HomeMy WebLinkAbout7/16/2003 - STAFF REPORTS (10) DATE: July 16, 2003 TO: City Council FROM: Public Works Director/City Engineer ANNUAL MAINTENANCE DISTRICTS (10) - PUBLIC HEARINGS FOR FISCAL YEAR 2003/04 RECOMMENDATION: It is recommended that City Council hold annual Public Hearings for 2 of the 4 Lighting Maintenance Districts and 6 Parkways Maintenance Districts and approve 8 Resolutions adopting maintenance costs for: Lighting District No. 1-BelardoArea; Lighting District No.2-McManus Drive; Lighting District No. 3-Crossley Tract; Lighting District No. 4- Eagle Way area; Parkways District Nos. 6A, 6B and 6C - various locations; Parkways District No. 7 - Sunrise Norte ; Parkways District No. 8-Vintage Palms and Parkways District No. 9-Flora Vista Tract, approving the Annual Assessments for the above 10 Maintenance Districts for Fiscal Year 2003/04. SUMMARY: At the June 18 , 2003 Council Meeting, 8 Engineer's Reports and 6 Resolutions of Intention were approved by City Council, setting the Public Hearing date for July 16, 2003 for 8 of the 10 maintenance districts in Palm Springs: 1. Street Lighting Maintenance District No. 1 (Belardo Area-166 Lots)* 2. Street Lighting Maintenance District No. 2 (McManus Drive-25 Lots)* 3. Street Lighting Maintenance District No. 3 (Crossley Tract- 75 Lots) 4. Street Lighting Maintenance District No. 4 (Eagle Way Area-43 Lots) 5. Parkways Maintenance District No. 6A (Chia Rd. Area- 24 Lots) 6. Parkways Maintenance District No. 6B ("Parkside Estates" Tract- 93 Lots) 7. Parkways Maintenance District No. 6C ("Park Sonora" Tract- 30 Lots) 8. Parkways Maintenance District No. 7 ("Sunrise Norte' Tract- 53 Lots) 9. Parkways Maintenance District No. 8 ("Vintage Palms" Tract- 63 Lots) 10. Parkways Maintenance District No. 9 ("The Springs' Tract- 77 Lots) BACKGROUND: Eight of the districts listed above are under the "Landscaping and Lighting Act of 1972" which requires Public Hearings every year. *LMD No.1, &12 were created under the "Street Lighting Act of 1931," requiring public hearings every 5 years (last held in July 2001)those public hearings will reoccur in 2006. The City Council will therefor approve the annual maintenance costs for the 649 properties within the 10 districts and conduct Public Hearings only for Lighting Districts 3 &4 and the 6 Parkways Districts. Attached is the Fixed Charges Report Summary for the 10 Maintenance Districts for FY03/04. Individual assessments are listed by assessor's parcel number and County Fund Number in the Fixed Charges Reports. Upon approval by City Council,the annual assessments will be forwarded to the Riverside County Tax Collector to be listed on the 2003/04 tax rolls. Under laws governing maintenance districts,any increases in annual assessments,overpreviously set maximums,would require a Public Meeting,then a Public Hearing following mailing of individual ballots to all affected property owners (Proposition 218-Article XIIID, Section 4 of the California Constitution, approved by California voters on November 5, 1996). Prop. 218 requires a 45-day Notice and Ballot(majority vote) for new formations or increases that exceed,previously set maximums . Note: There are no cost increases over and above previous public hearing and Council approved maximum limits for any assessments for the maintenance districts in 2003/04. 74 Assessments for 8 of 10 maintenance districts are detailed in the Engineer's Reports approved by City Council on June 18, 2003. Engineer's Reports for SLMD No. 1 & 2 do not require a public hearing this year, but are included herein for Council approval. The Annual Assessments for the 10 existing Maintenance Districts are summarized as follows for FY 2003/04: SLMD No.1 (Belardo): Assess $9,027 ($54.71 average cost each for 165 lots)- $8,581 in 02/03 SLMD No.2 (McManus): Assess $4,250 ($170 each for 25 lots)- same as 02/03 SLMD No.3 (Crossley): Assess $2,492 ($33.23 each for 75 lots)- $2,484 in 02/03 SLMD NoA(Eagle Way): Assess $1,129 ($26.26 each for 43 lots)- same as 02/03 PMD No.6A (Fairport): Assess $4,560 (24 Lots:20 @ $162.86; 4 @ $325.71)- $4,181 in 02/03 PMD No.613 (Parkside): Assess $1,818 ($19.55 each for 93 lots)- same as 02/03 PMD No. 6C (Park Sonora): Assess $8,262 ($275.40 each for 30 lots)- same as 02/03 PMD No.7 (Sunrise Norte Tract): Assess $23,747 ($448.06 each for 53 lots)- $23,747 in 02/03 PMD No.8 (Vintage Palms): Assess $11,657 (62 @ $110.94; 2 @ $2,389.50)- $11,657 in 02/03 PMD No.9(Flora Vista Tract):Assess$0($0 because$17,172 surplus exceeds$16,573 estimate) Assessments are based on comparison of actual costs incurred in prior years vs. assessments in prior years to obtain annual adjustments to compensate for debits and credits on an annual basis. (An 11tb District is in process for the formation of Parkways District No. 10 for the "Mountain Gate" Tract 30963, which was proposed for FY 03-04 as well). Also attached is a background memorandum which indicates the formation dates, locations and reasons for formation for the annual maintenance districts.The resolutions overrule protests,confirm the spread of assessments as indicated on the Engineer's Reports and orderthe City Clerk to file a certified copy of the spread of assessments and map with the County of Riverside to place the assessments on the Riverside County Tax Roll for Fiscal Year 2003/04. 4" ROBERT L. Most of the annual costs(about 80% or more) are the basic SCE monthly electrical charges. In many cases the street lights were requested by property owners as a crime deterrent. Most of the general public, however, seem to prefer the dark desert sky atmosphere and do not wish neighborhood street lighting promoted by the City. The lighting districts were established in areas where more than 60% of the given area residents had petitioned the City to have the street lights installed. There are 309 properties in Palm Springs within the 4 lighting district boundaries. Parkways Maintenance Districts The parkways districts are primarily developer oriented projects that installed off-site landscaping along the public right-of-way perimeters of subdivisions as a condition-of-approval requirement of the Planning Commission. The landscaping is an enhancement to the project and neighborhood. -2- a OR � These are typically single-family property ownerships that are not within a condominium type situation to handle the costs by association dues. Their chosen option is to form the maintenance district to spread the costs annually on the tax rolls since there is no other practical method to collect and pay for the annual maintenance costs . There are 340 properties in the 6 parkway maintenance districts City-wide, (see attached location map). Effective July 1, 2001 PAC WEST LAND CARE, INC. took over the annual Parkways Maintenance contract,in addition to maintaining the City Parks,Center Medians and City Facilities landscape and irrigation. The PAC WEST contract was for 3 years, with an option for 2 +2 additional years of extensions. Scott Mikesell, Director of Parks, Recreation and Facilities, administers and oversees the annual maintenance contracts, assisted by Vicki Oltean, Parks & Recreation Manager and Ted Molhoek, Parks Maintenance Supervisor. With the exception of Lighting Districts Nos. 1 and 2, the remaining 8 Maintenance Districts were formed under the California "Landscaping and Lighting Act of1972". The exceptions are Lighting District No. 1 (Belardo area)and Lighting District No. 2 (McManus), which were formed under the California "Street Lighting Act of 1931". The 1931 Act only requires a public hearing once every five years, whereas the 1972 Act requires public hearings every year. The annual assessments (Fixed Charges Reporting Forms)must be submitted to the County Tax Collector in August annually. We therefore schedule to approve the Engineers Reports and adopt the Resolutions of Intentions annually in June and hold the Public Hearings annually in July in order to make the County Clerk's annual August deadline. An 1I'Maintenance District (Parkways Maintenance District No. 10) for a new 308 home single family subdivision called "Mountain Gate" Tract 30963 at Highway 111 & Gateway Drive is in the formation process at this time. Century Homes hopes to make formation in time for FY 2003/04 assessor's tax rolls. According to the City Clerk, there have been no protests to date for any of the districts listed above, including the earliest district dating back to 1967. There is no net cost to the City for the annual maintenance districts as all maintenance and administrative costs are assessed to the property owners. WHEREAS in accordance with the provisions of the Landscaping and Lighting Act of 1972 that the Engineer of Work determine actual maintenance costs of the previous year and an estimate of costs for the ensuing year in order to prepare the annual spread of assessment; and WHEREAS July 16, 2003, was set as the date to hear protests on the spread of assessment for Street Lighting Maintenance District No. 3 (Crossley Tract- 75 Properties); and WHEREAS notice duly was given by publication etc. and a hearing duly conducted at which all persons interested testified; and WHEREAS written protests have been received representing less than fifty percent (50%) of the area of assessable lands within the maintenance area; and WHEREAS spread of assessment is forwarded to the County Tax Collector who, in turn, includes this assessment on the County Tax Roll for FY 2003-04, NOW THEREFORE BE IT RESOLVED by the City Council of the City of Palm Springs as follows: Section 1. That all protests, if any, are hereby overruled for Street Lighting Maintenance District No. 3 (Crossley Tract: 341h Ave, Lawrence St., Marguerite St. & Martha St.) Section 2. The improvements, assessment amount, spread of assessment, and the diagram, as set out in the Engineer's Report, are hereby confirmed for fiscal year 2003-04 at $2,492($33.23 each for 75 lots). (Note 02/03 Assessment was$2,484-$33.12 ea.) Section 3. The City Clerk is hereby ordered and directed to file a certified copy of the diagram and assessment roll with the County Tax Collector by August, 2003, together with a certified copy of this Resolution upon its adoption and the auditor is requested to collect such assessments on the tax roll in the same manner and subject to the same penalties for non-payment as are county property taxes. Section 4. This project is statutorily exempt from CEQA under Section 15273 of the guidelines as an ongoing maintenance charge.
