RECOMMENDATION: It is recommended thatthe City Council adopt the attached Resolutions forthe abatement of 20 public nuisances located throughout the city and record the liens against the title of each property . SUMMARY: By adopting the resolution the City Council will authorize the City Clerk to process the filing of the resolutions report to allow for a special assessment to be placed on the individual property tax rolls for monies owed to the City. BACKGROUND: In the course of normal activities the Community Preservation Staff posted priority cases as public nuisances following non-compliance by owners. After time limitations lapsed, abatement procedures were completed. Attached to this report are the resolutions for 20 of these public nuisances that have been abated, but for which the property owners have not paid the billing. The total amount outstanding is $75,451.99. Section 11.72.260 of the Palm Springs Municipal Code requires this report of Resolutions to be filed with the City Council. Vacant property is difficult to repair since the property was 4 constantly vandalized. The city of Palm Springs illegally removed my electric meter in 5 order to prevent anyone from occupying and watching the building while repairs were in process. City codes habitually change year to year, and the building was originally 6 constructed when different building codes were in effect. 7 7. Defendant denies, each and every allegation in paragraph 7. Defendant 8 asserts the following affirmative defense: 9 The City of Palm Springs illegally entered the building by manipulation of a 10 tenant being sued for an unlawful detainer or a tenant who was in the process of being 11 evicted. This was done by the city to continue the harassment and discriminate against 12 me as a property owner. 13 The city of Palm Springs attempted to interfere with my lawful eviction of an undesirable tenant that was not allowing me to repair my property. I have the legal right 14 to remove a tenant who is destroying my property and is refusing to pay rent. Instead 15 the city encouraged the tenant to continue to break the law and remain in the building 16 they declared to be dangerous and uninhabitable, nor adhere to the Rental Agreement, 17 nor pay rent (owing $2,500.00 in back rent). The city did not recommend that the 18 tenant contact the "Fair Housing Agency," the correct agency to be handling the 19 situations. Instead they continued to harass me. 20 The tenant refused to move. When the Marshall arrived to perform a "lock out," the tenant informed the city of the move out date, and the city ordered the electric meter 21 to be removed, limiting my ability to repair the building in a timely manner, causing the 22 building to remain vacant and opening the building to be vandalized and destroyed. 23 The city of Palm Springs required me to perform duties that were and are not 24 required of the neighboring houses. 25 8. Instead they are making money, by 18 taking advantage of minorities living in run down neighborhoods. The city has recently 19 received millions of dollars for a "revitalization program" and is constantly receiving 20 redevelopment monies, but they are neither redeveloping nor revitalizing this neighborhood. They are abusing their power and authority, by keeping our 21 neighborhood as a drug and crime infested slum. 22 They are costing me, as well as the community, many unnecessary hard earned 23 dollars. They are attempting to take away my hard earned investment and are double 24 charging me through taxes and liens for services not provided. They are spending 25 millions of dollars to destroy homes, where they should be building low income housing. 26 The city should develop a plan for the community of reconstruction, not destruction. 27 The city "double charges" the homeowner for administrative costs, and in 28 addition, demands payment for every code enforcement action, through taxes and 4 ANSWER TO THE VERIFIED COMPLAINT I liens. 2 It is not fair to low-income families to suffer economical and social loses and 3 have to cope with housing shortages, the name of the law, i.e., city ordinances and 4 codes.
