HomeMy WebLinkAbout9/3/2003 - STAFF REPORTS (22) DATE: September 3, 2003 TO: City Council FROM: Director of Planning & Zoning CASE NO.5.0902 CUP-B-APPLICATION BY VERIZON WIRELESS FORA CONDITIONAL USE PERMIT FOR THE INSTALLATION OF A COMMERCIAL COMMUNICATIONS ANTENNA ON A 55-FOOT TALL MONOPOLE DESIGNED TO LOOK LIKE A PALM TREE AND AN EQUIPMENT CABINET WITHIN AN 1100 SQUARE FOOT LEASE AREA LOCATED AT 1776 NORTH PALM CANYON DRIVE, ZONE C-1, SECTION 3. RECOMMENDATION The Planning Commission recommends that the City Council approve Case No. 5.0902 CUP-B for the installation of a commercial communications antenna on a 55-foot tall monopole designed to look like a palm tree and an equipment cabinet within an 1100 square foot lease area located at 1776 North Palm Canyon Drive, Zone C-1, Section 3. The lease area is located south of Billy Reeds restaurant and northeast of the Mobile Gas Station at Vista Chino between North Palm Canyon Drive and North Indian Canyon Drive. Verizon Wireless' representative is Norman MacLeod on behalf of Delta Groups Engineering. Douglas Jones is the sublessor of the property to Verizon Wireless. SUMMARY The Planning Commission voted 6-1 (Commissioner Matthews dissenting) to approve the project at its July 23, 2003 meeting. The Commission reviewed a stealth monopalm design showing antennas located inside the trunk as opposed to the traditional monopalm design with external antennas arrays. The Commission also discussed the height of the monopalm at 55 feet. The applicant spoke in support of the project and clarified the reasons as to why Design Review's recommendation of internalized antennas and live palm trees would be difficult to implement. The applicant proposed 3 sectors of 4 external panel antennas for a total of 12 antennas, with the antenna span reduced to 10 feet from the original 12 feet. He explained that Verizon is concerned about loss of coverage and a higher, fatter pole if the antennas are internalized. He clarified that the smaller antennas with more palm fronds may the best solution in order to achieve the City's aesthetic objectives and Verizon's coverage objectives. While it was pointed out that the approved AT&T monopalm on the subject property does not have a parabolic dish, the applicant explained that the proposed parabolic dish was necessary because there were no telephone lines in the lease area. He indicated that hiding the parabolic dish in the monopalm design would be more unattractive than leaving it exposed and painted to match the trunk. The Commission agreed that the traditional monopalm design with the 10 foot wide antenna span and exposed parabolic dish painted to match the trunk, would be an acceptable solution. Therefore, the Commission recommended the deletion of Condition#15 with regards to internal antennas but adopted Design Review's recommendation of at least 3 live palm trees within 25 feet of the monopalm. The Commission further recommended that the applicant submit propagation maps to the City Council for further review in order to show the difference in coverage between a 47 foot high and 55 foot high monopalm. The Council may approve a monopole structure of 55 feet in height, after review of propagation maps. Please refer to Planning Condition #6 regarding the monopole height. D BACKGROUND Verizon Wireless has submitted an application for a Type II Conditional Use Permit to install a commercial communications antenna on a 55-foot tall monopole structure designed to look like a palm tree and an equipment cabinet within an 1100 square foot leased area located at 1776 North Palm Canyon Drive. The proposal would require the closure of an existing 10 foot wide service drive on the north side of the property. Verizon Wireless is currently in the process of expanding their wireless telecommunication services to cover the immediate area as well as the entire Coachella Valley. The project was reviewed by the Design Review Committee, which recommended that the monopalm have internalized antennas as well as a 4 foot diameter parabolic antenna hidden inside the design of the monopalm. The applicant does not agree with Design Review's recommendations and has submitted information as to why the recommendations will be difficult to implement. With regards to screening of the lease area, a final landscape plan will be required to be reviewed and approved by the Director of Planning and Zoning prior to issuance of building permits. The Design Review Committee recommended the stealthed monopalm design along with the addition of at least three(3)live palm trees within 25 feet of the monopalm in order to create a cluster effect. The Committee felt that due to the site's location on a high visibility commercial corridor, there would be less flexibility in their recommendation for the monopalm design. The associated radio equipment will be housed in one 11'6"x 16'equipment cabinet. The proposed lease area will be surrounded by a six-foot high black wrought iron fence and landscaping. A six- foot tall, four-foot wide swing gate is proposed to secure the lease area. There is an existing 55-foot tall monopalm that was previously approved at the southern portion of the property for AT&T Wireless. Co-location would not be possible in this case due to discrepancies in the requirements for vertical distance between antennas and Verizon's coverage objectives. No complaints have been received since the AT&T Wireless' monopalm was installed on January 2003. ANALYSIS Airport staff was consulted about the site and anticipate that the proposed commercial communications antenna structure is not an obstruction (i.e., the structure does not penetrate air space around the airport), nor would the proposed antenna have any direct or indirect impacts on operations at Palm Springs International Airport. Helicopter tours fly in that area during the season, as well as some private helicopters, and whenever necessary,emergency/rescue aircraft. As such, a condition of approval has been included, which indicates that the City reserves the right to require, at any time in the future, one obstruction light on the tallest point of the structure extending 12" - 24" above the highest point of pole/fronds if deemed necessary by the Director of Planning and Zoning. Airport Operations would advise the Director of Planning and Zoning in the event the Airport receives complaints from pilots, the Tower Manager or the FAA. As an additional condition of approval, the applicant would be required to obtain all necessary approvals from the Federal Aviation Administration prior to issuance of building permits. The applicant has submitted photographs of the existing site as well as elevations of the proposed monopalm and how it would appear in the current visual environment surrounding the site. These elevations depict existing palm trees and the proposed monopalm at 55 feet, one pre-fabricated equipment cabinet within the leased area, and proposed 6'tall wrought iron fence and swing gates around the lease area. The site is surrounded by commercial uses. As a condition of approval, a final landscape plan will be required to be reviewed and approved by the Director of Planning and Zoning prior to issuance of building permits. In addition, the applicant has provided a title report that shows that the closure of the service drive would not be detrimental to the abutting Edison substation. The Planning Commission has also included conditions of approval pertaining to the removal of the antenna and/or monopole and equipment cabinets in the event the equipment becomes obsolete, are abandoned or the Conditional Use Permit expires. Based on analysis of the site, architectural elevations, and photo simulations, the Planning Commission found that the proposed monopalm, together with the existing vegetation and proposed vegetation, will not create a negative visual impact. ENVIRONMENTAL ANALYSIS AND NOTIFICATION This Conditional Use Permit is categorically exempt from environmental assessment pursuant to Section 15303 of the California Environmental Quality Act (CEQA). Section 15303 states that installation of small new equipment is exempt from CEQA. All property owners within 400 feet of the project site have been notified of the public hearing. As of the writing of this report, no correspondence or inquiries from the public have been received by staff. fn irector o Planning an ding City Manager ATTACHMENTS: 1. Vicinity Map 2. Jing Yeo,Associate Planner, reviewed exhibits and reported that a monopalm 55 feet in height was previously approved and that the Design Review Committee's recommendations are the same as for the previous application (internalized panel antennae and three live palms planted within 25 feet) in this highly visible commercial corridor between two major thoroughfares. She stated that staff is concerned regarding the proposed addition of a four foot parabolic antennae as it was not previously approved. She confirmed that the Fire Department has reviewed the application and has not reported any concerns and that a title report for Southern California Edison showed no recorded easements. Chairman Shoenberger opened the Public Hearing. There being no appearances, the Public Hearing was closed. Mr. MacLeod addressed the Planning Commission to state that the tower is dependent upon the site elevation and vegetation and that, if a tower is too high, there can be radio-frequency pollution and signal blockage. He stated that co-location is not possible at this site. He explained that a clear line of sight is necessary to a donor site and that panel and dish antennae (microwave beam/hard telephone line) can not be located within immediate proximity. He stated that propagation studies would need to be done to determine diminishment of signal from reducing height of pole. There being no further appearances, the Public Hearing was closed. M/S/C (Conrad/Marantz 6-1, Matthews dissenting) to approve subject to Conditions of Approval, deleting Condition No. 15 regarding internal antennae and with a parabolic dish and exterior antenna with 10'fronds with a pole height limit of 47 feet unless, after review of propagation maps, Director allows height up to 55 feet. Chairman Shoenberger suggested that propagation reports be submitted to City Council for its review.
