20 Defendant, Willie Holland, answers the verified complaint as follows:
21 1. Defehdant admits, each, allegation of the following numbered paragraph 1.
22 2. Defendant admits, each allegation of the following numbered paragraph 2.
23 3. Defendant denies, because of the lack of sufficient information or belief to
24 answer, each allegation of the following numbered paragraph 3.
25 4. Defendant denies, because of the lack of sufficient information or belief to
26 answer, each allegation of the following numbered paragraph 4.
5. Defendant denies, because of the lack of sufficient information or belief to
27 answer, each allegation of the following numbered paragraph 5.
28 6. Defendant denies, each and every allegation in paragraph 6. Defendant
1
ANSWER TO THE VERIFIED COMPLAINT
1 asserts the following affirmative defense:
2 The property in question was destroyed by an undesired tenant that I was in the
3 process of evicting. Vacant property is difficult to repair since the property was
4 constantly vandalized. The city of Palm Springs illegally removed my electric meter in
5 order to prevent anyone from occupying and watching the building while repairs were in
process. City codes habitually change year to year, and the building was originally
6 constructed when different building codes were in effect.
7 7. Defendant denies, each and every allegation in paragraph 7. Defendant
8 asserts the following affirmative defense:
9 The City of Palm Springs illegally entered the building by manipulation of a
10 tenant being sued for an unlawful detainer or a tenant who was in the process of being
11 evicted. This was done by the city to continue the harassment and discriminate against
12 me as a property owner.
13 The city of Palm Springs attempted to interfere with my lawful eviction of an
undesirable tenant that was not allowing me to repair my property. I have the legal right
14 to remove a tenant who is destroying my property and is refusing to pay rent. Instead
15 the city encouraged the tenant to continue to break the law and remain in the building
16 they declared to be dangerous and uninhabitable, nor adhere to the Rental Agreement,
17 nor pay rent (owing $2,500.00 in back rent). The city did not recommend that the
18 tenant contact the "Fair Housing Agency," the correct agency to be handling the
19 situations. Instead they continued to harass me.
20 The tenant refused to move. When the Marshall arrived to perform a "lock out,"
the tenant informed the city of the move out date, and the city ordered the electric meter
21
to be removed, limiting my ability to repair the building in a timely manner, causing the
22 building to remain vacant and opening the building to be vandalized and destroyed.
23 The city of Palm Springs required me to perform duties that were and are not
24 required of the neighboring houses.
25 8. Defendant denies, that due to the lack of sufficient information or belief to
26 answer each allegation of the following numbered paragraph 8.
27 9. Defendant denies, each and every allegation in paragraph 9. Defendant
28 asserts the following affirmative defense:
2
ANSWER TO THE VERIFIED COMPLAINT
a .
1 The city gave me incorrect information reference unpermitted improvement and
2 code violations. They removed my utilities and would not reinstate them, stating I had
3 to bring my building up to current city code changes; thus, attempting to force me to
4 spend unnecessary excessive money, i.e., making a two-car garage and adding an
5 additional kitchen.
10. Defendant denies, because of the lack of sufficient information or belief to
6
answer each allegation of the following numbered paragraph 10, including 10a, 10b,
7 10c, 10d, 10e, 10f, 10g, 10h, 10i, 10j, 10k, 101, 10m, 10n, 100, 10p, 10q, 10r, 10s, 10t,
8 10u, 10v, 10w, 10x, 10y, 10z, 10aa, 10bb, 10cc, 10dd, and 10ee.
9 10c. Defendant denies each and every allegation in paragraph 10c. Defendant
10 asserts the following affirmative defense:
11 The garage and kitchen were modified without the required approval and permit
12 is untrue.
13 11. Defendant denies, because of the lack of sufficient information or belief to
answer, each allegation of the following paragraph 11.
14
12. Defendant denies, because of the lack of sufficient information or belief to
15 answer, each allegation of the following paragraph 12.
16 13. Defendant denies, each and every allegation of the following paragraph
17 13. Defendant asserts the following affirmative defense:
18 Requested permits were delayed, resulting in my inability to restore the building
19 to its original state.
20 14. Defendant denies each and every allegation of the following paragraph
21 14. Defendant asserts the following affirmative defense:
The city of Palm Springs continually created "special rules" that applied only to
22 me, and other property owners in the community were treated differently.
23 15. Defendant denies each and every allegation in paragraph 15. Defendant
24 asserts the following affirmative defense:
25 The city of Palm Springs falsely informed the defendant concerning the
26 requirements necessary to bring the building up to current code standards. The city
27 removed the utilities and withheld the necessary permits wrongfully.
28 16. Defendant denies, because of the lack of sufficient information to answer
3
ANSWER TO THE VERIFIED COMPLAINT
1 each allegation of the following numbered paragraph 16.
2 17. Defendant denies, each and every allegation in paragraph 17. Defendant
3 asserts the following affirmative defense:
4 The city of Palm Springs repeatedly attempted to prevent or discourage the
5 defendant from repairing the building by withholding permits, and giving false
information reference code requirements.
6 18. Defendant denies each and every allegation in paragraph 18. Defendant
7 asserts the following affirmative defense:
8 The city of Palm Springs is failing to fulfill their requirement to provide low and
9 moderate income housing by destroying existing homes and apartment buildings in the
10 area and replacing them as they deem necessary.
11 19. Defendant denies each and every allegation in paragraph 19. Defendant
12 asserts the following affirmative defense:
The defendant has demonstrated an intent to repair the building but has been
13 hindered by the city with it's false claims, and a desire to destroy the buildings in our
14 community.
15 20. Defendant denies each and every allegation in paragraphs 20, and 1, 2, 3,
16 4, 5, 6, and 7. Defendant asserts the following affirmative defense:
17 The city is not losing money in this case. Instead they are making money, by
18 taking advantage of minorities living in run down neighborhoods. The city has recently
19 received millions of dollars for a "revitalization program" and is constantly receiving
20 redevelopment monies, but they are neither redeveloping nor revitalizing this
neighborhood. They are abusing their power and authority, by keeping our
21 neighborhood as a drug and crime infested slum.
22 They are costing me, as well as the community, many unnecessary hard earned
23 dollars. They are attempting to take away my hard earned investment and are double
24 charging me through taxes and liens for services not provided. They are spending
25 millions of dollars to destroy homes, where they should be building low income housing.
26 The city should develop a plan for the community of reconstruction, not destruction.
27 The city "double charges" the homeowner for administrative costs, and in
28 addition, demands payment for every code enforcement action, through taxes and

I liens.
2 It is not fair to low-income families to suffer economical and social loses and
3 have to cope with housing shortages, the name of the law, i.e., city ordinances and
4 codes. The code and ordinances are created to benefit the city and not minority
5 neighborhoods within the city, thus, denying them their equal rights.
