HomeMy WebLinkAbout10/15/2003 - STAFF REPORTS (6) DATE: October 15, 2003 TO: City Council FROM: Director of Planning &Zoning CITY COUNCIL REVIEW OF PLANNING COMMISSION DENIAL OF SIGN AT PLAZA THEATER. APPEAL: The Planning Commission, by a 6-1 vote, denied the proposed sign which includes a television monitor. The City Council may uphold, overrule, or modify the decision of the Planning Commission. SUMMARY: The Palm Springs Follies applied for an historic theater sign pursuant to section 93.20,00 of the Palm Springs Zoning Ordinance. The sign consists of two attraction displays and one television monitor mounted in wood sign cabinets. After review of plans, the Planning Commission denied the sign at its October 08, 2003 meeting. BACKGROUND: An application for sign approval was submitted by the Downtown Development Director on behalf of the Palm Springs Follies. The sign would include one display case facing the Plaza Theater. As proposed,the display facing the street would advertise the show and the display facing the theater would promote downtown and utilize the City's Share the Legend graphics. The signs do not impede pedestrian movements, are in scale with the proposed location, and do not touch the historic buildings. The following Conditions of Approval were included in staff's report to the Planning Commission: 1. Findings: That the proposed sign is consistent with Section 93.20.C.7 of the Palm Springs Zoning Ordinance (pending effective date), the signs are visually creative, in scale with pedestrian activity,will provide an opportunity for marketing downtown, and that the design will not affect the public health, safety, and welfare; and 2. That the materials and finish shall match the existing sign; and 3. That the rear of the sign be fully enclosed and that the fans and vents be completely shielded on the top and bottom of the sign structure; and 4. That the video screen is approved and that audio is shall not be audible to patrons at the adjacent outdoor dining establishment. In order to approve this proposed sign, the City Council would need to make the following findings: 1. Signs shall not alter the historic character of a structure; 2. Signs are visually creative; 3. Light source of signs shall riot be excessively bright or obtrusive to passing a� Page 2 of 2 vehicular traffic, pedestrians and surrounding uses. See Section 93.20.10(C)(6); 4. If sound is proposed, said sound shall not be audible by adjacent businesses or nearby residential properties; 5. Signs and related media displays shall be designed and located to be oriented toward pedestrians and shall be limited to a size proportional to the pedestrian scale adjacent to the sign location; and 6. Signs shall be part of a sign program subject to Planning Commission Architectural Approval (Ord. 1538 (part), 1996; Ord. 1442, 1992; Ord. 1418 (part), 1992; Ord. 1354 (part), 1990; Ord. 1294 (part), 1988). The subject Zoning Ordinance amendment was adopted by the City Council on October01, 2003 and will be in effect on October 31, 2003.
