HomeMy WebLinkAbout7/30/2003 - STAFF REPORTS (18) DATE: July 30, 2003 TO: City Council FROM: Director of Planning &Zoning SIGN PROGRAM—APPLICATION BY AGUA CALIENTE BAND OF CAHUILLA INDIANS FOR SIGN PROGRAM FOR THE SPA RESORT CASINO LOCATED AT 401 EAST AMADO ROAD AND INDIAN CANYON DRIVE PYLON SIGN, SECTION 14. RECOMMENDATION: The Planning Commission recommends that the City Council recommend approval of the Spa Resort Casino Sign Program and recommends that the Tribal Council consider restudying the revised pylon sign located on Indian Canyon Drive. A draft resolution based upon the Planning Commission recommendation is attached. SUMMARY: The Tribal Council proposal for new signage at the Spa Resort Casino has been provided to the City for review and comment. The Sign Program includes monument and building- mounted signs for the new casino,directional signs, resurfacing all existing hotel signs, and refurbishing the Indian Canyon Drive pylon sign. The Planning Commission, at its July 23, 2003 meeting, by a 5-0 vote (two abstentions), recommended that the City Council support the Spa Casino Sign Program and recommend that the Tribal Council re-evaluate the height,scale, and design of the revised pylon sign. Planning Commission members felt that the onsite Spa Resort Casino Sign Program design and materials are of the highest quality and that the proposed pylon sign is not in character with the new casino and downtown Palm Springs. The City Council may,at its discretion, support the Planning Commission recommendation, modify it, or choose to make no comment on the proposed Sign Program. BACKGROUND: The proposed Sign Program was not reviewed by the City Council as part of the Casino Conformity Report process. Tribal and City planning staff have agreed to utilize the Minor Project Review section of the Agreement for Tribal/City Land Use Coordination on Certain Parcels. This provision allows review similar to architectural review. Both City and Tribal Planning Officials determined that the Sign Program meets this criteria and that a formal process would unnecessarily delay this portion of the overall project. g Page 2 of 3 The proposed signs are shown in the Sign Program provided under separate cover(on July 18, 2003). The sign sizes are described as follows: Sign Number of Signs Square Footage Casino Monument 4 56 Casino Building 2 90 Building Entry 2 40 Tenant/Restaurant 2 50 Indian Canyon Pylon 1 356 (existing 385) Directional 9 12-36 City staff would consider the Spa Resort Casino Sign Program pursuant to a site-specific Sign Program since this is a unique project with special sign needs. Pursuant to Section 93.02.05.C.6. Sign Programs, the Planning Commission may approve a Sign Program as follows: "Sign programs shall integrate with the architectural of the building complex, including such elements as size, color, location, and construction material;" and "A Sign Program may be approved which varies from the specific limitations of the sign ordinance if the planning commission finds that due to the physical characteristics of the property and the orientation of the design of the structures on the property, strict application of the regulations of the sign ordinance will not give adequate visibility to the signage; that the approved program will be compatible with the design of the property and will represent the least departure from the standards of the sign ordinance necessary for the effectiveness of the program; and that the approved program is compatible with the surrounding property and not contrary to the purpose of the sign ordinance." Staff is currently evaluating the proposed Sign Program for conformity with the City Sign Ordinance. Since the permitting decision on this Sign Program is by the Tribal Council, the City's comments are advisory. The Section 14 Master Plan references the City Sign Ordinance for sign regulations. Overall,the proposed signs are in scale with the new casino building and are of high quality design and materials. The primary signs are reverse channel letters with a back-lit halo illumination. Signs are mounted over ceramic tile. The existing Indian Canyon Drive pylon sign is proposed to be renovated. It is currently 385 square feet and is proposed to be reduced in size to 356 square feet. Its height will be reduced from 31' to 30'. It will have an interactive LED graphics display which is approximately 85 square feet in size. This sign would likely either require an amendment to the Sign Ordinance or a variance if it were to be permitted by the City. Palm Springs, CA 92262 The Mayor and The City Council 14 Palm Springs City Hall Palm Springs, CA RE; SPA CASINO SIGN PROGRAM As an active opponent of the Spa Casino Sign erected on Indian Canyon in 1998, which led me to become a plaintiff before the California Supreme Court, invalidating Proposition 5, 1 wish to address the proposed sign program for the Spa Casino. With one exception I find the sign program tasteful as is the casino, landscaping , and parking lot lighting. The tribe should indeed be congratulated for their efforts. One remaining problem is the major Indian Canyon sign. It remains out of scale for our village and ideally should be reduced in size. The large video screen is definitely overwhelming for its location right in the heart of our town. Both Design Review and the Planning Commission had problems with the screen. Consequently the Planning Commission recommended unanimously that the Agua Caliente Tribe reconsider its proposal. I do hope that the Council will join in asking the tribe to do this. Enclosed are a number of public responses from 1998, which clearly show community sentiment. Please note a Desert Sun Poll, a letter from a former Tribal Council Chairman and a former city council woman and city planning commissioner. I realize that the Tribal Council can override you. However, being representatives of some 42,000 non-tribal residents, I believe you need to consider the interests of the entire community. I believe that a compromise can be worked out avoiding the need for another outburst of negative public sentiment. (See enclosure) Please help to make this a win, win situation for all. WHEREAS,the Planning Commission found that the Sign Program is of the highest quality of design and materials; and WHEREAS, the Planning Commission found that the proposed Indian Canyon Drive pylon sign was not in character with the design and character of the new casino building and downtown Palm Springs; and WHEREAS, the City Council is in agreement with the review and comment of the Planning Commission. NOW, THEREFORE, BE IT RESOLVED that the City Council of City of Palm Springs, California, has reviewed the proposed Spa Resort Casino Sign Program and proposed Iq � modifications to the existing Indian Canyon Drive pylon sign and has the following comments: 1. Spa Resort Casino Sign Program: That the City Council supports the proposed Sign Program. 2. Indian Canyon Drive Pylon Sign: That the City Council recommends that the Tribal Council reevaluate the size, scale, design, and overall need for this proposed sign as currently designed.
