CASE NO.5.0667-REQUEST BYTHE AGUA CALIENTE BAND OF CAHUILLA INDIANS
FOR CITY REVIEW OF PARKING LOT PLANS FOR THE SPA RESORT CASINO
LOCATED AT 400 NORTH INDIAN CANYON DRIVE, C-2 ZONE, SECTION 14.
RECOMMENDATION:
The Planning Commission recommends that the City Council review and support the
proposed parking lot plans for the Spa Resort Casino located at 400 North Indian Canyon
Drive subject to the following conditions: 1)parking lot lighting shall not exceed an average
illumination of three(3)footcandle,with an attemptto achieve as close to one(1)footcandle
as possible; 2)replace proposed jacaranda trees with another shade tree; and 3)parking
lot dimensions shall comply with Palm Springs Zoning Code Section 93.06.00.
SUMMARY:
The subject site is currently Tribal trust land and will be utilized for Casino Parking. In
accordance with the Land Use Coordination Agreement,the Tribe has submitted the subject
parking lot design for City review and comments. The Planning Commission reviewed and
made its recommendation to approve at its August27, 2003 meeting by unanimous vote
(5-0 vote).
BACKGROUND:
On August 27,2003,the Planning Commission recommended approval of the parking lot
subject to changes related to lighting, tree species, and City parking lot standards. In
addition, the Design Review Board at its meeting on August 11, 2003, recommended
approval as submitted.

OF THE CITY COUNCIL. OF THE CITY OF PALM SPRINGS,
} CALIFORNIA,PROVIDING REVIEW AND COMMENT ON THE
PROPOSED PARKING LOT PLANS FOR THE SPA RESORT
CASINO LOCATEDAT400 NORTH INDIAN CANYON DRIVE,
C-2 ZONE, SECTION 14. ,
WHEREAS, the Agua Caliente Band of Cahuilla Indians (ACBCI)and the City have entered
into the Agreement for Tribal/City Land Use Review on Certain Parcels (Agreement)for the
purpose of cooperating in promoting the orderly and expeditious use and development of all
lands of the ACBCI Reservation; and
WHEREAS, the Agreement provides for the opportunity for the City to review and comment
on projects and that the ACBCI will consider, review, and comment in its consideration of
projects; and
WHEREAS, the Agreement contains a provision for review of minor projects and forgo the
more detailed Conformity Report process; and
WHEREAS, a small parking lot (166 spaces) was provided to the City for review and
comment; and
WHEREAS,the Planning Commission reviewed the proposed Spa Resort Casino parking lot
at its August 27, 2003 meeting and has made a recommendation to support the proposed
parking lot design with a few changes as listed herein; and
W+IEREAS, the Planning Commission found that the parking lot is of the highest quality of
design and materials; and
WHEREAS, the City Council is in agreement with the review and comments of the Planning
Commission.
NOW, THEREFORE, BE IT RESOLVED that the City Council of City of Palm Springs,
California, has reviewed the proposed parking lot and has the following comments:
1. Parking lot lighting shall not exceed an average illumination of three (3) footcandle,
with an attempt to achieve as close to one (1)footcandle as possible;
2. Replace proposed jacaranda trees with another shade tree; and
3. Parking lot dimensions shall complywith Palm Springs Zoning Code Section 93.06.00.
4. Off-set driveways on Indian Canyon Drive and Calle Encilia to eliminate through traffic
potential.
ADOPTED this 3rd day of September , 2003.
