CASE NO.5.0967: ARESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS,
AMENDING THE COMPREHENSIVE FEE SCHEDULE REQUIRING THE PAYMENT OF FEES
FOR PARK AND RECREATIONAL PURPOSES AS AUTHORIZED BY ORDINANCE NO. 1632.
RECOMMENDATION
That the City Council approve the attached resolution to amend the City's Comprehensive Fee
Schedule to include the imposition of fees for park and recreational purposes(park fee)as approved
by Ordinance No. 1632.
SUMMARY:
On September 12, 2003, Park Fee Ordinance No. 1632, will take effect and the City can start
collecting parkfees on all applicable newresidential development,as a condition tothe approval of
a tentative or parcel map, or as a condition in the design review process for a residential
development which does not require a subdivision. The Comprehensive Fee Schedule (Palm
Springs Municipal Code, Title 3, Revenue and Finance)will be amended to include a reference to
the park fees required to be paid to the Cityforthe purpose of acquisition and improvement of new
parks, as well as preservation of its existing parks.
BACKGROUND:
On July 30,2003,the City Council approved Ordinance No. 1632, in accordance with Government
Code Section 66477(Quimby Act)to levy park fees for the purpose of acquisition and improvement
of new parks, as wall as preservation of existing parks. A second reading of the ordinance was
adopted by City Council on August 13, 2003.

OF THE CITY OF PALM SPRINGS, CALIFORNIA, AMENDING
RESOLUTION 20362, CITY'S COMPREHENSIVE FEE SCHEDULE,
REQUIRING THE PAYMENT OF FEES FOR PARK AND
RECREATIONAL PURPOSES AS AUTHORIZED BY ORDINANCE NO.
1632.
WHEREAS, on June 5, 2002, the City Council adopted Resolution 20362; and
WHEREAS, Resolution 20362 is the City's Comprehensive Fee Schedule; and
WHEREAS, the City Council desire to amend the Comprehensive Fee Schedule to require the
payment of fees for park and recreational purposes as authorized by Ordinance No. 1632 (Park
Fees); and
NOW THEREFORE BE IT RESOLVED bythe City Council of the Cityof Palm Springs, California,
that Resolution 20362,establishing the Comprehensive Fee Schedule, is herebyamended, bythe
following:

15. The developer may be required to pay to the City a fee in lieu of making the
dedication computed pursuant to Ordinance No. 1632, Section IV. The in-lieu fee
shall be computed by multiplying the area of park to be dedicated bythefair market
value ofthe land being developed plus the cost to acquire and improve the property
plus the fair share contribution, less any credit given by the City, as may be
reasonably determined bythe City,based upon the formula contained in Ordinance
No. 1632.
