result in
immediate revocation of the permit.
6. Nonprofit organizations raising money through sales,except community services
organizations described at paragraph 7 immediately below, are governed by and shall adhere to all

rules and regulations of VillageFest as if such organizations were a commercial VillageFest
participant,although they are entitled to a reduced space rental as provided by resolution of the City
Council.
7. Nonprofit organizations that service the community ofPatin Springs byreturning
any moneys collected to organizations and causes that predominately benefit the City of Pahn
Springs,are non-political,and non-religious shall be entitled to sell items for such purposes,without
having to meet the requirements of Section 11. A of these rules and regulations.
E. MISCELLANEOUS
Additional miscellaneous categories for participation in VillageFest include the following:
1. Antiques produced before 1940.
2. Aromatics including incense, potpourri, scented oils, candles, and limited
accessories.
3. Books including comic books bearing the seal of the Comic Code Authority or
published prior to the establishment of the Comic Code Authority.
4. Collectibles appearing in a collector's guide,which guide must be presented to the
VillageFest Board for prior approval.
5. Entertainment: Entertainers wishing to perform at VillageFest must contact the
VillageFest Coordinator.
6. Sponsorship: A business that does not meet the proper criteria under category
guidelines may become involved with the event by becoming a sponsor and setting up a booth.
However, no direct sales will be allowed during the event itself. Examples of potential sponsor
businesses include radio stations, newspapers, and real estate firms. Interested applicants should
contact the VillageFest Coordinator at 760-320-3781 for more information on sponsorship packages.
III. APPLICATION
A. An application with the application fee must be delivered to the VillageFest office at least
fourteen days before the next scheduled regular VillageFest Board meeting. The application fee
should be in the form of a check or money order or cash(out of state checks not accepted) and
must bear the applicant's driver's license number and expiration date, and a copy of a valid
picture identification. Applications must be complete. Applications without complete
information cannot be considered. (Applicants may contact the VillageFest Coordinator to find
out when the next VillageFest_Board meeting will take place.).
B. Prospective vendors must attend a VillageFest Board meeting with representative
samples, including intended selling price, for each item desired to be sold, pictures of the craft

process,and invoices of raw materials.The prospective vendor shall have the burden to establish that
the item desired to be sold meets the requirements set forth in these rules and regulations.
C. All applications for the event must contain name, address, phone number, and
signature of the responsible person. Applicants will be required to show satisfactory proof of
adequate liability insurance coverage as determined by the City of Pahn Springs Risk Management
Division, or may purchase liability insurance coverage from the City of Palm Springs at the
applicable rate, as provided by the VillegeFest Coordinator.
D. All merchandise will be reviewed and evaluated by the VillageFest Board
according to the goals and purposes of VillageFest, as well as such subjective considerations as
quality of the item and raw materials used,workmanship,uniqueness and appropriateness of the item
for the VillageFest event. It is within the discretion of the VillageFest Board to deny VillageFest
applications based on these criteria. If the application is approved,space will be assigned subject to
availability within the vendor's category and the following breakdown of spaces available for each
category:
Farmers/Food 200/,
Arts/Crafts 50%
Jewelry 15%
Miscellaneous 15%
IV. FEES AND PERMITS
A. All participants must obtain a VillageFest permit before renting a space'at the
event. Fees for permits and space rental must be paid before spaces can be assigned. The annual
permit fee can be paid at the Business License Division at City Hall,3200 E.Tahquitz Canyon Way.
Political,religious, and nonprofit organizations will be given the VillageFest permit free of charge.
B. Those vendors who have a City of Palm Springs business license to sell a product
and plan to sell the same product at VillageFest must still obtain the VillageFest permit; they will
not,however,be charged a VillageFest permit fee. Those vendors who have a City of Palm Springs
business license to sell a product but plan to sell a different product at VillageFest must obtain the
VillageFest permit and pay the VillageFest permit fee.
C. Vendors must possess a California state seller's permit, which can be obtained
from the State Board of Equalization, 42-700 Bob Hope Drive, Suite 301, Rancho Mirage, CA
92270, telephone: 760-346-8096, before a space will be assigned. ON A QUARTERLY BASIS,
THE CITY WILL RUN A CHECK ON ALL VENDORS' SELLER'S PERMITS TO ENSURE
LOCAL SALES TAX IS BEING DECLARED.
D. Fees for permits, space rental, and other fees and charges shall beset and may be
amended from time to time as provided by resolution of City Council. The City reserves the right to
adjust the fees at any time, with such adjustment to be immediately effective.

V. GENERAL RULES FOR PARTICIPANTS
A. Vendors must participate once space is allocated. VillageFest will proceed as
scheduled,rain or shine. There is no fee credit given to a vendor if they decide not to
participate on any night, for whatever reason.
B. It is the responsibility of the vendor to notify the VillageFest Coordinator twenty-four
hours in advance if unable to participate. Vendors failing to notify the VillageFest
Coordinator prior to an absence,or vendors who notify the VillageFest Coordinator
but without adequate explanation for their absence, shall be charged with an
unexcused.absence. Any vendor with two or more unexcused absences in a one
month period will be subject to suspension and possible revocation of that vendor's
VillageFest permit.
C. When a vendor decides to discontinue participation in VillageFest, they must notify
the VillageFest Coordinator in writing before the first Thursday of the month of the
departure. A vendor will then pay for only those Thursdays on which they will be
present. No fee credit or refund is given if a vendor notifies the VillageFest
Coordinator of departure after the first Thursday of the month.
D. Sales privileges and spaces may not be sold, sublet, or transferred in any way.
E. Participants in the event, their employees, and their children, shall be appropriately
dressed(e.g.,shirts and shoes)and conduct themselves in an orderly and businesslike
manner.
F. No person shall deface or otherwise abuse the downtown buildings, plants, or
landscape. The City is under no obligation to provide water or any equipment to
participants. The City's only obligation is to provide a space on the street. Power
cords must be completely taped down to limit the liability for the vendor and
conform to City safety requirements.Power must be supplied from public light poles
rather than private connections. No power cords shall be connected to outlets
attached to the palm trees on Palm Canyon Drive.
G. All participants shall indemnify, defend, and save harmless the City, its officers,
officials, agents, and employees, from and against any and all claims, demands, law
suits,penalties or liabilities by any name and of any kind or nature whatsoever,which
the City,its officers, officials, agents, and employees may sustain or incur, or which
may be imposed upon them or any of them, for injury to or death of any person, or
damage to any property, as a result of, or arising out of, the participant's acts of
omissions in connection with VillageFest.

H. No person or business participating in the VillageFest shall state,imply,or otherwise
suggest that the City of Palm Springs endorses, sponsors, or supports the views of
their organization, candidate,product, or service.
I. Participants must police all streets, curbs, sidewalks and areas surrounding their
booth and remove all litter and stains that results from their activity.When removing
or dismantling setups, all participants must clean their own spaces of all debris.
J. No alcoholic beverages are to be consumed or sold within a booth.
K. Merchants' windows may not be obscured at any time by vendors' or participants'
boards, banners, or other large displays or equipment.
L. Participants are not guaranteed space in the location of their choice.Because the City
wishes to provide maximum visibility and access to merchant businesses that remain
open during the hours of VillageFest,booth height will be a major consideration in
booth space allocation.Proposed increases in participant's booth height may require
booth relocation. Contact the VillageFest Coordinator if any modification to the
booth is desired.
M. The VillageFest Coordinator has the authority to assign and reassign spaces upon
two-weeks written notice.
N. Dimensions of the space allocated to each vendor are sixteen feet wide and twelve
feet from the curb. Vendors shall not move into the middle of the street with their
booth space in violation of health and safety regulations.
O. Participants must staywithin their assigned spaces and out of fire lanes at all times.It
is the participant's responsibility to be aware of the fire lanes, as specified by the
VillageFest Coordinator.
P. All tables used must be covered and. draped with a fire retardant fabric, which may
be either a disposable or non-disposable material, of either royal blue, burgundy,
hunter green or golden yellow color. Fanners may use skirted tables in lieu of using
full table covers. The covering or draping should be neat and clean and in bright,
festive colors (one of the four colors approved by the VillageFest Coordinator) and
should not be more than two(2)inches from the ground on all sides. All covering or
draping must be treated to be fire-retardant.
Q. The person in charge of any activity must be in possession of a valid VillageFest
permit at all times during set-up, operation, and dismantling. The permit is to be
conspicuously displayed during operation in the upperright-hand comer of the booth.
Additionally, if the activity involves food sales, the participant must also have all
relevant documents or permits demonstrating compliance with health department

regulations. Any permit or license required by the City, Riverside County, or the
State of California must be displayed at all times.
R. Vendors must remove all boxes and containers used in the transportation of their
merchandise BEFORE VillageFest begins for the evening. Empty boxes may be
stored under tables as long as they are not visible (e.g., under a drape).
S. Street Closure; Parking:
1. The City begins barricading the streets at approximately 5:00 p.m.
season,6:00 p.m. non-season on Thursdays. Vendors must not park in the
traffic lanes until after the VillageFest air hone has been signaled for set up.
Vendor vehicles must be unloaded and parked outside of the event perimeter
prior to the scheduled time for commencement of the event.Vendors must be
cleared off the street within 45 minutes after the scheduled time for closing.
Participants must obtain and display a Vendor Pass for each vehicle involved
in the event. The Vendor Pass must be displayed in the front windshield of
the car in order to gain entry to VillageFest.
2. Beginning at approximately 5:30 p.m. season, 6:30 p.m. non-season,
participants will only be allowed to enter the event from the intersection of
Arenas and Palm Canyon. Vehicles are not allowed to enter the event from
any other location. This includes entering Palm Canyon at Baristo and
heading north.
3. Participants and their employees shall park outside of the event perimeter
except for participants in the Farmers Market, or except as may be
specifically approved by the VillageFest Coordinator.
4. No vendor may bring their vehicle onto the street from the time the event has
started until the time it ends. The VillageFest Coordinator will notify all
vendors in advance when seasonal hour changes go into effect.
5. Participants must not at any time move any traffic control devices, such as
barricades, signs, or delineators. Citations will be issued to violators of these
rules.
T. HEALTH, FIRE, AND POLICE REGULATIONS:
1. Cooperation with local health, fire and police departments is essential.
Participants must be aware of and comply with code requirements. Only
pedestrian traffic will be permitted in the fire lanes. Specific questions
regarding the interpretation of codes should be directed to the appropriate
agency.

2. Any furniture or equipment to be used within the space assigned must first be
approved by the VillageFest Coordinator. Any drapes, curtains, drops, or
decorative materials must be treated with a flame retardant in accordance
with Palm Springs Fire Department regulations. Any vendor selling
combustible products or doing open-air cooking must provide a fire
extinguisher(2A- I OBC type).
3. All use of propane in conjunction with cooking or heating must be pre-
approved by the Palm Springs Fire Department before a permit will be issued.
U. The scheduled hours of the event are as follows:
Season(October-May): 6:00 p.m. to 10:00 p.m.
Non-season(June - September): 7:00 p.m. to 10:00 p.m.
VI. ENFORCEMENT AND APPEALS
A. ISSUANCE OF PERMITS
1. The VillageFest Board will review all VillageFest applications and product
samples to determine whether they meet VillageFest criteria. The VillageFest Board will not
discriminate on the basis of race,religion, creed, color, gender, or national origin.
2. Upon approval of an application by the VillageFest Board,and if the application
meets all criteria of these rules and regulations and the applicant pays all applicable fees, the
VillageFest Manager will issue a VillageFest permit subject to availability of spaces within particular
categories.
3. If the application is denied,an.appeal maybe made to Palm Springs City Council.
The appeal must be filed within fifteen days of the date of denial.
4. The City Council may, in their sole discretion,hear the appeal or decline to hear
the appeal. In the event that the City Council declines to hear an appeal, then the decision of the
VillageFest Manager is final.
5. In the event that the City Council chooses to hear the appeal,the applicant, at the
direction of the City Council, must present the appeal to the City Council orally or in writing and
shall have the burden of showing that the application should be granted. The applicant will be
notified by mail within fifteen days of the City Council's decision.
6. The City Council's decision is final. Denied applications will be kept on file for
sixty days after final action.
B. SUSPENSION AND REVOCATION OF PERMITS

1. All VillageFest participants must comply with the purposes and goals of
VillageFest and all applicable rules and regulations. All participants should bear in mind that
VillageFest is an event for the enjoyment of the residents of the City and the Coachella Valley, as
well as visitors to the desert area,thus contributing to the tourism industry.VillageFest participants
shall not conduct their activities so as to antagonize or be offensive to residents or visitors, and will
do everything possible to encourage and promote the festive nature of VillageFest.Non-compliance
with any VillageFest rule or regulation, including offensive conduct, is grounds for suspension or
revocation of the VillageFest permit.
2. Upon finding grounds for suspension or revocation, - the VillageFest Manager
will suspend or revoke a participant's permit for a period deemed appropriate in light of the nature of
the violation.Minor but repeated violations will be grounds for longer suspensions or revocation of
permits. The order of suspension or revocation shall be issued by the VillageFest Manager in writing,
specifying the effective date of and grounds for the suspension or revocation.
3. Generally, the first violation of the rules and regulations will result in a verbal
warning, the second in a written citation, and the third in suspension or revocation of the
participant's VillageFest permit.Notwithstanding the forgoing,violations which by their nature are
knowing, or are very serious, may result in immediate revocation of the participant's VillageFest
permit regardless of the presence of absence of prior violations. The City reserves the right to
immediately order the removal of all equipment and material belonging to a participant from the
street, for any reason deemed necessary to secure the public health, safety, and welfare.
4. Upon suspension or revocation of a VillageFest permit,the participant shall have
the right to appeal the suspension or revocation to the VillageFest Board. Such appeal must be made
within fifteen days of the issuance of the suspension or revocation, and any such suspension or
revocation is effective until and unless overturned on appeal.
5. After receipt of an appeal,the VillageFest Manager shall schedule the matter for
hearing at the next available VillageFest Board meeting at which the matter can be presented and
shall provide the participant with at least ten days written notice of the time and place of the hearing.
The participant shall have the burden of overturning the order. Technical rules of evidence shall not
apply. Following the hearing,the VillageFest Board may approve,modify,or reverse the VillageFest
Manager's order of suspension or revocation. Notice of the VillageFest Board's decision shall be
given in writing to the applicant.
6. If the suspension or revocation is upheld, the participant may appeal the
VillageFest Board's decision to Palm Springs City Council.The appeal must be filed within fifteen
days of the VillageFest Board's decision.
7. The City Council may, in their sole discretion,hear the appeal or decline to hear
the appeal. In the event that the City Council declines to hear an appeal, then the decision of the
VillageFest Board is final.

8. In the event that the City Council chooses to hear the appeal,the hearing shall be
conducted in the same manner and be subject to the same rules as the hearing before the VillageFest
Board.
9. The City Council's decision is final.Denied appeals will be kept on file for sixty
days.

The undersigned acknowledges receipt of the rules and regulations outlined and agrees that
he/she will comply with the rules. Non-compliance will result in removal of the activity from the
streets. The undersigned further certifies that he/she is the responsible person referred to in the
riles and that he/she is authorized to execute the permit and release and waiver forms on behalf
of the group. The undersigned has read the release and waiver clause in the permit and hereby
agrees to be bound by its terns.
Failure to comply fully with all rules and regulations will result in forfeiture of right to
participate in Pahn Springs VillageFest activities and/or immediate removal from event site.
All participants shall indemnify, defend, and save harmless the City, its officers, officials, agents,
and employees, from and against any and all claims, demands, law suits, penalties or liabilities by
any name and of any kind or nature whatsoever, which the City, its officers, officials, agents, and
employees may sustain or incur, or which may be imposed upon them or any of them, for injury

participant's acts of omissions in connection with VillageFest.
