PURCHASE OF TWENTY ONE (21) "DOWNTOWN" DECORATIVE LIGHT
FIXTURES FOR NORTH PALM CANYON DRIVE STREETSCAPE PROJECT
RECOMMENDATION:
Approve a Minute Order authorizing the purchase of twenty one (21) additional
"Downtown" decorative light fixtures from Delta Lighting Systems, Inc.,at the
total cost of$59,849.74 to be installed on foundations to be constructed by the
City along the west side of North Palm Canyon Drive between Amado and
Tahquitz Canyon Way as part of a streetscape enhancement and on-street
parking public improvement project located in front of the Desert Fashion
Plaza.
SUMMARY:
The City needs to purchase twenty one (21) standard "Downtown" lighting
fixtures to be installed within the North Palm Canyon Streetscape
Improvement Project located along the west side of North Palm Canyon Drive
between Amado Road on the north and Tahquitz Canyon Way on the south.
The construction documents for this project are currently in the process of
being put out to bid by the City Engineer's office, with a scheduled completion
of construction by November 10, 2003. In order to meet this deadline, due to
the lead time required for fabrication and delivery of these light fixtures, the
City needs to place an order for the fabrication of these units at this time, take
delivery of the fixtures, and have the selected construction contractor install
them before the construction completion deadline.
BACKGROUND:
In August of 1992, the City/ Agency entered into a competitive bid process for
the purchase of themed, decorative light fixtures in "Downtown" Palm Springs.
As a result of this process, City Council awarded the contract for the
production and delivery of these fixtures to Delta Lighting Systems, Inc. of
Corona, CA. The unit price for these fixtures has been held constant by Delta
since the initial award in 1992. Subsequently, the City requested Delta to
slightly modify the selected Downtown street lighting fixture for additional use
as: 1) "Downtown" parking lot lighting fixtures; and 2) "Uptown" street lighting
fixtures. Since then, the City has continued to specify the original and the two
(2) slightly modified versions of this fixture for use in "Downtown" and
"Uptown", and Delta has continued to hold unit prices constant for each
version. 136

The Director of Procurement and Contracting for the City of Palm Springs
recommends that this specific purchase of 21 additional "Downtown"
decorative lighting fixtures be approved on the basis of declaring Delta
Lighting Systems, Inc. a "sole source" provider of these fixtures. The reasons
for this recommendation are summarized as follows:
• The Director of Procurement and Contracting has checked with other
manufacturers of lighting. They could make fixtures identical to Delta's, but
they say they will not for the type of quantities of fixtures we are requesting
because the cost of retooling is too high to justify the effort. Also, there is a
concern that if they duplicate Delta's design, Delta will also duplicate theirs.
• There are roughly similar products available which can be powder coated to
match the existing fixtures, but they are noticeably different and more
expensive. Delta won the competitive bid in 1992, and has held unit prices
constant since the initial bid process (per unit cost is $2,645 including sales
tax, delivery, lamps and custom hardware).
• This purchase of the lights is not a net drain on general fund money. The
City is funding this from the Parking Fund Account Number 132-4462-50218
which was established specifically for this project and which has a current
unencumbered balance of $450,000.00
As summarized above, there is a current need for the City to purchase an
additional twenty one (21) standard "Downtown" (DJ 1892) lighting fixtures in
order to complete projects scheduled for the current Fiscal Year.
The total cost of the twenty one (21) standard "Downtown" fixtures (Model DJ
1892) from Delta is $59,849.74 including sales tax and delivery charges. As
previously noted, there are sufficient funds in the City's Parking Fund to cover
this purchase.
